PROCEEDINGS OF
SHAKOPEE HOUSING AND REDEVELOPMENT AUTHORITY
SPECIAL SESSION SHAKOPEE , MINNESOTA June 19 , 1979
Chairman Hullander called the meeting to order at 7 : 35 P.M. with
Comm. Lebens , Reinke, Ward, and Leroux present .
Leroux/Ward moved to approve the Minutes of June 5 , 1979, as kept .
Motion carried unanimously.
Leroux/Reinke offered Resolution No. 79-8, A Resolution Authorizing
Condemnation Proceedings , and moved its adoption.
Roll Call : Ayes - unanimous . Noes - none . Motion carried.
The Deputy Director reported on the feasibility of extending the park-
ing lot between Fuller and Holmes on Levee Drive onto the site of
the proposed senior citizen high rise , which would also require the
vacation of one-half block of Fuller. The Deputy Director reported
further that the two business owners directly affected by this
alteration were contacted . Mr. Bob Sieman of Shakopee Motors was
opposed to the alteration because he felt he would be losing too many
existing parking spaces and that it would cause too many inconveniences
for his business . Mr. and Mrs . James Rein, owners of Jim and Lucy' s ,
were in favor of the parking lot extension, stating that they feel
the change will aid their business .
Leroux/Ward moved to refer the matter of the parking lot extension to
the City Council and that the HRA advise the Council to direct City
Staff to begin vacation proceedings of Fuller Street one-half block
back from Levee Drive . Motion carried unanimously.
A copy of a letter from the Minnesota. Department of Transportation
was viewed, regarding the proposed pedestrian crossing for the senior
citizen high rise . The letter indicated that approval of the issuance
of a permit allowing the installation of a pedestrian signal would
be granted, contingent upon various stipulations .
Reinke/Ward moved to adjourn at 7 :45 P.M. Motion carried unanimously.

RE: Update on 1978 Community Development Block Grant
Program
DATE : July 12 , 1979
A. Acquisition:
1 . Eminent domain proceedings have been initiated against
four property owners in the project area. On August 1 , 1979,
the HRA will petition the court for the right to condemn
and also the appointment of appraisers will occur.
2 . Onr property acquisition should be closed shortly.
The necessary papers are being drawn up.
3 . Two property acquisitions should be transacted in the
next couple of weeks .
4. The City has acquired title to two parcels in the Fourth
and Minnesota Project area .
B . Water Main Installation:
The City Engineering Department will advertise for bids on
July 13 , 1979 , for water main installation North from Seventh
Avenue , across the Milwaukee Railroad line onto the City' s right-
of-way, then East across the Fox and Weiler property to Clifton
Addition. This extension should not affect condemnation proceed-
ings since it will not be lain adjacent to any of the involved
properties . A map indicating the extension will be available
Tuesday evening.
C. Platting:
Suburban Engineering, whom the City has contracted for this
service , is finalizing the plat for the project area. The plat
will be presented to the Planning Commission shortly.
I will keep the Commission abreast of any further project
developments .

RE : City Parking Lot Extension and Vacation of Fuller
Street
DATE: July 12 , 1979
At the June 19 , 1979 , HRA meeting, City Staff presented a
proposal to extend the parking lot between Fuller and Holmes
on Levee Drive onto the proposed Senior Citizen site . This
proposal also would have necessitated the vacation of Fuller
Street one-half block back from Levee; Drive.
Since that time, discussions between the City and the developer
and his architect have indicated that design problems
(accessibility, drainage and grade) would ensue and, addition-
ally, the number of parking spaces made available would be
minimal .
Given these conditions , City Staff decided to abandon the
parking lot extension and street vacation proposal .

RE: Engagement of Relocation Specialists for
Senior Citizen Project
DATE: July 17 , 1979
One homeowner is located on the proposed senior citizen site.
According to Federal/State regulations, this homeowner is
entitled to relocation benefits . These regulations are quite
involved and complicated and an exact procedure is legally
mandated.
In order to follow the letter of the law, and due to local staff ' s
inexperience in relocation activities , it is recommended that
the HRA direct City Staff to engage the services of VonKlug and
Associates , Inc . The City is presently contracting VonKlug and
Associates to carry out acquisition and relocation activities
in the Fourth and Minnesota Project and their professional
competence and fairness is well-documented .
Previous discussions with VonKlug and Associates have indicated
that the costs of engaging this firm will range between $250 to
$500; the range attributed to the preliminary work already
completed by local staff .

