CONSIDERATIONS
Tollefson Development has made application for final plat approval of Church Addition. The
proposed development is located east ofCSAH 83 and south ofCSAH 16 (Exhibit A). The
development, as proposed, would consist of 166 dwelling units and reserve approximately 6.9
acres for future neighborhood commercial development. (Exhibit B).
The final plat is in substantial conformance with the approved preliminary plat and the
development patterns approved with the Conditional Use Permit (CUP) for the site.
Shakopee Public Utilities (SPUC) , the Engineering Department, and Park and Recreation
have provided comments attached as Exhibits C, D, and E. Staffhas incorporated these
recommended changes into the draft resolution for Council's consideration.
ALTERNATIVES
1. Approve Resolution No. 6060, approving the Final Plat of Church 1st Addition subject
to the conditions presented.
2. Approve Resolution No. 6060, subject to revised conditions.
3. Do not approve the final plat and direct staffto prepare a resolution consistent with the
direction ofthe Council.
4. Table the matter and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends Alternative No.1, approval of Resolution No. 6060, approving the Final
Plat of Church 1st Addition.

RESOLUTION NO. 6060
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF CHURCH 1ST ADDITION
WHEREAS, , Tollefson Development, applicant and property owner, has made
application for final plat approval of Church I st Addition; and
WHEREAS, the subject property is legally described as:
The Northwest Quarter of the Northeast Quarter of Section 16, Township 115, Range 22, Scott
County, Minnesota, subject to Scott County Road 16, (Eagle Creek Boulevard)and Scott County
Road 83 (Canterbury Road South), both as described in document number 549517; and
WHEREAS, the Planning Commission recommended approval of the proposed
preliminary plat and conditional use permit with conditions; and
WHEREAS, on June I, 2004 the City Council reviewed the proposed final plat, and
found it to be generally consistent with the approved preliminary plat and conditional use
permit.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that final plat of Church I st Addition is hereby approved subject to the
following conditions;
I. The following procedural actions must be completed prior to the recording ofthe
Final Plat:
A. The mylars shall be revised to include 1 st Addition since the property will
be platted in phases.
B. The final plat shall be revised to accurately reflect the location of the
Minnegasco easement and include recording information.
C. Twenty feet of drainage and utility easement, centered on all storm sewer
alignments outside the right-of-way, shall be provided.
D. A total of ten feet of drainage and utility easement shall be provided
between all proposed building "clusters".
E. A drainage and utility easement shall be provided to encompass the
proposed storm sewer alignment through Outlot A.
F. A total often feet of drainage and utility easement shall be provided along
the interior of Outlot A.
G. Approval of the plat is contingent upon approved drainage calculations.
H. The applicant shall provide the 2.056 acres identified as parkland to the
City by deed.
I. The applicant shall deliver a deed to the city conveying the sumbersible
well parcel to Shakopee Public Utilities, and an easement from Shakopee
Public Utilities to the city for use ofthis parcel as parkland.
J. Lot 77, Block 4 shall be revised to show its northern property line as the
south limit of the Northern Natural Gas Co. easement.
K. Approval of title by the City Attorney.
L. Execution of a Developers Agreement with provisions for Plan A and Plan
B improvements, as well as payment of engineering review fees, and any
other fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements
ofthe Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements ofthe
Design Criteria and Standard Specifications ofthe City of
Shakopee.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Storm Water Storage and Treatment
Charges, Trunk Sanitary Sewer Charges, security for the public
improvements, engineering review fees, and other fees as required
by the most current City of Shakopee adopted Fee Schedule for the
entire plat.
6. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve the
Final Construction Plans and Specifications.
7. Park dedication fee is $214,127.01. The applicant shall provide
security for that amount. All or a portion of this amount may be
credited to the developer for improvements made to the park.
8. The City will waive the standard set forth in the Park
Comprehensive Plan for 300' of public road frontage.
9. The applicant will work with staff to design and construct the park
as part of the construction of the development. Construction costs
shall be credited toward the applicant's cash contribution
requirement. The applicant shall bring back a park plan for review
by the Advisory Board.
10. Sidewalks and trails be constructed as shown on the plat.
11. All park dedication shall be recorded at time of final plat approval.
M. Easements shall be shown on the Final Plat as approved by the City
Engineer, including, but not limited to, those listed in the May 7, 2004
memo from Joe Swentek.
N. The survey data (length and bearings) shall be shown for each lot.
O. Temporary street signs shall be installed.
P. Streets less than 32 feet in width per City of Shakopee design standards
shall be posted for no parking on 1 side.
Q. Street signage shall be approved by the Fire Inspector.
R. Property address signs shall be posted at driveway and/or access road
entrances. (ie 1542-1665 or 1492 -1544 even)
S. A six foot solid visual screening fence shall be constructed along the
western property line along the residential portion of the site. The
screening should be accomplished through a combination of berm and
fence or fencing.
T. The lot width for Lot 77, Block 4 shall be allowed as shown on the final
plat.
U. Access permits shall be required for each of the proposed accesses onto
CSAH 83 and CSAH 16.
V. The right-in/right-out on CSAH 16 should be to a public street connection.
If the right-in/right-out is not a public street, the access should then be
limited to a right-in only.
W. A right turn lane shall be required at each access to the County road. A left
turn lane shall be required at the full access on CSAH 16.
X. The right-of-way width and road design for the full access public street on
CSAH 16 should match the planned public street improvements on the
north side of CSAH 16.
Y. The developer shall implement Best Management Practices for erosion
control and storm water management during construction.
Z. Placement of6" of topsoil. The soil composition from offsite sources
should be similar to the MnDOT topsoil borrow requirements.
AA. Install rain sensors for all irrigation systems.
BB. The plat shall be revised to rearrange the text to the East of Lots 25, 26,
and 27, Block 1.
II. Following approval and recording of the final plat, the following conditions shall
apply;
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. The developer and/or Homeowners Associations shall be responsible for any
required or desired noise mitigation measures.
C. The developer and/or Homeowners Association shall be responsible for the
maintenance of all areas held in common ownership.
D. All utility meters shall be screened.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the final plat of
Church 1 st Addition does not constitute a representation or guarantee by the City of Shakopee
as to the amount, sufficiency or level of water service that will be available to lots within the
plat as they are developed.

