HOUSING AND REDEVELOPMENT AUTHORITY
SPECIAL SESSION SHAKOPEE, MINNESOTA JUNE 24, 1980
Chrmn. Hullander called the meeting to order at 8:10 P.M. with Cncl.
Lebens, Leroux' and Colligan present. Absent: Cncl. Reinke. Also present;
HRA Director, Jeanne Andre, City Attorney, Julius A. Coller,II, City Engineer
H.R. Spurrier, and Finance Director, Gregg Voxland.
The HRA Director indicated that Clete and Larry Link have withdrawn their
proposals to build one duplex each in the Fourth and Minnesota Neighborhood
Revitalization Project, therefore new proposals must be selected. She
recommended the proposals by Goodwin Construction and Joe Miller Construction
Colligan /Lebens moved to ask Goodwin and Miller to add one more unit to their
work load rather than seeking another builder. Motion carried unanimously.
Discussion was held regarding a letter from Mr. Goodwins Attorney, Mr.
William Odell, regarding three changes requested in the proposed development
contact, summarized as follows:
1. Reasonable notice will be provided prior to drawing on letter of
credit. The same letter of credit will be used in,sequence for
each building.
2. Add damaged by the Builders or its sub - contractor to clause re-
garding replacement of public improvements.
3. Add provision for HRA to buy building if no eligible buyer found
within 6 months of completion.
Mr. Goodwin was present in the audience and commented on Mr. Odell's letter.
Leroux /Colligan moved to amend the previous contract to include the clauses
recommended by Mr. Odell as stated above. Motion carried unanimously.

HOUSING AND REDEVELOPMENT AUTHORITY

Chrm.Hullander called the meeting to order at 7:32 P.M. with Comm.Lebens,
Reinke, Leroux, and Colligan present. Also present were Mayor Harbeck,
City Admr. Douglas S. Reeder, City Engineer H. R. Spurrier, Ass't. City
Attorney P. R. Krass, and H.R.A. Director Jeanne Andre.
Colligan /Lebens moved to approve the Minutes of June 3rd and June 17th,
1980, as kept. Motion carried unanimously.
Colligan /Leroux offered Resolution No. 80 -5, A Resolution Authorizing
Execution of An Amendment to The Redevelopment Contract, and moved its
adoption.
Comm.Reinke asked if there were sufficient funds available to fund the
installation of a fence around the Kmart site, which fence would become
part of the Kmart tax increment project upon adoption of Res. No. 80 -5.
The City Engr. explained the difference between on site and off site
improvements and stated that there was more than sufficient funds to
pay for the installation of a fence. Discussion followed on whether or
not the installation'of the fence should wait until the improvements in
process are completed.
Colligan/Lebens moved to recess for ten minutes, at. 8:05 P.M. Motion
carried unanimously. Shakopee was experiencing a severe thunder storm.
Hullander /Lebens moved to reconvene at 8:14 P.M. Motion carried
unanimously.
Upon question of the Chair, "Shall Resolution No. 80 -5 now pass ?"
Roll Call: Ayes; Hullander and Colligan

Chrm. asked the Commissioners in opposition to Res. No. 80 -5 to explain
why. Comm.Lebens, Reinke, and Leroux explained why they were opposed
to Res. No. 80 -5, which would add to the tax increment project, a fence
around the Kmart site.
Leroux /Lebens moved to reconsider Res. No. 80 -5.

The H.R. A. Director reported on the progress on the Elderly High -Rise.
Work on the High -Rise is ahead of schedule, with occupancy expected in

October. The City has...been awarded $11,282.00 under the Title III -B
Older Americans Act Grant to purchase equipment for the multi - purpose
' center to be located in the community room of the High-Rise. .The Jaycee
Women have contributed $1,000.00 for window covering or other furnishings
for the Center.

Staff was directed to prepare a Certificate of Appreciation to the
Shakopee Jaycee Women, in appreciation of their contribution.
Leroux /Colligan moved to approve the expenditure of $50.00 for the
H.R.A. Director to become a notary public.

Chrm.Hullander asked to postpone his report on the National Housing &
Redevelopment Officials Workshop until the next meeting, because of the
lateness of the hour.
Leroux /Hullander moved to allow an increased cost of $285.00 to Joe
Miller Construction for the underwriting of a letter of credit, for
the 4th and Mn. Neighborhood,Revitalization Project.
Roll Call: Ayes; Unanimous Noes; None Motion carried.
Chrm.Hullander explained that the reason for the delays in the 4th and
Minnesota Street Project is due to the torrencing process. It looks
like it will be August before construction will commence.
The H.R.A. Director explained the contract clauses requested by Goodwin
Builders, one of the contractors for construction of homes at the
4th and Mn. Revitalization site.
Leroux /Colligan moved that the Shakopee H.R.A. will reimburse Goodwin
Builders for the cost of FHA appraisals on the buildings to be constructed
if the contract is nullified.

Lebens /Leroux moved that if the HRA directive to start work is given after
August 31, 1980, costs for each building will be increased by 2% to Goodwin
Builders, (this amounts to $1,520, or $750 per unit) and if the directive
to start work comes after October 20, 1980, the contract will be nullified.

Hullander /Reinke moved that no matter when the start work directive is
given, a cost increase for heating the units will be allowed to Goodwin
Builders for each building which has not been completed and closed prior
to December 1st, 1980 at the rate of $50 /unit /mo for the months of December,
January & February; said expenses to be payed out of the H.R.A. fund.

RE: Agreement with Scott County HRA for Administration of
Home Improvement Grants
DATE: July 31, 1980
I previously met with Jim Degiovanni of the Scott County HRA
to suggest an alternative to a lump -sum payment to them for services
they provide Shakopee Citizens, such as Section 8 rental assistance
and MHFA loans and grants. The suggested alternative is a payment
for each grant administered to a Shakopee resident, based on the
average amount of time spent by the Scott County Staff (and not
reimbursed by MHFA) in administering the grant. In their analysis
Scott County determined an average charge, at this time, of $108.50
per MHFA grant. This seems like a reasonable charge for a worth-
while service to Shakopee residents.

I ther0fore recomment that the Shakopee HRA take action to
authorize an agreement with the Scott County HRA for the administration
of the MHFA Grant Program to Shakopee residents, to be billed to the
Shakopee HRA .on an individual case basis. The agreement should
also authorize the provision of additional services that could be
most appropriately delivered to Shakopee residents by the Scott
County HRA as they arise.

