Session Shakopee , Minnesota September 25, 1979 Mayor Harbeck called the meeting to order at 7150 PM with Cncl . Lebens, Reinke and Leroux present. Absents Cncl. Hullander. Arriving late : Cncl. Ward. Also present; Douglas S. Reeder, City Admin. , H. R. Spurrier, City Eng. , Julius A . Coller, II, City Attorney and David A . Dacquisto, Assistant Zoning Admin. City Admn. reported on a letter received from Senator Schmitz regarding a public hearing to be held on October 10th at the New Prague City Hall at 7130 PM on bridges and transportation. Mayor Harbeck stated his intention to attend and requested that anyone else interested in seeing a bridge across the river try to attend also and express their feelings and opinions. City Admin. read a letter from Governor @uie regarding the Energy Crisis Program and the need to set up emergency centers for all citizens not able to sustain the high heating costs for the coming winter. City Admin. stated he had received an invitation to attend a Hennepin County Park Reserve District meeting on September 26th at 8100 PM at the Prior Lake City Hall regarding the trail corridor to connect the Minnesota Trail and Cleary Lake Regional Park. Leroux/Reinke moved to reopen the Public Hearing on the Financing Plan for the Proposed Elderly Highrise Redevelopment Project. Motion carried unanimously. Mayor Harbeck asked for comments from the audience. Ione Theis asked if the Senior Citizens could be optimistic about a highrise development, and mentioned rumors regarding the proposal . Mayor Harbeck suggested she disregard any rumors because the City Council has related everything they know on the proposal to the citizens , and any further information would be continued to be relayed to them. He then stated he had made an error in judgment in committing himself to a "no" vote because he felt the City of Shakopee really does need a highrise . He further stated that if HUD considers the Wampach site , the City Council will negotiate to make this work, but if that fails, the Levee site would still be considered. Mary Schmidt stated that a highrise is needed but the majority of the Senior Citizens want the Wampach site . She then stated that she trusted the City Council to make the wisest decision on the highrise should the Wampach site proposal fail. Ione Theis stated that she was depending upon the City Council to make the best decision possible for the Senior Citizens, and that she had complete faith in the members of the Council to do this. Leroux/Reinke moved to continue the public hearing to October 2, 1979, at 8100 PM. Motion carried unanimously. Mayor Harbeck asked for comments from the audience on anything not on the agenda. There was no response. Cncl. Ward arrived at 8 : 15 PM and took his seat. Discussion was held on Ordinance No. 30 , An Ordinance Setting Curfews for Minors . Official Proceedings of the Page -2- Shakopee City Council September 25, 1979 Cncl. Ward stated that perhaps the 10 : 30 curfew was just a little tight for after-school activities . Tom Brownell, Chief of Police , stated that warnings would be extended when the curfew was violated and utter descretion would be used when enforcing this ordinance . He further stated he did feel that 10 : 30 PM would be a reasonable hour because a curfew set at midnight would not solve the problems . Ward/Reinke offered Ordinance No. 30, An Ordinance Amending the City Code by Reapeal.ing Section 10. 28 and Enacting a New Section 10. 28 Establishing Curfews , as recommended by the Police Department , and moved for its adoption. city Admin. read the Ordinance . Roll Call: Ayes - unanimous Noes - none Motion carried. City Admin. reported on the O'Dowd Lake Study Committee . He stated that the committee had recommended that a 1 .5 million dollar bond issue be proposed to the residents of Shakopee at the next general election for a community park on the north side of O'Dowd Lake . They had also recommended that the Planning Commission request this area for a regional park. Dick Stoks was present for discussion and stated he felt that if this land wasn' t acquired now perhaps through the bond issue , it would never get acquired. Leroux/Harbeck moved to direct City Staff to prepare a resolution for a referandum for a 1 .5 million dollar bond issue for the purpose of purchasing park land composed of an approximate 300' corridor around O' Dowd Lake north and east shore . Motion carried unanimously. Leroux/Harbeck moved that the City hire an appraiser to appraise the land which would be purchased under the bond issue. Roll Call: Ayes - unanimous Noes - none Motion carried. Reinke/Ward moved to authorize the hiring of Steven P . Hurley a probationary employee as an Eng. Aid II at $6 . 80/hour with an increase to $6 . 