PROCEEDINGS OF THE
SHAKOPEE HOUSING AND REDEVELOPMENT AUTHORITY
Regular Session Shakopee , Minnesota June 5 , 1979
Chairman Hullander called the meeting to order at 7 : 30 P.M. with
Comm. Leroux, Ward , and Lebens present . Comm. Reinke was absent .
Leroux/Ward moved to approve the Minutes of May 1 , 1979 , and May 15 ,
1979 , as kept. Motion carried unanimously .
Leroux/Lebens moved to approve payment of the following bills:
a) Von Klug and Associates , Inc . - $ 1 , 375 .46 .
b) Paul W. Wermerskirchen Abstract Co . , Inc . - $ 226 . 15
c) Capesius Agency, Inc . - $ 35 .00.
Roll Call : Ayes - unanimous . Noes - none . Motion carried .
The Deputy Director reported on the status of the eminent domain
proceedings , stating that there are four property owners in the 4th
and Minnesota Neighborhood Revitalization Project that are reluctant
in accepting the City' s purchase offers and that final notice had
been sent to them on May 25 , 1979 . The necessary papers for initiating
eminent domain proceedings will be filed by the City Attorney with
the Federal District Court on June 11 , 1979 .
The Deputy Director also explained that due to the initiation of
eminent domain proceedings and torrencing problems in connection
with the acquisition of property in the 4th and Minnesota Project ,
that acquisition of all parcels in the area cannot be accomplished
until late this year . The Deputy Director suggested that public
water and sewer be installed in the meantime and that platting be
commenced of a section of the project area. Discussion followed.
It was pointed out that the value of the parcels may very well increase
due to the installation of public improvements in the area .
In the long run, commissioners felt , the City would end up paying
increased settlement costs in the acquisition of the property.
Leroux/Ward moved to cease all street and utility construction of
the project until all property in the project is acquired . Motion
carried unanimously.
Leroux/Ward moved to authorize the proper City Officials to enter into
an agreement with Suburban Engineering for the additional surveying and
platting work to be conducted in the 4th and Minnesota Project Area.
Motion carried unanimously.
Ward/Lebens moved to authorize the purchase of an additional 10. 5
foot strip from Mr. and Mrs . John Thies on Minnesota Street .
Roll Call : Ayes - unanimous . Noes - none . Motion carried .
The Deputy Director reported that he is awaiting word from the
State Engineer concerning the semaphore and pedestrian crosswalk in
connection with the Senior Citizen Highrise .

The Deputy Director presented a proposal to the Commission from the
United States Department of Housing and Urban Development for mortgage
insurance under its Section 8 Subsidized Housing Program for a 43
unit townhouse development to be located at the intersection of
County Road 16 and County Road 17 .
The Deputy Director stated that this proposal surpasses the City' s
HUD-approved HAP (Housing Assistance Plan) but it still falls short
of meeting the Metro Council ' s Fair Share Housing Allocation for
Shakopee .
Cncl . Leroux spoke in opposition to the proposal as he felt it is
too severe a concentration of low income housing in a given area.
Additional discussion followed.
Wark/Leroux moved to oppose the proposal .
Roll Call : Ayes - unanimous Noes - none . Motion carried .
City Staff was directed to draft a letter to HUD voicing the
City' s disapproval of this proposal .
Leroux/Lebens moved to adjourn at 7 : 57 P.M. Motion carried unani-
mously.

meeting of the Shakopee Housing and Redevelopment Commission

:'dear Mayor and Council Members :
Ely, Minnesota ; has been awarded the 1980 American Legion National
World Series oz Baseball . The Tournament will be held August 28
through September 1 , 1980 . In order to get the bid, Ely was obli-
gated to guaranty $25 , 000 plus an additional $15 , 000 for expenses .
This is the first time that this Tournament will be held in a com-
munity of less than 100 , 000 people , and only the second time this
great baseball tournament will be held in Minnesota .
The State Tourism Division has projected that over $3 , 000 ,000 will
be spent in the State of Minnesota during that week, and there is a
strong possibility of one-third repeat business from the fans coming
into Minnesota for the first time .
We are putting out an attractive souvenir booklet to help defray the
cost of this tournament , and are asking for your help . We would ap-
preciate it very much if you could purchase an ad (82 x 11") for
$100 in our booklet . The ad could include a picture of something
from your area that would attract the fans on their return trip so
that they would stop in to see your community and also spend a few
dollars . We are going to try to get this souvenir booklet out by
October 1 , 1979 , so that the people planning this trip from various
parts of the country can see the beauty of our State , and not only
the baseball tournament .
Some of the events that we have scheduled besides baseball are a
wall-eye pike banquet at which the main speaker will be Bob Feller .
We are having a dance with the Florian Chmielewski Orchestra , and
also a community Bar-B-Q, put on by master chef Duke Skorich . Br-Lice
Jenner will also be a guest at the Tournameii , along with many other
VIP ' s .
If you intend to participate , please send your check for $100 payable
to the 1980 Tournament Committee to the above address along with any
pictures and your ad. Deadline for ads is AugusL 1 , 1979 .
Mr . Mayor, if you like to attend any of the other functions , such as
the banquet , please let us know so that we may reserve some tickets
for you. We intend to have a special section just for the Mayors of
Minnesota.

SUBJECT: Donald R. Gilbert CondiionalUse Permit Application
DATE : June 1 , 1979
Request : The applicant , Donald R. Gilbert , requests a Conditional
Use Permit to allow the construction of a 6 ' privacy fence across
the front and on the west side of his property.
Location: The property is located on tract "F" of registered land
survey 24 , in Sec . 12 , Twp 115 , R 22 , an R-1 lot . It is on 13th Ave .
East , south of Hwy. 101 , and east of CR #89 .
Analysis : Mr. Gilbert proposes to construct a 6 ' fence across the
front of his property . From there it would run down the west side
of the lot for 50' .
The fence is requested by Mr. Gilbert to provide relief from
"heavy traffic , dust , and noise . "
The property is a corner lot . The road beside the property to
the west is a private road.
City code restricts fences in the front yard to 3 ft . in height .
This may be exceeded by granting a Conditional Use Permit .
City code further prohibits fences of over 22 ft . in height on
corner lots , or there construction within 30 ft. of the intersecting
right of way lines .
Staff Recommendation: Staff recommends against the Conditional Use
Permit request . It would not be advisable to construct a 6 ft . fence
on a corner lot . Although, the road to the west is private, it is
still a travelled road providing access to residential land. By con-
struction of a 6' fence , visibility in and out of the road would be
cut and a dangerous situation created.
The fence could be constructed if it were situated 30 ft . off the
corner. A Conditional Use Permit would still be required to exceed the
22 ft . limit .

