Robert Sweeney at 7: 00 p.m. , with Comm. Steve Clay, Eldon Reinke, Gloria Vierling, and Richard Marks. Also present: Robert Schmitt, Scott County Assessor and Judith S. Cox, City Clerk. Reinke/Vierling moved to nominate Robert Sweeney as chairman for the 1992 Shakopee Board of Review. Robert Sweeney asked for further nominations. Vierling/Marks moved nominations for the chairman of the 1992 Board of Review cease. Motion carried unanimously. Clay/Reinke moved to cast a unanimous ballot for Robert Sweeney to serve as the chairman for the 1992 Shakopee Board of Review. Motion carried unanimously. Robert Schmitt explained the purpose of the Shakopee Board of Review stating it is the function of this Board to review the market value and the classifications placed upon the parcels in question by the Scott County Assessor's office. Mr. Schmitt also gave a summary on how the 1992 assessments had been calculated for the City of Shakopee. Chrmn. Sweeney asked if there were any general questions for Mr. Schmitt by either the Board or members of the audience. There were none. Chrmn. Sweeney stated that he has received a list of property owners wishing to have their assessed valuation reviewed. He stated that these individuals have been placed upon the agenda and would be considered prior to those not currently on the agenda. Chrmn. Sweeney stated the first parcel to be reviewed is that of John and Diane Listerud, Parcel #27-932011-0. Robert Schmitt stated this parcel is located at 3876 Marschall Road. He then gave a brief description of this parcel. He stated the classification for this parcel has gone from agriculture to residential. He added the area is 9.36 acres and the total assessed value for 1992 is $116,800. Chrmn. Sweeney asked if the Listerud's were present. They were not. Discussion was held on the reclassification. Vierling/Clay moved to concur with the assessor's valuation and classification. Motion carried unanimously. Official Proceedings of the May 12 , 1992 Board of Review Page -2- Chrmn. Sweeney stated the next parcel to be reviewed is that of Dennis and Kay Fetzer, Parcel #27-913006-0. He asked if the Fetzer ' s were present. They were not. Robert Schmitt stated this parcel is located at 1850 County Road 18 . He gave a brief description of the property stating it consists of 2 . 5 acres. He stated the cabinet shop on site was appraised at 80 percent completion. He added he believes the disagreement on valuation is between the mortgage appraisal on this cabinet shop against the Scott County appraisal. He added the 1992 total assessed value is $147 , 400. Discussion was held on the assessed valuation of the cabinet shop. Reinke/Vierling moved to concur with the valuation of the Scotl. County Assessor. Marks/Vierling moved to amend the motion to reduce the Assessor' s valuation on the cabinet shop by 50 percent, to be more reflective of the market value. Discussion was held on the market demand for a cabinet shop not yet classified as a business. Motion carried unanimously on the amendment. Motion carried unanimously on the motion as amended. Chrmn. Sweeney stated the next parcel for consideration is that o : Mark and Bonnie Casey, Parcel #27-131074-0. He asked if the Casey' s were present. They were not. Robert Schmitt stated this parcel is located at 1278 Diamond Court. Mr. Schmitt gave a brief description of the property. He stated that land value has increased from 1991 and has an assessed value for 1992 of $110, 500. Discussion was held on the assessed increase from 1991 to 1992 . Marks/Clay moved to sustain the Assessor' s valuation for the Casey property. Motion carried unanimously. Chrmn. Sweeney stated that the next parcel to be reviewed was that of Ray Friedges; Parcel #27-092036-0. He added that since placement on the agenda, the Friedges ' have withdrawn their request for review. Chrmn. Sweeney stated the next parcel to be considered is that of Total Minnesota Property; Parcel #27-001143-0. Chrmn. Sweeney asked if a representative was present. There was no representation. Official Proceedings of the May 12, 1992 Board of Review Page -3- Robert Schmitt stated this parcel is located at 234 West 1st Avenue, and has a total assessed valuation for 1992 of $144,800. Mr. Schmitt reported on the letter dated May 5, 1992 received from Mr. Jack Hanna, of the Total Petroleum, Inc. , which states this property is "suffering from environmental contamination" and the cost to cure is $110, 000. Mr. Schmitt stated that according to Mr. Hanna, they are asking for this