95/hr. upon successful completion of the probationary period. Roll Call : Ayes - unanimous Noes - none Motion carried . Ward/Reinke moved to accept the bid of $17, 754.56 from Valley Paving Inc . , Savage , MN for the Jefferson Street Reconstruction. Roll Call: Ayes - unanimous Noes - none Motion carried. Ward/Leroux moved for a recess at 8 :55 PM. Motion carried unanimously. Leroux/Ward moved to reconvene at 9:15 PM. Motion carried unanimously. The City Council reviewed, discussed and commented on the proposed zoning ordinance. Leroux/Reinke moved that adjournment be no later than 11 : 30 PM. Motion carried unanimously. Reinke/Leroux offered Resolution No . 1498 , a Resolution Approving Plans and Specifications and Ordering Advertisement for Bids for 1 . 5 Million Gallon Reservoir, and moved for its adoption. The Addendum consists of a map en- titled "Interim Plan for Sanitary Sewer Service 1977-1980" Amended for 1980-1981, estimates of new sewer connections for the 1980-1981 time period, and a report entitled "Supplemental Data for Comprehen- sive Sewer Plans". i Shakopee's CSP as approved by this addendum will serve only until Shakopee's full Comprehensive Plan is approved by the Metropolitan Council . Shakopee, MN 55379 Dear Mayor Harbeck: In the next three months, I will be meeting with local officials and key administrative officers of communities throughout the Twin Cities Area to discuss matters of mutual concern. You are cordially invited to one such meeting, to be held at the Savage City Hall, 12305 Quentin Ave. So. , on Tuesday, October 23, 7:30 p.m. The purpose of the sessions is to strengthen communications between local government officials and the Metropolitan Council. I'm new in my job as Council chairman. I haven't had a chance as yet to meet with many of you. I want to learn first-hand of your concerns, particularly as they relate to the performance of the Council in carrying out its responsibilities for long-range planning and coordination in the Twin Cities Area. I would also like to share with you my ideas on Council priorities and the role I would like to see it play in our Region. One subject that bears discussion is the Metropolitan Land Planning Act of 1976. I would be happy to try to answer any questions you have about the law and problems you may be experiencing in meeting its requirements. Representatives of several neighboring communities and school districts and area legislators are being invited to the meeting. I hope that you will be able to attend. First Avenue Shakopee, Minnesota 55379 CITY OF SHAKOPEE Dear Mayor Harbeck: Representative Tom Rees stopped by the other day to discuss the follow-up to last February's meeting between you and Governor Quie. Due to the departure of Mike Keompel last June, a letter from Chairman Charles Weaver dated May 8 in regard to the Shakopee- Jackson intercept was not provided to you for your review. A copy is now enclosed. The petition in regard to the 18-169 bridge proposal has been sent to Commissioner Richard Braun for his information. Representative Rees indicated that Commissioner Braun will be invited to meet with local Shakopee leaders in the near future to discuss the future of this project. According to Commissioner Braun, none of the work at Shakopee was on the 1980-1981 deferred jobs list. Most of the work is on the 1982-1985 unscheduled trunk highway program. However, included in the deferrals was trunk highway 41 southwest of Shakopee, north across the river to highway 212, trunk highway 212 from Norwood to 494 . The Shakopee by-pass was not included in the deferral list. Anything programmed for Shakopee has been deferred for repriori- tization based on funding levels which will be debated by the 1980 Legislature. In regard to the Senior Citizen highrise, I believe Jim Solem of the Minnesota Housing Finance Agency has been in contact with city officials . The Metropolitan Airport Commission Chairmanship is not open until 1983 . PAUL 55155 CT 9 1979 September 28, 19 79 C'Ty OF SHAKOPEE Mr. Walt Harbeck Mayor, City of Shakopee 129 East First Avenue Shakopee, Minnesota 55379 Dear Mayor Harbeck: I have received your letter in which you ask why Minnesota penalizes a family with one wage earner. The federal government several years ago allowed income splitting for married people. This was done to equalize the treatment between residents of community property states and those who do not have that law. Generally, community property states are those which have a Spanish heritage, such as California, Arizona, New Mexico, Texas , etc. The community property law provides that property owned and acquired by a married couple is owned equally by each spouse. The federal government has had numerous complaints from single people who feel that they are unfairly discriminated against because married people are allowed the income splitting pro- visions. Minnesota is not a community property state. Minnesota's income tax taxes the person who earns the income, while the federal tax on married people is on the marriage unit. Minnesota has a statute which does allow married people to file their income tax separately on a combined return. This provision allows a married couple to divide the itemized deductions in any manner that they feel. The Research Division