SUBJECT: Request from Shakopee Public Utilities Commission (SPUC) for
Waiver of Subdivision Criteria
MEETING DATE: April 20, 2004
INTRODUCTION:
Shakopee Public Utilities Commission (SPUC) has submitted an application requesting
approval of a waiver of subdivision criteria for property located on 17th A venue (Exhibit
A).
SPUC has submitted a request for waiver of lot size and street frontage criteria to allow
the creation of lots that would contain wells & pump houses # 16 & 18 (See attached
letter from Joe Adams dated March 16,2004, and plans dated March 18,2004). These
pump houses would be located on the City-owned land south/east of Sun Path
Elementary School and west of SACS School (proposed soccer field site).
DISCUSSION:
SPUC has a policy which prefers that they own the property on which their facilities are
located. For that reason, SPUC seeks to create lots for the above-identified wells and
pump houses. Because of the zoning on the subject property (R-IB for pump house #16,
and AG for pump house #18), these lots could not meet zoning ordinance criteria. As a
result, SPUC is requesting that the Council waive these requirements.
If approved, SPUC would then proceed with the submittal of a minor subdivision
application. A requirement of the minor subdivision is that easements shall be provided
for these wells and pump houses as well as for proposed wells #17 & 19, and the water
mains and access,to these wells/pump houses. Prior to construction of these pump
houses, SPUC will need to submit Conditional Use Permits (CUP's), consistent with the
process that was followed involving well and pump house # 15 proposed along 17th
A venue East on School District property.
ALTERNATIVES:
1. Offer and approve a motion approving SPUC's request for waiver of subdivision
criteria regarding the City's lot size and frontage requirements.
2. Offer and approve a motion denying SPUC's request for waiver of subdivision
criteria regarding the City's lot size and frontage requirements.
3. Provide staffwith other direction.
4. Table the matter and request additional information.
STAFF RECOMMENDATION:
Staff recommends Alternative No.1, approve a motion approving SPUC's request for
waiver of subdivision criteria regarding the City's lot size and frontage requirements for
the sites for wells and pump houses # 16 & # 18.
REQUESTED ACTION:
Offer and approve a motion w'iliving the subdivision criteria related to lot size and
frontage for City-owned property south of 1 ih A venue, west of SACS School and east of
Sun Path Elementary School, that would allow the creation of new lots for SPUC's wells
and pump houses #16 & 18 by means of the minor subdivision process.

Subject: Waiver request for pump houses 16 and 18
Honorable Mayor Schmitt and Council Members:
The Shakopee Public Utilities Commission (SPUC) is requesting waivers from city
zoning standards for pump houses 16 and 18. The pump houses are part of the 17th
Avenue well field master plan. The plan includes sites for five wells aild three pump
houses. (See the attached map.)
The two sites with only submersible wells do not require to be subdivided, however
easements are needed for access and service purposes. The sites containing the pump
houses will require a subdivision. Pump house 15 has been subdivided based upon a
waiver for lot standards that was approved by the Council on September 16, 2003.
Pump house 16 is to be located in an area that is zoned Urban Residential (R-IB). Itis
the desire of SPUC to have the road frontage requirements waived for this parce1. An
access easement will be maintained from the Sunpath Elementary School parking lot.
Public street frontage is not available, nor is it necessary, as no person is stationed at the
site and service calls are infrequent. The proposed pump house and'lot will meet the
design standards as set forth for the R-IB zoning district. A rear yard setback will be
established along the westerly lot.line abutting the adjacent residential properties.
Pump house 18 is to be located in an area classified as Agricultural Preservation Zone
(AG). SPUC wishes to have the road frontage requirements waived for this parcel.
Access to the site will be gained via the shared (with SACS) private drive and the central
parking lot for the soccer fields. As with pump house 16, public street frontage is not
necessary as no person is stationed at the site and service calls are infrequent.
In addition, it is the desire of SPUC to have the design standards waived for this parce1.
While the proposed lot and building will meet the requirements ofR-lB it will not meet

the requirements for AG. Rather than asking for a rezoning of the area, SPUC feels it
would be more prudent to request a waiver for the aforementioned criteria.
The reque~ted waivers would allow for the sites to be subdivided administratively.
However, both sites will require public hearings for conditional use pennits to construct
the pump houses. The CUP will be submitted at the time when SPUC expects to
construct the pump houses. Tentatively, construction is expected to take place in 2005.
SPUC will continue to work with the neighboring residents and the parks department in
designing the pump house.
The Shakopee Public Utilities Commission appreciates the Council's attention to this
matter. SPUC looks forward to working cooperatively with the Council and Planning
Staff of Shakopee, so water service can be available in a timely manner.