review because they believe that this damage has caused a loss to the market value of the property. Discussion was held on the possibility of the assessed valuation being too low. Marks/Vierling moved to concur with the assessor's valuation. Motion carried unanimously. Chrmn. Sweeney stated that the next case is parcels owned by Cletus Link and reflect Parcels #27-121001-0, #27-121011-0, #27-121012-0, #27-121013-0, #27-121016-0, #27-121017-0, #27-121026-0, #27-121027-0, #27-121028-0, and #27-121029-0. - He added that Cletus Link is present for discussion. Robert Schmitt gave a brief description of all the Link parcels for review. He stated some of these parcels are vacant lots and the others are outlots. Cletus Link stated that currently he has been denied a permit to build on this land, and the classification should be agricultural until he can build on these parcels. Robert Schmitt stated that parcel #27-121001-0 has been valued as platted/undeveloped property at $6300 per acre. Mr. Link stated this parcel is a corner lot and these lots are usually less desirable and should have less assessed value. He added that besides being a corner lot, Parcel #27-121001-0 fronts on 12th Avenue and abuts a county road. He stated the valuation of $20,400 is much too high for this parcel. Discussion was held on the demand and market value of a corner lot, especially one abutting a busy county road. Clay/Marks moved to reduce the assessed valuation to $19,800 for Parcel #27-121001-0. Motion carried unanimously. Robert Schmitt stated that $6300 per acre is how they value all platted undeveloped property that has sewer and water availability. He added that lots without sewer and water are selling at $6300 per acres. Official Proceedings of the May 12, 1992 Board of Review Page -4- Clay/Marks moved to concur with the assessor's valuation of $6300 per acre for the remaining of Mr. Link's parcels under review. Motion carried with Comm. Sweeney and Vierling voting in opposition. Chrmn. Sweeney stated the next property for consideration is that of Gregory Weigold, Parcel #27-929014-0. Gregory Weigold was present for discussion. Robert Schmitt gave a brief description of the property located at 3000 County Road 42„ consisting of 10 acres. He stated the valuation for 1992 placed upon this parcel is $143 ,400. Gregory Weigold stated he has some conflicting numbers. He stated his taxes had increased 100 percent over 1991. He stated his value has increased above that of his neighbors. He stated that when he purchased the property in January of 1991 for $148,000, this seemed to be a fair price with the taxes at the rate they were then. He added that now with the taxes so high, this no longer seems to have been a fair purchase price. He added he gets no City services to this site. Chrmn. Sweeney reminded Mr. Weigold that the Board of Review cannot deal with taxes only with the assessed valuation and the classification of properties. Chrmn. Sweeney suggested Mr. Weigold give documentation indicating that his parcel is over assessed. He added that way Mr. Schmitt will be able to look at specifics to determine if this parcel should be reevaluated. Comm. Marks suggested that Mr. Weigold obtain an independent appraisal and present this information to Mr. Schmitt. Vierling/Clay moved to sustain the valuation of the appraiser. Motion carried unanimously. Chrmn. Sweeney stated the next parcel for consideration is the Reed Otterblad property; Parcel #27-913030-0. Chrmn. Sweeney asked if Mr. Otterblad was present. He was not. Robert Schmitt gave a brief description of the property stating it it located at 9186 Boiling Springs Lane. He added the 1992 valuation is $83 ,400. He stated he is unsure why the Otterblad's have asked for a review. Reinke/Marks moved to concur with the valuation of the appraiser. Motion carried unanimously. Chrmn. Sweeney stated that the next parcel for consideration is the James O'Leary property. He asked if the property owners were present. They were not. He stated that the total assessed value is $78, 700. He added he is not certain why they have asked for a review. Reinke/Marks moved to concur with the assessor's valuation. Motion carried unanimously. Chrmn. Sweeney stated the next parcel for review is the Sherman Thurmer property, Parcel #27-017051-0. He asked if the Thurmer's were present. They were not. Robert Schmitt gave a brief description of the property. He stated this parcel is located at 742 South Madison and has a 1992 assessed valuation of $97, 300. Discussion was