of the Revenue Department has informed me that if Minnesota had income splitting for married couples in calendar year 1979 , the state income tax revenues would be decreased by $156,000 ,000. I have decided instead to grant tax cuts to all Minnesotans in their income tax, including married and single people. I have done this by persuading the legislature to enact an indexing program to prevent Minnesotans from receiving a tax increase in the future due strictly to inflation. We have also increased the personal credits. We have also expanded the property tax relief programs that are available for homeowners and renters through the circuit breaker and various other property tax relief programs. Reeder, City Administrator RE : Citizens State Bank Renewal of Temporary Occupancy Permit DATE: October 11 , 1979 When the Citizens State Bank was issued a Temporary Occupancy Permit for their mobile bank, one of the conditions was that a Building Permit be issued for their permanent bank within six (6) months . The Council renewed this Temporary Occupancy Permit and extended the time for permission of a Building Permit application to October of 1979 . We still have not received an application for a Building Permit for a permanent bank. We have received, as we did last time , a site plan and sketch of the proposed bank. The Council must determine if it wishes to again extend the Temporary Occupancy Permit or enforce the conditions of that Occupancy Permit which would close the existing bank. Dacquisto, A.�sistanL Zoning Adrnirni _�LraLur HE : Laurent Variance Request DATE' October 5 , 1979 Request : The applicant , Gary Laurent , requests a five ( 5 ) foot variance from the 30 foot front yard requirement, a 15 foot variance from the 30 foot rear yard requirement , and a 4, 000 square foot variance from the 16 , 000 sauare foot requirement for four townhouses. Location: The applicant wishes the variances for Lots 1 - 7 , Block 3, and Lot 1 , Block 4, Minnesota Valley 3rd Addition. Analysis: The applicant has applied for variances on all lots as the site plan for all the townhouses will be the same . This action will alleviate the need for considering the lots one at a time . The developer will begin construction of two four unit townhouses immediately . The lot variance is for 4 ,000 sq . ft . This is necessary because the new ordinance requires 4,000 sq . ft. of lot per townhouse or 16 ,000 sq. ft . for four. If the developer were constructing a 4-plex or apartment he would be within the lot requirement. He has a 12 ,000 sq. ft . lot and a 4-plex would only require 12 , 000 sq. ft . of land. The lots were originally planned for four units and were within the ordinance. The area is one of single family homes and a townhouse development would be more acceptable than a 4-plex design which would be allowed by ordinance. The townhouses would be under seperate ownership . A variance request has also been made on the front and rear yard setbacks. This request would allow the townhouse to be constructed sideways to Polk St . with ample off street parking and one driveway for each eight units . This type of development suits a P U D very well , however, in this case the site is too small and therefore setbacks roust be dealt with . The specific variance requests are for a five ( �) ) foot variance from the 30 foot front yard requirement and a 15 foot variance from the 30 foot rear yard require- ment . All townhouses would then have the 25 foot front yard setback and line up equally along Polk . Recommendation: Staff recommends approval of the variance requests. Reeder, City Administrator RE: Park Dedication Ordinance DATE : October 11 , 1979 It is recommended that the' City Council consider amending the Park Dedication Ordinance to accomplish two things : 1) To make clear the language which allows cash contribution in lieu of land dedication. 2) To eliminate Park Dedication requirement for newly platted property which already has a building constructed on it . The new language will provide , for example, that if a home owner divides his lot into two parcels that Park Dedication will be required only on the vacant parcel and not on the parcel which already has a home on it . Reeder City Clerk Dated : SPECIFICATIONS FOR THE COLLECTION AND DISPOAL OF GARBAGE AND RUBBISH IN THE CITY OF SHAKOPEE, MINNESOTA SECTION I DEFINITION AND TERMS a) City shall mean the City of Shakopee , Minnesota; City Council shall mean the City Council of the City of Shakopee ; City Administrator shall mean the City Administrator of the City of Shakopee . b) Contractor shall mean any person, or the agent or employee thereof , with whom the City of Shakopee may contract to collect and dispose of garbage and rubbish . c) Rubbish is nonputrescible solid waste including ashes , consisting of both combustible and noncombustible wastes , including, but not limited to , paper, cardboard, tin cans , yard clippings , wood , glass , bedding, concrete , and Christmas trees up to six (6) feet in length . d) Garbage