SUBJECT: Text Amendment Regarding the Planned Residential District (pRD) Zone
MEETING DATE: May 18, 2004
INTRODUCTION:
Section 11.33 of the Zoning Code currently outlines the regulations for the Planned Residential
District (pRD) zone. The PRD zone was established in 1999. The draft ordinance accompanying this
staff report essentially proposes to leave the PRD regulations in place so that they may be utilized on
the existing parcels zoned PRD but would eliminate the possibility of rezoning future properties to
PRD.
ALTERNATIVES:
1. Approve Ordinance No. 704, approving the text amendment as presented.
2. Approve Ordinance No. 704, approving the text amendment with revisions.
3. Do not approve the proposed amendment.
4. Table the matter for additional information.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission reviewed the proposed amendment at its May 6, 2004, meet,ing. The
, .;,.
Commission has recommended approval of the proposed amendment as presented. A copy of the staff
report from the May 6 Commission meeting is attached for the Council's reference.
ACTION REQUESTED:
Offer and pass a motion to approve Ordinance No. 704, ending City Cqde Sec. 11.33, as presented.

ORDINANCE NO. 704, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CHAPTER 11.33 PLANNED RESIDENTIAL DISTRICT
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1 - That City Code Chapter 11, Zoning, Section 11.33 is hereby amended by adding
the language which is underlined and deleting the language which is struckthrough.
SEC. 11.33. PLANNED RESIDENTIAL DISTRICT (PRD).
Subd. 1. Purpose. The purpose ofthe Planned Residential District (PRD) is to provide
areas for the mixed use development; including single family detached, medium density, and
high density residential, as well as compatible neighborhood commercial and service uses.
By allowing mixed use development, the PRD provides a mechanism for providing a range
of housing types and easy accessibility to services either within a single development or area
of the City of Shakopee.
No property in the city shall be rezoned to PRD after May 18. 2004. The substantive
provisions in the Section shall apply only to those properties that are zoned PRD as of that
date.
Section 2 - - Effective Date. This ordinance becomes effective from and after its passage
and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota, held
the day of ,2004.

SUBJECT: Text Amendment Regarding the Planned Residential District (pRD) Zone
MEETING DATE: May 6, 2004
DISCUSSION:
City Code Section 11.33 currently provides the regulations for the Planned Residential District
(pRD) zone. The city currently has 6 developments that are zonedPRD. These include a portion
of Southbridge Crossings 1 st Addition, Providence Pointe, Church Addition, Riverside Fields,
Brittany Village 4th Addition, and Thomas A. Philipp Addition.
The PRD zone was established in 1999. The intent was to attract/allow development that is
compatible with the development patterns seen in the Old Shakopee Resicl.ential (R-IC) zone.
Based on formal direction from the Planning Commission and informal discussion by the City
Council, staff has prepared a text amendment that essentially deletes the opportunity to rezone
additional properties to the PRD zone. The amendment, as proposed, would allow the current
PRD regulations to stay in place for properties that have already been zoned PRD.
Staff has prepared draft language for this text amendment. Language which is underlined is
proposed for addition and language that is struckthough. is proposed for deletion.
SEC. 11.33. PLANNED RESIDENTIAL DISTRICT (PRD).

City Code states that the City Council may grant a zoning ordinance amendment when it finds
that one or more of the following criteria exist. Staffhas prepared draft findings for the Board's
consideration:
Criteria #1 That the original zoning ordinance is in error;
Finding #1 The original zoning ordinance is in error, in that the intended results of the PRD
have not materialized while it has been in place.
Criteria #2 That significant changes in community goals and policies have taken place;
Finding #2 Significant changes in community goals and policies have not taken place, though
the mechanism implemented to provide for the intended development has not
afforded the City the controls desired relative to development.
Criteria #3 That significant changes in City-wide or neighborhood development patterns
have occurred; or
Finding #3 Significant changes in development patterns 'have not occurred.
Criteria #4 That the Comprehensive Plan requires a different provision.
Finding #4 The proposed amendment does not conflict with the policies outlined in the
Comprehensive Plan.
ALTERNATIVES:
1. Recommend to the City Council approval of the proposed text amendment as presented.
2. Recommend to the City Council approval of the proposed text amendment with revisions.
3. Do not recommend to the City Council approval of the proposed text amendment.
4. Continue the public hearing for additional information.
5. Close the public hearing, but table the matter for additional information.
STAFF RECOMMENDATION:
Staff recommends alternative no. 1 or 2.
ACTION REQUESTED:
Recommend to the City Council approval of the proposed text amendment as presented, or with
revisions.