RE: Amendment of HRA By -Laws

The City Attorney is preparing a resolution regarding a pro-
posed amendment to Article I, Section B, of the HRA By -Laws. This
section indicates that the HRA has a seal bearing its legal name.
In the recent legal proceedings to torrence property owned by
the HRA in the vicinity of Fourth Avenue and Minnesota Street, a
discrepancy has been discovered. Although the above - mentioned
Section B indicates that the HRA shall have a seal bearing its legal
name, in fact this is not true. The legal name of the HRA is as
follows: "The Housing and Redevelopment Authority in and for the
City of Shakopee, Minnesota." The seal we now have reads "Housing
and Redevelopment, Shakopee, Minnesota." The City Attorney has
indicated that legally the HRA should not have a seal at all. As
the proceedings for the torrencing and registration will be
happening within the next month, the most expediant approach is to
amend i.he By -Laws such that the HRA does not have a seal.

RESOLUTION AMENDING THE BY- LAWS,,OF THE HOUSING AND REDEVELOPMENT AUTHORITY
IN AND FOR THE CITY OF SHAKOPEE
WHEREAS, "The`Housing'and Redevelopment Authority in and for the City of Shakopee
adopted,certain By -Laws by Resolution on May 14, 1968, which said By -Laws have

remained.in force and effect from said date, and

,..WHEREAS, Article I, Section B, provides that the' Authority shall have a

corporate bearing its legal name and the'year of` incorporation. But, the

Authority has not•had and still does have a corporate seal bearing its legal
name ,and the seal that it does is a non- entity,•and
,, WHEREAS, It is not necessary that the Authority have a seal and that the
Authority. it would be to the best interest of all parties concerned to
abolish the seal for the Authority, and
WHEREAS, legal notice has been sent to each member of the Authority and to each
member of the Council as required'by the By -Laws of intention to amend the By -Laws.
WHEREFORE, BE IT RESOLVED by The Housing and Redevelopment Authority in and for •
the City,of,Shakopee that effective this date Section B of Article T. is hereby
abolished.
BE IT FURTHER RESOLVED That effective this date a new Section B shall be added
to Article I as follows:

RE: Resolution No. 80 -6, Authorizing the Establishment of a
Trust Account
DATE: August 1, 1980
The Assistant City Attorney has previously advised the HRA that
a special trust account for escrow funds (earnest monies) from the
sale of real estate should be established. Review of previous resol-
utions authorized by the HRA regarding bank accounts indicated that
two resolutions now in effect have the stipulations:
Resolution No. 6 - Indicates that the First National Bank of
Shakopee will be the official depository of the HRA and gives
and officer of the HRA the authority to open the necessary
accounts,.or initiate loans, with the Executive Director and
Chairman or Vice - Chairman of the HRA designated as authorized
signatories.
Resolution No. 77 -4 - Indicates that the HRA checking account
will be merged with that of the City, with a separate fund to
be for the HRA. This resolution thereby allows
the City to establish the authorized signatories.
Resolution No. 80 -6, presented for your adoption allows the
establishment of a trust account with the Executive and Deputy
Director of the HRA and the Finance Director of the City of
Shakopee listed as authorized signatories.

A RESOLUTION AUTHORIZING THE ESTABLISHMENT
OF A TRUST ACCOUNT FOR ESCROW FUNDS
FROM THE SALE OF REAL ESTATE
WHEREAS, the Shakopee Housing and Redevelopment Authority
has by Authorization of Resolutions No. 6 and 77 -4 made certain
determinations regarding the establishment of bank accounts; and
:WHEREAS, it has now become necessary to establish a trust
account''for the deposit of earnest monies to be held in escrow
for 'the sale of certain ,real estate; and
WHEREAS, this trust account .will be completely separate and
in no,way-'interrelated with the checking or any other acounts
previously established.
l''''/NOW,-THEREFORE, BE IT RESOLVED BY THE SHAKOPEE HOUSING AND
REDEVELOPMENT AUTHORITY THAT:
1'.'''A "trust account in its name be established at the First
National Bank of Shakopee for the purpose of holding

2. The account be established with two signatures necessary
for all transactions, and that three persons be authorized
to serve as signat?ries, including the Executive Director

RE: Letter of Credit Requirements
Haefner Enterprises
DATE: August 1, 1980
Simon Haefner has requested the HRA reduce his required letter
of credit ($52,200.00 on $42,000.00 building) by approximately
$25,000.00. As you know, Mr. Haefner will utilize a modular unit for
the top floor, of the house to be constructed on Lot 2, Block 2,
Macey Second Addition. He must provide the factory that produces
the modular unit a letter of credit for that amount, and pay them in
full for the unit when it is delivered. (They then provide a lien
waiver.) Therefore with our letter of credit, he would have extended
his own credit to $77,500.00, which is far more than the value of
the house. It is a hardship for Mr. Haefner to provide this amount
of credit.
Mr. Haefners bank has agreed to send me a copy of the letter of
credit to the modular home company. The City Attorney has agreed to
explore the possibility of involving the HRA in the lien waiver or in
some way assuring that the unit delivered to the site cannot be other-
wise encumbered. I will report any further information available on
this issue at the HRA meeting. I would like to determine the concerns
and opinions of the HRA members regarding Mr. Haefner's request at the
meeting.

RE: Establishing value of lots in
Macey Second Addition
DATE: July 29, 1980
The actual value of the lots created in Macey Second
Addition will not be used in establishing the price of homes
sold under the Shakopee 235 Homeownership Program. However,
the HRA has created a deed restriction requiring the home
purchasers to repay the Shakopee Housing and Redevelopment
Authority an amount equal to the lot value (or a propor-
tion thereof) if the home is sold within five years of
the date of purchase. Therefore we must establish a value
for each lot to be used in the deed restriction. Based
on the recommendation of Leroy Houser, Shakopee Building
Inspector, I recommend that a price of approximatley
$1.25 per square foot be used to establish a value for
the lots on which buildings are now scheduled for con-
struction. Applying that rate to each lot and leveling
the price off, I recommend the establishment of the
following prices for the lots in Macey Second Addition:
Lot 1, Block 1 $10,500
Lot 2, Block 2 $13,000
Lot 3, Block 2 $ 7,900
Lot 4, Block 2 $ 7,900

