Dear Mr. Reeder:
We have received a copy of the letter which you sent to Mr. C. Weichselbaum
on October 11, 1979.
In regard to the request for a fourway stop at Sixth and Adams, we find
that we cannot honor this request based on the information available to
us at this time.
We have checked the Department of Public Safety records and found that there
was one accident at this location per year from 1976 through 1978. One
accident per year does not warrant stopping traffic on Sixth. We know from
past studies of similar locations and experience that such an installation
would substantially increase accidents, in particular the rear-end type.
If the purpose this stop sign has been requested is to slow the traffic on
Sixth, we have literature on studies which prove that placing unwarranted
stop signs increases the speed at which the traffic moves through an area
after being required to stop.
The only reason, which we can accept at this time, to place the requested
stop signs, would be that the city has traffic counts which shown that the
volumes of traffic on Sixth and on Adams a very nearly equal. If this is
the situation we will place the requested signing.

RE: Fencing of Public Works Area
DATE: October 11 , 1979
As has previously been discussed in the City Council , and
the staff recommends that the area behind the Public Works
building be fenced. With the construction and the future
occupancy of the townhouses directly west of the Public Works
area , it is now imperative that this fencing be constructed
to insure the safety of the residents and to protect City
and Utility Commission equipment from vandalism.
There is still some money available from the bond issue for the
construction of the Public Works and Police building which I
would propose to use for this purpose .
We hope to have available at the City Council meeting three
quotes for the construction of a 7 foot chain link fence
around the area outlined on the attached diagram.

SUBJECT: 1 , 500,000 Gallon Elevated Water Storage Tank

Attached is the bid tabulation for the Water Storage Tank and the
Consulting Engineer ' s recommendation on the award .
The low bid with tank was $979 ,200, which was 6 .4% over the engineer' s
estimate of $920,000.
In addition to the $979 , 200 bid , we will have to pay the following
costs :
Bid Price $979 , 200
Consulting Engineer 55 ,000
Soil & Tank Testing 25 ,000
Construction Contingency(10%) 97 ,000
Administration (1%) 12 ,000
Total Project Cost $1 , 168,200
Bond Issue Estimate $1 ,168,500
For the Kmart Tax Increment Project budget we had used $1 , 168, 500
which had also included some financing charges . Therefore, without
the financing costs included and with the appropriate administrative ,
testing, consulting fees and contingency charges , the project is
within budget .
Recommendation
It is recommended that the City Council take no action on awarding the
bids for the Water Storage Tank for the following reasons :
1) Moody' s has not yet rated the bonds .
2) The bonds have not yet been sold .
3) The contract with Kmart is not yet signed .
The schedule of events as I now see it is as follows :
1) We should receive the Moody rating on the bonds this week.
2) The signed contract with Kmart should be received from
Kmart next week.
3) 'The City Council should be able to act on November 7 to
approve the sale of the bonds to the underwriter.
4) The City Council could award the contract for the tank
construction on November 7th if the above actions occur.
We may want to wait until the bond closing date, which
will be several weeks later.

Gentlemen:
Herewith is a Tabulation of Bids received October 12 , 1979 ,
for construction of subject storage tank. Three bids were received
ranging from a low of $979, 200. 00 to a high of $1, 220 ,375 . 00 .
The low bid from Pittsburgh-Des Moines Steel Company is 6 . 4
percent above the feasibility study estimate of $920 ,000. 00. The
plans, however, require fencing and more extensive site work than
anticipated in the original estimate.
The bids included an alternate deduct for use of a center
support column and riser pipe in place of a riser pipe adjacent to
the outside support column. The low bidder indicated that with
their tank design and method of construction, the construction cost
is about the same and therefore they offered no deduct.
Pittsburgh-Des Moines Steel Company has satisfactorily completed
several elevated storage tanks in the southwest metropolitan area.
We recommend award of the subject contract to Pittsburgh- Des
Moines Steel Company in the amount of $979 ,200 . 00. Award should be
made as soon as possible to allow completion by fall of 1980.

At its meeting October 1, 1979, the SPUC considered
the petition for extension of city water along Hwy. 101
East of the Cretex Plat.
A motion was passed to accept the recommendations
of the Engineering Department (of 9-13-79) and set the
petition aside until such time as a looping and grid
system can be established with the entire area.