RE : Topic/Claude Lenzmeier Zoning Change Request
DATE : June 4 , 1979
Request : The applicant , Joseph Topic , requests a zoning change
from R_-2 Urban Residential and B-1 Thoroughfare Business District
to R-3B Multiple Family Residential District.
Location: The area under consideration is a 9 .58 acre tract lying
north of Trunk Highway 300, east of the West Schneider property
and south of T. H. 169 , legal description of record .
The area is northeast of the Minnesota Valley Mall . To the south
and east is residential to the northeast business .
Analysis : Mr. Topic requests a zoning change for the property in
question from the present R-2 Urban Residential and B-1 Business
Districts to an R-3B Multiple Family Residential District .
The land survey of the area is in question and would have to be
clarified before a rezoning could take place to ensure that the
boundaries of the rezoning are correct .
The area is situated with part of Mr. Lenzmeier' s property on a
plateau and part falling away into a slope towards Hiway 169 .
Flat land extends from STH 300 and Harrison northwest for 200 feet ,
after that it quickly drops off for an additional 100' .
When our consultants developed the new zoning maps for Shakopee ,
this area of flat land was designated with the new classification
R-4. This would allow multi-family development and is in agreement
with the request by the applicant . The request for rezoning, however ,
includes a further 100 feet northwest which includes the slope .
This slope area would be unacceptable for development . If developed
as rear yard, it may create unusable , and hazardous space for the
eventual homeowner. Subdivision design would require careful
consideration of the problems of slope in developing this area .
Recommendations : Staff recommends approval of the rezoning with
the requirement that the entire area be platted at one time .
This would help to prevent problems with the development of the area .

Request : The applicant , Bernard J. Broos , requests a Conditional Use
Permit to move a 20' x 20' garage from 724 E . Fourth Ave . , Shakopee ,
to the applicant ' s home address at 403 E. Second Ave.
Location: The garage presently at 724 E. Fourth Ave . will be moved
to 403 E. Second Ave . a lot presently zoned B-5 .
Analysis : Mr. Broos proposes to upgrade his property by tearing down
an existing garage and replacing it with a much more attractive struc-
ture . The newer structure would also provide Mr. Broos with two park-
ing spaces for his automobiles , space his present structure does not
provide .
Staff Recommendation: Staff recommends approval of the Conditional
Use Permit request .

.Koehaen/Colligan moved to open Public Hearing on Hall ' s 1st Addition --
Preliminary and Final Plat . Motion carried.
City Admin. explained the proposal plat to the Commission.
A variance for a moritorium is needed before the Plan can be approved .
Don Woodward was present representing the proposal and to answer questions
from the Commission.
Marie Klavestad was present in the audience concerned with the type of
equipment which would be used and where the equipment would be run.
Doug , also representing the proposal stated all equipment
would come directly off Highway 101 .
, owner of the Stagecoach was present in the
audience and questioned the type of business this would be .
This is a sales type of building. No manufacturing is involved.
Discussion was held on the driveway. It appeared to Chairman Schmitt
that there was a common driveway to both parcels . The plat reads
"existing driveway for common use" .
City Admin. explained that the builders have no desire to build a
road at that point .
Chairman Schmitt asked for questions from the Commission.
Discussion followed on the driveway.
This is unsewered property.
This property is currently zoned Highway Commercial .
Questions on the drainage proposal were raised. Discussion held .
Chairman Schmitt asked for comments from the audience . There were none .
Colligan/Rockne moved to close the Public Hearing. Motion carried.
Chairman Schmitt asked for comments or recommendations from Staff.
Staff recommendations were :
1 . ) The name be changed to Hall ' s 1st Addn . , deleting the first two
initials .

Subject: Proposal to Study Fire Flows to
the Central Business Area, the
Area Between Marschall Road,
Main Street, Fourth Avenue and
Shakopee Avenue and the Area
Between Trunk Highway 169 ,
10th Avenue and Clay Street.
Dear Mr. Van Hout:
As requested, we herein submit our proposal for the above
mentioned studies. Please note that the study area between
Trunk Highway 169, 10th Avenue and Clay Street was verbally
requested by Mr. Bo Spurrier. This area is included with the
two study areas requested in your letter dated May 11, 1979,
because all three studies are closely related.
Our proposal is to furnish an individual study for each
of the three areas. It is obvious that there will be a certain ,
amount of overlap involved in preparing the three studies.
Therefore, our fees for the above mentioned studies would vary
as to which studies were authorized.
The scope of each study and our fee proposal is as follows:
DOWNTOWN FIRE FLOW ANALYSIS
We would recommend the two alternative approaches as outlined
in your letter of May 11, 1979, be used to determine the most
feasible means of providing adequate fire flows to the Central
Business Area. They are:
1. A major loop of watermain through the downtown area, and
2. Connecting a nrznber of mein* using the existing
grid system.

There exists the possibility that more than one combination
of north-south ties will achieve the desired goal. Each combi-
nation would be presented along with the advantages and dis-
advantages of each.
We would also provide cost data, in such a form, that the
proposed improvements for each study approach could be utilized,
for example, in the development of a five-year Improvement Program.
Our proposal for furnishing the study as previously outlined
is $5,000. 00.
MARSCHALL ROAD, MAIN STREET, FOURTH AVENUE
AND SHAKOPEE AVENUE AREA
We would recommend that this area be considered in conjunction
with the Downtown Fire Flow Analysis study because certain pro-
posed improvements in that study would benefit this area. However,
this area could be studied independently but the results of which
may not satisfy other long range goals.
The study for this area would include proposed improvements
and cost data for the study area and would specifically address
itself to any impending development within the described boundaries.
We would furnish this study for $1,500.00 and, if authorized in
conjunction with the study for the Downtown Fire Flow Analysis,
our fee would be reduced to $1,000. 00.
CLAY STREET, TRUNK HIGHWAY 169 AND TENTH AVENUE AREA
As stated previously, this area has been requested by Bo
Spurrier to be studied in response to a proposed development. We
would propose to study the adequacy of the existing water system
and make recommendations for improvements so that adequate fire
flows can be obtained after this area is completely developed.
A study of this area would also best be done in conjunction with
the Downtown Fire Flow Analysis. But if an immediate response
is required in this circumstance, an independent study is possible.
The recommendations of an independent study may not conform to the
solutions that would be presented in the larger study.
We would propose to furnish the independent study of this
area at a cost of $1, 500.00. Our fee would be reduced to $1,000. 00
if this study were authorized in conjunction with the Downtown
Fire Flow Analysis.

would be glad to discuss this matter with you after you have had
time to digest the information contained herein.