Homes for Fourth and Minnesota Neighborhood
Revitalization Project

You have previously reviewed the contract format to be used
in the contracts for deed to be executed with the contractors for
the Fourth and Minnesota Project, and the description of the homes
to be built. The negotiations have been completed and we are now
ready to enter into the contracts.
Recommendation: To authorize appropriate HRA officials to
execute contracts with the following:
Goodwin Builders, Inc.
Four duplex buildings to be completed in 90 days at a
cost of $71,141.00 for each building on the following
lots in Macey Second Addition:
Lots 5 and 6, Block 2
Lots 7 and 8, Block 2
Lots 9 and 10, Block 2
Lots 1 and 2, Block 3
Haefner Enterprises, Inc.
One single family home to be completed in 60 days at
a cost of $42,980.00 on Lot 2, Block 2, Macey Second
Addition.
Joe Miller Construction, Inc.
One single family home to be completed in 60 days at
a cost of $47,265.00 on Lot 1, Block 1, Macey Second
Addition.
One Duplex building to be completed in 60 days at a
cost of $79,818.00 on Lots 3 and 4, Block 2, Macey's

Costs sited do not include the cost of points. Certain
additions (ie. appliances) would be added at an additional
charge.

I recommend the HRA approve the following bills:
Soil Testing Services of Minnesota, Inc. $2,666.39, for field
monitoring and testing services at the K -Mart Distribution Center
to be withdrawn from on site improvement fund of tax - increment
proceeds.
Von Klug and Associates, $127.50, for Professional Relocation
Services, Fourth and Minnesota Revitalization Project. Payment
of this bill will leave a total of $1,484.31 until the revised
contract maximum is reached.

A RESOLUTION DENYING A REQUEST FOR A VARIANCE BY
STEVEN I-IENTGES (Case #PC 80-21V)
WHEREAS, Mr. Steven Hentges made application to the City of
Shakopee for a 5 foot variance from the side yard set back requirements
in order to buildan attached garage;and
WHEREAS, the City Staff at the Planning Commission meeting raised
questions concerning the potential impact on neighboring property values
which could result from granting the variance; and
WHEREAS, the Planning Commission held a public hearing on June 19,
1980 and all persons in attendance were given the opportunity to speak; and
.WHEREAS, the Shakopee Planning Commission amended and approved
Variance Resolution No. 254 to grant a 2 foot sideyard setback variance; and
WHEREAS, the applicant and the applicant's neighbor both appealed
the decision of the Planning Commission; and
WHEREAS, the members of the City Council discussed the appeal of
Variance Resolution No. 254 at its July 15, 1980 meeting and took action
to deny the variance unanimously;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, that the variance request of Steven Hentges (PC 80 -21V)
for property located at 3055 Hauer Trail, legal description of record, is
hereby denied for,the following reasons:
The lack of findings 1, 2, and 4 of Section 11.04
Subd. 5A of the City Code as required for granting
a variance.

Recommendation:

Dear Mr. Reeder;
Scott County has been mandated by the Minnesota State Legislature,
(Chapter 564) to identify four potential sanitary landfill sites and one
site for demolition debris within the County. To accomplish this task,
a Solid .Waste Advisory Committee is being used to assist the County in
identifying concerns of the solid waste industry, citizens and the muni-
cipalities. This committee will be working on the broad spectrum of issues
relating to Scott County's 20 year solid waste master plan. The immediate
task of identifying locations for landfills requires more extensive input
than this existing committee can provide. The county is therefore requesting
• that a representative from your governing body be appointed to serve on a
temporary task force to assist us in this process. The role of this task
force will be to:
1. Assist in the development of the criteria to be used in screening
Scott County for suitable landfill locations.
2. Work with County staff and a consultant to review the application
of the siting criteria to Scott County.
3. Assist in identifying landfill sites by making recommendations
to the County Board.
The seven metropolitan counties have joined forces and are in the
process of selecting a consultant to assist us in this formidable task.
The Scott County Solid Waste Advisory committee, previously established,
has begun to formulate siting criteria also. Their recommendations, along
with recommendations from this new "Landfill Siting Task Force" will be
presented for review and comments to the Scott County Planning Advisory
Commission and ultimately to the Scott County Board. After final County
Board approval, these siting criteria will be given to the consultant to
use in identifying suitable sites.
The entire county will be screened for landfill sites. Potential
sites must be a minimum of 80 acres in size with additional land of equal
size for a buffer zone. We are urging that your governing body appoint

Some time ago several members of the City Council requested
information on the uniform policy used in the police department.
Attached is the policy.
We currently have two different methods of paying for uniforms
because of the two different contracts with sergeants and patrolmen.
The patrol contract which goes to 1981 includes a specific payment to
the uniformed policemen which we make at the beginning of each year.
The non uniformed police receive one -half of the uniform allowance and can
submit vouchers for the other half if they purchase police uniforms.
The-- sergeants do not receive a clothing allowance, but rather the
City /buys whatever they need in accordance with the attached lists.
The officer gets the purchase approved before buying.
It is.my preference to convert the entire department to the
,t sergeants plan. This is generally cheaper and insures that all money
is spent on the purchase of uniforms. I will include this request
in the negotiations for 1981.

SECTION 1. UNIFORM CAP: The uniform cap shall be oval, it
may have the permanent cap cover, and it shall
have a patented shape support. The cap visor
shall be black vinyl and shall be no longer
than 2 ". The cap shall have a removable cloth
band for ventilation. The color of the band
will conform with the color of the cap. The
color of the cap shall be navy blue elastique.
Subd. 1. The patrolman's cap shall be dressed with a silver
metal stretch cap strap and two (2) silver police
buttons. _
Subd. 2. The sergeant's cap shall be dressed with a gold
metal stretch cap strap and two (2) gold police
buttons.
Subd. 3. ' The deputy chief's cap shall be dressed with a
gold cloth braid cap strap and two (2) gold
police buttons.

