SUBJECT: Text Amendment Addressing Shopping Center Parking
MEETING DATE: May 4, 2004
INTRODUCTION:
Section 11.61 of the City Code provides the requirements for parking based on uses. The current
language within City Code provides a requirement of 1 parking stall for every 200 square feet of floor
area for shopping centers. However, the term shopping center is not defined or utilized elsewhere in
the City Code. The term retail center is defined and regulations for retail center Planned Unit
Developments (PUD) are provided in the Zoning Ordinance.
Staff is proposing a housekeeping text amendment to provide consistency between terms in the Zoning
Ordinance.
ALTERNATIVES:
1. Approve Ordinance No.702, approving the text amendment as presented.
2. Approve Ordinance No. 702, approving the text amendment with revisions.
3. Do not approve the proposed amendment.
4. Table the matter for additional information.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission reviewed the proposed amendment at its April 22, 2004, meeting. The
Commission has recommended approval of the proposed amendment as presented. A copy of the staff
report from the April 22 Commission meeting is attached for the Council's reference.
ACTION REQUESTED:
Offer and pass a motion to approve Ordinance No. 702, amending City Code Sec. 11.61, Subd. 3 as
presented.

AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CHAPTER 11.61 PARKING
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1 - That City Code Chapter 11, Zoning, Section 11.61, is hereby amended by adding
the language which is underlined and deleting the language which is struckthrough.
City Code Sec. 11.61, Subd, 4.3.11;
ll. shopping centers retail centers 1 per 200 square feet of floor area
Section 2 - - Effective Date. This ordinance becomes effective from and after its. passage
and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota, held
the day of ,2004.

SUBJECT: Text Amendment Addressing Shopping Center Parking

DISCUSSION:
City Code currently requires shopping centers to provide 1 parking stall for every 200 sq. ft. of
floor area (Section 11.61, Subd. 4). However, the defmition portion ofthe City Code does not
provide a definition for shopping center.
The City does have adopted standards defining and regulating retail centers. A retail center is
defined as "a commercial area containing one or more retail establishments with a total building
area in excess of 50,00 square feet". Additionally, developments meeting the definition of retail
centers are required to receive approval as a retail center Planned Unit Development (PUD)
within the Highway Business (BI) zoning district.
In practice, staffhas applied the parking requirements for shopping centers to retail center
PUD's. However, as a housekeeping matter, staffis proposing that the language in the parking
section of the code be revised to require 1 parking stall for every 200 sq. feet of floor area for
retail centers rather than shopping centers.
Staff has prepared draft language for this text amendment. Language which is underlined is
proposed for addition and language that is struc1cthough is proposed for deletion.
SEC. 11.61. PARKING. Subd. 4. Required Number of Parking Spaces.

City Code states that the City Council may grant a zoning ordinance amendment when it finds
that one or more of the following criteria exist. Staffhas prepared draft findings for the Board's
consideration:
Criteria #1 That the original zoning ordinance is in error;
Finding #1 The original zoning ordinance is in error; the amendment as proposed allows for
consistency in applying parking requirements.
Criteria #2 That significant changes in community goals and policies have taken place;
Finding #2 Significant changes in community goals and policies have not taken place.
Criteria #3 That significant changes in City-wide or neighborhood development patterns
have occurred; or
Finding #3 Significant changes in development patterns have not occurred.
Criteria #4 That the Comprehensive Plan requires a different provision.
Finding #4 The proposed amendment does not conflict with the policies outlined in the
Comprehensive Plan.
ALTERNATIVES:
1. Recommend to the City Council approval of the proposed text amendment as presented.
2. Recommend to the City Council approval of the proposed text amendment with revisions.
3. Do not recommend to the City Council approval of the proposed text amendment.
4. Continue the public hearing for additional information.
5. Close the public hearing, but table the matter for additional information.
STAFF RECOMMENDATION:
Staff recommends alternative no. 1 or 2.
ACTION REQUESTED:
Recommend to the City Council approval of the proposed text amendment as presented, or with
reVISIons.
