SUBJECT: Construction Activity Hours Variance - Scott County Jail
DATE: April 16, 2004
INTRODUCTION:
The Council is asked to consider authorizing Scott County to provide for delivery of pre-
cast concrete jail cells during overnight hours.
BACKGROUND:
Scott County Chief Deputy Rob Boe contacted me, advising that plans are being made to
accept delivery of pre-cast concrete jail cells during overnight hours. The cells are 16'
wide, and therefore would be a disruption to traffic if delivered during normal use hours.
What is being contemplated at this time is that between the hours of 2:30 AM and 6:30
AM, Monday through Friday, for a period of 14 weeks, that four truckloads of these cells
will be delivered twice a night (for a total of eight loads) during these early morning
hours.
The individual cells would not be moved from the flat bed trailers until normal daylight
hours.
The route is anticipated to be from First Avenue (Highway 101), south on Fuller Street to
the j ail site. The trucks would then leave via 101.
The noise issue relates to the diesel trucks, and uncoupling the trailers. It is the intent of
the County to minimize as much as possible any ancillary noise, such as backup horns,
etc. Some of this would be unavoidable, however.
DISCUSSION:
The concern is impact upon adjacent residential areas during early morning hours. The
alternative to nighttime deliveries, however, would be significant disruption of traffic for
a considerable number of days- again, this will be 14 weeks duration, and five days per
week.
City Ordinance requires City Council to approve variances for construction activity that
takes place other then the normal 7:00 AM to 10:00 PM hours. While this is not
specifically construction work, in the opinion of staff it is construction-related, therefore,
does require Council approval.
At this point, it is unknown as to when the deliveries will actually start.
RECOMMENDATION:
Scott County should advise adjacent neighbors of the anticipated work. Assuming that
there are no insurmountable concerns, the Council could then authorize staffto approve
the overnight deliveries.
ACTION REQUIRED:
If the Council concurs, it should, by motion, direct staff to work with Scott County to
minimize residential neighbor concerns, and if acceptable, to then authorize overnight
delivery for a 14 week period.