100% polyester warp knit #179.
SECTION 8. UNIFORM SUMMER JACKET: For all ranks.

with or without inside taffeta lining (no quilt).
It shall have a navy blue corduroy collar. It
shall have two upper square three point button
outside pockets with velcro closures on the pocket
flaps. It shall have a double bottom band with
elastique at sides. The jacket should have a re-
. inforced badge eyelet which is to be centered above
the left pocket.
SECTION 9a. UNIFORM WINTER JACKET -WAIST LENGTH: For all ranks.
Subd. 1. The fabric shall be navy blue wearnyl.
• Subd. 2. The jacket shall have a quilted lining, collar to
be black corduroy with navy blue wearnyl trim on
collar frame, two (2) outside patch type pockets,
epaulets to be sewn down, two (2) pockets inside
lining, 7" on right side, 5" on left side, knit
waist band.
SECTION 9b. UNIFORM WINTER PARKA: Optional for all ranks.
Subd. 1. Minneapolis Police style parka.
Subd. 2. Fabric shall be navy blue wearnyl.
Subd. 3. Parka shall have zip -off hood and side zippers on
right and left sides, two (2) patch pockets in
front, with badge eyelet to be mounted directly
above left pocket.

must be worn, the white shall not be exposed.

each completed four (4) years of service with

Subd. 2. Service chevrons shall be silver in color for
the rank of patrolman, gold for sergeant and
above, and shall be sewn upon a navy blue cloth
backing.
SECTION 21. SERGEANT CHEVRONS: Sergeant rank.
Subd. 1. Sergeant chevrons shall be gold in color and
affixed to each sleeve of uniform shirt, jacket,
or parka.
SECTION 22. SHOULDER EMBLEMS: For all ranks.

We have been exploring the various options for providing liability
insurance for city employees with the Assistant City Attorney in order
to make sure all employees,and especially policemen, are well covered.
There is a police liability insurance policy available through the
International Chiefs & Police which appears to give us the coverage we
need and it is our recommendation that we obtain it at an additional
cost of approximately $4,500. Rod Krass will have additional information
on this coverage at the meeting.
Recommendation:
It is recommended that the City Council authorize the purchase of
additional liability insurance for city employees at an annual additional
cost of not to exceed $4,500.00.

RE: Proposed Metropolitan Council Plan Amendment Guidelines

Attached are draft guidelines establishing a procedure for
review of proposed amendments to local comprehensive plans.
The Metropolitan Council held a public hearing.on Thursday,
July 31st to receive comments on the proposed guidelines. The
public hearing record will be held open until September 2nd to
permit submission of written comments.
Section 473.856 subd. 2 of the State Statutes (Metropolitan Land
Planning Act) requires counties, cities and townships that wish
to amend their comprehensive plans to follow the same review and
approval procedure they used when adopting their plans. This
means that local governments must submit proposed amendments to
adjacent communities and affected school districts for comment,
and to the.Metropolitan Council for review.
The proposed guidelines list 12 types of changes in a local
comprehensive plan that are amendments. The guidelines provide
a review of 90 -120 days. following Metropolitan Council receipt
of a proposed amendment.
The staff comments in response to the proposed guidelines follow.
Staff requests City Council approval (with additions, deletions
or corrections) prior to entering into the public hearing record.

Dear Mr. Weaver:
Thank you for the opportunity to comment on the Proposed
Metropolitan Council Plan Amendment Guidelines. Following
review of the Guidelines by City staff, the City Council cn
August 5, 1980, authorized transmittal of the following comments:
1) IV. Review Procedures. In the event that all units of
government exercise their full period of review, it is
possible for amendments to require 150 days for review
and comment. All opportunities to compress this review
period should be explored.
2) III 1. a & b. Does this include trunk and lateral lines?
Sewer service should be defined.
3) IV. Review Procedures. Transmittal of an amendment
to adjacent governmental units may well create more
paper shuffling than good if a proposed action has no
impact to units of government on the other side of town.
Some effort should be made to define those situations
where there are impacts to adjacent jurisdictions.
4) The City would like to be informed as to how compliance
with these procedures will be enforced.
5) On balance, the City of Shakopee recognizes the need
for a review and comment procedure for comprehensive plan
amendments. This review should be reserved however, for
that class of amendments that are truly regional concerns.
There can be situations where any of the amendments (III.1
a through 1) may be very local in nature without potential
for outside impacts. These amendments should not bear the
burden of delay involved in the review process.

The City of Shakopee recommends that:
-- The types of changes be defined more clearly
and reflect the difference between the urbanized areas
and the rural areas, and;
-- There be a provision whereby the Metropolitan Council
can waive the review procedures for amendments that
are not regional concerns.
In conclusion, we urge that appropriate consideration be given
to the above concerns.

METROPOLITAN COUNCIL GUIDELINES
FOR REVIEW OF PROPOSED AMENDMENTS
TO LOCAL COMPREHENSIVE PLANS
I. PURPOSE AND OBJECTIVES
The Metropolitan Land Planning Act requires counties, cities, and
townships that wish to amend their comprehensive plans to follow the
same review and approval procedure they used when adopting their
plans. This means that local governmental units must submit proposed
amendments to adjacent communities and affected school districts for
comment and to the Metropolitan Council for review. Minn. Stat.
473.864, subd. 2 (1978).
The purpose of these guidelines is to establish a procedure for review
of proposed amendments to local comprehensive plans. The land
planning act authorizes the Metropolitan Council to prepare and adopt
such guidelines. Minn. Stat. 473.854 (1978).
Not all changes in local comprehensive plans are considered to be
amendments under these guidelines. Section III of the guidelines
lists 12 types of changes that are amendments. These changes fall
into three basic categories: changes in local sewer service systems,
changes that may have impacts on regional facilities and systems, and
changes that may affect planned population density in rural service
areas identified in local plans.
The guidelines provide for a review period of 90 to 120 days following
Metropolitan Council receipt of a proposed amendment.
II. SCOPE
These guidelines apply to all amendments proposed by a local
governmental unit after it has prepared and adopted a comprehensive
plan in accordance with the land planning act. Proposed changes in
local comprehensive plans not included in the definition of
"amendment" in Section III are not subject to these guidelines and
need not be submitted to the Metropolitan Council for review. •
III. DEFINITIONS
The terms "Applicable Planning Statute," "Capital Improvement
Program," "Comprehensive Plan," "Local Governmental Unit," or "Unit,"
and "Private Sewer Facility," shall have the meaning given them in the
definition section of the land planning act, Minn. Stat. 473.852
(1978). As used in these guidelines, additional terms shall be
defined as follows:
1. Amendment - one or more of the following proposed changes to a
comprehensive plan.
a. Any change in the area to be served by public or
private sewer service from that identified for such
.,.{ service in the local sewer policy plan.