RE : Appraisal for Senior Citizen Site
DATE : July 17 , 1979
In order that the HRA abides by Federal/State land acquisition
and relocation guidelines , an appraisal of the properties on
the proposed Senior Citizen site is necessary.
Several local appraisers were contacted as to their willingness
to perform the appraisal . Each declined, citing demands of
their present work schedules .
Therefore, Patchin Appraisals , Inc. from Minneapolis and Wiley
Appraisal , Inc . from Bloomington were asked to quote prices
on the site appraisal . Following are their price quotes :
a) Patchin Appraisals , Inc . $650 Start in one week
b) Wiley Appraisal , Inc . $450-$500 Finish in 10 days -
2 weeks
The Wiley firm states that their price could raise if they were
compelled to testify in court over their appraisal .
It is recommended that the HRA accept Wiley Appraisal , Inc .
as the Senior Citizen site appraisers and direct City staff to
engage their services for the quoted price . It is expected
that the appraisal costs will be covered by the tax increment
project under "administrative costs" .

RE : Railroad Spur Line Easement
DATE: July 17 , 1979
In 1899 , the Milwaukee Railroad was granted an easement to
construct a spur line across the proposed Senior Citizen
site . To claim clear title to the property, the Milwaukee
Road must relinquish its easement right to the property
purchaser.
The Milwaukee Road is willing to give up its easement , but
$1500 for the railroad ' s administrative engineering and
legal expenses must be paid to them before the railway will
initiate this process .
This $1500 also covers court costs , but settlement costs
that the court may decide the Milwaukee Road is entitled to
are in addition to this amount .
In order to expedite the Senior Citizen Project , it is
recommended that the HRA approve the paying of the $1500 to
the Milwaukee Road . As in the case of the appraisal firm,
this cost and subsequent additional costs will be included
in the tax increment project .

RESOLUTION N0. 79092; ESTABLISHING THE SCOTT
COUNTY CRIMINAL JUSTICE ADVISORY COMMITTEE.
WHEREAS, the Scott County Board of Commissioners desires to
be informed, undertake planning, implement and evaluate programs
relating to criminal justice, and
WHEREAS, the Scott County Board of Commissioners seeks the
valued contributions to such an effort on the Dart of _public
officials, professionals and other interested citizens throughout
Scott County,
NOW THEREFORE BE IT RESOLVED, that the Board of Commissioners
in and for the County of Scott, Minnesota, on this date hereby
establishes the Scott County Criminal Justice Advisory committee.
BE IT FURTHER RESOLVED, that same shall be comprised of the
following 17 members, each appointed by the Board of Commissioners
for a three (3) year term. The terms of those members initially
appointed shall expire on June 30, 1982.

RE : Elimination of Angle Parking
DATE: July 11 , 1979
As a continuation of the angle parking study , this discussion
paper will outline specific recommendations for handling angle
parking .
As stated before , it was the conclusion of staff that the
elimination of angle parking would not create undue hardship
on those who would loose it . Further, it was the recommendation
of staff that elimination of angle parking be phased . The
first phase would see the elimination of angle parking from all
sites except St . Francis Hospital . The second phase would
eliminate angle parking from St . Francis .
St . Francis has always been short of parking spaces . At its
construction, only 20 spaces were provided instead of the 63
required . Angle parking now makes up for this shortfall . To
avoid undue hardship, the angle parking should remain until
completion of a second off-street parking lot .
The hospital has the opportunity to purchase nearby lots and
with the permission of City Council could construct a parking
lot which would make up for the lost angle parking. The time
table for new parking spaces would call for an early fall
completion date . At that time , angle parking would be completely
eliminated from Shakopee .
For other areas of Shakopee the elimination of angle parking
could be immediate . The only areas which would not have adequate
off-street parking are the churches of the area . The loss of angle
parking in these cases could be made up by on-street parking.
Walking distances to church would be only slightly increased .
Making up for the lost angle parking spaces by parking parallel
on-street , would increase the maximum walking distance for those
attending church to 50 feet for St . Marks , 190 feet for St . Johns ,
70 feet for Mt . Olive , and 130 feet for St . Marys . Keeping in mind
that one-half block is approximately 150 feet , the increased walking
distances are not significant .
This , then, is the first recommendation, immediate elimination
of all angle parking except for the phasing out of angle parking
at St . Francis Hospital by early fall .