Municipal water seIVice is available subject to our standard terms and conditions. These
include, but are not limited to; installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk
Water Charge, and paying the Water Connection Charge.
Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to: entering into an Underground Distribution
Agreement, granting any necessary easements, andpaying the associated fees,
Street Lighting installation is available subject to our standard tenns and conditions,
These are contained in the current City of Shakopee Street Lighting Policy. Applicant

The application indicates a Final Plat request for a multi-family residential/commercial
development.
After reviewing the above referenced application, we have the following comments for the
applicant and the planning department:
General Comments
1. Execution of a Developer's Agreement, which shall include provisions for security for
public improvements within the Final Plat and the engineering review fees.
2. Payment of Trunk Sanitary Sewer Charges shall be made, as required by the most
current City of Shakopee Fee Schedule.
3. Payment of Trunk Storm Water Charges and Trunk Storm Water Storage and
Treatment Charges shall be made, as required by the most current City of Shakopee
Fee Schedule.
4. No public improvements shall be constructed until the City Engineer and the Shakopee
Public Utility Commission (SPUC) approve the Final Construction Plans and
Specifications.
5. Provide electronic (AutoCAD) files of the Final Plat to the engineering department.
6. The applicant shall extend the trunk sanitary sewer located on the East side of County
Road 83 as directed by the City Engineer.

Final Plat
1. Easements shall be shown on the Final Plat as approved by the City Engineer. They
shall include, but not be limited to, the following:
. Provide a total often (10) feet of drainage and utility easement along the interior of
Outlot A.
. Provide a minimum of twenty (20) feet of drainage and utility centered on all
proposed utilities through Outlot A.
. Provide a total of ten (10) feet of drainage and utility easement between all lot
"clusters". Verify this is being provided between Lots 6 and 7 of Block 1.
. Provide a total of ten (10) feet of drainage and utility easement adjacent to all
right-of-way. Verify this is being provided near Lot 1, Block 2.

