SUBJECT: Public Hearing on Petition of ISD 720 for the Annexation of Land in
Jackson Township
MEETING DATE: May 18, 2004
INTRODUCTION:
Council is asked by the petitioners to consider the annexation of the subject property, which is located
south of 1 ih A venue extended between County Road 77 and County Road 79. A copy of the petition,
as well as the report the May 6,2004, report to the Planning Commission is attached for the Council's
information.
ALTERNATIVES:
1. Close the public hearing, and adopt an ordinance approving the annexation.
2. Close the public hearing and direct staff to prepare a resolution denying the petition for
annexation based on specific findings of fact for consideration at the June 1,2004 meeting.
3. Close the public hearing, but table the petition for additional information.
4. Continue the public hearing for additional information.
PLANNING COMMISSION REVIEW:
The Planning Commission reviewed the proposed annexation at its meeting of May 6,2004, and
unanimously recommended approval of the annexation.
ACTION REQUESTED:
Offer a motion to approve the annexation of the subject property, and move its adoption.

ORDINANCE NO. 706, FOURTH SERIES
AN ORDINANCE RELATING TO THE ANNEXATION
OF CERTAIN PROPERTY
THE CITY OF SHAKOPEE, MINNESOTA, HEREBY ORDAINS AS FOLLOWS:
Section 1 - The City Code is amended by adding a new section to read:
Section 2 - The City Council hereby finds that ISD 720, filed a properly prepared Petition
requesting the annexation to the City of Shakopee of real property located within Jackson
Township, Scott County, State of Minnesota, legally described as found on attached Exhibit A:
Section 3 - The City Council hereby finds that the property is not included in boundary
adjustment proceeding pending before the Minnesota State Planning Agency.
Section 4 - The City Council hereby determines and finds as follows;
1. That the subj ect properties abut the City of Shakopee;
2. That the properties proposed to be annexed are not presently served by public sewer
facilities, and that public sewer facilities are not otherwise available to the subject
properties;
3. That the City of Shakopee has received a properly prepared Petition for annexation
from all of the owners of the subject properties; and
4. That the area is appropriate for annexation by ordinance under Minn. Stat. Sec.
414.033, Subd. 2, and that the Petition complies with all ofthe provisions of Minn. Stat.
414.033, as well as the provisions of the Orderly Annexation Agreement between the
City of Shakopee and Jackson Township.
Section 5 - The subject properties are urban or suburban in nature or about to become so.
Section 6 - Pursuant to law, a public hearing was scheduled, with proper notification given,
and held on May 18, 2004, prior to Council consideration of this ordinance for annexation.
Section 7 - The corporate limits of the City of Shako pee are hereby extended to include the
subject properties, and the same is hereby annexed to and included within the City of Shako pee as
ifthe property originally been part thereof.
Section 8 - The City Clerk is directed to file certified copies of this ordinance with the
Minnesota State Planning Agency, Jackson Township, the Scott County Auditor-Treasurer, and the
Minnesota Secretary of State.
Section 9 - This ordinance takes effect upon its passage and publication and filing of certified
copies as directed in Section 8 and approval ofthe ordinance by the Minnesota State Planning
Agency.
Adopted in regular session of the City Council of the City of Shakopee, Minnesota held this
18th day of May 2004.

Range 23, Scott County, Minnesota, and of the North Half of the Southeast Quarter of the

SUBJECT: Petition oflSD 720 for the Annexation of Land located in Jackson
Township
MEETING DATE: May 6, 2004
INTRODUCTION:
The City received a petition dated March 10, 2004 from ISD 720 for the annexation of about 96 acres
of land from Jackson Township into the City of Shakopee. On May 18, 2004 the Council will hold a
public hearing on the requested annexation. A copy of the petition is attached for the Commission's
information. The Commission is asked to provide a recommendation to the City Council on whether
the City should proceed with annexation of the subject property.
DISCUSSION:
The City's adopted Land Use Plan identifies this area for single-family density development. This
designation was based on direction received from Council in the course of previous discussions
between the Township and the City. With the assistance of Northwest Associated Consultants
(NAC), the City is in the process of updating its Comprehensive and Land Use Plans.
The draft land use plan prepared by NAC has shown this area as guided for Public/Semi-public land
uses.
Should the Council ultimately decide that the subject properties should be annexed into the City, that
action does not constitute a guarantee of any particular land use guiding or zoning. Both guiding and
zoning will need to be determined after separate public processes on,?e the property is within the
City's jurisdiction.
The subject property will be bounded on the north by the future extension of 1 ih Avenue.
The Engineering Department has provided comment regarding sanitary sewer and storm water on the
attached Exhibit B. Extension of water service and looping of water service are issues that need to
be specifically addressed with the Shakopee Public Utilities Commission.
ALTERNATIVES:
1. Recommend to the City Council that the proposed annexation proceed.
2. Recommend to the City Council that the proposed annexation not proceed at this time.
3. Continue the item for additional information.
ACTION REQUESTED:
Offer a motion consistent with the Commission's wishes.

Dear Mayor Schmitt and City Council Members,
As you know District 720 successfully passed a bond issue in February paving the way
for the design and construction of a new high school. We are appreciative of the supp011
of the citizens for the school district project.
We now are in the process of planning and designing the building. At the same time, we
are moving forward with meeting the requirements for the development of the site. For
example, we are proceeding with an application for annexation. The Board realizes the
need to work closely with the City on this project. The school building will be an asset to
the community into the future and we want it to be the best facility possible. We
appreciate the relationship we have had with the City and we request the continued help
of City staff in making this a successful project. \
We stand ready to meet with the City Council to dialog on the project if you are
interested.

SUBJECT: Complaint about berming at Shenandoah Apartments
MEETING DATE: May 18, 2004
DISCUSSION:
At the May 4, 2004 Council meeting, Cliff and Kathy Stafford and John Dellwo addressed their
concerns about Shenandoah Apartments, primarily focused on the height of the berming. In response,
planning staff requested that the developer, Heritage Development, have their surveyor shoot the
elevations of the berm relative to the finished grade to determine whether the conditions of plat
approval were complied with. That information would be shared with both the Council and the
Staffords. In the event the berm height does not meet the conditions ofapproval,-city staffwould
follow up to secure compliance.
The elevations will not be available until the week of May 17th, and so this item will be placed on the
Council agenda of June 1, 2004.
ACTION REQUESTED:
No action is requested at this time. The item will be presented to the Council on June 1, 2004.