The Council did previously hold public hearings on the vacation
of land around the proposed Furrie 2nd plat . The action on the
vacation was tabled until the plat was ready for approval .
The plat is now ready for final approval , but it has been
six months since the hearings were held. It is necessary to have
another public hearing.
Action: Adopt Resolution #1439 Setting Public Hearing on
vacation of :
1) Part of Shawmut - 2nd to 4th
2) Alleys in Blocks 34 and 35, East Shakopee Plat
(East of Shawmut)

MEMO TO: Mayor and City Council

RE: Stop Signs on Sixth Avenue
DATE: June 11 , 1979
The City Council ordered the erection of two stop signs on
Sixth Avenue to slow down traffic . We have installed only
the stop sign at Apgar because we found Clay Street to be
an off-set intersection and a poor place for a four-way
stop.
In the meantime, we have received the attached letter from
Scott County indicating that Sixth Street is a County-State
Aid Highway and therefore, need approval of the County Board
before any stop sign can be erected .
It appears that the Council , at this point, will have to
order the removal of the stop sign at Apgar and request Scott
County to authorize the installation of stop signs . If two
stop signs are needed, I would suggest that Adams and Apgar
are the more appropriate places since these are both County
Roads coming into town.

Dear Sir:
The City of Shakopee recently installed stop signs at the intersection
of CSAH 16 (6th Ave. ) and CR 77 (Apgar Street) making this intersection
an All-Way Stop. Because stop signs are regulatory signs, they can
only be installed after the local authority having jurisdiction has
approved and directed such installation.
Stop signs cause a substantial inconvenience to motorists and therefore
they should be used only where warranted. Also, the installation of
unwarranted traffic signs , of any kind, leads to driver disregard of
such signs and also disrespect for other traffic signs . Therefore ,
before any traffic sign is installed, a determination if the traffic
sign is warranted and other possible alternatives is conducted.
Inasmuch as Sixth Avenue is County State Aid Highway 16 and therefore
under the jurisdiction of Scott, all regulatory signs must be approved
and direction for installation given by the Scott County Board of
Commissioners . Inasmuch as Apgar is also a County Road (77) from
6th Avenue South and has priority over intersecting traffic from
TH 169 to 10th Avenue , except for 6th Avenue, we can accept the 4-Way
Stop at this intersection, if the City of Shakopee believes it to be
justified. Stop signs at any other intersection between Fuller and
Webster Streets cannot be justified.
Also, consideration should be given to change the current yield signs
installed approaching CSAH 16 (6th Avenue) to Stop signs as there
appears to be some non conformance to the actual traffic control
message of the Yield sign. If you would like us to proceed with this
replacement project, please inform this office with a written request.

Subject: Traffic Survey on West 6th Avenue
On 06-07-79 at approximately 2420 hrs . , Officer
Lawrence and I set up radar on West 6th Avenue approxi-
mately one half block east of Clay Street monitoring
traffic both east and westbound from the Reformatory
to Clay Street. Officer Lawrence and I monitored the
traffic for approximately 45 minutes .
During this period of time, we clocked 23 vehicles
exceeding the speed limit. The breakdown is as follows :
31 MPH 7 vehicles
32 MPH 2 vehicles
33 MPH 4 vehicles
34 MPH 1 vehicle
35 MPH 3 vehicles
36 MPH 1 vehicle
37 MPH 2 vehicles
42 MPH 1 vehicle
46 MPH 1 vehicle
Citations were issued to the two vehicles operatinq
over 40 MPH.

Dear Mr. Reeder: CITY OF SI AKOPEE
At this time, the Shakopee Chamber of Commerce requests that
the City of Shakopee consider renting to the Chamber space in City Hall
for purposes of establishing permanent Chamber Offices.
It is our understanding that the old City Council Chambers is
now vacant; this space would be most suitable for our purposes.
Commencing in July, 1979, the Chamber intends to undertake a
program of developing permanent staffing for Chamber activities. This
Will require separate offices which the Chamber would like to obtain for
nominal charge. In this way, a maximum percentage of our dues can be
used to develop programs and to hire staff which will directly benefit
the business climate of our City.
I would ask that the space mentioned above be rented to the
Chamber for an indefinite term at the rate of $1.00 per year beginnin
July 1, 1979, with the understanding that the Chamber pay its g
pro
share of the costs of utilities for the building, together with all of
its telephone charges. Such a contribution by the City would be rata
assistance to the Chamber in its efforts to increase its contributionrtot
the progress of our community.

The City of Shakopee is in ownership of a 0. 25 acre tract of
land East of Kaufman and Broad just off the existing frontage road.
The City has been leasing this property to Mobil Oil Corporation
since 1951 for the storage of ,bulk -oil .
We are currently under a five year Lease with them and receive
$750.00 per year.
Mr. Earl Dressen, on their behalf , has asked that the City
consider selling said property to them.
It is staff recommendation that the City sell said property
for $7 ,500.00.

SUBJECT: Mileage Allowance
DATE: June 6 , 1979
Due to the rapidly increasing cost of operating automobiles , I
am suggesting an increase in the mileage allowance for employees .
The allowance was last adjusted about three years ago, and costs ,
especially fuel and insurance have increased significantly.
According to data compiled for AAA, the average cost for driving
a Malibu-sized car with standard features for 1979 is 18. 13¢/mile .
Since the data was compiled, gasoline costs have gone up about
20¢ a gallon which would add 1 .5¢ to the per mile figure. Also,
gas prices are undoubtedly going to increase further yet this
month.
Therefore , I recommend the Council consider this item and that the
mileage allowance be set at 20¢/mile . 'The current rate is 150/mile .