RE: Cletus Link Variance Request
DATE: October 17 , 1979
Request : Mr . Link requests a 6 foot variance from the required
30 foot side yard setback to allow a 24 foot side yard for an
office building.
Location: The site is situated at the southwest corner of 1st and
Market .
Analysis : The office building will be constructed on three lots
along 1st Avenue . The side yard will be on Market . Market
is a dead end street at the railway right of way resulting in
limited traffic . The office ' s parking lot will have an entrance
from Market but exit only onto 1st Avenue .
There is an alternative site arrangement available to the developer .
At present , 46 parking spaces are required. These have been
prgvided by the developer. If parking is changed to allow
45 angle parking, the building may be moved 6 feet eliminating the
necessity for a side yard variance . The change in parking
however, would eliminate two parking spaces bringing the
number two below the number required . This loss of parking spaces
may prove more significant than the 6 foot variance and less
desirable therefore .
Recommendation: Staff recommends approval , but requests the developer
to consider other alternatives .

Chrmn Schmitt asked for further comments from the audience . There
were none .
C,oller/Perusich moved to close the public hearing. Motion carried.
Coller/Marschall moved to recommend Preliminary Plat approval only of
Shimek' s 1st Addn. and that prior to Final Plat approval, the Planning
Commission have a drainage plan plus the following conditions be net$
1 ) Favorable Title Opinion of the City Attorney.
2) Park dedication be in cash.
3) Developer give road name acceptable to the City Admin.
4) Developer enter into an acceptable Developer' s Agreement, including
the issue of road construction.
5) No access be permitted from Lot 1 , Block 1 and Lot 1 , Block 2 unto
County Road 89, except on proposed road and only one access from
Lot 2, Block 1 to County Road 89.
6) On-site retention for drainage .

Conditional Use Permit No. CC-1)1 (Reviewal) e
Assistant Zoning Admin. stated that this Conditional Use Permit was
(1 j for a Bicycle Tract in an I-1 zone granted with the condition that
permanent restroom facilities be completed by July 1 , 1979. These
restroom facilities have not been completed.
Cecil Behringer, applicant, was present and explained the status of
the Velodrome . He is asking for an extension in order to complete
further plans. He stated he wanted to promote the bicycle tract to the
schools for their use as a public service . The Velodrome is currently unusec
Coller/Colligan moved to recommend to the City Council an amendment
of a condition as established in Conditional Use Permit No. CC-131 to
extend the construction of permanent restroom-facilities prior to
any public event and waive the parking lot construction for the year
1980 . Motion carried.

Permit
Assistant 4oning Admin. reported that Warners True Value Hardware , Inc .
would like to purchase land for storage of lumber. This would be
located in the I-1 zone in Last Shakopee. They can buy the land now
and would not need a Conditional Use Permit. However, upon adoption of
the new zoning ordinance , they would need a Conditional Use Permit for
expansion and for outside storage . The applicants would like a straw
vote from the Planning Commission to see if a Conditional Use Permit of
this nature might be graiiLed .

It is requested that the City Council discuss the construction
of Fourth Avenue between Harrison and Adams .
As you are aware there is currently one four-plex on this
.stretch of road and a proposal to build a second four-plex.
At this time , the road is poorly constructed of fill material
which probably does not meet appropriate standards . The
City now performs minimal maintenance on this road including
only emergency snow plowing. In conjunction with the issuance
of the Building Permit for the new four-plex, it is recommended
that the City Council order construction of this road even
if we do not receive a petition for such construction. The
appropriate action of the City Council would be to direct
the staff to prepare the appropriate resolution ordering a
Feasibility Study .

The City of Shakopee is in ownership of a 0. 25 acre tract of
land East of Kaufman and Broad just off the existing frontage road.
The City has been leasing this property to Mobil Oil Corporation
since 1951 for the storage of -bulk oil .
We are currently under a five year lease with them and receive
$750.00 per year.
Mr. Earl Dressen, on their behalf , has asked that the City
consider selling said property to them.
It is staff recommendation that the City sell said property
for $7 ,500.00.