Subject: Church Addition Park Easement Area
I am writing to update you on the status park easement area for Church Addition, and to
provide you with suggested conditions for the resolution.
As you know, the Parks and Recreation Advisory Board recommended that the
developer provide a park easement for the parcel that is shown on the plat to be the
future site of a submersible water well. Conditions in the preliminary plat resolution
require the applicant to provide documents for execution of the park easement area prior
to review of the final plat, and require the applicant and Public Utilities to come to an
agreement for the purchase of this parcel.
Gary Wollschlager from Tollefson Development, Joe Adams from Shakopee Public
Utilities and I met today to come to resolution on this issue. As I understand, Shakopee
Public Utilities will need to provide the easement to the city instead of the applicant since
a park easement cannot be shown on a plat. Therefore, we reached agreement where
the following would occur:
1. Tollefson Development would accept the offer that Shakopee Public Utilities is
making for this parcel ($27,500). They will finalize the purchase agreement and have
the Public Utilities Commission act on it at their June 7 meeting.
2. Shakopee Public Utilities would convey the park easement to the city. This easement
agreement would be presented to City Council for consideration at their June 15
meeting.
In order to protect the city and ensure these transactions occur, I would recommend that
as a condition of approval prior to recording the plat:
. The applicant shall provide the 2.05 acres identified as parkland to the city by deed.
. The applicant shall deliver a deed to the city conveying the submersible well parcel
to Shakopee Public Utilities, and an easement from Shakopee Public Utilities to the
city for use of this parcel as parkland.

Subject: Church Addition Final Plat Review
I am writing to provide comments related to the final plat application for Church Addition.
Park Dedication Cash Contribution Calculation
The preliminary plat conditions require that the applicant meet park dedication
requirements through a combination of land and cash. The cash amount was to be
calculated at time of final plat approval.
The applicant provided me with a copy of the closing statement for the sale of the land,
$6,500,000. Therefore, the cash contribution calculation is as follows:
Fair Market Value of the Land as Defined by City Ordinance:
$6,500,000 (sale price of land)/41.26 acres = $157,537.56/acre
Calculation for Land and Cash Senario as Defined by City Ordinance:
Residential Park Dedication Cash Contribution: 166 units X $3,012/unit =$499,992
Credit for the Land Being Dedicated: 2.05 acres X $157,537/acre =($322,951.99)
Commercial Park Dedication Cash Contribution 6.94 acres X $5.344/acre =$37.087
Cash Contribution Due =$214,127.01
Based on this calculation, the developer could be required to contribute $214,127.01 in
cash.
Improvements to the Park
The conditions of the preliminary plat also require that the developer work with the city to
design and construct the park as part of the development project, and cost of the
improvements would be credited toward the applicants park dedication fee. I have been
working with Joel Hussong, Landscape Architect from John Oliver and Associates (the
applicant's engineer), to design the park. We anticipate presenting the park design to the
Parks and Recreation Advisory Board at their May meeting.
Park Easement Area
It is my understanding that condition 1.H. in the preliminary plat resolution requires the
applicant to provide documents for execution of the park easement area shown on the
preliminary plat where the submersible well is located. In speaking with the applicant, he
believes that it is the city's responsibility to negotiate that easement with Shako pee
Public Utilities, the potential future owner of this parcel.

The applicant informed me that he continues to negotiate with Shakopee Public Utilities
for the purchase of this parcel. However, his negotiations apparently do not have the
easement associated with the purchase - the city would need to acquire that easement
from SPUC at a later time.
If the applicant is unable or unwilling to provide the easement documents, the city should
require the applicant to redraw the plat to incorporate this area as parkland, and the park
dedication cash contribution recalculated. Shakopee Public Utilities would then need to
negotiate an easement from the city.
As I understand from the applicant, he is trying to arrange a meeting for sometime this
week to discuss this further with SPUC and the city.
