Hullander called the meeting to order at 5 :49 PM with Comm. Leroux, Ward and Reinke present. Also present: Douglas S. Reeder, City Administrator; H. R. Spurrier, City Eng., Jeanne Andre, Admin. Assistant; Dean Colligan, Councilman -Elect and Rod Krass, Assistant City Attorney, and Mayor Harbeck. Absent: Comm. Lebens. Wally Bishop, Lou VanHout and Russ Nolting were present on behalf of the Shakopee Public Utilities Commission to discuss the Elderly Highrise Watermain, and the watermain extension for Peterson Seed, Ziegler and the Auto Auction and various other, items concerning both the HRA and the Public Utilities Commission. Discussion was held on the possibility of combining the Holmes Street Watermain Reconstruction Project with the Elderly Highrise watermain Construction Project. John Bergstad was also present to discuss the issues on the Elderly Highrise Project. `Ward /Leroux moved to authorize the proper HRA officials to enter into an Escrow Agreement between the City of Shakopee and the Minnesota Housing Finance Agency and the Housing and Redevelopment Authority and 200 Levee Drive Associates for the construction of the watermain • to serve the Elderly Highrise. Motion carried unanimously. Discussion was then held on the request by Peterson Seed and Ziegler thatthe City take action on a watermain project for their area. This request was prompted by some preliminary test results indicating • water contamination. City Admin. suggested that no action be taken until final test results would be received on the water for that area. He further suggested that the City be able to initiate a feasibility study should the . results come back showing water contamination. The HRA agreed with the suggestion of the City Admin. and also recommended that if a feasibility study would be done that it include some areas of problems encountered by the Public Utilities. City Eng. stated that Pittsburg -Des Moines had held their bid bond • to ask for an extension on the completion time for the 1.5 million gallon water storage reservoir. The HRA had no objections to this. ' Proceedings of the -2- December 18, 1979 ; Shakopee HRA Discussion was held on the Highrise Redevelopment Contract and minor changes which had been made. • Discussion was on the Lease for theSenior Citizen Center and the agreement by the developers to lease this center to the HRA at a cost and with conditions. • • Discussion was also held on the Escrow Agreement for the Highrise Watermain Project. • Leroux/Ward offered Resolution No. 79 -32, A Resolution Approving • Agreement Between the Housing and Redevelopment Authority and the • City of Shakopee for Operation of ,Elderly Highrise Redevelopment Project No. 1, and moved for its adoption. Colder., II • • • ORDINANCE #35 Fourth Series An Ordinance of the City of Shakopee Amending Shakopee City Code, Chapter 11 Entitled "Zoning Regulations" By Adding a New Sentence to Section 11.04 Sub. 5, Paragraph B.3 and By Deleting the Last Sentence of Section 11.04 Sub. 6 Paragraph C10 and Inserting Two New Sentences and Adopting By Reference City Code Chapter 1 and Sec. 11.99, Which. Among Other Things, Contain Penalty Provisions SECTION I: The Shakopee City Code, Chapter 11, is amended as follows: • • .I' • A. Section 11.04, Sub. 5, Paragraph B.3 is hereby amended by inserting this sentence before the last sentence thereof, to -wit: "Written appeals may be made by any interested party and must be received by the City Administrator within seven (7). days of the Planning Commission action." B. Section 11.04 Sub. 6, Paragraph C10 is hereby amended by deleting the last ' sentence thereof and in lieu thereof inserting the following sentence, to -wit: "Written appeals may be made by any interested party and must be received by the City Adminis- trator within seven (7) days of the Planning Commission action. All decisions by the City Council are final." • SECTION II: Interested party defined. An interested party is any person, firm, association or corporation who is liable to be affected or prejudiced or who may gain or loose on the outcome of an appeal. . SECTION III: Certain provisions of the Shakopee City Code adopted by reference: Shakopee City Code Chapter 1 entitled "General Provisions and Definitions Appli -' cable to the Entire City Code including the penalty provisions" and Section 11.99; • . which, among other things, contains penalty provisions, are hereby adopted in their entirety by reference as though repeated verbatim herein. SECTION IV: Provisions for After Adoption . • After adoption, signing, attestation, this ordinance shall be published once in the official newspaper of the City of Shakopee and then shall be in full force and effect. Work Plan for Feasibility Study The following work plan summarizes the work Barr Engineering Co. pro- poses to perform in conducting the fEasibility study. The study will include • the preliminary design of the drainage