The second alternative would be to retain the phasing for St .
Francis , retain Sunday and Saturday angle parking for churches ,
and eliminate the rest of the City' s angle parking .
This alternative would take into account the special cir-
cumstances of the hospital . The situation for the churches would
remain substantially the same as at present . Angle parking is
evedent only on Sundays and Saturdays at area churches . During
the week people generally parallel park. Thus , to allow only
Sunday and Saturday angle parking for area churches would not
significantly alter parking for them.
Those who would loose angle parking can make up for the loss
in nearby municipal parking lots .
This alternative would have almost no impact on the community.
Changes in parking for churches , in fact , would be simply ordinance
changes rather than changes in parking practices .
These two alternatives answer the question of angle parking
best . The first would eventually see the elimination of angle
parking in Shakopee . The second , would have the least impact
creating a compromise situation which would allow churches to
retain weekend angle parking .
A third alternative would be to eliminate angle parking in the
central business district only. This would eliminate the traffic
problems caused by angle parking and the accident potential in
the high traffic areas of the City. This is less attractive in
that it deals with only half of the problem of angle parking .
As well , the business community may feel singled out if we do not
have a uniform policy for Shakopee . This would however, be an
acceptable choice if no other alternative could be worked out .
It is the recommendation of the Zoning-Planning staff that
Council choose the first alternative . The reason is that it deals
with angle parking as a whole , and leads to its eventual elimination.
As was shown in the last report and this , the impact on the City and
individuals is minimal . The increased walking distance for those
attending church is also not significant .
The second choice would be to work with St . Francis to increase
their off-street parking and to eliminate angle parking from the
central business district . This takes inty account the fact it may
be pointless to legislate against angle parking during the week
around churches when this may not, in fact; occur at present .

MEMO TO: Shakopee Planning Commission

RE: Howard Gichy Rezoning Request
DATE : June 15 , 1979
The request is for the rezoning of Lot 7 , Block 28, Original
Shakopee Plat., from the present B-5 to a proposed R-3 district .
Under the proposed Comprehensive Plan the area is to be rezoned
to R-3 . The southern portion of the block is already zoned R-3 .
While rezoning to R-3 Would conform.._to the Comprehensive Plan, . to
single out one lot for rezoning at this time would constitute
spot zoning . Spot zoning is not acceptable and a practice
that the City should not become involved with.
To avoid the question of spot zoning, in setting a hearing
for the zoning change , all lots on the north half of Block 28
should be included in the rezoning. These are Lots 6 through
Lot 10.
Recommendation: Move to set public hearing July 12 , 1979,
at 7 : 30 P.M. for the rezoning of lots 6 through 10 of Block 28,
Original Shakopee Plat , from B-5 (General Business District)
to R-3 (Multiple-Family District) .

RE : Island in O'Dowd Lake
DATE : July 13 , 1979
The Planning Commission has recommended a variance which would
allow a home to be built on an island in O' Dowd Lake . The applicant
has now apparently fulfilled the requirements of the Planning
Commission as listed in the attached minutes .
I was asked to talk with officials from Louisville Township
to discuss their concern with this application since the access
to the island is from Louisville Township. I have talked to
several of the Board Members and their attorney and they have
in turn talked to residents on the street which abuts the island .
It is my opinion that the Township Board is not in favor of
the house on the island, but that they have been advised by their
attorney not to get involved . I have asked the Board Members if
Louisville Township would be interested in a joint venture to
purchase the island for park use rather than allow it to be developed
and I believe they are interested . They suggested that the
City Council should consider the purchase first and then approach
the Township.
If the Council is interested in trying to find City funds and
asking the Township for half of the cost , I would suggest the
Council table the variance and ask the staff to investigate
the option.
If the Council has no interest in the purchase , it may be
questionable as to whether a denial of the variance would be
sustained by the courts - if it got to the courts . The City
Attorney could further address this matter.

