Cox, City Clerk ,RE: Setting Date for Tobacco Violation Hearing DATE: July 14, 2004 INTRODUCTION: City Council is asked to set a date to review the actions of a certain tobacco licensee. BACKGROUND: Any licensee who furnishes, sells or attempts to sell tobacco, tobacco products or tobacco related devices to a minor or whose employee furnishes, sells or attempts to sell tobacco, tobacco products or tobacco related devices to a minor shall be charged an administrative fine and shall also have his or her license suspended as outlined in the City Code. Tobacco compliance checks were completed on May 16 and May 19,2004. There are 35 tobacco licenses in the City of Shako pee and 34 of the 35 establishments passed their compliance check. Staff is ready to proceed with the setting of a hearing date to consider the tobacco violation that occurred during the compliance check on May 16, 2004. This is the third violation for Twin Cities Stores, Inc. dba Oasis Market within a three-year period. Under the current ordinance, adopted by City Council on July 2, 2002, the penalties for a third or subsequent violation are a $1,000 fine plus a 30-day license suspension or revocation. The penalty for a third or subsequent violation may only be imposed by the City Council. Any revoked license shall not be eligible for ' reinstatement for at least twelve (12) months. (The penalty for a first or second incident shall be imposed and administered by the City Administrator upon an admission by the licensee that the licensee furnished, sold, or attempted to sell tobacco, tobacco products or tobacco related devices to a minor.) ACTION REQUESTED: Set a hearing for Wednesday, August 4,2004, at 7:00 p.m., or thereafter, to review the action of Twin Cities Stores, Inc. dba Oasis Market #528,615 South Marschall Road. i:licenses\tobaccoviolationmemo