examination of the balance sheets of the various funds of the City of
Shakopee at December 31, 1979, and the related statements of changes in

auditing standards. Accordingly, we will test the accounting records of
' the organization and perform other auditing procedures by methods and to
the extent we deem appropriate for the purpose of expressing an opinion
on the financial statements. We expect that city staff will be avaiable
to prepare, under our direction, certain of the detailed schedules
necessary to the examination. An examination directed to the expression
of an opinion on the financial statements is not primarily or specifically
designed, and cannot be relied upon, to disclose defalcations or other
similar irregularities should any exist, although their discovery may
result.
At the conclusion of our examination, we will submit our report with
respect to the financial statements and will make separate recommendations .
for strengthening internal accounting controls and improving operating
procedures to the extent that such matters come to our attention.
Our charges will be made at regular per diem rates, plus direct
expenses. We will advise you promptly if we discover any indication of
defalcations or other irregularities, or if other circumstances develop
that require us to extend our work significantly (e.g. , internal control
is found to be ineffective, books are not effectively closed, accounts
are out of balance) .

The Coast to Coast store has gone out of business next
door to City Hall . It is available for purchase at an estimated
cost of $100,000 to $115,000. It contains 3 ,200 square feet
which is about the same as in the building we previously bought .
I am asking, at this time , only the direction of the City
Council of whether or not the staff should pursue a proposed
financial agreement and funding source.
I do not think the City needs the space right now, but we
will within a year and it may be the most reasonable way .to get
more space .

I have reviewed the applications received some four
months ago for the position of Building Inspector and have
received an additional application from LeRoy Houser.
After consideration of this position and the applicants ,
I am convinced that LeRoy Houser is by far the best qualified
person for this position. He has a complete knowledge of the
building inspection regulations and in addition is the only
person qualified to inspect Valleyfair.
Recommendation
It is recommended that the City Council approve the
hiring of LeRoy Houser in the position of Building Inspector
for the City of Shakopee at a salary of $23 , 540, (his salary
when he left) . He would be considered a new employee for all
purposes except retirement which he may buy back into . His
salary would be reviewed again after he has completed his
six month probationary period .

The Shakopee Police Department is accepting bids for one motor
vehicle to be used for investigative transportation. Duration
of the lease is for a one year period , January 1, 1980 through
December 31, 1980. One current year model is to be furnished
January 1 , 1980 to June 30 , 1980 and the vehicle is to be re-
placed with a second vehicle of the same specifications from

We now have the prices for this truck automatic 'iransr«.ission Rebuild Tool Kit.
The prices exceed our budgeted amount because we find that we need 6itferent tools
for the various types of automatic transmissions that we have in our fleet. The
x800.00 that we budgeted was for the basic rebuild tools needed for j ,ost transmissions.
The total of the tools on all of the various transmissions amounts to $1,498.23. I'm
hoping that we can find the ndditional, rr:oney needed for this purchase because we have
a heavy duty duty automatic transmission scheduled for nn overhaul as soon as the tools
are made available. If we nave to send a heavy duty transndssion out for repair, the
cost of one overhaul would equal the amount paid for the tools. S.P.U.C. sent a
transmission out for an overhaul. la.xrt year to Malkerson Motors, who simply removed
the transmission and sent it to Interstate Diesel in Bloondngton, the cost of this
repair was $1,325.00. Perry Cheever attended P. 4 day school at the Interstate Liesel
2 years ago, so we areas you can see, very fortunate to have people in our opganiza-
ti.on who are capable and trained to overhaul these transrrdssions.
Adirdttedly, an error was made in not budgetting enough for a complete rebuild
kit, I'm hoping that you and Gregg can find some extra money to help make this
purchase.

RE: K-Mart Warehouse

This memo is to update you on the actions connected with
this project .
Construction
The grading of the land and the installation of the site
storm sewer system seems to be progressing as expected with no
problems. We are working with K-Mart to adjust the location
of the driveway so that it relates better to proposed sub-
division on the opposite side of CR 83 .
Agreement
The agreement between K-Mart and the HRA has been finalized
and is awaiting signature by K-Mart . We have been assured that
• we will have a signed agreement by Wednesday, November 8, 1979.
Value of Building
Some preliminary estimates on the cost of the warehouse made
by City Staff were in the area of 30 to 40 million dollars . We
have met with K-Mart and had independent contractors give us an
estimate of construction costs and I am now confident that the
building will cost in the area of 16 million dollars as originally
proposed by K-Mart .
Bonds
The sale of the bonds has been delayed because of the
uncertainty of the value of the building. We now anticipate that
the Council should be able to approve the sale of bonds by
November 20, 1979 .
Watertank
The low bidder on the watertank has agreed to hold his bid
until November 20, 1979 . This will give us time to handle the
bond sale .