Attachment
Colligan/Perusich moved to open the public hearing on a variance
request to build a home on a parcel of land which does not abut
a dedicated public street . Motion carried.
City Admin. explained this is a request to build a home on an
island in the middle of O'Dowd Lake . City Admin. read the code as
it pertains to this request . This request is not in accordance
with City Code because the development does not have access to a
public street . This structure could not be protected by the City.
He stated another concern is if one home is allowed, how many more
should be allowed .
Julius A. Coller, II City Attorney, was present for counsel .
Mike Peters , purchaser, Edward Christian, Attorney and Lonnie and
Janet Blaine , fourth partners in development, were present for
discussion. Mr. Christian stated they would be agreeable to only
one dwelling being allowed on this piece of property. This would
also be stipulated to the heirs. This would be a seasonal (summer)
residence . If the City is concerned regarding liability, a waiver
could be signed taking the liability from the City, which would
ultimately mean a raise in insurance for the owner, Mike Peters
is the contract buyer on this piece of property. Lonnie and Janet
Blaine are fee owners .
Discussion was held on the type of soil and ground conditions plus
the elevation.
Bill Price was present and questioned the pumping of the septic
tank.
Ms . Blaine stated that an easement of 10' wide through putloC A;
of the highlands is available.
'Mr. Peters stated that vehicle equipment could be gotten to the
island during the winter months when the ice was thick or could'
- be driven with a four-wheel drive right through the water since.
it is only 2 feet deep . He stated the DNR would npt. 'allow a bridge
permit on undeveloped land but if there woul.d 'be a house there, '
th, DNR would give a permit to get to this house.
Ms . Blaine stated that after checking with the utilities, electri-
pity could be run to the island as Gould phone service,
Chrmn. Schmitt asked for questions from the Commission'.
Commissioner Colligan stated this was . the individuals,_ concerns
and how and what he does with the house should, �be no. 'concern to
the Commission. He stated that as long as 'the City is not held
liable and the water is not polluted, the City should really
have no concerns .
Commissioner Rockne stated his agreement with Comm. Colligan but
Added that if anything would be dropped into the lake, the DNR'
would be sure to enter into it then, so the City would have no
responsibity in that area .

Comm . Koehnen questioned subdivision of any sort . She also
questioned the property south of this proposed dwelling which
consists of five acres . She was concerned with a binding way to
write up a contract that would allow for no further development
on this island . Mr . Coller answered her concerns that if a
contract to this nature would be signed , there would be no way
it could be broken.
Comm. Perusich had no further questions .
Comm. Marschall was concerned with pollution and proper septic
system.
Chrmn. Schmitt passed the gavel to Comm. Marschall and stated that
he was concerned that the City would be a party to something that
would affect Louisville Township. He did not like the idea of
on-street parking and stated adequate easements for parking should
be provided in consideration of Louisville Township.
Mr. Coller suggested contacting Louisville Township to work with
them on this .
The Comm. questioned if Outlot A of the highlands was a buildable
lot . They were informed by Ms. Blaine that it was not .
Comm. Marschall passed the gavel back to Chrmn. Schmitt .
City Eng . questioned if the developer would be agreeable to
transportation to the island for City staff . They replied trans-
portation would be provided by the owner .
City Admin. had very serious consideration with this not being
made a precedence with having no public access to this home. $tnce
this would be the only one in Shakopee without a public access,
would someone in the future try to come in fora variance regax7din$
a similar circumstance .
Perusich/Colligan moved to close the public hearing. Motion carried.
�. Comm. Marschall stated he wished tQ abstain from voting and froal
any motions since he is a lakeshore owner. .
Perusich/Colligan moved to approve variance resolution No. PC-196,
a variance to allow a home to be built on a parcgl' of land which'
does not abut a dedicated public street, with the following
conditions :
1 . That they enter into a .fileable.,agreement acceptable to the City.
}. 2 . There be no Fire or Police tiabili:ty from, the `City.
3 . This be the only permit issued and, only development a11owed,
4. Electrical easements be secured end all utilit,ie¢ be undergro4nd.
5 . City Admin. talk to the Louisville Township to see if there
are any concerns on parking easement and utility easements .
6 . These agreements should be prepared by the applicants attorney
prior to being presented to the City Council .
7 . Permissable accessory buildings be allowed but no further
dwellings .

Request : The applicant Gordon J. Wagner requests permission to
construct a 672 sq . ft . accessory building. This would be 22 sq .
ft . over the maximum of 650 sq.ft . set in the City Code.
Location: The property is located at 1097 Jackson St . at the
NE corner of Jackson and 11th.
Analysis : The applicant requests a 22 sq . ft . allowance to con-
struct an accessory building larger than the maximum allowed by
the City Code . The increased size would allow Mr. Wagner to store
two cars and specifically his boat which is presently stored outside .
Recommendation: Staff recommends approval .