3. Airport reference point means the geographic center of an
airport, as identified in the airport layout plan for each airport.
4. Change includes, but is not limited to, changes in the type,
location, intensity, and extent of land and water use.
5. Implementation program means the implementation program
required by the land planning act, at Minn. Stat. 473.859, Subd. 4,
(1978)._
6. Land Planning Act means Minn. Stat. 473.851 - 473.852 and
Minn. Stat. 473.175 (1978).
7. Metropolitan interchange means the physical means by which a
metropolitan transportation facility is accessed and connected to
other metropolitan facilities and /or elements of the local
transportation system.
8. Principal or intermediate arterial means a principal or
intermediate arterial as these terms are defined in Table 12 and 13 of
the Metropolitan Council's Transportation Development Guide /Policy
Plan.
9. Regional recreation facility means a regional park, regional
park reserve, linear park, or other regional recreation facility as
r;,; identified in the Metropolitan Council's Recreation Open Space
Development Guide /Policy Plan.
10. Rural Service Area means that area identified in a local
comprehensive plan prepared under the land planning act that is not
planned to receive urban services, including central sewer and water
services, before 1990.
IV. REVIEW PROCEDURES
1. After consideration of the amendment but before final •
approval, the governing body simultaneously shall transmit a copy of
the proposed amendment to the Metropolitan Council and to adjacent
governmental units and affected school districts. The transmittal
letter to the Council shall contain an affidavit of mailing
identifying the adjacent governmental units and affected school
districts notified of the proposed amendment.
2. Adjacent governmental units and affected school districts
shall have 30 days from receipt of the proposed amendment in which to
notify the Metropolitan Council and the proposing unit of government
of their intent to review and comment upon the proposed amendment.
Failure to submit a notice of intent to review and comment within the
time limit herein specified constitutes a waiver of the right to so
review and comment.

Larry Martin, City Assessor, has recently completed the requirements
to become an Accredited Assessor in the State of Minnesota as indicated
in the attached letter. This is a significant achievement in his field.
He is only the second Assessor in Scott County to achieve this distinc-
tion. (Leroy Houser is the other). Scott County is mandated by law
to have an Accredited Assessor by January 1, 1981; however, no one has
qualified to date. The requirements to become accredited are shown on
the attached sheet.
In addition to this achievement, I was very pleased with the
handling of the property valuations in the City of Shakopee this year.
While everyone may not agree with the valuations, I believe the setting
of the valuations was handled in a very professional manner and the
contact with the local residents was well done.
In order to encourage Larry to achieve accreditation, I indicated
to him that I would review his salary upon achievement of this goal.
He has worked hard on his own time and I believe merits some recognition.
In reviewing the salaries of other City Assessors in the metropolitan
area, I find that there are few assessors in cities the same size as
Shakopee; however, the cities which do have assessors are paying
significantly higher salaries than are we, as shown on the attached taken
from the 1980 Salary Survey. The Scott County Assessor is paid significantl
higher ($26,559) as are the Deputy Assessors ($15,772, 17,233, 19,800,
20,767, and 21,065).
In addition to a salary adjustment, it is recommended that the
City Assessor be granted a car allowance of $100.00 instead of the use
of a city car. The assessing department does not use a car enough to
justify a staff car and therefore it is in the best interest to pay
an allowance or mileage. In the case of department heads we have always
paid car allowance.
Recommendation:
That the City Council authorize a salary increase for the City
Assessor from $17,000 to $19,000 and that a car allowance of $100 per
month be established.

History: This property was originally platted as part of
the Minnesota Valley 3rd Addition.
URBAN SERVICES AVAILABILITY:
Storm sewer: One 13th Avenue
Sanitary Sewer: 8" line on Polk Street
Water: 12" watermain on Polk Street
All utilities are constructed to the front property lines.
CONSIDERATIONS:
1. The present request is for a re -plat of 5 lots from the
approved Minnesota Valley 3rd Addition with the inclu-
sion of approximately 32,000 addition square feet from
Outlot A (for a total of approximately 90,000 square feet).-

by the Planning Commission on May 10, 1979 and by the
City Council on May 22, 1979. All the conditions of
of final approval have been met.
2. The proposal is to develop the same number of units
(20,townhouses) on 90,160 square feet rather than on
59,760. The additional space will be utilized as open
space and maintained by the homeowner's association.
3. The utilities will be served as originally planned in
the earlier plat with the exception of an extension of
services for Blocks 3 and 4 which will be set back ap- •
proximately 120' further off the streets.
4. The utilities manager has recommended that the ease -,
ments between old lots 3, 4, 5, 6, and 7 will not be •
needed .but the easement along the rear of lots 3, 4,
5, 6 and 7 still are required. A 10' utility easement
on the north side of building 3 will be necessary,
5. Each unit will be served by a separate sewer and water •
.service.:. The sewer will be served with a 6" line from
the street laterally with a 4" service to each unit.
Water will be served with •a 2" lateral and 1" indi-
vidual 'service: All utilities will be within utility
easements.
6. The proposed siting of all buildings meet setback
requirements. A blanket variance was granted re-
ducing the required setbacks along Polk Street from
50' to 25'.
7. Staff has reviewed future transportation options to
serve this area. The present request does not limit
any of the feasible options of future circulation
plans for this area.
8. The City Engineer has determined that the proposed
subdivision does not increase the amount of run -off
already approved as part of Minnesota Valley 3rd
Addition.
9. The development of this area of the City is restric-
ted under the sewer flow allocation plan as adopted
by the City Council on February 22, 1977. The pro -
posed development is in conformance with this al-
location' plan.

WHEREAS, the Planning Commission of the City of Shakopee has approved

adoption; and
WHEREAS, all notices of hearing have been duly sent and posted and all
persons appearing at the hearing have been given an opportunity to be heard thereof;

WHEREAS, the City Council has been fully advised in all things.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

RE: Easements from Gene Hauer
DATE: July 31, 1980
Bo Spurrier and I met with Gene Hauer on Thursday, July 31st, and
discussed the easements needed for the various water and sewer projects.
CR -16 Watermain (tank to well)
Mr. Hauer said he would grant the needed easements for this project
after he has been given a map showing the location of the easements needed.
We will give this . t� him and discuss it again before the Council meeting.
Hauer's Addition Sewer Laterals 80 -1
Mr. Hauer indicated that he did not realize that we would save money
by locating the laterals off the property line because the lines would not
be so deep. He indicated that he did not have a big problem with granting
the easement after we give him a map showing thelucation. We will give him
the map and discuss it again before the Council meeting.
VIP Sewer Easements 79 -4
Mr. Hauer indicated that because the pipe cuts across some lots, that
he could not give the easements without some payment. We told him that if
we could bid the project now, that we would get the best possible bids. He
said we should go unless we could go with the original agree-
ment.