is discarded materials resulting from the handling, processing, storage , preparation, serving and consumption of food . e) Removal shall include both collection and disposal . SECTION 2 PROPOSAL REQUIREMENTS AND CONDITIONS Proposal Forms The proposals or bids shall be made in duplicate on blank forms provided by the City Administrator . Proposals submitted on forms other than the ones issued to the bidder will be disregarded . All proposals shall be signed by the bidder in accordance with the instructions contained in the Call for Bids . Rejection of Proposals Proposals will be rejected if they show any alterations of form, additions not called for , conditional bids , erasures , or irregularities of any kind . Disqualification of Bidders More than one proposal for any alternate from an individual , firm or co-partnership, a corporation or association under the same or different names , will not be considered . Reasonable grounds for believing that any bidder is interested in more than one proposal for the work contemplated, will cause the rejection of all proposals in which such bidder is interested . If there is cause for believing that collusion exists among the bidders , none of the participants in such collusion will be considered in this or future proposals . y-� 2 . Qualification of Bidders No award will be made to any bidder who cannot give satisfactory assurance as to his ability to carry out the contract both from his financial rating and by reason of his previous experience and performance of work of the nature contemplated in the contract . The bidder may be required to submit his record of work of similar nature to that proposed under these specifications , and unfamiliarity with the type of work may be sufficient cause for rejection of bids . No award will be made to any bidder who does not have modern equipment and a sufficient amount of equip- ment to accomplish the required collection of garbage and rubbish . SECTION 3 AWARD AND EXECUTION OF CONTRACT Performance Bond The successful bidder shall , before entering into a contract , deposit and maintain with the City during the two year term of the contract a good and sufficient corporate surety bond satisfactory to the City Council in the principal sum of SO% of the total annual anticipated award, as computed by the City . Such bond is to be conditioned upon the faithful performance of the contract . If no surety bond is filed as herein provided, the bidder ' s bid bond shall be forfeited to the City immediately . The Contract is to begin work no later than January 14, 1980. Insurance Certificates of insurance indicating that the insurance required in these specifications is in force for the term of the con- tract shall be filed with the City before entering into a contract ; and shall provide for 10 days notice to the City in event of cancellation of said insurance or any part thereof . SECTION 4 SCOPE OF THE WORK AND CONTRACT The work to be done under these specifications shall include the finishing of all labor, material , equipment and expense necessary to perform the following services for the City of Shakopee ; once a week collection of garbage and rubbish for all dwelling units , single , duplex, and triplex, non-containerized that are within the "urban" area of Shakopee with approximate boundaries of the Minnesota River, Shawnee Trail , Austin Street , 12th Avenue and Tyler Street The contract shall be until January 13 , 1982 . The foregoing work shall be done under the direction and to the satisfaction of the City Administrator or his authorized representative . 6 3 . The contractor shall provide a senior citizen rate . There are approximately 2 ,000 regular pickups and 325 senior citizen pickups for a total of 2 , 325 pickups . Collection The collection of garbage and rubbish shall be confined to Monday, Tuesday, Wednesday, Thursday , and Friday and to the hours between 6 : 30 AM and 1 : 00 PM on any collection day. Saturday collection shall be allowed in any week in which New Years Day, Memorial Day , Fourth of July, Labor Day, Thanksgiving, or Christmas Day are observed on the aforementioned work days . Bidders may take exception to the hours listed above. On the basis of collection once weekly, not over eight (8) days nor less than five (5) days shall elapse between one collection and the next , and not less than one collection shall be made in each calendar week. Routes of collection will be as selected by the Contractor_ and approved by the City Administrator and so arranged that collections will be made on the same day of each succeeding week, and further the Contractor shall travel said route in the same direction and manner each collection day. If the collection day falls on the observance of New Year' s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day or Christmas Day, the Contractor may elect to collect the garbage or rubbish on the aforementioned holidays or he may elect to collect the garbage or rubbish on the day after the holiday ; provided in all instances , however, that the Contractor ' s holiday collection schedule is specifically stated in the published collection schedule compiled by the Contractor, approved by the City Manager and published as hereinafter provided . The Contractor shall provide sufficient personnel and equipment to complete within one day, as defined in the first paragraph of the section designated "Collection" , the collection of all garbage in any established collection district within the City on any given collection day . The Contractor agrees to perform all work described above without any further compensation from any individuals living within the City or producing such rubbish and garbage within said City, except as herein provided . All garbage and rubbish collected by the Contractor shall be and become his property from and after the time of such collection, except as provided in these specifications . Garbage These specifications are intended to insure the removal of all household garbage which has been prepared or used for food, 4 . or shall have resulted from the preparation of food and every accumulation of animal , vegetable and dothen in that attends meats . the preparation, consumption, decay, g fish, fowls , fruits or vegetables . This category shrubs , fruit and edible products from trees , bushes , culls and droppings , from residential areas . All vehicles and equipment used in the collection of garbage under these specifications shall be kept in clean, sanitary quarters when not in use in collection of garbage . Combustible Rubbish Except as hereinafter provided, combustible rubbish. shall be deposited for collection by property owners and tenants n containers as specified in the City Ordinances and Code . Rubbish - General The intent of the householder to have his rubbish removed shall be deemed to be expressed by his act in placing such rubbish at the usual collection poi waste The Conratr shall not other wasteematerials from e1 e the construction, building maters ri i IJCL-1 S . alteration, repair, moving and demolition of buildings or from pro- motion and development of property by an real estate or commercial agent or from commercial , industrial or manufacturing processes . Household appliances , excessive amounts of brush, interior remodeling and containable refuse must be picked up by the contractor if the resident calls the office of the contractor and makes necessary arrangements . Such service furnished by the contractor to residents of the City will be charged to said residents by volume or time or both. Such special service shall be billed and collected by the office of the contractor . Vehicles All trucks , trailers and other conveyances or equipment used to collect , haul , or transport garbage or rubbish shall at all times be kept clean, in good repair, and well painted, to the satisfaction of the City Administrator, or his authorized repre- sentative . Each truck shall be constructed and used that rubbish or garbage will not blow, fall or leak out of the truck into the street . The Contractor shall use mechanical packer trucks so constructed . The Contractor ' s name or firm name, together with his phone number, shall be printed or painted in legible letters . on both sides and rear of all trucks and conveyances used in the City in performance of the contract . Should the City Administrator, or his authorized representa- tive, give notification in writing to the Contractor that any designated truck, trailer or other conveyances is not in compliance with the City ' s standards - hereunder, such truck, trailer or other con- veyance shall be forthwith removed from service by the Contractor and not again so used hereunder until inspected and approved in writing by the City or its authorized representative . Care of Containers All containers shall be replaced where found . Contain- ers and lids shall not be placed or thrown on the streets , high- ways , or oa adjoining property. The Contractor, his agents , or employees , shall not throw garbage or rubbish containers from the truck to the pavement , or in any other way break or damage or roughly handle the same . The City reserves the right to withhold compensation under the contract until any claim or damage for broken garbage or rubbish containers has been paid for or adjusted with the owner of such container. 