ORDINANCE AMENDING CHAPTER 3. 21 OF THE SHAKOPEE CITY CODE
Be it ordained by the City Council of the City of
Shakopee as follows :
Section 1 - Section 3. 21 of the Shakopee City Code,
formally Ordinance number 386 , filed as abstract document number
154681 in the Office of the Scott County Recorder and as torrens
document number 15991 in the office of the Scott County Registrar
of Titles, is hereby amended to provide a new Subdivision 6
as follows :
Subd. 6 . Records. The flow allocations as herein before
set forth are subject to transfer by and between the
affected parcels and are further subject to creating
specific designated flow allocations within each
individual parcel. No such transfer or specific
designation of said flow allocation shall be effective
and recognized by the City unless and until an agreement
is entered into by and between parties affected thereby,,
and a signed copy of which agreement is filed with the
office of the City Engineer for the City. The records
kept by the City Engineer shall be deemed conclusive
and final with respect to said flow allocations and
all building permits issued within the controlled
area shall be issued in accordance with flow allocation
records in the office of the City Engineer.
Section 2 - This ordinance shall take effect upon its
passage and publication.
Adopted in regular session of the Shakopee City Council
on the 3rd day of July, 1979 .

SUBJECT: Design Criteria and Standard Specifications
DATE: July 17 , 1979
Pursuant to the request of City Council July 3 , 1979 , the following
summarizes the difference in past and proposed practice caused by
adoption of Design Criteria and ' Standard Specifications .
The least amount of change is to the Standard Specifications . The
specifications are used throughout the metropolitan area and most
contractors are accustomed to them. Publishing specifications
aids new contractors , consultants and developers in determining the
quality of construction expected by the City.
Major changes are made to the Design Criteria. At the present time ,
criteria is scattered through the City Code . The criteria is in
very general terms and has arbitrary language. Reference is made
to record drawings being submitted to the City but nowhere is a
single comprehensive set required.
The first alteration is to drawing submittal procedure. Any drawing
of facilities to be installed in public right-of-way will be
submitted to the City Engineer for approval. Drawings with watermain
will be forewarded to the S.P.U.C. for additional approval of
watermains . Once the drawings are approved, an approved reproducible
copy of the drawings will be filed with the City and then any
construction performed shall be in accordance with the approved
drawing and the standard specifications . Any work being performed
without approved plans shall be immediately stopped until the
contractor has in his possession a set of approved plans .
There are numerous changes to the roadway design criteria . The
criteria is liberal, but not to a point of permitting poor design.
Crosspans or "Shakopee Dips" are expressly prohibited on any
arterial or collector streets . They are permitted on residential
streets only as a storm water drainage facility. Vertical and
horizontal alignment has been altered to make the design match
ordinary signed speed and provide safe driving roadways in new
subdivisions .

The most important change is the requirement that roadway structural
sections be designed. In general, the requirement to design roadway
structural sections could double and even triple road construction
costs . A soils report is required for each roadway to be built.
Examples of roadway sections that were not designed are Holmes
Street , Jefferson Street and most of the roads that are damaged
or show distress .
I have proposed design criteria and construction standards for
watermains , the SPUC should accept these or some modification of
the criteria and standards . As soon as the SPUC adopts criteria
and standards , the City should adopt SPUC' s criteria and standards .
The design criteria for sanitary sewers is a combination of basic
hydraulics and good sense. It is nothing that should not have been
done all along, but unfortunately it is something that was never
done. Now sewer mains must be designed and must have capacity for
upper basin flows .
The consultants working in the City will be effected most by the design
criteria . Fewer standard drawings will be appropriate and more
special designs will be required by analysis .