RESOLUTION NO. 1665
A RESOLUTION ESTABLISHING PROCEDURES FOR WATER PROJECTS
WHEREAS, the City of Shakopee has created a Shakopee Public
Utilities .Commission and empowered it to operate the water utilities within
the City of Shakopee; and
WHEREAS, the Shakopee Public Utilities Commission is so function -
ing; and
•
WHEREAS, it is in the best interests of the City of Shakopee and
the Shakopee Public Utilities Commission to establish a system for the func-
tioning of water projects within the City of Shakopee;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE AS FOLLOWS:
1. That no water projects under Chapter 429 of Minnesota Statutes
or otherwise shall be ordered by the City Council of the City of Shakopee
until said project has been approved by resolution by the Shakopee Public
Utilities Commission. The Commission shall be given all relevant documents
related to said proposed improvement project and have such documents deli-
vered to its office at least fifteen .05) days prior to consideration there-
of. The Commission may, in infrequent situations, determine that it is able
to consider an act on said proposal in a shorter time period.
2. Any resolution passed by the City Council ordering any
water projects under Chapter 429 of Minnesota Statutes or otherwise shall,
in the "WHEREAS" portion thereof, state that the Shakopee Public Utilities
Commission has considered and approved said project, and shall attach the
resolution of the Shakopee Public Utilities Commission approving said pro -
ject to its resolution ordering said project.
3. No final payments or acceptance of any water project shall be
made by the City of Shakopee until the Shakopee Public Utilities Commission
approves said project in writing.
4. The City of Shakopee agrees to advise Shakopee Public Utilities
Commission of all street or sewer projects the City contemplates, and to pro-
vide all documents related thereto to the of the Shakopee Public Util-
ities Commission at least fifteen (15) days prior to the City's consideration
of said projects, and allow the Commission to review and comment thereon.

CITY GOVERNMENT OF THE CITY OF SHAKOPEE OF ANY WATER
PROJECTS CONTEMPLATED BY THE SHAKOPEE PUBLIC UTILITIES COMMISSION
WHEREAS, the Shakopee Public Utilities Commission is charged with
the responsibility of operating and maintaining the water system within the
City of Shakopee; and
WHEREAS, on occasion the Shakopee Public Utilities Commission
considers and implements extensions of its water system which do not involve
financing contemplated under Minnesota Statutes Chapter 429, which financing
would require the approval of the City Council of the City of Shakopee;
NOW THEREFORE, BE IT RESOLVED BY THE SHAKOPEE PUBLIC UTILITIES
COMMISSION AS FOLLOWS:
' 1. The Shakopee Public Utilities Commission does hereby agree
to advise the City Council of the City of Shakopee of all extensions of
the water system operated by the Public Utilities Commission and to provide
the City all documents related thereto at least fifteen (15) days prior to
consideration of said extensions by the Shakopee Public Utilities Commission
to allow the City to review and comment thereon.
2. No extension of said water system by the Shakopee Public
Utilities Commission shall be made without compliance to this resolution,
and the resolution approving and ordering said extension shall state that
this resolution has been complied with.

RE: Election Judges for Primary Election
DATE: August 1, 1980
Attached is the resolution appointing election judges for the
upcoming primary election on September 9th. This should be adopted
at the next Council Meeting.
I have personally spoken with everyone in the resolution and
they qualify and are willing to work for the election. I haven't
been able to reach a few people and may wish to make additions to
the resolution Tuesday, before it is adopted.
In the past we have paid election judges $2.50 /hr and Chairman
$45.00 for their time. I am recommending that that be increased to
$3.00 /hr for election judges and $3.50 /.hr for the Chairman. Although
most of our regular election judges do not work for the money,I am
having difficulty getting enough judges and believe that it may help
if we did pay at least the minimum wage.

PRECINCTS IN THE CITY OF SHAKOPEE, APPOINTING JUDGES OF ELECTION,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, That

Attached is the revised assessment roll for Park Ridge Drive -
Special Improvement District 79 -1.
All assessments are computed on a per lot basis except for the
City of Shakopee assessment for park and roadway which are on
a front foot basis proportionate to the total number of front
feet in the special improvement district.
A per lot basis was used simply because of variance in front
footage along Park Ridge Drive, which would cause disproportionate
assessments to be levied.
After the bid opening July 16, 1979, residents were advised that
the estimated total assessments would be $9,389.00 if all
improvements were installed. The final assessment is actually
$8,703.86, somewhat less than the original estimate.

A RESOLUTION ADOPTING ASSESSMENTS
1979 -1 PUBLIC IMPROVEMENT. PROGRAM

WHEREAS; Pursuant to proper notice duly given as required by law, the
City Council of theCity of Shakopee met and heard and passed upon all objections
,.to the proposed assessments of
Park Ridge Drive between Hauer Trail and the Railroad tracks
by bituminous surfacing, watermain and sanitary sewer service
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE,
MINNESOTA:
1. That such proposed assessments together with any amendments thereof,
a copy of which is attached hereto and made a part hereof, is hereby accepted
and shall constitute the special assessment against the lands named therein and
each tract therein included is hereby found to be benefited by the proposed
improvements in the amount of the assessments levied against it.
2. Such assessments shall be payable in equal annual installments extending
over a period of ten (10) years, the first installment to be payable on or before
the first Monday inJanuary, 1981, and shall bear interest at the rate of 8.75
percent per annum from the date of the adoption of this assessment resolution.
To the first installment shall be added the interest-on the entire assessment
from the date of this resolution until December 31, 1981, and to each subsequent
installment when due shall be added the interest for one year on all unpaid
installments.
3. The owner of any property so assessed may, at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment, to the
City Treasurer, except that no interest shall be charged if the entire assessment
is paid within thirty (30) days from the adoption of this resolution; he may
thereafter pay to the County Treasurer the installment and interest in process
of collection on the current tax list, and he may pay the remaining principal
balance of the assessment to the City Treasurer. •

4. The clerk shall file the asessment rolls pertaining to this assessment
in his office and shall certify annually to the County Auditor on or before
October 10th of each year the total amount of installments and interest which are
to become due in the following year on the assessment on each parcel of land
included in the assessment roll.

