DISCUSSION:
On February 3,2004 the City Council approved the preliminary plat of Park Meadows.
Centex Homes has made application for final plat of the first phase of the project,
consisting of about 118 single-family lots.
The final plat is generally consistent with the approved preliminary plat. The City's
Engineering Department and the Shakopee Public Utilities Commission (SPUC)
submitted written comments, and copies are attached to this report for both the Council's
and the applicant's information. The conditions proffered by the Engineering department
have been incorporated into the draft resolution of approval.
ALTERNATIVES:
1. Approve Resolution No. 6053, a resolution approving the final plat of Park Meadows
as presented.
2. Approve Resolution No. 6053, a resolution approving the final plat of Park Meadows
with revisions.
3. Direct staff to prepare a resolution denying the request for final plat approval.
4. Table the request for additional information.

RESOLUTION NO. 6053
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING
THE FINAL PLAT OF PARK MEADOWS
WHEREAS, Centex Homes, applicant, and BAJ Investments, property owner, have
made application for final plat approval of Park Meadows; and
WHEREAS, the subject properties are legally described as:
The West Half of the Southwest Quarter of Section 16, Township 115 North, Range 22 West,
Scott County, Minnesota AND all that part of the abandoned Chicago, Milwaukee, St. Paul
and Pacific Railroad per Document No. 178639 lying in the Northwest Quarter of Section
16, Township 115, Range 22, Scott County, Minnesota, AND all that part of the abandoned
Chicago, Milwaukee, St. Paul, and Pacific Railroad per Document No. 178639 lying in the
Southeast Quarter of Section 17, Township 115, Range 22, Scott County, Minnesota; and
WHEREAS, the Shakopee Planning Commission conducted a public hearing on the
preliminary plat on November 6,2003, December 4,2003 and January 8, 2004; and
WHEREAS, all required public notices regarding the public hearing were posted
and sent; and
WHEREAS, the Shakopee Planning Commission has recommend approval of the
preliminary plat; and
WHEREAS, the City Council approved the preliminary plat request at its meeting
of February 3,2004.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKO PEE, MINNESOTA, as follows:

1. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval oftitle by the City Attorney.
B. Revise the name of the plat to Park Meadows First Addition.
C. Execution of a Developers Agreement with provisions for Plan A and
Plan B improvements, as well as payment of engineering review fees,
and any other fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the
requirements ofthe Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements of
the Design Criteria and Standard Specifications ofthe City of
Shakopee.
a) The applicant shall submit to the City Engineer for
review and approval a storm water infiltration system
design providing pretreatment of storm water runoff
prior to infiltration.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Sanitary Sewer Charges, security for the
public improvements, engineering review fees, and other fees
as required by the City's adopted Fee Schedule for the entire
plat.
6. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve
the Final Construction Plans and Specifications.
7. The applicant shall obtain a NPDES permit prior to any land
disturbing activity.
8. Park dedication requirements shall be met through land
dedication as shown on the plat (7.5 acres), plus a 20'wide,
650' long trail easement along the pond area, with the trail to
be constructed at some point in the future by the City, for an
additional .3 acres credited toward their park dedication
amount. . The park area shall be platted as a separate outlot.
9. The applicant shall provide the sidewalks as shown on the plan.
10. The applicant, with review and approval by the City's
Engineering Department, shall address any remaining drainage
issues in the park area.
11. All park dedication shall be recorded at time of final plat
approval.

12. The applicant is required to notify in writing those individuals
interested in purchasing lots with the trail easement about the
trail.
13. The applicant is required to post signage showing the trail
alignment.
14. A petition shall be provided by the developer for future
improvements to Valley View Road and it shall include a
signed waiver of assessment appeal for these improvements.
a) The applicant shall obtain all necessary right-of-way
and/or easements to perform work offsite.
D. Easements shall be shown on the Final Plat described in Project
Engineer Joe Swentek's April 23, 2004 memo to Julie Klima and/or as
approved by the City Engineer.
E. The survey data (length and bearings) shall be shown for each lot.
F. The final plat shall be revised to evenly distribute the ponding area
between Block 2 and Block 4.
G. Simultaneous with the recording of the final plat, deed restrictions
shall be filed as described in Project Engineer Joe Swentek's April 23,
2004 memorandum to Julie Klima.
H. Temporary street signs shall be installed.
II. Following approval and recording of the final plat, the following
conditions shall apply;
A. Building construction, sewer, water service, fire protection and
access will be reviewed for code compliance at the time of
building permit application(s).
B. The applicant shall work with the City and the City's consultant to
coordinate the simultaneous construction of Park Meadows and
Valley View Road.
C. The applicant shall provide the City's Engineering Department
with electronic (Auto CAD) files of the final plat.
D. A temporary cuI de sac with adequate easement(s) shall be
required at the Winterberry Lane terminus.
Adopted in session of the City Council of the City of Shakopee, Minnesota,

The application indicates a request for a Final Plat for a single-family residential development.
After reviewing the above referenced application, we have the following comments for the
applicant and the planning department:.
General Comments
1. A storm water infiltration system design providing pretreatment of storm water runoff
prior to infiltration shall be submitted to the City for review and approval.
2. The applicant shall obtain all necessary right-of-way and/or easements to perform work
offsite.
3. The applicant shall obtain a NPDES permit prior to any land disturbing activity.
4. The applicant shall work with the City and the City's consultant to coordinate the
simultaneous construction of Park Meadows and Valley View Road.
5. This development is adjacent to Valley View Road and should be required to sign a
waiver of assessment appeal for the Valley View Road improvements.
6. Execution of a Developer's Agreement, which shall include provisions for security for
public improvements within the Final Plat and the engineering review fees.
7. Payment of Trunk Sanitary Sewer Charges shall be made, as required by the most current
City of Shakopee Fee Schedule.

