Regarding Hourly Restrictions on Construction Activities
On Park Meadows

INTRODUCTION:
By letter dated July 2, 2004, Centex Homes, the developer for Park Meadows, has
requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3,
Hourly Restrictions on Certain Operations, D, be suspended for Saturday work hours.
DISCUSSION:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
Centex Homes is requesting a suspension on the hours as follows:
Saturday From 9:00 AM to 8:00 AM Start Time
From July 6, 2004 to September 30, 2004
The earlier starting time is to expedite work in order to work longer hours to allow
contractors to work earlier on Saturday and to meet the schedule for this project. The
contractor is anticipated to work at least six days a week to complete the project.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
3. Blasting activities, ifany, must be done from 10:00 A.M. to 6:00 P.M on Saturdays.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News. Staff
believes by allowing this suspension of work hours, the projects can be done sooner than
the length of construction description and inconvenience is minimized.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by
Centex Homes, as per their letter dated July 2,2004.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for some other
period of time as determined appropriate by the City Council, and direct staff to
publish notice ofthe suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer a motion approving suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by
Centex Homes, as per their letter dated July 2, 2004 and direct staff to publish notice of
the suspension terms with the conditions as recommended by staff.

Request for Extension of Saturday Hours
Dear Mr. Loney:
We are hereby requesting from the City of Shakopee an extension of working hours for Saturday
construction activities for the Park Meadows project from a 9:00 AM start time, per City ordinance, to an
8:00 AM start time, We would like this to occur from July 6, 2004 thru September 30, 2004. We
understand the issue must be approved by the City Council and are available to answer any outstanding
issues as it relates to this request.