RE: Robert Wolf Amendment to Zoning Regulations
DATE: June 15 , 1979
The applicant, Robert Wolf , requests an amendment to the
Shakopee City Code to allow ,as a Conditional Use ,a tool and
die model making shop in a B-5 (General Business District) .
This is an area presently bein considered for rezoning to
B-1 (Highway Business District under the new Shakopee
Comprehensive Plan. The Comprehensive Plan designated
1st Avenue as a B-1 (Highway Business District) in order to
take advantage of the unique opportunity to commercial
businesses afforded by Highway frontage .
A tool and die model making shop would not be compatible
with the future development plans for the area. The new
Comprehensive Plan has set aside a large part of Shakopee
for Industrial Land Uses , and an enterprise such as this
would be better suited to those areas .
For these reasons I would recommend against approval of
the amendment request .

Pursuant to goals I established for 1979, I have completed design
criteria for roadway and utility construction. The design criteria
establishes minimum requirements for the design of facilities irk public
right-of-way.
The attachments alter criteria for roadways , sanitary sewer and
watermains that have been used by the City. If adopted, there will
also have to be revisions made to City Code.
Since the proposed criteria will have the impact of altering City
Code , I recommend that copies of the proposed criteria be distributed
to Council. At the first meeting in July, Council could discuss the
criteria .
I would hope that the criteria could be adopted by late July since
1980 planning is in progress and this criteria should cover that construction.

Drawing Submittal Procedure
Consulting engineers and developers seeking approval of civil engineering
design and construction drawings are requested to follow the procedures
outlined below.
I . Submit two legible prints (either blueline or blackline) of each sheet
to the City of Shakopee Engineering Department for review.
2 . The time for review will be a minimum of fifteen (15) working days .
When the set of plans submitted for review contains more than five
sheets or more than one set of plans from the same consulting
engineering firm or developer is in the Engineering Department for
review at the same time , the time for review may be extended beyond
fifteen (15) working days .
3 . The check print and routing sheet will be returned with any comments
and necessary corrections noted .
4 . The consulting engineering firm will make all the changes requested on
its original drawing; and it will then submit a mylar sepia of its
corrected original along with the original check print and routing
sheet to the City Engineer for approval .
5 . The check print and routing sheet must accompany the mylar sepia . If
it does not , the mylar sepia will be treated as a print being submitted
for review.
6 . The time for approvals will normally be ten (10) days . This time may
also be extended under conditions outlined in item 2 .
7 . Three prints of the approved mylar will be returned by mail to the
consulting engineering firm or developer submitting plans for review.

GENERAL PLAN APPROVAL REQUIREMENTS
AND DRAFTING STANDARDS
1 . Vicinity Map Scale 1" = 2000 ' showing the location and names of major
streets all within one mile of proposed subdivision, all streets
in the proposed project , all proposed or non-existing future
streets and all other streets in the vicinity of the proposed
project . The project area shall be indicated by shading.

preferably on one standard size sheet) .

under the standards for the particular improvement proposed .

ROADWAY DESIGN CRITERIA
1 . Additional Approval Requirements and Drafting Standards The
requirements of this article are supplementary to the General
Plan Approval Requirements and Drafting Standards .
A . Plan Locate handicap ramps , elevations of curb returns ,
curb return radius station of drainage appurtenances ,
directional arrows , PC and PT elevations at all horizontal
curves for drainage , curve data , centerline station of all
cross streets and intersection offsets .
B. Profile Centerline stationing continuous for length of
street, verticle curves , top of curb elevation on MN/DOT
Standard V618, flow line elevation on MN/DOT Standard D418.
C. Vertical Curves VPI, VPC , and VPT elevations , elevation
and station of high or low point (not the middle ordinate) ,
length, K (see notes on Table 2 - Design Speed) .
D. Typical Detail ROW width, street width (face of curb to
face of curb) , street names and station limits , curb type ,
sidewalk, profile grade point, cross slopes on streets ,
sidewalk and boulevard.
2 . Curb , Gutter and Sidewalk Curb, gutter and sidewalk shall be
provided in all residential areas where the density is more
than six (6) dwelling units per acre*; in all commercial areas ;
in industrial areas where required.
* Sidewalk, where required above shall be on the north and
east side of the street.
MN/DOT V618, vertical curb and gutter shall be used for all
collector or arterial streets . Residential streets may use
MN/DOT B418 in accordance with this criteria.
Minimum curb return radius shall be as shown in Table 1.
Minimum fall around curb returns shall be 0.30 feet.
All curb returns and all "T" intersections where sidewalk is
required shall have Handicap ramps .
Storm water from downspouts or a concentration of storm water
from the site shall not be allowed to flow over sidewalks or
driveways but shall drain to the streets by the use of chase
sections .
The top of curb elevation shall be the same on both sides of a
street . Except at intersections or where super elevation is
required . Differences in elevation of more than 0. 20' will
not be allowed.
Drainage Drainage systems shall be in accordance with City of
Shakopee drainage design requirements. Drainage plans must be
approved before final approval of street plans . Drainage shall
not be the major function of a street. The minimum pipe in
street R.O.W. shall be 18" Class III R.C.P.
Crosspans The use of double crosspans shall not be encouraged.
Double crosspans may be used on collector or arterial streets
to convey storm runoff across residential streets . Double cross-
pans may be used at the intersection of residential streets
only when absolutely necessary to prevent flooding of one side
of the street. Cross.pans are not allowed across collector or
arterial streets . Crosspans are not allowed on streets with
storm sewer systems or on other streets designated by the City
Engineer.
Inlets Inlets shall be located to intercept the major curb-flow.
Due to the presence of handicap ramps , inlets are not allowed in
the curb returns. All inlets in streets shall be the curb
opening type without grates in accordance with the latest City
Spec if ica t ions.
Cross Slope Normal cross slope or crown shall be 2% as measured ,
from centerline to lip of curb or lip of median curb to lip of

outside curb on streets with raised center islands . Parabolic
or curved crowns shall not be allowed.
Horizontal Alignment All streets shall intersect at right angles.
The minimum allowable intersection turning radius for any street
shall be 50 feet.
Horizontal alignment design speed shall be consistent with the
requirements for vertical alignment design speed.
Super-elevation shall be as recommended by MN/DOT and approved
by the City Engineer. The rate of super-elevation shall be
clearly shown on the drawings along with exaggerated (I" - 101

