During this meeting, the body elects members to officer positions. The Board of Adjustment and Appeals officer positions are Chair, Vice Chair, and Second Vice Chair. The Board of Adjustment and Appeals is required to elect a Chair, and it should also elect a Vice Chair and a Second Vice Chair to ensure the commission continues smooth operations in case of absences. Officer positions are not required to change every year; nothing prevents previous officers from being reelected. However, no member may serve as Chair until he or she has served for one full year on the commission. Motion Type: Simple Majority Background: Site Information: Applicant: Wold Architects Site Address: 4601 Dean Lakes Blvd Property Owner: Southwest Metro Intermediate School District No. 288 Lot Area: 8.33 acres Zoning District: BP, Business Park 2040 Comp. Plan: Mixed Use Center Wold Architects, representing Southwest Metro Intermediate School District No. 288, has applied for a conditional use permit amendment to expand the school at 4601 Dean Lakes Blvd for a 5,000 square -foot fabrication lab addition to the northeast corner of the building. City Code was amended in 2020 to allow K-12 schools in the Business Park zone as a conditional use. Intermediate School District No. 288 received their conditional use permit for a school in December of 2020 and is proposing to expand the building to allow additional fields of study and remodel portions of the existing building to include a new automotive shop and expand the commons area / cafeteria. A 20'x70' polycarbonate greenhouse is also proposed on the east side of the property for the district's agricultural program. The proposed addition supplements the district's Career and Technical Education (CTE) programs is also designed to be a storm shelter, which is a requirement of the Minnesota Building Code. As the CTE addition is required to be a storm shelter, there are limitations on the number and size of window openings. Staff has worked with the applicant extensively to come up with a design that meets City Code requirements of the Business 4 Park Zone for materials and design. The proposed addition is pre -cast concrete panels that are embossed with split -face block texture and inlaid with brick to match the existing building. A potential future expansion of the CTE lab is being planned for as noted in the applicant's narrative. Other city departments have reviewed the request and provided comments. The Engineering Department has provided a comment memorandum that is attached. The Fire Department has commented that the applicant must confirm that fire apparatus is able to maneuver around the proposed addition. The amount of parking provided on the site meets City Code requirements even with the addition and removal of eight parking spaces for the greenhouse. Overall staff is recommending approval of the request with the conditions of approval in the attached resolution. Recommendation: Adopt the resolution, as presented. As part of Southwest Metro's long-range planning efforts, the District is reorganizing and upgrading programming to better serve its students and member School Districts. This project is intended to consolidate and expand the District's Career and Technical Education (CTE) programs to a single site. The District plans to relocate its automotive program to this facility and introduce a new fabrication program. In addition to these program changes, the school will increase cafeteria capacity and create a central gathering space by remodeling a portion of the building into a school commons, fostering a stronger sense of community and school pride. The District is seeking approval for an addition to the facility that will house the new fabrication program. The addition is required to function as a storm shelter in accordance with the Minnesota Building Code. To meet this requirement, the exterior construction will consist of precast concrete wall panels. To maintain architectural consistency between the existing building and the new addition, the precast panels will be embossed with split -face block textures and inlaid with thin brick to match the existing materials and stained to match the current color palette. Openings within the addition are also subject to storm shelter requirements, which limit their overall size based on storm window manufacturer capabilities. The north end of the addition has been master planned to accommodate a future expansion as additional CTE programs added to this facility. Modifications to the existing building include the installation of a pair of glass garage doors on the north side to allow vehicle access for the automotive program. Additionally, on the southeast side of the building, within the parking lot, the District proposes the installation of a permanent polycarbonate greenhouse measuring approximately 20 feet by 70 feet to support and expand the agriculture program. The subject property is located east of CSAH 83 (Canterbury Road South), north of Eagle Creek Boulevard, and on the north side of Deans Lakes Boulevard. The Engineering department has completed its review and offers the following comments at this time for the applicant and for the planning department: 1. Submit a turning movement diagram that shows accessibility for the Shakopee fire truck throughout the site. 2. Prior to any land disturbing activity, a grading or building permit must be obtained. 3. Obtain an NPDES construction site permit prior to any land -disturbing activity if one acre or more of land will be disturbed. A copy of the permit must be provided to the city. 4. Final approval of the stormwater management plan shall be required if applicable. 5. The contractor must submit a Construction Management Plan to the city prior to any construction activities if required. 6. The owner must enter into a Utility Facilities Easement Agreement with the city. The document must be recorded with Scott County. 7. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5 and Section 11.2 (A -L). The record plans need to be certified and submitted to the engineering department. H:ADevelopment\4601 Dean Lakes_ Southwest MetroA_Project Management\Letters and Memos Staff Review CUP (Southwest Metro) 03 0226.docx 28 RESOLUTION PC2026-008 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING A CONDITIONAL USE PERMIT FOR A SCHOOL AT 4601 DEAN LAKES BOULEVARD WHEREAS, Jacob Windschitl, applicant, and Southwest Metro Intermediate School District No. 288, property owner, have made application for a Conditional Use Permit to allow a K-12 public or private school in the Business Park (BP) Zone; and WHEREAS, the property which the request is being made is legally described as: Tract B, Registered Land Survey No. 199, Scott County, MN; and WHEREAS, all required public notices regarding the public hearing for the application were duly sent and posted and all persons appearing at the hearing have been given an opportunity to be heard thereon; and WHEREAS, the Board of Adjustment and Appeals of the City of Shakopee reviewed the initial request on December 3, 2020 and the amendment request on March 5, 2026 and adopted the following findings: Conditional Use Permit Findings: Criteria #1 The use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity; Finding #1: The Board has not received any evidence that the use of the property as a school will be injurious to the use and enjoyment of other property in the vicinity, if conducted in accordance with proposed conditions. The proposed addition meets City Code requirements for design and building materials. Criteria #2 The approval of the conditional use will not impede the normal and orderly development and improvement of surrounding vacant property for uses allowed in the area; Finding #2: The Board finds that the conditional use permit for a school will not impede the normal and orderly development and improvement of surrounding property. All adjacent properties are commercially zoned properties. 29 Criteria #3 Adequate utilities, access roads, drainage, and other necessary facilities have been or will be provided; Finding#3: The Board finds that adequate utilities, access, drainage and other necessary facilities have been or will be provided for the site. Criteria #4 The use is consistent with the purposes of the zone in which the applicant intends to locate the proposed use; and Finding #4 The Board finds that this use is consistent with the purposes of the BP, Business Park Zone. The proposed use of the site as technical education, offices, and classrooms is consistent with the purpose of the Business Park Zone. Criteria #5 The use is not in conflict with the Comprehensive Plan. Finding #5 The Board finds that the use is not in conflict with the Comprehensive Plan. The comprehensive plan guides this property for Mixed Use Center, which allows for institutional / office uses, such as a school and affiliated offices. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT AND APPEALS OF THE CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS: That the conditional use permit for a public or private K-12 school in the BP, Business Park Zone is hereby approved, subject to the following conditions: 1. All conditions of Resolution PC2020-008 still apply. 2. The applicant must confirm that fire apparatus is able to maneuver around the proposed addition to the building. 3. The applicant must comply with the Engineering Department Memorandum dated February 24, 2026. 4. Mechanical units associated with the remodel / addition must be painted or screened in accordance with City Code requirements of Section 151.108. 5. The design / materials of the CTE addition must match proposed plans and elevations and greenhouse must be polycarbonate and not exceed the proposed size of 20'x70'.
