Action Sought
Offer a motion to approve Resolution No. 7287, A Resolution Approving the Final Plat of Southbridge Crossings
East 2nd Addition and move its approval. This action has no immediate budget impact.
DISCUSSION
Shakopee Crossings Limited Partnership has made application for final plat approval of Southbridge Crossings
East 2nd Addition, Caselog No. 13 -008. This application has a review period deadline of June 19, 2013. The
proposed plat is on property located north and south of Hansen Blvd. and east of County Road 21. A location map
depicting the subject site is attached for your reference. The subject site is approximately 68 acres in size. The
plat proposes the creation of a lot and and 3 outlots for future development. These outlots will require further final
platting prior to development.
Other departments and agencies have reviewed the application and have provided comments. All applicable
comments have been incorporated into the draft resolution of approval and copies of comments received have been
attached for Council's reference.

ALTERNATIVES
1. Approve the Final Plat of Southbridge Crossings East 2nd Addition, subject to the conditions presented.
2. Approve the Final Plat of Southbridge Crossings East 2nd Addition, subject to revised conditions.
3. Deny the Final Plat of Southbridge Crossings East 2nd Addition.
4. Table a decisions and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends the approval of the Final Plat of Southbridge Crossings East 2nd Addition, subject to the
conditons proposed in Resolution No. 7287 (Alternative No. 1).
ACTION REQUESTED

RESOLUTION NO. 7287
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF SOUTHBRIDGE CROSSINGS EAST 2 ADDITION
WHEREAS, Shakopee Crossings Limited Partnership, applicant and property owner, has
made application for final plat approval of Southbridge Crossings East 2 Addition; and
WHEREAS, the subject property is legally described as:
Outlot A, Southbridge Crossings East First Addition, according to the recorded plat thereof Scott
County, Minnesota. Except Parcels IA, 1B, and IC of Scott County Right -of -Way Plat No. 39; and
WHEREAS, on July 25, 2002, the Planning Commission recommended approval of the
proposed preliminary plat with conditions; and
WHEREAS, on August 7, 2002, the City Council reviewed the proposed preliminary
plat and adopted Resolution No. 5762, approving the Preliminary Plat of Southbridge Crossing
East subject to the conditions contained with said Resolution; and
WHEREAS, on April 2, 2013, the City Council reviewed the proposed final plat.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee,
Minnesota that the final plat of Southbridge Crossings East 2 " Addition
is hereby approved subject to the following conditions:
I. The following procedural actions must be completed prior to the release of the
Final Plat for recording:
A. The final plat shall be revised to eliminate the signature blocks for the
Planning Commission.
B. Approval of title by the City Attorney.
C. The final plat shall be revised to include the following:
1. Right -of -way, in the form of sight triangles fifteen (15) feet in
dimension, will be provided at the Hansen Avenue intersections with
County Road 21 and Crossings Blvd.
2. Easements need to be shown on the Final Plat as approved by the City
Engineer. The will include, but are not limited to, the following:
a) Minimum drainage and utility easements for all sanitary sewer
and storm sewer, existing and proposed, deemed public by the
City Engineer need to be dedicated per the City of Shakopee
Design Criteria, Section 10.1 (A -D). The easements will be
centered along the public utility alignments.
b) Provide a minimum of ten (10) feet of drainage and utility
easement adjacent to the interior of each lone of Outlot A.
c) Provide an adequate drainage and utility easement to
encompass the approved high water level of the existing storm
water basin in Outlot A.
d) Provide a drainage and utility easement over all of Outlot B to
encompass the existing storm water basin.
e) Provide a minimum of ten (10) feet of drainage and utility
easement adjacent to the interior of each lot line of Outlot C,
with the exception of the shared lot liens with Lot 1, Block 1.
f) Provide a minimum of twenty -five (25) feet of drainage and
utility easement adjacent to the interior of the westernmost
property line of Lot 1, Block 1.
g) Provide a minimum of ten (10) feet of drainage and utility
easement adjacent to the interior of the northernmost lot line of
Lot 1, Block 1.
II. The following items shall be completed prior to the approval of a grading
permit, a building permit and /or a street /utility plan:
A. Execution of a Developer's Agreement, which shall include provisions for
security for public improvements within the plat and the engineering review
fees, and any other fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Street construction and sanitary and storm sewer installation shall be in
accordance with the specifications and requirements of the City of
Shakopee.
5. Payments of Trunk Sanitary Sewer Charges need to be made, as