1" - 1 'V) profiles of the centerline and both top of curbs .
The super-elevation runout length, crown runout length and
point at which full super-elevation is reached shall be clearly
shown. Super-elevation shall be required for curves on all
arterial streets and selected collector streets . Super-elevation
shall not be used on local service streets .
Drainage water shall not be allowed to cross the pavement when
the crown slope is reversed for transitions into or out: of
super-elevation.
Vertical Alignment The minimum allowable grade for any, street
shall be 0. 5%, the maximum allowable grade for any street shall
be as shown in Table 2. The minimum grade for alleys shall be
0. 5%, the maximum grade shall be subject to the approval of the
City Engineer. All vertical curves shall be labeled with length,
sight distance , design speed as listed by MN/DOT and K(K=L/A) .
Continuous changing of grades that create a roller coaster effect
shall not be permitted. Connection with existing streets shall
be smooth transitions and existing grades shall be shown for at
least 300' on each side of the intersection. The grade and
ground lines of all streets that dead end, except cul-de-sacs ,
shall be continued for 500 feet or to its intersection with
an arterial street. The grade and ground lines for arterial
streets shall be continued 1000' beyond their ends .
Design controls for vertical alignment shall be as shown in
Table 2 . The grades at intersecting arterials shall not be
greater than 2% for 200' on either side of the intersection.
On all other streets , the grade shall not be greater than 3%.
The more important street at an intersection shall govern the
through grade.
Grade breaks will be allowed if the algebraic difference in
grade is less than 0. 8%
Pavement Design Pavement design shall be in accordance with the
Flexible Pavement Design Section of this specification. It shall
be accompanied by a complete soils report signed and stamped by
a Registered Professional Engineer competent in the field of
Geotechnical Engineering.
Handicap Ramps Handicap ramps shall be installed at all. inter-
sections and at certain mid-block locations for all new
construction or re-construction of curb and sidewalk. Handicap
ramps shall be shown at all curb returns and at all. "T" inter-
sections .

4 . When street lights are to be installed and operating within
3 months after the street is opened to traffic , the minimum K
for sag vertical curves may be reduced to 75 for arterials and
55 for collectors . The designer shall submit evidence suitable
to the City Engineer that the street lights will be installed
and receive specific approval before taking such reduction in K.

Street Specifications : Table 3 - Street Construction Requirements
is a summary of minimum street construction requirements contained
in Section 12 . 06 , Subd. 1.
Sidewalk shall be constructed on the north and east side of all
streets unless specifically deleted by action of City Council.

FLEXIBLE PAVEMENT DESIGN
The procedure set forth herein may be used -in lieu of
design procedures set forth in the "Road Design Manual" 5-
291. 523 and 5 .291. 524, prepared by the Minnesota Department
of Transportation.
Soils Report
Flexible pavement design shall be based on a soils report signed
by a Registered Professional Engineer competent in the field of
Geotechnical Engineering. No paving shall be done until, said
report is approved by the City Engineer.
Minimum Information Required
• Map with location and depth of test holes
• Ground water elevations , if encountered
Drill logs
Grading analysis curves
Atterberg limits
AASHTO soil classification
• Moisture-density curves
• Location or limits of different soil type on a map
In addition, the Geotechnical Engineer shall investigate and
recommend solutions to problems of:
1. Expansion of cohesive soils
2 . Frost heave in silty soils
3 . Potential ground water problems
4. Any other matter that may adversely affect the design
and life of the pavement '
Soil samples shall be taken at the proposed subgrade elevation
and shall represent the soil of the subgrade. All borings shall
be for a minimum of 4 feet. If more than one soil type is
encountered in the boxing, they shall be logged and tested
separately. The pavement shall be designed for the worst soil
encountered from the standpoint of subgrade support.

Subgrade shall be sampled in accordance with the frequency
guidelines in Table 4, Subgrade Sampling Frequency Guidelines .

in areal extent to economically justify a change in pavement
design. Where there is more than one major soil texture , the
minimum number of samples that results in the largest number of
samples shall be used.

clay, clay loams . This means that a sufficient number of gradation

Hveem Stabilometer R-Value
The R-value of the subgrade material is determined by the Hveem
Stabilometer laboratory method. This stabilometer R-value is a
measure of subgrade soil resistance strength expressed on a
scale from 1 to 100.
Stabilometer R-Value by Soil Type
The R-value of subgrade material is an assumed value , based on
the AASHTO soil type and geologic origin of the soil. The
assumed values shall be in accordance with the values listed
in Table S , Stabilometer R-values by Soil Type. Assumed values
may be used if approved by the City Engineer.

NOTE: In using the above assumed R-values for bituminous pavement
design it is essential that the subgrade be constructed of
uniform soil at a moisture content and density in accordance
with MN/DOT Spec . 2105 and be capable of passing test rolling,
MN/DOT Spec . 2111 . To minimize frost heaving and thaw weakening
it is also essential that finished grade elevation be placed an
adequate distance above the water table . This distance should
be at least equal to the depth of frost penetration. In the case
of silty soils the distance should be significantly greater.

R-Value by California Bearing Ratio
The California Bearing Ratio (CBR) is determined in accordance
with the procedures detailed herein. The R-value is determined
by using Figure 1 , Approximate Interrelationships of Soil
Classifications and Bearing Values .
CBR Test
CBR tests shall be performed according to ASTM D1883 modified
as follows . The CBR value reported shall be based on 3 specimens
compacted so that their compacted densities range from below 95%
to near 100% of the maximum dry density per AASHTO T193 procedures .
Samples shall be soaked a minimum of 96 hours prior to performing
the penetration test. Calculations shall be performed per AASHTO
T193, Section 8. Compaction method shall be as specified in
Subgrade Support below.
The following data shall be reported for each CBR specimen
tested.
• Method used for preparation and compaction of the specimen
• Dry density before and after soaking
• Moisture content of sample before compaction, after
compaction, top 1-inch layer after soaking and average
after soaking
• Percentage of swell
• Surcharge weight
• Stress-strain curves
• Piston seating pressure for each sample, show on stress-
strain curves
• A table showing all penetration/load readings for each
sample
Maximum load and penetration if it occurs at less than 0.500
in penetration
• Soaked CBR/Dry Density as molded curve
Composite Soil Samples
Composite soil samples may be used for determining CBR for R-values .
When composite samples are used, individual soil samples shall be
taken at a minimum interval of 250 feet. Soil samples shall not
be combined unless the sieve analysis , Atterberg Limits and group
index indicate that the characteristics of the individual soils
are similar enough to allow grouping. ' Soils in different AASHTO
soils classifications shall not be used to form a composite sample.
Soils that are combined for determining the CBR for R-value
shall be identified. The composite sample shall represent
the typically worst soil expected to be encountered in the
paving area .
Unit Wets
The following unit weights shall be used in calculating the
surcharge weight for the CBR test .
Asphalt 140 1bf/ft3
Base Gravel 133 lbf/ft3
The surcharge weight used shall be not more than 2 . 5 lbs .
greater than the weight of the final base and pavement over-
lying the tested material.
Subgrade Support
CBR for R-values may be used to determine the soil support value
to be assigned to the subgrade for use in pavement design. The
CBR for R-values used shall be at 95% of the maximum dry density
for the soil compacted as specified below.

