Authorize Execution of Deed for SPUC Headquarters Property /~ F. j, CITY OF SHAKOPEE Memorandum CONSENT TO: Mayor and City Council FROM: Mark McNeill, City Administrator SUBJECT: SPUC Headquarters Property Deed DATE: April 16,2004 INTRODUCTION: The Council is asked to execute a deed which would transfer property inadvertently from the title of the City of Shako pee, to the Shakopee Public Utilities Commission. This is for the land upon which the new headquarters building is being built on Sarazin Street (formerly Viking Steel Road). BACKROUND: I was contacted by City Attorney Jim Thomson, who indicates that he was advised by the attorney who handled the condemnation matter for Shakopee Public Utilities, that the title to the property was inadvertently entered in the name of the City, rather than SPUc. In order to correct the error, the attached Quit Claim Deed has been prepared, with title correctly being listed in SPUC's name. RECOMMENDATION: The recommendation ofthe City Attorney is that the attached deed be executed. ACTION REQUIRED: If the Council concurs, it should, by motion, execute the Quit Claim Deed transferring the new SPUC headquarters building from the City of Shakopee, to Shakopee Public Utilities. /)),--{J2J,Lt~~ Mark McNeill City Administrator MM:th QUIT CLAIM DEED Corpomtion or Partnership to Corporation or Partnership No delinquent taxes and transfer entered; Certificate of Real Estate Value ( ) filed ( ) not required Certificate of Real Estate Value No. ,2000 County Auditor by Deputy STATE DEED TAX DUE HEREON: $_ Date: April _,2004 (reserved for recording data) FOR VALUABLE CONSIDERATION, The City of Shakopee, a municipal corporation under the laws of the State of Minnesota, Grantor, hereby conveys and quit claims to Shakopee Pubic Utilities Commission, Grantee, a municipal public utilities commission under the laws of the State of Minnesota, real property in Scott County, Minnesota, described as follows See attached Exhibit A. oThe Seller certifies that the seller does not know of any wells on the described real property. oA well disclosure certificate accompanies this document. 01 am familiar with the property described in this instrument and I certify that the status and number of wells on the described real property have not changed since the last previously filed well disclosure certificate.