system including the size, grade, and • general location of the trunk sewer, and determination of the size, location, flood levels, and outlet requirements for any storage areas incorporated into the design. - In preparing this proposal, we assume that the City of Shakopee will provide all available information to Barr Engineering Co. regarding existing and future land use, plans for existing drainage facilities, and other utili- ties, soil borings, street grades, and similar information. In addition, we assume the recently obtained aerial photography will be available for our use . on this project. Following is our detailed work plan. • 1. Collection and Review of Pertinent Data. Barr Engineering Co. will contact appropriate agencies such as the state and county highway . departments, the Minnesota Department of Natural Resources, the U.S. Soil Conservation Service, and others to obtain all available information concerning soils, ground water, surface water, and existing utilities. This information will be given consideration • • in the analysis of the watershed and design of the drainage facili- ties. 2. Field Reconnaissance and Survey. Barr Engineering Co, will conduct a field inspection of the watershed tributary to the study area In . ?'addition, we propose to examine the Dean's Lake outlet channel and • downstream culverts to estimate existing hydraulic capacity. In preparation of the feasibility study, we propose to conduct some limited field survey including several cross - sections along he Dean's Lake outlet channel and at critical elevations • such a: culverts affecting the hydraulics of the lake and outlet - channel. • 3. Hydrology. During the conduct of the feasibility study, we propose' to meet with you to review the selection of appropriate design " criteria and to obtain your approval of proposed computation I td 'methods. We will then compute discharges and runoff volumes at critical collection points along the storm drainage' system and.at storage sites. We propose to determine these discharges.based . on future land use and development plans. We propose to utilize the . Barr Etgineering Co. hydrograph method, however,'we are familiar with other synthetic modeling techniques' and would be pleased to, - utilize another method should you find this preferable. • 4. Hydraulic Design. Based on the stormwater discharges, runoff volumes, and water quality considerations, we will prepare a pre- ' • liminary design of the needed drainage facilities. We propose to .'consider alternates including both direct discharge to the Dean's Lake outlet channel and routing through Dean's Lake,. In the analy -.' ••sis of both systems, due consideration will be given to water qual -i . • '.' ity parameters and the affects on the receiving waters. • • 5. Cost E,,timates. Barr Engineering Co. will prepare cost estimates • based on the preliminary design of the alternate systems described . • above: These' estimates will be based on current costs of construct- • ing similar facilities based on our experience on other projects 6: Report. All elements of this study will be summarized in a feasi bility report. Meetings. Barr Engineering Co. will meet with you as necessary to'' discuss, in detail, progress of the work and to obtain your inputto design considerations. Further evaluation and discussion on the bids with the Purchasing Cooperative staff shows that if we waive the performance bond, Superior Ford becomes the low bidder at $35,215.00 or $5,200 less than Towns Edge for identical trucks. While performance bonds are still written into specifications, there is a trend toward less reliance on them and more reliance on the County Attorney's office, within the Cooperative. City staff gave approval to the Cooperative of changing the recommended bid award to Superior Ford. They currently have budgeted $1,850.00 for two typewriters and $1,200.00 for three pocket recorders. What they wish to do is take part of the recorder appropriations and apply it to the typewriters. They will do with fewer recorders and /or lower priced recorders in order to buy one typewriter as planned and one typewriter with more features and capabilities. The second typewriter is $500.00 more than the first and this amount will come from the recorder appropriation. We also have approximately $600.00 left in the appropriation for squad cars and approximately $350.00 left in the 4 -wheel drive appropriation. The typewriter they wish to buy has memory capability. It can remember margins and tab settings for more than one form as well as remembering information that will be repeated on several forms such as date, name, address, etc. The machine also has other features such as automatic centering, underscoring, error correction and automatic carriage return. I think.there is some merit in this suggestion and we should consider this proposal. If we decide to go with the part time inspector, we would