Subject: Allocation of budgeted Tahpah Park funds
At the direction of the Shakopee Jaycees, I have been asked to check the
availability of budgeted park funds to be used in Fiscal 1979.
On April 14, 1979 when we presented our goals to the City Council for the
year of 1979, we initially asked the City of Shakopee to reserve its funds
for the water and sewer project. At that time the City Administrator
assured us that the Engineering Department would start a feasibility study
and get back to us with the results. Due to the heavy work load of that
department the study was never completed.
Upon talking with the City Administrator we have concluded that the water
and sewer project for this year cannot be completed. So at this time the
Shakopee Jaycees request that those city park funds, allocated for that
project, be diverted to help us cover costs which have been incurred during
the past year.
Enclosed are two bills which we could like you to consider:
A. Montgomery Ward for outfield fencing on Softball Field # 3. ($2265.00)
B. Minn Valley Fence for fencing on the baseball field. The Jaycees have
already paid $4989.50 of that bill . ($5000.00)
Any financial help that the City of Shakopee would consider giving us
would be gratefully appreciated. If you have any questions please feel free

On Friday, July 13 , 1979 , the City Engineering Department
will advertise for bids on construction of the Lions/Tapah
Bike Trail .
In 1977 , the estimated cost of the project equaled $24, 354.00.
The City has received a FY 1978 LAWCON/LCMR Grant totalling
$21 , 919 .00; $12 , 177 .00 (50% of estimated cost) is from federal
sources while $9 , 742 .00 (40% of estimated cost) is from state
sources . Local service organizations (Lions Club and the Mixed
Couples Softball League) will donate the remaining $2 ,435 .00 or
10% of the estimated construction costs .
However, due to inflationary construction costs an alteration
to the intended 12 , 300 linear feet of trail may be necessary.
The extent of the alteration will not be known until bids are
received.
Maps indicating the bike trail design will be available at
the Council meeting Tuesday night .

Notice is hereby given by the City Council of the City of
Shakopee , Minnesota, that it will hold a public hearing in the
Council Chambers at City Hall , Shakopee , Minnesota, on the 17th day of Ju

dated June 29, 2979, to the Valley Industrial Park Redevelopment
Plan, dated January 23, 1979, which Plan is being carried out by the

Having talked to Richard Sandberg of the Pollution Control
Agency , the following are the guidelines in issuing burning permits :
ALLOWED
1 ) Recreational and cooking fires if wood, coal , or charcoal is
burned . Individual cities may require permits or set their
own conditions if they wish.
2) You may burn any elm or oak to destroy diseased trees or wood
which may become habitant for the dutch elm beetle or oak wilt .
3) Burning of wood and brush if cleared from a site on which a new
structure is being built . You must, however, be 600 feet from
the nearest structure .
4) Agricultural burning is allowed but the county agricultural
agent should be consulted to asertain whether or not the
burning is valid as an agricultural technique and appropriate .
NOT ALLOWED WITHIN THE SEVEN COUNTY METROPOLITAN AREA
1) Burning of brush and debris . (Later this year a change may be
made to allow the burning of brush by permit) .
2 ) Leaves may not be burned.
3) Anything not specifically allowed should be considered as not
allowed.

In order to improve the Administrative efficiency of City
Hall , I am recommending several changes in staff and office
use . The changes suggested are as follows :
1 . Divide Building Department between the Finance Department
and the Engineering Department . Assessing will go with Finances ;
Building will go with Engineering .
a) This will eliminate one department reporting to
the City Administrator and place the functions in
areas where we have strong administrators .
b) The Assessing function is quite compatable with
Finance and in most cities is under their administration.
c) The Building function is closely related to Engineering
and needs to be closely coordinated with the functioning
of the Engineering Department .
d) The relationship between the Assessing and Building
functions can continue as needed even though in different
departments .
2 . Change the Secretary in Engineering to a full time position
(as was originally authorized in the 1979 budget) and move the
Building application function to that Secretary . These applications
were originally received by Finance (Kathy) then moved to Assessing
(Phil) and they would now go to Engineering (Nancy Engler) . This
will allow one stop service for Building Permits which have to go
to Engineering anyway . It will also allow more staff time for
Assessing and will eliminate any part time assessing. The
combination of Assessing and Finance will also provide to some
extent backup secretarial for Finance .
3 . Make some modifications in the office layout to accommodate
their staff shifts . These are shown on the attached drawings .
In making these modifications , I estimate the cost will not
exceed $10,000. I must advise you that within three years we
will be getting relatively cramped for space and may have to look
at some additional space gaining moves .