8. Payment of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment
Charges shall be made, as required by the most current City of Shakopee Fee Schedule.
9. No public improvements shall be constructed until the City Engineer and the Shakopee
Public Utility Commission (SPUC) approve the Final Construction Plans and
Specifications.
10. Provide electronic (AutoCAD) files of the Final Plat to the engineering department.
Preliminary Plat
1. The proposed park shall be platted as a separate outlot.
2. A drainage and utility easement approved by the City Engineer, centered on all proposed
utilities through Outlot A, shall be provided.
3. A drainage and utility easement encompassing the approved high water level shall be
provided for the proposed storm water pond in Outlot A.
4. A minimum of ten (10) feet of drainage and utility easement shall be provided along the
interior of Outlot A.
5. Adequate drainage and utility easements shall be provided to encompass runoff to low
point storm sewer structures in non-paved areas.
6. Provide a total of forty (40) feet of drainage and utility easement, centered on the
proposed storm sewer, between Lots 2 and 3 of Block 1. Twenty (20) feet of drainage
and utility easement shall be provided from the centerline of the proposed storm sewer
structure into Outlot A.
7. Provide a total of forty (40) feet of drainage and utility easement, centered on the
proposed storm sewer, between Lots 5 and 6 of Block 3.
8. Provide a total of thirty (30) feet of drainage and utility easement, centered on the
proposed storm sewer, between Lots 2 and 3 of Block 4.
9. Provide a total of thirty (30) feet of drainage and utility easement, centered on the
proposed storm sewer, between Lots 6 and 7 of Block 4.
10. Provide a total of thirty (30) feet of drainage and utility easement, centered on the
proposed storm sewer, between Lots 4 and 5 of Block 6.
11. Provide a total of twenty (20) feet of drainage and utility easement, centered on the
proposed stonn sewer, between Lots 17 and 18 of Block 6.

12. Verify the need for the twenty (20) feet of drainage and utility easement between Lots 16
and 170fBlock 6.
13. A temporary cul-de-sac shall be required at the Winterberry Lane terminus. The
applicant shall provide an adequate easement.
14. Easements shall be shown onthe Final Plat as approved by the City Engineer.
15. Simultaneous to the recording of the plat, a deed restriction shall be recorded on the
following lots:
. Lots 2, 3, 5 and 6 of Block 1
. Lots 2-6 and 10-14 of Block 3
. Lots 1-7, 16-25 of Block 4
. Lots 1-5 and 14-18 of Block 6
. Lots 4 and 5 of Block 8
The Deed Restriction shall appear as the following:
This conveyance is made conditioned upon and subject to the following restriction. The
Grantee, heirs, successors and assigns, are restricted from erecting any fence or other
structure within the utility and drainage easements dedicated by plat over the above-
described property, except with the prior written consent of the City of Shakopee. This
restriction shall nm in favor of and be enforceable by the City of Shakopee.
Storm Water Mana1!ement Plan Review
The applicant shall submit a storm water infiltration system design providing pretreatment of
storm water runoff prior to infiltration to the City for review and approval.
Recommendation
Engineering staff recommends approval subject to the conditions listed above being addressed by
the applicant prior to recording of the Final Plat approval.

COMMENTS:
Municipal water service is available subject to our standard terms and conditions. These
include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk
Water Charge, and paying the Water Connection Charge.
Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to: entering into an Underground Distribution
Agreement, granting any necessary easements, and paying the associated fees.
Street Lighting installation is available subject to our standard terms and conditions.
These are contained in the current City of Shakopee Street Lighting Policy. Applicant
must pay the associated fees.
Applicant should contact Shakopee Public Utilities directly for specific requirements
relating to their project.
Note: This parcel is in SPU's 1 st High Elevation Service District. There will need to
be additional easement for an 8" watermain between lots 3 & 4 of block 8
(10' each lot for a total of 20').

Yesterday I picked up a copy of the memo from R. Michael leek that was part of
the agenda packet for your May 4, 2004 meeting. The Final Plat map and the
proposed Resolution No. 6053 do not make sense together. For example,
I. E. talks about a ponding area between Block 2 and Block 4. What implication
does that have then on Block 3? Hopefully, I will be able to ask questions at your
meeting and sense will be made of this proposal.
Because the Resolution needs work, I will limit this memo to what I have learned

As you probably are well aware, mosquitoes are much more than pests. They are
becoming vectors for increasingly dangerous diseases. Mixing large populations
of people and mosquito breeding habitats is something a responsible government
body should avoid.
When first constructed, drainage ponds such as the one proposed in the Park
Meadows development are not a problem. As the site matures, it changes. When
vegetation around the pond is mowed and gets into the water, it rots and creates
an odor that attracts egg-laying mosquitoes. Over time, plants like cattails grow
in the pond itself creating a breeding ground.
Other contributing factors are: water depth, whether water disappears or is there
permanently, water level fluctuations.
In the words of Mr. Mike Mclean, "This [developer-created wetlands] is an issue
we struggle with." Catch basins are another problem created by development.
They have to be treated against mosquitoes that carry the West Nile virus. Access
is a concern. If a resident will not let them on their property, they are forced to
wait until there is an illness and then the Minnesota Department of Health can
intervene.
Recommended permit conditions:
1. Pump or aeration system to keep the water moving.
2. Homeowner covenants that require Metropolitan Mosquito Control
access.
My preliminary conversations with a farmer about the pond drainage system
indicate that it may keep the soil too wet. I am in the process of researching this
further and will bring my findings to your May 4 meeting.