not hire any summer help as we did last year. I believe that with the elderly highrise, Kmart, and Rahr, we have more construction than normal and that we may be able to :iustify additional help in this '. area. I have not executed a lease as proposed because there is an additional cost that was not explained to me before. The proposed plan with the additional cost would exceed the budget if implemented at this time. There is an alternate pricing plan that is within our budget appropriation. This . would be monthly rent of $320.00 plus $.019 per copy over • 9,000 copies per month. We would build equity at the rate of $105.00 per month instead of $361.00 per month. The Savin would then cost us somewhere in the range. of $55 to $68 more per month than the present copier. For this cost we then have dual paper feed (eliminates • changing paper numerous times per day), a 20 bin sorter, a document feeder, a faster first copy speed and no special wiring required. If we would decide to buy the . machine, 'the cost outlay plus allowance for estimated value of the machine at the • time would produce a break -even point somewhere just short of five years. Reeder, City Administrator • ' RE: Reconstruction Policy for Water • DATE: January 11, 1980 At the City Council meeting on January 8th, the City Council discussed the policies for the reconstruction of streets, sanitary sewer and water facilities in Shakopee. The conclusion of that meeting was the following preliminary directives of the City Council to staff to determine the feasibili- ty of the following policies: Storm Sewer - keep same policy for new construction • Sanitary Sewer - pay for reconstruction from sewer fund - fund sewer fund from: A. Hook -up charges B. User fees Street Reconstruction - 100% ad valorem taxes or state aid The City staff also recommended that the Utility Commission consider funding the cost of reconstructing and improving the water system from the water fund as we plan to do with the sewer fund. Staff suggested that SPUC could use the following revenue sources • to pay the cost of reconstruction and improvement. A. User fees B.. 'discussions on setting a water improvement and reconstruction •'; 1,. policy. • . 1. I have no problem with the assessing of property for water which has never been assessed and never served. This is the way it should be done. ; 2. When we look at reconstruction of water mains, I believe ' we may not be talking about a large number of instances throughout the City where this will be necessary and there_ fore, a street assessment policy for this may cause more ' problem's than it is worth. 3. What we will have more need of is improving the system by ' closing loops, increasing the size of the system in areas,; , adding appropriate valves where needed and replacing fire, plugs. For these instances I believe we still have a` significant problem in showing benefit when property, is • already 'served and /or assessed. 4. I' believe that the water system should be run as a separate,: and distinct fund which is supported totally by the users • of the system as we plan to do with the sewer system,'and ` ` as you do with the electric utility. If the system•is not capable of making a profit because of unfunded or underfunded'., maintenance, reconstruction and improvement needs over .• • a'short period, I believe this needs to be determined and:'; discussed. On the other hand, the long range rate system . should be set to achieve a goal of self support. • ' • 5.' It would be a big help to have a policy set as soon as possible in order that we could get on with the Holmes Street project. As developers of the areas known as Halo First and Second Additions, we felt it appropriate to add our input to your decision on whether, to appeal the recent court decision in favor of Vickers. In particular, we wanted to bring your attention to the practical effects of prolonging this litigation. Appeal would obviously delay the construction of the Vickers station. The damages which we and Vickers would suffer as a result can be adequately covered by the appeal bond which the city would post. However, the effects of this legal dispute are much broader. We have already lost an excellent chance for private financing of a motel at the corner of Marschall Road and Hwy. 101, which was dependent on closing the Vickers transaction. We are still attempting to arrange motel financing, and to promote other development on Halo First and Second Additions, but our task is made much more difficult by the uncertainty as to when the closing and construction will begin on Vickers. This uncertainty and the resulting delay of development does no more good for the City than it does for us. Therefore, we are hopeful that the Council will abide by the previous decisions of the Planning Commission, half the Council and Judge Mansur that the Vickers station would be a positive addition th the City of Shakopee.