The "design traffic number" (DTN) is the estimated average daily
number of equivalent 18,000 lb. , single axle-load applications
for the design lane during the design period. The design period
is 20 years , Minimum DTN's are listed in the table below. The
City Engineer may increase the DTN on any street if in his
opinion traffic conditions warrant it.

Pavement Design Report
The report shall include the following minimum information.
Design monograph showing the line connecting DTN-SN
Map showing location of each different pavement section
and showing soil type
• Design calculations for each pavement section
Discussion of any unusual design or construction
problems or requirements
Construction
All work shall conform to City of Shakopee Standards and
Spec if ica t ions .
Prior to placing any layer of the pavement section upon the subgrade
or any previously placed layer of the pavement section, compaction
tests shall be taken and approved by the City Engineer. The tests
shall be certified and signed by the Geotechnical Engineer.
Testing shall include but not be limited to:
1. Trenches for water, sanitary, storm, telephone, gas ,
electric.
2 . Around manholes , valve boxes , inlets
Field compaction of the subbase shall be as specified in Sub rade
Support above. If the specified compaction cannot be obtained,
the R-value shall be adjusted accordingly and a new pavement
section shall be determined.
Compaction tests shall be taken within 24 hours prior to placing
the next layer in the pavement section.
The Geotechnical Engineer shall take sufficient compaction tests
to assure himself that the street is ready for gravel or paving
as the case may be and shall so certify on his compaction report.

WATERMAIN DESIGN CRITERIA
I . Additional Approval Requirements and Drafting Standards
A. Vicinity Map Each sheet shall have an overall drawing of the
development (when required) at a scale no larger than 1"=1000'
showing the location of public water mains on that sheet in
relation to the total development .
B. Overall Plan The overall plan of the study area shall have
the following information:
* Location of City or USGS Bench Marks . All bench mark
elevations shall be USGS 1929 vatum
* Property lines and easement lines
Streets and street names
* Existing water facilities including size, type and location
Proposed piping, including any appurtenances, plainly labeled
* A master water plan shall be submitted for each planned
development or other major development prior to approval of
any portion of the water system
C . Profile Profile shall be required for water mains larger than
12 inches . The profile shall show the elevation and location
of other utility lines where crossed .
D. Plan The following additional elements shall be shown on
watermain plans :
* Pipes with size , type and structural class of pipe,
including ASTM or AWWA specification designation.
* Special structures or details as required .
* Bedding Requirements .
2 . General
:'.11 watermain plans shall be checked for conformance with the
minimum design criteria specified herein prior to approval for
construction. No watermain construction shall commence unless
the contractor has in his possession an approved set of plans.
3 . Design Criteria
All additions to the City of Shakopee Water System shall be
designed in accordance with the criteria set forth in this and
other sections of these Specifications as approved by the City
Engineer and the Utilities Manager. Ductile iron pipe shall be
used exclusively unless special approval of alternate materials
is give,_ by the Citv 7ngineer sn-� '.°v tUtilit-,- - Manager.
A . Main Size The water distribution system shall be designed to
meet the maximum hourly water demand (9gpm per acre) plus
the fire flow demand as determined by ISO Criteria . During
peak demand and fire demand , the water pressure shall not be
less than 20 p . s . i." at any point in the water distribution
system. The velocity of the water in the water system shall
not exceed 12 feet per second. Design parameters and the
critical conditions shall be shown on an overall plan of the
study area . Under a separate cover, the conditions shall be
shown which isolated the critical condition. A complete
analysis shall be submitted for any fire demand in excess of
1 ,200 g.p .m.
The minimum diameter for water mains in residential areas
shall be 6 inches . Schools , shopping centers and high
density residential areas shall be looped with at least 8
inch diameter lines . Twelve inch diameter feeder mains
shall be spaced a maximum distance of 3 ,000 feet apart and
looped to provide water from more than one source. Four
inch water lines may extend into cul-de-sacs , serving not
more than four residential units . No fire hydrant shall be
supplied by a line less than 6 inches in diameter.
B. Alignment and Depth Water mains shall be placed ten (10) feet
south or west of street centerlines . Where a car may be
parked beside a water valve , the maximum distance the valve
may be from the centerline of the street is five (5) feet.
On streets over 40 feet in width, water line valves shall be
located at least 15 feet from the flow line. A minimum cover
of seven and one-half (7k) feet below final grade shall be
maintained over all water mains . When water pipes cross sewer
lines , the water line must be laid above sewer line with 18
inches vertical separation minimum. Water pipe shall be laid
at an elevation of at least 18 inches above that of nearby
sewers or sewer lines with all water pipe joints no closer than
ten (10) feet horizontal from the sewer pipe centerline . When
the above is not possible, extra durable and corrosion resistant
sewer pipe shall be used. Valves shall be located on the
extension of R.O1.W. lines where possible.
C. Valves
1. Water main valves shall be installed in the distribution
system to isolate sections of water main in the event of
water main failure. The length of section to be isolated
shall be in accordance with the following table:

Additional valves shall be installed at such places designated
by the City Engineer and the Utilities Manager. The locations
may be at the termini of new extensions or in locations to
facilitate testing.
Butterfly valves shall be installed in watermains 16 inches and
larger. The valves shall be in a vault.
Air and vacuum relief valves shall be installed at the high points
of any watermain 16 inch and larger. The valves shall be in vaults .
Blowoff valves shall be installed at the low point of any watermain
16 inch and larger. The valves shall be in vaults . Smaller
temporary or permanent blowoff valves or fire hydrants shall be
required at the end of any other dead-end main where required by
the City Engineer and the Utilities Manager.
D. Fire Hydrants Normally, fire hydrants shall be placed so that two
(2) fire hydrants shall be within 500 feet of every structure as
measured along public right-of-way. Closer fire hydrant placement
shall be required when the fire flow requirements , as determined by
ISO criteria , exceed 2 ,000 gallons per minute or if additional fire
hydrants are required in order to meet the requirements of the
following table:

E. Arrangement of Distribution System The City of Shakopee has
gridiron water system. It is imperative that any extension
perpetuate that concept. The basic system requires the completion
of watermain loops and the design of a gridiron system that has a
north-south and east-west 6 inch watermain every 800 feet or any
combination of watermains which has at least the equivalent water
carrying capacity in any direction.
In addition to the requirements of the gridiron system, watermains
shall be looped. Temporary dead-end watermains shall not be
permitted unless approved by the City Engineer and the Utilities
Manager.

