A RESOLUTION CANVASSING RETURNS OF SPECIAL ELECTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE,
MINNESOTA,that it is hereby found, determined and declared that the special election held in
and for the City on Tuesday, May 11, 1999, was in all respects duly and legally called and held
and the returns thereof have been duly canvassed, and the votes cast at said election for and
against the proposition submitted to the electors were as follows:
Should the City of Shakopee,Minnesota, be authorized to issue and sell its General
Obligation Bonds in an amount not to exceed$5,000,000 to finance the acquisition and
betterment of various park and recreational facilities?

As the proposition did not receive the approval of a majority of the votes cast thereon, it is hereby

Memorandum
TO: Mayor and City Council

SUBJECT: Fire Station Alcohol
DATE: May 10, 1999
INTRODUCTION:
At its meeting of May 12th,the City Council will be asked to consider granting approval
to the Fire Department to allow for the serving of alcohol at a retirement party at the new
fire station on May 21st.
BACKGROUND:
As I understand it, each of the Council received an invitation to a retirement party to be
held Friday evening, May 21st. A question has been raised as to whether alcohol is going
to be served; in checking with Chief Mary Athmann, he responds in the affirmative.
The Fire Department falls under Section 5.092 of the City Code, which states that any
consumption of alcohol on public property must be approved by the City Council. This is
what happened concerning the special grand opening event of the new station in June,
1998.
It is not a matter of licensing. As long as this is a private party,the City Council does not
have to issue a license.
Instead, it focuses on the policy of whether the Council wishes to allow alcohol to be
consumed on public property. I have talked to Chief Athmann,who assures me that this
would be on very specific occasions, and likely limited to primarily retirement parties.
(The last one of these parties, according to the Chief, was about five years ago. However,
he said that there are some other fire fighters who are nearing retirement age, so he can
make no guarantees as when the next one might be.)
He also assured me that no alcohol would be kept in the station at other times. In
addition, he would have a"head count"of those fire fighters who are attending, but did
not intend to consume alcohol. They would be available for response to fire calls without
interruption. Neighboring communities with whom the City has mutual aid would also
be put on notice to be available that evening,and until the imbibing fire fighters were
capable of responding.
DISCUSSION:
The major source of concern for fire station consumption has been the liability issues
involved with fire fighters who consume alcohol, and then respond to calls. It appears
that Chief Athmann is proposing some adequate safe guards for this specific event. If
those are adhered to, it would not appear to be a problem to allow this.
The other, and less quantifiable issue, is the problem with any public perception about
consumption of alcohol on public property. That is a policy question that the City
Council will have to answer.
ACTION REQUIRED:
If the Council wishes to allow consumption of alcohol, it should,by motion, agree to its
use between the hours of 5:30 pm May 21st and 1:00 am May 22, 1999 at Shakopee Fire
Station No. 51.
Gift Law: One aside on the invitation that the Council received-the City Attorney
advises that the City Council should reimburse the Fire Department for the appropriate
amount of the value of the meal.

§5.092
C. A certificate of the State Treasurer that the licensee has deposited with the State
Treasurer$100,000.00 in cash or securities which may legally be purchased by
savings banks or for trust funds having a market value of$100,000.00.
Subd.2. Exception. This Section does not apply to beer licensees with annual sales of beer of
less than $10,000.00. Provided that such exception shall not apply where sales are made on
public property. All licensees desiring to claim this exemption must prove entitlement thereto in
such a manner as the Council shall by resolution from time to time determine.
Subd. 3. Repealed.
Subd.4. Delayed Issuance of License. Notwithstanding the foregoing provisions of this Section
5.09, the Council may, in its sole discretion and in the case of a new facility, grant an application
for a license but direct that the license shall not be issued until the applicant has fully complied
with all of the requirements of this Section 5.09. The time lapse between Council action in
granting the application and the issuance of the license shall be limited to a 12-month period and
if compliance is not completed within such time a re-application shall be required. (Ord. 124,

SEC. 5.091. ALCOHOLIC BEVERAGES IN CERTAIN BUILDINGS AND GROUNDS.
It is unlawful for any person to introduce upon, or have in the person's possession upon, or in, any
school ground, or any schoolhouse or school building, any alcoholic beverage, except for

SEC.5.092,CQNSUMPTIONAND POSSESSIONOF ALCOHOLIC BEVERAGES ON STREETS,
.UBL4CI3ROPERTY,PRIVATE PARKING LOTS TO WHICH THE PUBLIC HAS ACCESS,AND
OTHER PRIVATE PROPERTY.
It is unlawful for any person to consume, or possess in an unsealed container, any alcoholic
beverage on any (1)City park, (2) street, (3)public property, or(4) private parking lot to which the
public has access, except on such premises when and where permission has been specifically
granted or licensed by the Council. It is also unlawful for any person to consume, or possess in
an unsealed container, any alcoholic beverage on any private property of another which is not a,
private parking lot to which the public has access, without a specific oral or written invitation or
permit to do so from the owner, lessee, or other person in lawful possession of such property.
Provided, that this Section shall not apply to the possession of an unsealed container in a motor
vehicle when the container is kept in the trunk of such vehicle if it is equipped with a trunk, or kept
in some other area of the vehicle not normally occupied by the driver or passengers, if the motor
vehicle is not equipped with a trunk. For the purpose of this Section, a utility or glove
compartment shall be deemed to be within the area occupied by the.driver or passengers.
Provided, however,that it is not a violation of this Section to consume or possess in an unsealed
container any beer in a City park where such possession and consumption is in a picnic,

C. A certificate of the State Treasurer that the licensee has deposited with the State
Treasurer$100,000.00 in cash or securities which may legally be purchased by
savings banks or for trust funds having a market value of$100,000.00.
Subd.2. Exception, This Section does not apply to beer licensees with annual sales of beer of
less than $10,000.00. Provided that such exception shalt not apply where sales are made on
public property. All licensees desiring to claim this exemption must prove entitlement thereto in
such a manner as the Council shall by resolution from time to time determine.
Subd.3. Repealed.
Subd.4. Delayed Issuance of License. Notwithstanding the foregoing provisions of this Section
5.09, the Council may, in its sole discretion and in the case of a new facility, grant an application
for a license but direct that the license shall not be issued until the applicant has fully complied
with all of the requirements of this Section 5.09. The time lapse between Council action in
granting the application and the issuance of the license shall be limited to a 12-month period and
if compliance is not completed within such time a re-application shall be required. (Ord. 124,

SUBJECT: Status Report- Shakopee Outdoor Pool
DATE: May 10, 1999
As of this writing, we are still working with Tom Shaffer of U.S. Aquatics regarding his
assessment of the safety of the Shakopee outdoor pool. There is also information coming
from the City Attorney regarding potential liability.
A reminder that I have planned to be in attendance at the Minnesota City Management
Association Annual Conference, which begins earlier that day. City Attorney Jim
Thomson, and City Clerk Judy Cox will be in attendance to answer questions on both the
pool issue, and on the fire station alcohol issue.