SUBJECT: Uncollected SAC Charges
DATE: November 2 , 1979
Several years ago, from about 1973 to 1977 ,. the City of Shakopee
failed to collect SAC charges on building permits for the rural ,
areas. MWCC is pushing for payment of these charges by the. City .
They apparently have the power to also collect interest and a
service charge on these monies also . If the City takes prompt
positive action, some of the additional charges may be reduced.
I see three options for the City: ( 1 ) Pursue collection from the
property owners , ( 2 ) Pay the amount out of the Sewer Fund or the
General Fund, or (3) Do nothing and let MWCC levy the amount plus
interest as. an ad valorem tax across the, whole city,
Request Council be appraised of this situation and direction given
as to course of action. The amount in question is $26, 433 .

RE: Sound System for City Council Chambers
DATE: November 7 , 1979
A quotation for a new sound system for the Council Chambers
has been received from Audio Engineers . They are experienced in
the field and have worked with several government bodies . Their
proposal includes material and labor for installation of :
seven microphones with stands ; on/off switches and indicator
lights ; amplifier for the system; two column speakers ; control
box. Six microphones are for the table and one floor micro-
phone for the audience . Audio Engineers is recommending a floor
microphone versus a ceiling microphone . Our present mixer
and recorder will still be used .
There is $2 , 800 budgeted for a system, quoted price is
$2 , 165 . This still leaves room for purchase of a new recorder ,
if desired . Audio Engineers feels that our present model of
recorder is suitable for our needs . Under separate arrangement ,
they will clean and check over this recorder . They also have
several optional recorders for our review if, we still wish to
change . Price for new recorders varies from $100 to $400.
Unless otherwise directed I will proceed with the installa-
tion of this system .

Dear Landowner or Tenant,
Last July, we at Northern States Power Company (NSP) announced plans
for a 200-megawatt Twin Cities-area power plant to begin service in
1989 . We plan to spend the next several months studying the idea in
detail and carrying out the long process of identifying possible sites
within a 20-mile radius of Minneapolis and St. Paul.
An important part of this project is to design the plant for electri-
city and district-heat production. District heating, a well-known
technology in Europe, is a system in which a central facility provides
steam or hot water to heat nearby buildings. The NSP facility will be
designed for "co-generation; " that is , for producing electricity as
well as district heat and steam for industrial processes.
In July, we pledged to keep the regulatory agencies , the general
public and our customers informtd as these studies progress. I wish
you to know that we have identified eight sites in the metro area as
possible locations for the proposed plant. Your property is either
within, adjacent to or near a site that we will consider in the coming
months. In the attached newsletter is additional information on the
study and a map that identifies the proposed area.
Let me stress that NSP is a long way from recommending any locations
to the state, which makes the final decision on the proposed plant,
including its location. Our siting study is a multi-step process
that takes years to complete. What we are doing now is the pre-
governmental planning, so that when we seek regulatory approval--most
likely in 1980--we will present the best application possible , one
that has been worked out with the people most affected by the project.
As you read this letter, you may have a number of questions and
concerns. Although we may not be able to answer all your questions,
specially designated NSP personnel will try to help you. In the
enclosed newsletter is a list of people you can write or call to
obtain more information and to whom you can express your opinions .

NSP METRO UPDATE

TWIN CITIES-AREA SITING PROJECT
Northern States Power Company (NSP) Will be publishing the NSP
METRO Update to keep the public informed of a study we are doing
on a proposed 200-megawatt (MW) coal-fired power plant for the
Twin Cities area. The plant , as announced last July , will be
designed to provide electricity and piped hot water or steam for
space heating , water heating or industrial use.
NSP is now studying the engineering and environmental impacts of
eight possible Twin Cities-area locations. Three of the sites
under study are at existing NSP metropolitan plants. They are
Riverside in Minneapolis, High Bridge in St. Paul and Black Dog in
Burnsville. The new locations are areas within:
*Fridley , immediately north of the FMC Ordnance Plant
between East River Road and the Burlington Northern
Railroad tracks
*The Evergreen Industrial Park in Coon Rapids north of
85th Avenue NW and near Coon Rapids Boulevard
*Cottage Grove, west of the 3M Chemolite plant
*Rosemount, immediately west of Koch Refinery
*Shakopee, adjacent to the NSP Blue Lake peaking power
plant near Highway 101

Some of the sites are being studied for a possible second 200-
megawatt unit because uncertain electrical demands in the early
1990s may require it. NSP will continue to review this option.
All eight locations have rail or barge access and sufficient water
supplies from either the Minnesota or Mississippi River.
NSP is looking at possible sites now because it wants to include
input from the public and local communities in its final site
recommendations to governmental agencies. Citizens can forward
comments and questions to the NSP office that serves their area.