4. I am now convinced that the City should have a full-time,
experienced Planner on the staff. This position was requested
in 1979 and ended up as an intern position. I believe the
intern position has worked well and we have been able to do a
much better job in this area with the additional manpower. I
will request in 1980 that this position be included in the budget .
I am requesting now that the City Council consider the need for
this position and the need for filling the position at the end
of the current intern period which will run to October. If
we began considering the hiring now, we could have someone on
staff by that time . I am not certain on the starting salary,
however, the salary range adopted by the City Council for 1979
for this job is $13 ,000 to $21 , 500.

RE: MWCC Sludge Ash Disposal Site

A representative from the MWCC, Mr. Ramsdall , MWCC Staff and
engineering consultants were present at the July 17 , 1979 ,
Scott Count Board Meeting to explain the MWCC ' s Residual
Solids (Ash Management Study.
Briefly, the main points of the MWCC ' s presentation were as
follows :
1 . The accommodate ash disposal, sixteen search
areas (not actual sites) have been identified in
the Metropolitan Region.
2 . One of these search areas is located in
northern Scott County.
3 . The MWCC has not ruled out the possibility of
selecting an ash disposal site on the land it has
purchased for the sludge farm.
4. Additional criteria relating to soil conditions,
land use (e .g. a requirement for a 1000 foot
buffer from any residential area) will be applied
to search areas to select a more definite site.
5 . A possibility exists that the area in northern
Scott County will be ruled out as not meeting the
criteria.
6 . The MWCC will reappear before the County Board
with the results of its continued studies within
four weeks .
As a final note, the County Board was very apprehensive toward
any ash disposal site ' s location in Scott County. The Board
advises the MWCC that careful consideration must be given to
the site selection and, in any event, political/public
opposition will confront any MWCC site selection.

The Sludge Farm case has now progressed to the Supreme
Court with the Waste Control Commission pushing to get a decision.
The attached letter details the schedule .
I think the League now needs to consider seriously the
entrance into the case as amicus cuniae as we have previously
discussed .
I believe the best way to get at this issue would be to get
a meeting with you and maybe Stan Pescar and Rod Krass and I
to discuss the current situation.
I will be out of town until July 31st and I think it would be
best if you go ahead with such a meeting with Rod Krass without
me . I would appreciate it if you would arrange a meeting with
him in the new future so that you have time to secure whatever
approvals you need from the Board without cutting short your
time to prepare a brief .

The Council previously authorized staff to proceed with the
possibility of obtaining a CETA employee in the Assessing
Division. The County CETA office approved and funded the
position. The opening was advertised and posted for two weeks .
We received one application from George Johnson who has previous
assessing experience . CETA funds the salary and fringes
except PERA (optional) .
A request is being made at this time to the City Council to
approve the hiring of George Johnson for Assessing Clerk at
$3 . 50/hour.

In accordance with your request at the meeting on June 6, 1979,
and your letter of June 8, 1979, I am writing to clarify the
Minnesota Pollution Control Agency staff' s position with respect
to the amended Findings of Fact, Conclusions of Law and Order for
Judgment in the case of the Metropolitan Waste Control Commission
vs. the City of Shakopee.
The Agency staff stated that in its best professional judgment,
based upon a review of the technical information it has obtained,
the municipal sludge generated by the operation of the Blue Lake
Wastewater Treatment Facility is not a hazardous waste requiring
non-routine waste management techniques . However, the staff made
it clear that the land-spreading of sewage sludge requires proper
management in order to insure no adverse environmental or human
health consequences .
The Agency staff also stated that the decision on whether or not
to permit land spreading of sludge from the Blue Lake Wastewater
Treatment Facility and the decision on what conditions should
attach to any permit issued will be made only after the receipt of
a permit application. Additionally, the Agency staff made it
clear that the administrative process of reviewing the permit
application will be open to the public and that the staff looks
forward to the participation of- Shakopee. Finally, the staff
pointed out that municipal sludge is an exempted waste under the
recently promulgated hazardous waste rules and that it does not
intend to issue a permit for municipal sludge entitled "hazardous
waste permit. "

Each year the Metropolitan Council prepares estimates of the
Population of each community in the Seven-County Metropolitan Area .
These estimates will be forwarded to the Minnesota Department of
Revenue on July 17. The Department of Revenue will use the estimate
as a basis for determining levy limitations for counties ,
municipalities and townships in the Region , as well as fiscal
disparity computations .
The Council ' s preliminary estimate for your community as of April 1 ,