Table 1 - Design Flow Parameters , with Table 2 - Peak Flow Factors ,
and with Table 3 - .Minimum Permissible Grade . Sanitary Sewer design
must account for the study area and all areas outside the study area
which would naturally drain through the study area , Natural drainage
areas will be established by using the Comprehensive Sewer Plan and
Comprehensive Drainage Plan adopted by the City. In no case shall
the design velocity be less than 2 .2 feet per second. nor more than
10 .0 feet per second as computed by Mannings formula for flow in open
channels . Manning "n" shall be 0.013 for purposes, of design.

4. Manholes
Manholes shall accommodate hydraulic expansion and contraction losses
by providing in addition to design slope a drop of 0. 20 feet on runs
and a drop of 0. 30 feet on branches or bends .
5 . Lift Stations
The use of public sewage lift stations shall not be permitted where
gravity service may be available . Any area which is not proposed
for gravity service may install a public lift station. The lift
station shall be a three (3) pump system with an auxiliary power
system. Private lift stations may be installed if approved by the
City .
6 . Overall Plan
An overall plan of the study area, including all areas outside of
the study area which would naturally drain through the study area shall
be submitted. The overall plan shall have the following information:
A. Location and elevation of City or USGS Bench Marks . All bench
mark elevations shall be USGS Datum.
B . Property lines.
C. Streets and street names .
D. Existing sanitary sewer facilities including size, slope, location
and hydraulic capacity . All pertinent information regarding which
trunk lines will ultimately receive the wastewater collected by
this system.
E. Proposed piping including manholes and appurtenances plainly labeled.
F. Proposed outfall point (or points) for wastewater from the study area .
G . Estimated average quantity of wastewater generated outside of
study area . The City Zoning map shall be the basis for determining
the character of undeveloped land outside the study area .
H. Proposed easements for areas outside the study area which would
naturally drain through t'-e s'ludy area
I . Proposed minimum, maximum and average design flows at all
junction manholes . (Manholes where branches have peak flows
in excess of 3 CFS) .
J . All sanitary sewer systems shall be designed in accordance with
the criteria established by the Metropolitan Waste Control
Commission and the Minnesota Polution Control Agency.
* There shall be no vertical or horizontal curves in sanitary
sewers .
* The design flow shall not exceed 10 feet per second using
Mannings Formula and Mannings "n" equal to 0.013 .

In as much as I have submitted my resignation as Shakopee
Civil Defense Coordinator to Mr. Doug Reeder on May 4th, 1979
and in as much as Mr. Reeder has refused to accept this resignation
I now feel it is my obligation to inform you that I am resigning
this position effective June 1 , 1979 .
In my original letter to Mr. Reeder I felt that it would be
possible to continue until a replacement was located. However,
in view of Mr . Reeder reluctance and somewhat mistaken reply,
I am recinding this offer and allowing two weeks to locate a
replacement .
I am also enclosing a copy of my original letter of resignation
and Mr . Reeder ' s reply. The office of Civil Defense has not been
incorporated into the realm of the Police Department , therefore ,
I do not feel that the position of Civil Defense Coordinator can
be an assigned position . Furthermore , when appointed to that position,
it was voted upon by the Council .
I am deeply sorry that I must take action of this nature , but
I feel that it is the only way that you will know my feelings .
I want to thank each of you personally for the faith that you held
for me in appointing me in the first place and hope that something can

This is to inform you of my decision to resign my
position as Civil Defense Coordinator for the City of
Shakopee, effective immediately.
I have pondered over, this decision for some time and
have come to the conclusion that it would be a disservice
to the citizens of Shakopee for me to continue . The position
requires more time alloted to performing the necessary duties
than I can adequately give . My position as a Patrolman for
the Shakopee Police Department requires that I work mostly
night shifts with court time and other duties required of
my off duty hours . The needed hours for performing Civil
Defense duties also comes mostly from my oi'f duty hours which
detracts from the time I can spend with my family.
I wish to thank you and the City Council for the display
of-faith and trust in me in appointing me to the position last
fall and will make myself' available until a replacement can
be found.

The Cit has an offer to lease the upstairs of City Hall
(large room for the purpose of a retail stamp/coin outlet
(see attached letter) . In addition to the information in the
letter, I have determined that the question of door security
to the rear offices can be satisfactorily resolved with a
simple dead bolt ; paint, possible carpet and possible parti-
tioning will be done at the expense of the leasee ; the City
would be expected to replace broken glass pane in the sky-
light and repair possible leak in skylight ; leasee may deem
it necessary to bar the skylight for security at his expense .
I have been informed that the sign referenced in the letter
is approximately 3 ' high x 18" wide and would need electrical
work to provide power to it .
The leasee proposed to pay $200 per month for three (3)
years . The City has a listing agreement with Eberhart to
base at $3 .00 per square foot per year, utilities included.
This agreement was a renewal of a previous one and the price
was not updated at renewal . Based on cost estimates prepared
by staff last summer, rental should be in the range of
$3 . 60 - $3 . 65 per square foot. Monthly rental in accordance
with the agreement is $225 . per month.
Therefore, since the leasee proposes to base for $200
per month, and do some improvements and the space has been
vacant for some time and the other details can be worked out,
it appears to be a valid offer and I recommend Council author-
ize staff to proceed with a lease agreement. The one item I
would suggest changing is reducing the no escalating clause
from three (3) to two (2) years as a counter offer.