held on the value being reduced due to the fireplace not functioning. Vierling/Marks moved to concur with the assessor's valuation. Motion carried unanimously. Chrmn. Sweeney stated the next case is being represented by Property Tax Research Company for the J. L. Shiely Company-Shakopee Quarry parcels numbers 27-902020-0, 27-903004-0, and 27-911006-0 and the Shakopee Valley Printing parcels of #27-089001-0 and #27-089002-0. Chrmn. Sweeney asked if representatives were present. There was no representation. Robert Schmitt gave a brief description of these properties stating he is not sure why they have requested a review. Vierling/Marks moved to sustain the valuation of the J.L. Shiely and Shakopee Valley Printing properties. Comm. Clay moved to amend the motion for the J. L. Shiely property to increase the valuation by $500 per acre. Amendment died for lack of second. Motion carried unanimously on the main motion. Chrmn, Sweeney stated the next parcel for review consideration is the Stanley and Linda Beireis property. He asked if the Beireis' were present. They were not. Robert Schmitt stated the parcel is located at 137 Naumkeag. Mr. Schmitt gave a brief description of the property. He stated the assessed valuation for 1992 is $132, 600 and classified as commercial. Marks/Vierling moved to concur with the assessed valuation. Motion carried unanimously. Chrmn. Sweeney stated that Patricia Goldberg has asked to have her assessment reviewed. He added that Ms. Goldberg was present for discussion. Robert Schmitt gave a brief description of the property located at 2780 County Road 42 (Parcel #27-929014-1) . He stated this property consists of 20 acres and has a total assessed value of $116,800. Patty Goldberg stated her property has sustained a $30, 000 increase from 1990, and believes this is too high especially since there a gravel road going through her property that is heavily used to get to the indian reservation. Robert Schmitt stated the county is trying to get all parcels tc- market value. He added that her property is classified as a hobJ, farm because it falls in the 10 - 20 acres range, and is also bein( considered as Green Acres. Patty Goldberg stated that the parcel is 20 acres but has a large ponding area, which cannot be built upon, and abuts the Mielkc cartway where the Sioux have plans to purchase and use as heavily-traveled roadway. Discussion was held on whether or not the assessed valuation is a little high due to the roadway being a disadvantage. Discussion continued on how this property could be reevaluated. Robert Schmitt will look at this property to determine if there is additional depreciation that could be applied, due to the excessive use of the roadway. Vierling/Marks moved to concur with the assessor's valuation. Motion carried unanimously. Chrmn. Sweeney stated that Gordon Grannes, Parcel #27-915008-0 has asked to have his parcel reviewed. Robert Schmitt gave a brief description of the property stating it is located at 5015 Eagle Creek Blvd. and consists of 2.45 acres with a 1992 total assessed value of $101,200 and is classified as residential. Mr. Schmitt stated this parcel is under discussion with the owners. He added that this parcel was reduced in size with the construction Official Proceedings of the May 12, 1992 Board of Review Page -7- of the Dean's Lake Outlet so there really is only 1.7 usable-. property. Gordon and LaVonne Grannes were present for discussion. They stated it was reevaluated at an increase of $16,500 for 1992 . Mrs. Grannes stated the assessed value of all the adjacent property owners have also increased. Vierling/Marks moved to concur with the assessed valuation. Motion carried unanimously. Chrmn. Sweeney stated the next property to consider for review is that of Vicky Burt, Parcel #27-932002-0. Robert Schmitt gave a brief description of the property which is located at 1774 County Road 14. He stated this parcel is given ars assessed valuation of $139,500. Mr. Schmitt stated that the main concern with Mrs. Burt is that in 1990 an outside appraisal firm valued this property at $130, 000, and Mrs. Burt believes the assessed value of $139,500 is in excess. Clay/Vierling moved to concur with the assessed valuation. Motion carried unanimously. Chrmn. Sweeney stated the next parcel for review consideration is that of Dennis Sanford. Robert Schmitt stated this is Parcel #27-117002-1 and located along Shenandoah Drive south of the Shakopee Ballroom on East 4th Avenue. He gave a brief description of the property and added