6 . All claims for damage by reason of the misuse or rough handling of such cDntainers by the Contractor shall be presented to the Contractor and a copy thereof filed with the City Administrator . _Routes and Changes The Contractor shall prepare and file with the City Ad- ministrator, prior to the commencement of this contract , a collection schedule , together with a complete map of the several garbage and rubbish collection districts within the City . He shall indicate thereon in an appropriate and easily understandable manner the days on which collection shall be made throughout these districts . This schedule shall be subject to the approval of the City Administrator . The collection schedule when approved by the City Administrator, shall be maintained unless a change therein is first approved by the City Administrator and notice thereof given as hereinafter provided . The Contractor shall cause a collection schedule to be published once in the official newspaper of the City prior to the beginning collection under this contract . The Contractor shall also publish the collection schedule in the official newspaper of the City in January of each year of this contract . This published schedule shall contain a map or sketch delineating the boundaries of each district ; the day or days of the week upon which collections will be made ; and the name , address and phone number of the Contractor and other information deemed necessary by the City Administrator . Thereafter, before any change in the collection schedule is made by the Contractor, he shall provide the City Administrator with a proposed revised collection schedule , together with a new map as aforesaid . No such change may be effected unless approved by the City and until ten (10) days after publishing of notice .by the Contractor advising residents within the district of the change . Such notice shall be similar to and include all items required to be included in the original notice . Office for Inquiries and Complaints The Contractor shall maintain an office at some fixed place and shall maintain a telephone therein, listed in the local telephone directory in his own name or in the firm name by which he is most commonly known, and shall at all times during the hours between 8:00 A.M. and 4 : 30 P.M. on each day that garbage or rubbish is collected, have a full time employee at said office for the answering of inquiries and by whom complaints may be received from property owners and tenants within the City . The telephone of the Contractor shall be on the exchange or exchanges of Shakopee or a toll free number . The Contractor shall maintain a written log of all such complaints , the date thereof and the action taken pursuant thereto or the reason for non-action. Such log of complaints 7 . shall be open to the inspection of the City Administrator, or his authorized representative . If a dwelling unit is missed because of reasonable cir- cumstances the Contractor shall collect that dwelling unit not later than 10: 00 A.M. of the following day provided that day is not a Saturday or Sunday . If that following day is a Saturday or Sunday, the Contractor shall collect the missed dwelling unit on Monday . SECTION 5 COMPENSATION Initial Bid The bidder shall specify in his bid a monthly rate for collection for regular customers and a monthly rate for senior citizen customers . The monthly rate shall be for collection in Area "A" as shown on the attached map of the City of Shakcpee . The bidder shall include in his bid a monthly rate (both regular and senior citizen) for the year, beginning January 14, 1980 and ending January 16, 1981, and a monthly rate for the year beginning January 19 , 1982 and ending January 15 , 1982 . Method of Payment to Contractor The City will act as billing and collection agent for the Contractor . The Contractor will be paid on a monthly basis with payment being made by the fourth Monday of each month beginning with the fourth Monday in March, 1979 . The amount of each monthly pay- ment shall be the monthly charge times the number of units billed at the beginning of the month by the Shakopee Public Utilities Commission. SECTION 6 LEGAL RELATIONS AND RESPONSIBILITIES Legal Requirements The Contractor shall at all times comply with all pro- visions of the -Shakopee City Ordinances and amendments thereto, relative to the collection, transportation and disposition of garbage and rubbish and such other ordinances or amendments as the City Council may enact relative to the collection, transport- ation and disposal of garbage and rubbish and shall comply with all regulations and laws of the County of Scott and the State of Minnesota now in effect or hereinafter enacted . Personnel All employees shall be of good character and no personnel shall continue to be employed on any work under these specifications 8 . who is found to be troublesome , disorderly or otherwise objectionable as determined by the City Administrator or his authorized reporesentative . Permits and Licenses The Contractor shall obtain all permits and licenses required by the City, County and State . Public Liability and Property Damage Insurance The Contractor shall assume all responsibility and shall hold harmless and indemnify the City for any and all damage to property or injuries to persons , including accidental death, which may be caused by the Contractor ' s performance of the contract , whether such performance be by himself, his subcontractor, or any- one directly or indirectly employed by him, and whether such dam- ages accrue or are discovered before or after termination of the contract . The Contractor shll take out and maintain during the term of the contract such public liability and property