maintain, promote, conduct, advertise , act as entrepreneur, undertake, organize, manage,
or sell or give tickets to an exhibition or show of any nature which exhibition or show
is planned to continut, six or more couaecutive hours, and can reasonably be anticipated
to cause an assembly of 1 ,000 or more people, without first obtaining from the County of
Freeborn, a license to continue, said license to be subject to the following terms and
conditions, to-wit:
1 . Application for the license must be made at least thirty days in advance of the
commencement of the show or exhibition. The application must be accompanied by
certified copies of all other necessary Minnesota State licenses or permits to
support the application. When a license is granted to one person, any other person
is entitled to engage in any lawful activity in connection with the holding of the
licensed show or exhibition.
2. The applicant must determine the maximum number of people which will be assembled
or admitted to the location of the show or exhibition, provided that the maximum
number shall not exceed the maximum number which can reasonably assemble at the
location of the show or exhibition in consideration of the nature of the show or
exhibition and provided that, where the assembly is to continue overnight together
with the show or exhibition, the maximum number shall not be more than is allowed
to sleep within the boundaries of the location of the show or exhibition by the
zoning or health ordinances of the County, and the regulations of all Minnesota
State agencies.
3. At the time the application for the license is submitted, the sponsor will provide
a plan including the provisions herein for the operation of the show or exhibition.
Ten days prior to the start of the show or exhibition, local authorities will
inspect to determine whether the requirements of these provisions have been
substantially met.
a. A fence completely enclosing the proposed location of sufficient
height and strength to prevent people in excess of the maximum
permissible number from gaining access to the show grounds, which
fence shall have at least four gates, at least one at or near four
opposite points of the compass.
b. Potable water, meeting all federal and state requirements for sanitary
quality, sufficient to provide drinking water for the maximum number
of people to be assembled to observe the show, at the rate of at least
one gallon per person per day.
C. Separate enclosed toilets for males and females, meeting all state
and local specifications, conveniently located throughout the grounds,
sufficient to provide facilities for the maximum number of people to
be assembled in accordance with the Minnesota State Board of Health
Regulations and Standards and Minnesota Pollution Control Agency.
d. A sanitary method of disposing of solid waste in compliance with state
and local laws and regulations, sufficient to dispose of the solid
waste production of the maximum number of people to be assembled at
the rate of at least 2.5 lbs. of solid waste per person per day,
together with a plan for holding and a plan for collecting all such
waste at least once each day of the show or exhibitions continuance,
and sufficient trash containers and personnel to perform tasks.
e. If the show or exhibition is to continue during hours of darkness, or
the people in attendance to observe shall continue to be assembled
during hours of darkness, upon the grounds where the show or exhibition
is being held, illumination sufficient to light the entire area of the
assembly shall be provided.

f. If the show or exhibition is to continue during hours of darkness,
or the people in attendance to observe shall continue to be assembled

is being held. camping Facilities in compliance with all state and
local requirements as set forth in Minnesota Statutes and Regulations
and ordinances of this County, sufficient to provide camping accommodations
for the maximum number of ,people to be assembled to observe the show or
exhibition.
g. Security and traffic control plan which will meet the requirements of
local authorities and the Minnesota Department of Public Safety. Regularly
employed off duty Minnesota law enforement officers, or other approved secur
officers, sufficient to provide adequate security for the maximum number
of people to be assembled for the purpose of viewing the show or exhibition.
h. Administrative control center with telephones where local authorities
can contact the sponsors and law enforcement personnel inside the area
where the show or exhibition is being conducted.
i. A bond, filed with the County Auditor of Freeborn County, either in
cash or underwritten by a surety company licensed to do business in
Minnesota in the minimum amount of $50,000.00, which shall indemnify
and hold harmless the County of Freeborn and all its agents, officers,
servants, and employees from any liability or causes of action which
might arise by reason of granting this license, payment of employees,
or services rendered by the granting authority and from any cost incurred
in cleaning up any waste material produced or left by the people in
attendance at said show or exhibition.
RESOLVED FURTHER, That an application for a license under the terms hereof, shall
be processed within 20 days of receipt and shall be issued if all conditions are
substantially complied with. The license may be revoked by the governing body of this
County at any time if any of the conditions necessary for the issuing of or contained
in the license are not complied with, or if any condition previously met ceases to be
complied with. The provisions of this licensing resolution may be enforced by injunction
in any court of competent jurisdiction, and the holding of an exhibition or show in
Freeborn County, whether on public or on private land, in violation of any provision
or condition contained herein shall be deemed a public nuisance and may be abated as
such. Any proceeding for an injunction, or for abatement of a public nuisance shall be
in addition to the penal provisions which apply hereto under Minnesota Statutes
Annotated, Section 375.40.
RESOLVED FURTHE2, That application for the license to conduct a show or exhibition
regulated hereunder, shall be on a form furnished by the County Auditor, said form to
be completed by the sponsor of the show or exhibition, under oath, and signed by said
applicant. The application form shall contain and require to be disclosed the following
matters, to-wit:
a. The name, age, residence and mailing address of the applicant if
an individual , and the officers of the corporation, if applicant
is a corporation.
b. The address and legal description of all property upon which the
show or exhibition is going to be held. .
c. The names and addresses of all persons owning the land where said
show or exhibition is going to be held.
d. The nature and purpose of the show or exhibition.
e. The maximum number of persons which the applicant shall permit to
assemble at any time, for purposes of observing the show or exhibition.
f. The maximum number of tickets, if any, which will be sold.
g. Plans of the applicant to limit the maximum number of people permitted
to assemble for purposes of observing the show or exhibition.
h. The plans for controlling and parKing vehicles of the persons
assembling to observe the show or exhibition.
i. The plans for security including the number of guards, their
deployment, their names, addresses, credentials and hours of
availabil ity.
j. The plans for so�uud control , it aphlic.,ble , and sound amplification,
if any, including number, location and power of amplifiers and speakers.
k. The plans for food concussions and concussioners who will be allowed
to oppratke on the grounds including; the naues ;end ad ?resses of all
concessioners and their license or permit nuaibera.

RESOLVED FURTHER, This resolution shall not apply to programs designed to
promote agricultural , trade or industrial programs, or to any regularly established,
permanent place of worship, stadium, athletic field, arena, auditorium, coliseum, or
other similar permanently established place, where shows or exhibitions are held,
where the reasonably nnticfp�ited asgembly of observers does not exceed by more than
250 people the maximum seating capacity of the structure where the show or exhibition
is held. This resoution shall not apply to government sponsored fairs held on
regularly established fairgrounds.