that Parcel #27-117002-0 could also be considered in this review since these two parcels are adjacent. Mr. Schmitt stated that Parcel #27-117002-1 consists of 10 acres and the other parcel, #27-117002-0, consists of 5 acres for a valuation of $202, 000 and $126, 000 respectively. He added that both parcels are in the Racetrack Zoning District, where there has been little to no development. Discussion was held on the marketability of land in the RTD. Comm. Clay suggested a lower valuation of $5, 000 per acre. Discussion was held on what would be a realistic valuation for these two parcels. Vierling/Marks moved a reduction in assessed valuation to $15, 000 per acre on both parcels (#17-117002-1 and #27-117002-0) . Motion carried with Comm. Sweeney voting in opposition. He added that the Broderson' s were not present for discussion. Robert Schmitt stated this parcel is a vacant lot and is located at 2325 Horizon Circle South. He stated the assessed valuation is $22 , 500 which is the value used for all vacant lots in Horizon Heights Addition. Marks/Reinke moved to concur with the assessor' s valuation. Motion carried unanimously. Chrmn. Sweeney stated the next parcel for consideration is that of Dave Chase located at 327 East 2nd Avenue; Parcel #27-001193-0 . He added that the property owner is not in attendance. Robert Schmitt stated this is being valued like all apartment buildings and is based on the calculations for the Central Business District. Discussion was held on the value of property abutting a railroad track. Discussion also continued on the marketability of apartment buildings. Marks/Vierling moved that the assessor discuss the valuation with the owner, and arrive at a value not to exceed $74 , 000 . Motion carried unanimously. Chrmn. Sweeney stated that the next property for consideration is the Edman-O 'Brien property; parcel #27-001863-0 . Robert Schmitt stated this parcel is located at 1066 West 3rd Avenue. He added that based on the income approval for valuations it's market value is $271, 000. James O'Brien stated he is the principal owner of this parcel since Mr. Edman was forced to file bankruptcy. He added that the income approach for valuation does not apply in this case because Mr. Edman was the one source for income. He stated that the conditions on this property have changed drastically since 1991. Robert Schmitt stated they can take another look at this parcel if it remains empty for the rest of the year. The parcels are being taxed one year ahead. Marks/Vierling moved to reduce the valuation back to the 1991 assessed market value of $247, 800. Motion carried unanimously. Chrmn. Sweeney opened the review up to those not on the agenda but in the audience. Official Proceedings of the May 12, 1992 Board of Review Page -9- Robert Drury, parcel #27-001224-0, stated his assessed valuation is $29, 300 for 1992 but it was only $15,500 in 1989. Chrmn. Sweeney stated that since Mr. Schmitt was unaware of Mr. Drury's concern, this review will have to continue to the May 18th review at 7: 00 p.m. to allow Mr. Schmitt time to research information on this property. Chrmn. Sweeney suggested Mr. Drury contact Mr. Schmitt to see if they can come to an agreement. Darlene Schesso, 927 Sommerville, stated she did not mail in her card for an official review, but has a concern as to the increasc in the assessed value. She stated her parcel's assessed valuation has increased by $10, 300 since 1991. She added she will speak with Mr. Schmitt but may return on May 18th if she is unsatisfied with the outcome of their discussion. Kermit Bischoff, 2421 County Road 42, (parcel #27-920007-0 and 27- 920007-1) stated he had not submitted his card for assessment review at tonight's meeting. He is willing to further discuss this issue with Mr. Schmitt, but wants to retain his right to attend the meeting of Mary 18th if necessary. Jim Pietrzak, 5411 Eagle Creek Blvd. , (Parcel #27-915013-0) stated he is attending the meeting to learn more about how properties arc valued, but has a concern about the valuation placed on his parcel, which increased $11, 000 from 1991. Robert Schmitt stated this parcel has an assessed valuation of $108, 100 because they are trying to bring all the parcels up to market value. He added that the last increase was in 1988 for this parcel because there was not a good method to bring up the market value in the rural areas. Mr. Pietrzak stated there is no need for his parcel to be placed on the May 18th agenda because he now understands the process better.