RE: Assessment Roll for County Road 83 Watermain
DATE: August 1, 1980
The assessment roll distributed July 23, 1980, for the above-
• reference improvement, did not take into account oversizing
costs to be paid by Shakopee Public Utility Commission.
The revised roll takes oversizing costs into account. The
oversizing is paid on the difference in cost of installation
rather than the cost of material as traditionally paid by the
Utility Commission.
Oversizing is calculated in this manner because of statements
made by the Utility Commission regarding oversizing costs on
other trunk facilities.
The Shakopee Public Utility Commission share of4:the wate.rmain
project amounts to 48.8 percent of the project cost or
$31,380.98, leaving $32,924.16 to be assessed.
I will have detailed information prior to or at Council meeting
if there are any questions regarding these: computations.

PREPARATION OF PLANS
80 -8 Trunk Highway 101 Service Road
WHEREAS, a resolution of the City Council adopted the 17th day of June 1980,
fixed a date for a Council hearing on the proposed improvement of T. H. 101
Frontage Road, beginning at Shiely's Entrance Road and continuing easterly
approximately 5,500 feet more or less to County Road 89 and thence connecting
at County Road 89 by roadway construction and drainage, and
WHEREAS, ten (10) days' published notice of the hearing through two
weekly publications of the required notice was given and the hearing was held thereon
on the 5th day of August, 1980, at which all persons desiring to be heard were given
an opportunity to be heard thereon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA:
. 1. Such improvement is hereby ordered as proposed in the Council
resolution adopted June 17, 1980,

Council Members:
Following discussion with Metro Council staff members, we have
preparedsupplemental data for the Comprehensive Sewer Plan.
The data is primarily related to estimating future sewage flows
to the MWCC Lift Station and the feasibility of providing a
relief sewer as modified in the original comprehensive plan.
The MWCC staff in reviewing the plan, have indicated a concern
for the construction of the sewer proposed to releive the lift
station.' The supplemental data was requested for them to make
a determination of responsibility and timing.
The supplemental data includes population and sewage flow
projections in the presently sewered area of the City and on
particular the area from which the flows can be feasibly be
diverted to bypass the lift station. In addition, metered flow
data from MWCC and Raher Malting Co. is included. Population
projection data was developed with the assistance of Mr. Tim
Keane, City Planner, which is an integral part of estimating
sewage flows.-
In our analysis of the recorded meter data we found some incon-
sistances which would prevent our drawing conculsions without
further work.' According to recorded flow measurements and applying
flow factors:. as published by MWCC, the capacity of the lift
station has been exceeded during four of the last five years. The
inconsistancy is that according mainenance personnel, the station
has been able to meet all flows wihtout flooding.

RE: SPUC Outside Storage Area - -

Attached is a memo from Lou Van Hout concerning the use of City
property for SPUC storage of poles. I believe the area they have
agreed to is an appropriate location and would not interfere with City
needs at this time or in the foreseeable future.
Recommendation
It is recommended that the City Council approve the use of this
area by SPUC for a minimum of ten years and longer if the City does not
have a higher priority use for this area with the following conditions:
1. SPUC will erect a fence similar to the one currently in place
around the Public Works storage area
2. SPUC will provide appropriate landscaping along the Eastern and
Southern boundaries as required by the City ordinance
3. SPUC will be responsible for providing a suitable access road
to their area
4. SPUC will be responsible to insure that their road and fencing
are located on City property.

After meeting with you and Jim Karkanen to look at the site you proposed
for SPUC outside storage I have had a drawing made to determine more
precisely the area which we would have available to us.
I appears that the site contains about an acre and a half of land' (plus
some additional land when the Railroad property is available) which would be
sufficient space for SPUC storage. If we were to use this land SPUC would
leave the existing fence in place and install additional fencing along the
East and South lines and put a gravel drive entrance from the street.
• The length of time that this land will be reserved for SPUC use
continues to be a concern. Sensible planning would call for some assurance
that we could count on using this land for some time to come; however, I
can'see `your viewpoint that•you would not want to tie this land up forever.
A compromise which I feel would be satisfactory to all would be a no
less than 10 year commitment with the option that it could be extended by
mutual agreement of the City Council and Utilities Commission.
I have not yet presented this formally to the Utilities Commission but
feel that they would be in agreement with these terms. Please let me know •
if you feel these arrangements are workable.

I requested proposals from five firms: Toltz, King, Duvall, Anderson &
Assoc., Inc.
Donohue & Assoc., Inc. with Short -
Elliott- Hendrickson, Inc.
Rieke, Carroll, Muller Assoc., Inc.
McCombs - Knutson Assoc., Inc.
Bonestroo, Rosene, Anderlik & Assoc., Inc.
During the past two weeks, I have reviewed the proposals, and.visited the
offices of the firms in order to acquaint myself with the engineers responsible
for the work proposed.
All of the firms are qualified to perform Infiltration /Inflow Analysis.
Therefore, I will merely point out some of the differences in the companies.
Toltz, King, Duvall, Anderson & Assoc., Inc. and Donohue & Assoc., are very
large firms with more than 300 employees.
Rieke, Carroll, Muller Assoc., Inc. and McCombs - Knutson Assoc., Inc. are
large companies when considered with sub - constractors.
Bonestroo, Rosene, Anderlik & Assoc., Inc. is a medium sized company.
The difference between these firms is generally in the size of the communities
served by these different firms or the size of the company served by these
firms. Toltz, King, Duvall, Anderson & Assoc., Inc. and Donohue & Assoc., Inc.
are employed by Metropolitan Waste Control Commission and the City of
Milwaukee, respectively. These firms also do work for other large communities.
Rieke, Carroll, Muller Assoc., Inc. has performed this work for medium sized
and smaller communities. McCombs - Knutson Asso., Inc. and Bonestroo, Rosene,
Anderlik & Assoc., Inc. have worked for smaller communities with a population
of less than 10,000.

In interviewing former clients of all these firms, without exception,
Rieke, Carroll, Muller Assoc., Inc. received the best recommendations.
They received these recommendations for work similar to the work proposed
for Shakopee.
I would be the first to admit that any differences between these firms are
very subtle and difficult to see but based on the recommendation of previous
clients, I recommend that the City negotiate a contract with Rieke, Carroll,
Muller Assoc., Inc. for an Infiltration /Inflow Analysis.

