Cox, City Clerk~ SUBJECT: Establishing New Precinct Boundaries DATE: May 13,2004 INTRODUCTION: City Council is asked to adopt Ordinance No. 703, which establishes two new precincts within the City of Shakopee. The ordinance must be adopted no later than June 1, 2004. BACKGROUND: At the regular meeting on May 4, 2004, City Council received information relating to the creation of two new precincts as well as two maps, one depicting the current ten precincts and the other depicting the proposed twelve precincts. As a consent item, City Council directed staff and the City Attorney to prepare an ordinance for consideration by the Council that would establish two new precincts increasing the number of precincts to twelve. In follow up to that direction, the attached Ordinance No. 703 has been prepared for Council's consideration. The attached precinct map shows all twelve precincts. Current Precinct 9 is divided into Precinct 9 and new Precinct 11. Current Precinct 7 is divided into Precinct 7 and new Precinct 12. (Please bring the April 30, 2004 memo, Agenda Item 15.F.1., if discussion is desired.) Ordinance No. 703 and the precinct map have also been adjusted to include in Precinct 6 those areas that have been recently annexed to the City. RECOMMENDED ACTION: Offer Ordinance No. 703, Fourth Series, An Ordinance of the City of Shakopee, Minnesota, Amending City Code Chapter 2, Section 2.20, Precinct Boundaries, and move its adoption. I:\c1erk\Precincts-new-Ord 703 ORDINANCE NO. 703, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CITY CODE CHAPTER 2, SECTION 2.20, PRECINCT BOUNDARIES THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - Section 2.20, Subd. 6, Sixth Precinct, is hereby repealed and replaced by the following: Subd. 6. Sixth Precinct. The Sixth Precinct shall be bounded on the north by 10th A venue; on the east by a line beginning at the intersection of Spencer Street (County Road 79) and lOA venue, thence extending south along Spencer Street to Vierling Drive, thence east on Vierling Drive to Thistle Lane, thence south along Thistle Lane to Mound Street, thence west along Mound Street to Spencer Street, thence south along Spencer Street (Townline Avenue) to the southerly boundary of the City; on the south and west beginning at the southerly boundary of the City and Townline Avenue thence westerly along the southerly boundary ofthe City to Koeper A venue (County Road 77), thence southerly along Koeper Avenue to the southerly boundary of the City, thence westerly and northerly along the southerly boundary of the City to County Road 15, thence along the westerly boundary of the City to U.S. Highway 169, thence westerly along U.S. Highway 169 to County Road 15 (Adams Street), thence northerly along County Road 15 to 10ili Avenue. Section 2 - Section 2.20, Subd. 7, Seventh Precinct, is hereby repealed and replaced by the following: Subd. 7. Seventh Precinct. The Seventh Precinct shall be bounded on the south by the City corporate limits, on the east by Marschall Road, on the north by a line beginning at the intersection of Marschall Road and 17th A venue, thence west along 17th A venue to Weston Lane, thence south on Weston Lane to Olive Road, thence west on Olive Road to Evergreen Lane, thence south on Evergreen Lane to Valley View Road, thence north and west on Valley View Road to 1 ih A venue, thence west on 1 ih Avenue to Spencer Street (County Road 79); on the west by. a line beginning at the intersection of 17th A venue and Spencer Street (County Road 79) extending south along County Road 79 to Londonderry Cove, thence south along the westerly corporate City limit to County Road 14, thence South along County Road 79 to County Road 72. Section 3 - Section 2.20, Subd. 9, Ninth Precinct, is hereby repealed and replaced by the following: Subd.9. Ninth Precinct. The Ninth Precinct shall be bounded on the north by U.S. Highway 169; on the east and south by a line beginning at the intersection of U.S. Highway 169 and. Canterbury Road (County Road 83) and extending south along Canterbury Road to the corporate City limits, thence following the corporate City limits west, thence south, thence west, thence south to Marschall Road (County Road 17); and on the west by Marschall Road; except that area lying within Precinct Eleven. Section 4 - Section 2.20, Subd. 11, is hereby renumbered Subd. 13. Section 5 - Section 2.20 is hereby amended by adding a Subd. 11 as follows: . Subd. 11. Eleventh Precinct. The Eleventh Precinct shall be bounded on the north by a line beginning at the intersection of 17th A venue and Marschall Road (County Road 17), thence east along 17 A venue to Sarazin Street, thence north along Sarazin Street to Downing Avenue, thence east along Downing A venue to Dublin Lane, thence south along Dublin Lane to 1 ih A venue, thence east along 1 ih A venue to Independence Drive; on the east by Independence Drive; on the south by Valley View Road; and on the west by Marschall Road (County Road 17). Section 6 - Section 2.20 is hereby amended by adding a Subd. 12 as follows: Subd. 12. Twelfth Precinct. The Twelfth Precinct shall be bounded on the south by a line beginninw, at the intersection of Spencer Street (County Road 79) and 17th A venue, thence east along 17 1 A venue to Valley View Road, thence south and east along Valley View Road to Evergreen Lane, thence north along Evergreen Lane to Olive Road, thence east along Olive Road to W estonLane, thence north along Weston Lane to 1 ih A venue, thence east along 17th Avenue to Marschall Road; on the east by Marschall Road; on the north by a line beginning at the intersection of Marschall Road and Vierling Drive, thence west to Thistle Lane, thence south along Thistle Lane to Mound Street, thence west along Mound Street to Spencer Street (County Road 79); on the west by a line beginning at the intersection of Mound Street and Spencer Street (County Road 79) extending south along Spencer Street (County Road 79) to 17th Avenue. Section 7 - Effective Date. This ordinance becomes effective from and after its passage and publication.