damage insurance as shall protect him and the City from claims for such damages , in the following amounts : Public Liability Insurance , in an amount not less than $200,000.00 for injuries , including accidental death, to any one person, and in an amount not less than $500,000.00 for injuries , including accidental death on account of one accident , and Property Damage Insurance in an amount not less than $50,000.00. The Contractor shall name the City as an additional insured on such insurance and shall furnish evidence of the same to the City Admin- istrator or his authorized representative . Insurance shall include a 10-day notice to City in event of cancellation or major change in the policy . The Contractor shall maintain on file with the City certifi- cates showing said insurance to be in full force and effect for the term of the contract . Personal Liability No member of the City Council or the City Administrator or any other official or authorized assistant , employee or agent of the City shall be personally responsible for any liability arrising under the contract . Workmen' s Compensation Insurance The Contractor shall at all times keep fully insured, at his own expense , all persons employed by him in connection with the performance of the contract as required by the laws of the State 9 . of Minnesota relating to Workmen' s Compensation Insurance and shall hold the City free and harmless from all liability from any cause that may arise by reason of injuries to any employee of the Contractor who may be injured while performing work or labor necessary to carry out the provisions of the contract . No work shall be done by the Contractor during any period when he is not covered by insurance as herein required. in such event , the applicable provisions hereof shall apply the same as when the Contractor fails to collect and dispose of garbage and rubbish . The Contractor shall file a certificate with the City showing said insurance to be in full force and effect for the term of the contract . Defaults The breach of any of the terms and conditions of the con- tract on the part of the Contractor shall be grounds for the cancel- lation of the contract . The City, upon such termination, shall have the right to contract with other parties to perform the work, or to perform said work without contract, and in either case the City shall hold the Contractor and his surety liable for any excess cost for performing such work over the cost to the City if the initial contractor had continued to perform in the manner anticipated at the time the contract was awarded . Termination of the contract as herein provided shall notterminate:, suspend, or affect the liability of the surety upon the bond. SECTION 7 GENERAL CONDITIONS , INSTRUCTIONS TO BIDDERS, INFORMATION (1) Sealed bids will be received by the City Administrator of the City of Shakopee , Minnesota, in accordance with the "Call for Bids" and subject to all provisions contained in this bid document including the Specifications . " Bids by corporations must be signed with the names of the corporations , followed by the signature and designation of the president , vice president , or officer authorized to bind it in the matter . (c) Each bid shall be sealed and addressed to the City Administrator of the City of Shakopee, Minnesota and shall bear on its face , the name of the bidder, time and date of the bid opening, and the subject of the bid . (d) Bids received after the time specified in the advertise- ment will not be considered . (e) Erasures or corrections may invalidate a bid unless properly noted over the signature of the bidder . (3) Surety (a) Bid Bond : Each bid must be accompanied by a bid bond, deposit or certified check, or bank cashier ' s check, drawn on a solvent band, payable to the City of Shakopee , Minnesota, in the amount of S% of the total amount of the bid for the two year term of the contract as a guarantee that , if the bid is accepted, a contract will be entered into and the performance of the same properly secured . The City will determine the sufficiency of the surety . Bid bonds ,checks or cash will be returned to bidders Within a reasonable time when the City Administrator, or his authorized representative,determines the surety is no longer required . (4) Rejection of Bids (a) The City Council reserves the right to waive informal- ities , to reject any or all bids , or to accept any bid which may be deemed to be for the best interest of the City. 11 . (S) Withdrawal of Bids (a) No bid shall be withdrawn within thirty (30) days after the scheduled time for opening of the bids . (6) Infringements and Indemnifications (a) The bidder, if awarded the contract , agrees to protect , defend and save the City harmless against any demand for payment for the use of any patented material , process , article , or device that may enter into the manufacturer, construction or form a part of the work covered by tr_e contract and the bidder further agrees to indemnify and save the City harmless