RE: House of Hoy Inc, Liquor Violation

Attached is the police report on a liquor violation at the House
of Hoy Inc. dba /Opera House. The City Council has set the hearing
and notified the license holder of the hearing. The purpose of the
hearing is to determine if the liquor license should be revoked.
The Council has the following options:
1. If the violation is found to be willful, the Council must
revoke the license
2. If the violation is found to be non willful, the Council can:
a] Revoke the license
b] Suspend the license for up to 60 days
c Give a warning

plication shall be a pro rata share of the annual license fee.
Provided, however,'that in the case of on -sale liquor licenses,
the pro rata share shall be not less than one -half of the annual ‹.o4,
on -sale liquor license fee. Licenses shall be valid only at one
location and on the premises therein described.
C. License Refundment in Certain Cases. In the
event that,during the license year, the licensed premises shall
be destroyed or so damaged by fire, or otherwise, that the licen-
• see shall cease to carry on the licensed business, or in case the •
business of the licensee shall cease by reason of his illness or
death, or if it shall become unlawful for the licensee to carry
on the licensed business under his license, except when such li-
cense is revoked, the City shall, upon the happening of any such
event, refund to the licensee, or to his estate, such part of the
license fee paid by him as corresponds to the time such license •
had yet.to run. In the event of death of the licensee, his per-
sonal representative is hereby authorized to continue operation
of said business for not more than ninety (90) days after the
death of such licensee.
D. Transfer. No license shall be transferable
between persons. No license shall be transferable to a different
location without prior consent of the Council and upon payment of
the fee for a duplicate license. It is unlawful to make any
NO transfer in violation of this Subparagraph.
% 5J ( r E. Refusal, Revocation and Termination. The
�. r iCouncil may, in its sole discretion and for any reasonable cause,
r ,
t �.,i refuse to grant any application, or revoke, or suspend for a per -
;. iod not to exceed sixty (60) days, any license granted or appli- �,^
cation made under the provisions of this Chapter. The Council
•``-` shall revoke the license upon conviction of any licensee or agent
or employee of a licensee for violation of any law relating to
the sale or possession of beer, wine or liquor upon premises of
; licensee. If it shall be made to appear at the hearing
, ;thereon that such violation was not willful, the Council may or-

. suspension; provided, that revocation shall be ordered upon
the third such violation or offense. No suspension or revocation
' shall take effect until the licensee has been afforded an oppor-
tunity for a hearing pursuant to Minnesota Statutes. No license
shall be granted to a person of questionable moral character or
' business reputation. Licenses shall terminate only by expiration
� or revocation.
F. Notice. No beer, wine or liquor license ap-
plication, or request for transfer thereof between persons or lo-
cations, shall be acted upon by the Council until at least ten •
(10) days have elapsed after the date of one publication, in the
legal newspaper of the City, of a notice of such application or
request for transfer.
G. Corporate Applicants and Licensees. A corpor-
ate applicant, at the time of application, shall furnish the City
with a list of all persons that have an interest in such corpora-
tion and the extent of such interest. The list shall name all
shareholders and show the number of shares held by each, either
individually or beneficially for others. It is the duty of each
corporate licensee to notify the City Administrator of any change
in legal ownership or beneficial interest in such corporation or

SUBJECT: Liquor Violation
On Friday, November 23, 1979, acting upon a complaint from a
concerned father alleging his fourteen year old son had been
purchasing liquor in a number of liquor establishments, the
followi action was initiated.
Permission was received from the father and son to cooperate
in the investigation to determine if the allegation was in
fact valid.
At approximately 6:45 p.m. on November 23, 1979, upon the
request of this department, Officer Barry Brandt entered the
Opera House. A short time later, the fourteen year old male
entered and ordered a tequilla sunrise beverage. The female
waitress /bartender prepared the drink, monies were exchanged,
and Officer Brandt confiscated the drink as evidence.
The employee serving the drink was identified as Deborah Kay
Barnes. Ms. Barnes pled guilty to a misdemeanor charge of
sale of liquor to a minor and was fined $100.00.

On Friday,_11- 23 -79, at approximately 6:30 p.m., I was requested by Det. ._
Sgt. DuBois_.of the Shakopee Police Department to assist in inspecting a bar in
Shakopee in an.attempt to witness the sale of alcohol to a minor. ._____
At approximately,6:47. p.m. on 11- 23 -79, I entered the Opera House, located.
at 1st and Holmes _in_Shakopee,., and . s.at_ on a bar stool next to the waitress ..
station at the bar. _A_female bartender_then served me. A short time later, a
person known to me as a juvenile entered the Opera House Saloon and sat on the
bar stool directly adjacent to me on the left. I then heard the juvenile order -
a tequilla_sunrise__from the female bartender, the same bartender who had_waited .
on me. The bartender immediately prepared the drink and at 6:51 p.m. on 11 -23 -7
served the juvenile the drink and money was exchanged. I then confiscated the.
drink and the juvenile left the area.
I identified myself.,as.a Police_Officer to the bartender and requested
identification_from her.___The bartender produced a MN State D/L identifying
herself..as. Deborah ..Kay.Barnes,.DOB /12 19 -54 Ms. Barnes advised me that her.
new address is i3421 22nd Avenue South in Bloomington, MN. Ms. Barnes was then
informed that she would be contacted by the. Shakopee Police in the near future.
At 6:55 p.m. on 11- 23 -79, I turned the drink over to Det. Sgt. DuBois, _
who was waiting outside.

On April 28, 1980, Ms. Barnes entered a plea of guilty to a misdemeanor
charge of.sale of liquor to a minor. A representative from the State
was not in court at the time but the transcript shows that she was fined
$100.00. She also stated that she was the only one on the floor so she
sold it and that it was the first time she had done so: It should be
noted, however that while she said she didn't have permission, at the
omnibus the bartender said he asked her to take over the bar when he went
downstairs.

At the Planning Commission meeting of July 24, 1980, the Planning
Commission made a recommendation on the following case (PC 80 -31P).
An official report will be made at the City Council meeting of
August 5, 1980, on this case.
Recommendation of approval on the Preliminary and Final
Plat of Minnesota Valley 4th Addition, subject to the following
conditions:
1) Provision of Park Dedication in cash.
2) Construction of sidewalk on the west side of
Polk Street and the north side of 13th Avenue.
3} Provision of Utility Easements.
At the. Board of Adjustments and Appeals meeting held on July 24, 1980,
