Dear Mr. Reeder:
On May 1, 1979, a contract on the above noted project was awarded to
the Kratochvil Construction Company of New Prague. Construction on this
project is scheduled to begin within the next ten (10) days.
The purpose of this letter is to request on behalf of the county, the
waiver of city permit fees in all possible areas of this project. Would
you kindly bring this request to the City Council at tonight's meeting
for its consideration and convey our appreciation, win or lose, for all
the past considerations extended the county.

VIKING COUNCIL BOY SCOUTS OF AMERICA

A program for Cub Scouts, Scouts and Explorers

Dear Mayor:
During the week of June 4th a very special event for some very special people
will be taking place. This is the week of "THE PAPER DRIVE FOR HANDICAPPED
SCOUTS".
Currently, more than 1,000 physcially, emotionally and mentally handicapped
boys are enrolled in 20 Minneapolis Metro area Cub Packs, Scout Troops and
Explorer Posts. To obtain the money needed to support their special program
needs, a Minneapolis and Suburban paper drive has been scheduled for June 8,
9, and 10th.
Hundreds of Scouts from the Minneapolis and Suburban area will collect paper
and man trailers. There will be trailers located at the Dales and at all
Minneapolis area Target Stores, 11 locations in all. Newspapers, radio and
television stations have generously agreed to make public service announce-
ments of the event. Many area businesses have lent their support by posting
signs reminding their employees to save their papers for "THE PAPER DRIVE FOR
HANDICAPPED SCOUTS."
In all, it is a big event, and we need the support of you and your community.
What better way to draw attention to the event than by declaring the week of
June 4th as "Handicapped Scout Week". We at the Viking Council sincerely
hope you will support our efforts in this way. It will certainly contribute
to our success.

RE: Holmes Street Project
DATE: May 18, 1979
The City Council requested a report on the Holmes Street
Project which I am unable to complete to date . I will continue
to gather the information you need and will make it available
to you as soon as possible .
The attached information is my preliminary ideas which
I offer for your consideration. I agree that we need a
policy on reconstructing projects and I agree that the City
should participate in these projects . The one question
is how much is it appropriate for the City to contribute ,
and how much can we afford to contribute in the long run ?
The attached chart of the expenditures of this project
and the possible funding sources should be of help in
your consideration. This shows 50 % City, and 50 % assessed .
It is my recommendation that you meet with the Holmes
Street Committee to get their ideas, but delay final decision
until you have all the information you need .
The figures on the cahrt revise somewhat the funding
proposed in the report and are the results of further discus-
sion at staff level . The figures are rounded and may vary
slightly, but the concepts are what need to be resolved . Exact
figures will not , of course, be known until the bids are
received .

ASSUMPTIONS
1 . Storm Sewer Policy will remain 50 % assessed,
50 % City,as West Side Storm Sewer was set .
2 . In order to sell Bonds to finance this project
a minimum of 20 % of the total project must be
assessed against benefited properties . If we
assess less than this we will have to place the
matter on the next election.
3 . The water main construction is an improvement
to the system and does not give anybody water
who does not now have it .
4. Sidewalks on state aid roads will be paid from
state aid funds rather than assessed .
5 . That the City can spend state aid money for
future years now.
6 . For state aid streets the City should pay the costs
over and above the norman residential street .
7 . There is a problem with the City placing improvement
costs on the general tax levy. We have levy limits
which at some point may cause us to have to
reduce operating expenses to allow for capital
expenses .
8 . The project is needed and should be built .
9 . A hook-up charge on sanitary sewer should be
established to help defray the costs of replacing
trunk sewer in Shakopee. This , combined with service
charges , would keep the cost off the general tax
levy.

RECOMMENDATIONS
1 . The benefited property owners be assessed for
50 % of the cost of the improvement for which
they directly benefit .
2 . The cost of the water main looping be paid by the
Utility Commission and the tax increment project
for the senior citizen' s highrise .
3 . The sidewalk be paid by state aid.
4 . The City share of the project be paid by a
combination of state aid, FAV funds and general
tax levy.
5 . The project be begun this year as soon as possible ,
and completed next year.
6 . The City share of the sanitary sewer trunk should
come from the sewer fund if a hook-up charge is
established. If not ,it will have to be on the general
fund mill levy.

After discussing the Doc Holliday matter with the
Assistant City Attorney, I am requesting that you withdraw
the motion to notify Doc Holliday' s that we do not intend
to renew their license because we have not yet afforded
them the opportunity of a hearing.
After that I am requesting that you set a hearing
on the denial of renewal and on the attached proposed
ordinance to require large places to be restaurants .

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 5 OF THE SHAKOPEE
CITY CODE BY PROVIDING A NEW PARAGRAPH H TO SUB-
DIVISION 4 OF SECTION 5.02, ENTITLED "ESTABLISH-
MENTS ELIGIBLE".
Be it ordained by the City Council of the City of Shakopee as follows :
Section 1. The Shakopee City Code, Chapter 5, Section 5.02, is hereby amended to
provide the following new Paragraph H thereto:
"H. Establishments Eligible. No on-sale liquor license shall be issued or
renewed for any establishment which contains more than square feet
unless:
1. Said establishment qualifies as a restaurant as defined in this
Chapter; and
2. Said establishment receives at least 50 percent of its gross
receipts from the sale of food for consumption on the premises.
For purposes of this Paragraph, "square feet of space" is defined as
Section 2. This ordinance shall take effect upon its passage and publication.
Adopted by the Shakopee City Council this day of June, 1979.