6. Payments of Trunk Storm Water Charges and Trunk Storm Water
Storage and Treatment Charges need to be made, as required by the
most current City of Shakopee Fee Schedule and Trunk Storm Water
Charge Justification Report.
7. Payment of all storm water management plan review charges /fees need
to be made, as required by the most current City of Shakopee Fee
Schedule.
8. As no comprehensive site plan was submitted with the application, the
City Engineer will need additional information in order to determine if
public streets and/or utilities need to be extended to serve future lots
and if the existing storm sewer in Outlot C and Lot 1, Block 1 needs to
be public.
9. Provide electronic (AutoCAD and Adobe Acrobat formats) of the
Final Plat to be recorded with datum on the Scott County coordinate
system.
10. Park dedication fees in the amount required by the City Code and
adopted City fee schedule shall be paid at the time of recording of the
final plat. The portion of the property being platted as outlots shall
pay park dedication fees based on the fees in effect at the time of final
plat approval for creation of lots for development and shall be paid
before those final plat(s) are recorded.
11. Compliance with the Woodland and Tree Management Ordinance is
not required for this development given that the site does not have any
existing trees.
B. The applicant needs to submit a comprehensive site plan for the entire
subdivision showing the layout of the interior street system, sidewalk and /or
trail locations, and how future lots will be served by utilities.
C. The applicant will obtain the necessary Scott County permits /approvals.
Copies of these permit /s approvals will be provided to the City.
D. The applicant will grade the entire site, as proposed on the approved plans, in
one phase within one year from the date of approval of the grading permit
application. Grading is defined as bringing the site to the proposed finished
grade with materials deemed acceptable by the city of Shakopee engineering
department, providing topsoil per City requirements and applying seed,
mulch, and /or sod per City requirements and potentially providing an as -built
record grading plan per Section 2.5 of the City of Shakopee Design Criteria.
E. Record plans may need to be provided per the City of Shakopee Design
Criteria, Section 2.5 and Section 11.2 (A -L). The record plans need to be
submitted to the engineering department.
F. The applicant did not submit a storm water management
G. No public improvements shall be constructed until the City Engineer and the
Shakopee Public Utility Commission (SPUC) approve the Final Construction
Plans and Specifications.
H. The applicant shall obtain the necessary Scott County permits /approvals
(access, right -of -way, drainage, etc.). Copies of these will be provided to the

I. The applicant shall obtain a NPDES permit prior to any land disturbing
activity. A copy of this permit shall be provided to the City.

III. Following approval and recording of the final plat, the following conditions shall

A. Trees are required to be planted as follows:
a) A minimum of four feet from impervious surfaces.
b) A minimum of ten feet from property lines.
c) Not in easements containing utilities.
d) Not in City owned right -of -way.
e) Not below overhead utilities.
f) Not below high water levels (HWL) in existing or created ponds or
wetlands.
g) No planted tree species shall comprise more than 30% of the total
quantity of trees to be planted on site.
h) Consistent with Shakopee Tree Planting Guidelines.
i) Ash (Faxinus sp.) and Colorado Blue Spruce (Picea pungens) are
not allowed to be planted.
2. The developer should implement the use of Best Management Practices
for erosion control and storm water management during construction.
3. The applicant shall provide six inches of topsoil for the establishment of
turf and plantings. The soil compositions should be similar to the MnDOT
topsoil borrow requirements.
4. Irrigation systems require rain sensors.
B. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
C. No landscaping, ponding, berming, or signage shall be permitted within the
County right -of -way.
D. Any work within the County right -of -way shall require a permit.
E. Temporary street signs shall be installed prior to issuance of any building
permits.

interior of each lot line of Outlot A.
• Provide an adequate drainage and utility easement to encompass the approved high
water level of the existing storm water basin in Outlot A.
• Provide a drainage and utility easement over all of Outlot B to encompass the
existing storm water basin.
• Provide a minimum of ten (10) feet of drainage and utility easement adjacent to the
interior of each lot line of Outlot C, with the exception of the shared lot lines with
Lot 1, Block 1.
• Provide a minimum of twenty -five (25) feet of drainage and utility easement
adjacent to the interior of the westernmost property line of Lot 1, Block 1.
• Provide a minimum of ten (10) feet of drainage and utility easement adjacent to the

Storm Water Management Plan Review
The applicant did not submit a storm water management plan with the application. Prior to
