Michael Leek, Community Development Director SUBJECT: Proposal to amend the City's Zoning Code by allowing Residential Uses Serving Handicapped Persons in the Highway Business (B-1) Zone MEETING DATE: June 15, 2004 CASELOG: 04-046 INTRODUCTION: As a follow-up to the Commission's April 22nd review ofthe concept of National Handicapped Housing Institute (NHHI), and determination on June 3, 2004 that the proposed use is similar to other uses permitted by CUP in the B-1 zone, staff brought fOIWard a proposed text amendment adding the use to the list of conditionally permitted uses. PLANNING COMMISSION RECOMMENDATION: On June 3rd, the Planning Commission reviewed the proposed text amendment, and unanimously recommended its approval. ALTERNATIVES: 1. Offer and approve Ordinance No. 708 approving amending the Highway Business Zone (B-1) by allowing residential uses serving handicapped persons as a conditional use. 2. Do not approve Ordinance No. 708. 3. Table the request for additional information. ACTION REQUESTED: Offer and approve Ordinance No. 708 approving amending the Highway Business Zone (B-1) by allowing residential uses serving handicapped persons as a conditional use. A:d~ R. HIGHWAY BUSINESS ZONE (B-1) Subd. 3. Conditional Uses. T. Housing designed to serve the needs of handicapped persons. (Re-letter accordingly) Section 2 - - Effective Date. This ordinance becomes effective from and after its passage and publication. Adopted in session of the City Council of the City of Shakopee, Minnesota held the day of , 2004.