QUESTIONS AND ANSWERS
Q: Why is NSP looking for additonal generating capacity in
the Twin Cities metropolitan area?
A: We have received input from several state agencies and
the public indicating interest in generating units located close
to the area they serve. Besides that, locating a plant in the
Twin Cities metropolitan area would facilitate development of
district heating for residential , commercial or industrial
neighborhoods. A plant that provides district heating must be
near the area it serves.
In response to this input , NSP initiated a metropolitan
siting study in 1978 to look at the possibility of locating
a small coal-fired facility in the Twin Cities area. We are
uncertain at this time whether a new coal-fired power plant is
licensable in the metropolitan area, but we are committed to
studying that possibility .
Q: What is district heating?
A: District heating is heating piped from a central source
to supply surrounding buildings with hot water or steam for space
heating and water heating . When the hot water or steam for
district heating is produced along with electricity, the plant
is called a co-generation plant . The overall efficiency of a
co-generation plant can be as high as 80 percent , or roughly
double that of an "electricity-only" power plant.
Q: What are your siting criteria?
A: We are looking at tracts of land that have a sufficient
water supply and access to a rail line or a barge facility so that
fuel can be delivered . In addition, we are looking for sites in
which environmental and social impacts will be minimized; we wish
to displace as few residents as possible. Ideally, the areas also
will have industrial potential , which would make them suitable for
district heating expansion.
Q: What is the status of the metro-area study?
A: Each community within 20 miles of metropolitan Min-
neapolis-St . Paul has been studied for land availability to
identify areas that could accommodate a small coal facility .
NSP has completed facility layouts and environmental reviews for
the five new site areas and the three existing sites . We will
study these eight areas thoroughly over the next several months.
We will make final site selections and begin preparing
applications for the proper state agencies in 1980. Only after
completing the siting-and-application process will we be in a
position to purchase land.

RE : O'Dowd Lake Appraisal and Property Owner Discussions
DATE: November 5 , 1979
I have obtained the appraisal from Patchin Appraisals , Inc .
for the property surrounding O'Dowd Lake that is being
contemplated for purchase through General Obligation Bonds .
The appraisals were not available to the property owners until
Friday November 2nd , and thus a commitment for sale for the
designated prices is doubtful prior to the election.
The total values in the appraisals are as follows :
Property owned by Marschall $368, 700.00
Property owned by Boldt 228, 300.00
Property owned by Weinandt 279, 800.00
$876,800.00
The appraiser estimates the property to consist of a total
amount of 49 acres of land and 5400 feet of shoreline .
This produces a per acre purchase price of $17 ,894 .00 an acre .
I have reviewed the assumptions of the appraiser, the methodology
employed, and the comparable sales . They all appear thourough
and sound.
I would not recommend paying prices substantially higher than
those in the report ; unless numerous additional comparable
sales could be produced as evidence of higher retail land values .
Summary of discussion with owners to date :
Marschall , etal : Preliminary discussions indicate
they feel the amount offered is low. They feel the
development costs estimated are too high and that
the marketing pattern of three years indicated in
the report is too long.
I have researched and found that a few adjustments are warranted
in the development costs , however, I feel the marketing pattern
recommended is correct .
The four owners wish to study the appraisal .

Weinandt : Mr. Weinandt feels the price offered
is one we can negotiate with. He wishes to
study the appraisal further.
Mr. Boldt : Mr. Boldt does not wish to see his
property developed residentially at any time.
He did not appear to have strong opinions pro
or con regarding the price offered . He prefers
to wait until after the elction before signing
any agreements .
He has not researched and doesn' t feel secure in
his own knowledge of the value of his land. I
do feel a purchase could be negotiated and completed
with him if the bond issue passes .
