No. 6079 /61J I CITY OF SHAKO PEE Co tlSe 1\ T Memorandum CASE NO.: 04-056 TO: Mayor and City Council Mark McNeill, City Adminsitrator FROM: Mark Noble, Planner I SUBJECT: Set Public Hearing for Vacation of Easements Located South of Valley Industrial Boulevard South, West of Valley Park Drive, and East of Canterbury Road MEETING DATE: July 6,2004 .(,... \ INTRODUCTION McGough Construction has submitted an application for vacation of easements located South of V alley Industrial Blvd. S., west of V alley Park Drive, and east of Canterbury Road (Exhibit A). The attached Resolution No. 6079 sets a public hearing date to consider the vacation of the easements. DISCUSSION The attached resolution sets a public hearing for Wednesday, August 4, 2004. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission will consider the request at its July 22, 2004 meeting. ACTION REQUESTED Approve Resolution No. 6079, a resolution setting the public hearing date to consider the vacation of easements for property south of Valley Industrial Blvd. S., west of Valley Park Drive, and east of Canterbury Road. Mark Noble Planner I RESOLUTION NO. 6079 A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE VACATION OF EASEMENTS FOR PROPERTY SOUTH OF VALLEY INDUSTRIAL BOULEVARD SOUTH, WEST OF V ALLY PARK DRIVE AND EAST OF CANTERBURY ROAD WHEREAS, it has been made to appear to the Shakopee City Council that easements located south of V alley Industrial Blvd. S., west of V alley Park Drive, and east of Canterbury Road serves no public use or interest; and WHEREAS, a public hearing must be held before an action to vacate can be taken and two weeks published and posted notice thereof must be given. WHEREAS, two weeks published notice will be given in the SHAKOPEE V ALLEY NEWS and posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott County Courthouse, the bulletin board atthe U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council Chambers on the 4th day of August, 2004, at 7:00 P.M. or thereafter, on the matter of vacating easements located south of Valley Industrial Blvd. S., west of Valley Park Drive, and east of Canterbury Road.