from suits or actions of every nature and description brought against it , for or on ac- count of any injuries or damages received or sustained by a party or parties , by or from any of the acts of the Contractor, his employees or agents . (7) Default Provisions (a) In case of default by the bidder or Contractor, the City of Shakopee may procure the articles or services from other sources without further advertaising and may hold the bidder or Contractor responsible for any excess cost, occasioned thereby or damage suffered by the City . (8) Pricing (a) Where unit prices are requested and there is a discrepancy in the total amount of the bid, the unit prices shall govern. (9) Interpretation of Bid Document (a) If any person contemplating submitting a bid is in doubt as to the true meaning of the Specifications , he may submit to the City Administrator a written request for interpretation thereof . Any interpretat- ion of the proposed Specifications will be made only by written addenda issued by the City, and a copy of such addenda will be mailed to each person receiving a set of Specifications . The City Administrator will not be responsible for any other explanations of the Specifications . (10) Specifications (a) Unless otherwise stated by the bidder, the proposal will be considered as being in strict accordance with the Specifications outlined in the bi-d document . CAP 7 12 . Reeder, City Administrator RE: Purchase of Police Vehicles DATE : October 11 , 1979 The 1980 Capital Improvement Program and the 1980 City Budget included appropriations for the purchase of a four-wheel drive vehicle for the Police Department . The Police Department has a strong need for that vehicle now. We hope to have ready by the Council meeting a proposal to either lease or purchase a four-wheel drive vehicle immediately. The funding for acquisition at this time would not be a problem since the money for the purchase in 1980 is from the Capital Improvement Fund which are not derived from annual tax levies . With the construction and the future occupancy of the townhouses directly west of the Public Works area , it is now imperative that this fencing be constructed to insure the safety of the residents and to protect City and Utility Commission equipment from vandalism. There is still some money available from the bond issue for the construction of the Public Works and Police building which I would propose to use for this purpose . We hope to have available at the City Council meeting three quotes for the construction of a 7 foot chain link fence around the area outlined on the attached diagram. The low bid with tank was $979 , 200, which was 6 .4% over the engineer ' s estimate of $920,000. In addition to the $979 , 200 bid , we will have to pay the following costs : Bid Price $979 , 200 Consulting Engineer 55 ,000 Soil & Tank Testing 25 ,000 Construction Contingency(10%) 97 ,000 Administration ( 1%) 12 ,000 Total Project Cost $1 , 168, 200 Bond Issue Estimate $1 , 168 , 500 For the Kmart Tax Increment Project budget we had used $1 , 168, 500 which had also included some financing charges . Therefore , without the financing costs included and with the appropriate administrative , testing, consulting fees and contingency charges , the project is within budget . Recommendation It is recommended that the City Council take no action on awarding the bids for the Water Storage Tank for the following reasons : 1 ) Moody ' s has not yet rated the bonds . 2) The bonds have not yet been sold . 3) The contract with Kmart is not yet signed . The schedule of events as I now see it is as follows : 1) We should receive the Moody rating on the bonds this week. 2) The signed contract with Kmart should be received from Kmart next week. 3) The City Council should be able to act on November 7 to approve the sale of the bonds to the underwriter. 4) The City Council could award the contract for the tank construction on November 7th if the above actions occur. At this time , the road is poorly constructed of fill material which probably does not meet appropriate standards . Reeder, City Administrator RE : Waiver of Fire Code Requirement DATE: October 11 , 1979 Scott County is requesting that the State Fire Marshall waive the requirement for the automatic fire extinguisher system heads in the Communications Room of the Scott County Courthouse . The Building Inspector has recommended to me that the City of Shakopee concur in the request for the waiver. The request is necessary as that the county does not have sprinkler heads located over the communications equipment . This area is manned 24 hours a day and the potential danger of a malfunctioning sprinkler head which would destroy the expensive equipment is a big problem. Appropriate City Council action would be to support the request of Scott County to get a waivEr from the State Fire Marshall ' s office for this requirement . At the same time, CC-187 was passed to allow the continuation of a non-conforming use abandoned for more than six months .
