Motion Type: Approve Background: Kimley-Horn, applicant, and MCP Shakopee LLC (Amazon), property owner, are requesting that the Board of Adjustment and Appeals approve their Conditional Use Permit to allow exterior storage of additional semi-trailer/trucks, and overheight fencing on property located at 2601 4th Avenue East (east of Shenandoah Drive, north of 4th Avenue and south of County Road 101). The subject property has been the site of the Amazon Fulfillment Center since receiving CUP approval in 2015. The applicant has provided a narrative of their proposed improvements, which would include additional trailer parking area, fencing for screening and security purposes, new landscaping, and other site & utility improvements. Amazon is looking to reuse the northwest area of their site for approx. 80 trailer parking/storage spaces. The area presently is used primarily for stormwater management, with some employee parking spaces also to be removed for use as trailer parking/storage. With this proposal, they would be constructing an underground (under the parking lot area) stormwater management storage system to ensure compliance with the City's stormwater management regulations. They would also be installing an 8' tall 5 black/dark gray composite commercial grade fence and new landscaping, both for screening purposes. An 8' tall fence at the location proposed requires approval of a Conditional Use Permit front yard setback encroachment). Findings Section 151.011 (Conditional Use Permits), Subd. A (Criteria for Granting Conditional Use Permits) states "In granting a conditional use permit, the Board of Adjustment and Appeals shall consider the effect of the proposed use upon the health, safety, and general welfare of the occupants of surrounding lands and the City as a whole." The Board of Adjustment and Appeals shall not grant a conditional use permit without making certain findings. The criteria required for the granting of conditional use permits are listed below with staff findings. Criteria #1 The use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity; Finding #1 The City has not received any evidence that the proposed use will be injurious to the use and enjoyment of other property in the immediate vicinity, nor would it substantially diminish or impair property values in the area, provided the use complies with the conditions of the resolution. Criteria #2 The establishment of the conditional use permit will not impede the normal and orderly development and improvement of surrounding vacant property for uses allowed in the area; Finding #2 The conditional use permit should not impede future development and improvement in the area, provided the use complies with the conditions of the resolution. Criteria #3 Adequate utilities, access roads, drainage and other necessary facilities have been or will be provided; Finding#3 necessary The Board finds that adequate utilities, access, drainage and other facilities have been or will be provided for the site, as conditioned in the resolution. 6 Criteria #4 The use is consistent with the purposes of the zone in which the applicant intends to locate the proposed use; and Finding #4 The use of the subject property is consistent with the purposes of the Light Industry (I-1) Zone. Criteria #5 The use is not in conflict with the Comprehensive Plan. Finding #5 The use is not in conflict with the Comprehensive Plan (Industrial). Staff reviewed the above criteria and have found that the proposal would meet the criteria, provided the conditions noted in the draft resolution are met. City Engineering and Planning staff have provided conditions in addition to the conditions noted in City Code Section 151.007 (K) (21) that have been incorporated into the draft Resolution. Of particular emphasis by city staff is the need for extensive screening of the site and that the applicant will need to work closely with City staff prior to any building permit or site improvements construction should this CUP be approved to ensure compliance with any City Code and CUP Resolution requirements. Recommendation: Approve the requested action. Finding #2 The conditional use permit should not impede future development and improvement in the area, provided the use complies with the conditions of the resolution. NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment and Appeals of the City of Shakopee, Minnesota that the requested CUP is hereby approved, subject to the following conditions: 8 1. This use shall comply with conditions noted in City Code Section 151.007 (K) (21), Exterior Storage. 2. All proposed uses will take place as shown on the submitted Site Plan (dated 10/30/24), unless as specifically noted in this Resolution or by city staff. 3. Additional landscaping, fencing and/or berming will be required to ensure that screening of the parking lot complies with the City Code landscape requirements (151.112) and is compliant with the Tree Preservation requirements (151.113). The submitted landscape plan does not identify all of the existing trees proposed for removal. Financial security shall be provided in accordance with City Code for the proposed landscaping. 4. Fire department access shall be provided as required by the Minnesota State Fire Code. 5. Development of the site shall comply with the conditions noted in the City Engineering Memo (dated 10/28/24) and as identified on the redlined site plans, unless as revised/approved by City Engineering staff. 6. A Utility Facilities Easement Agreement template has been uploaded to the Attachments folder. Work with the Engineering department to finalize this prior to recording. 7. A Construction Management Plan template has been uploaded to the Attachments folder. Work with the Engineering department to finalize this plan prior to construction. 8. Fencing shall comply with City Code Section 111.02 standards (including not to exceed 8' in height, nor constructed of materials that are deemed hazardous, including use of barb -wire). Amazon is proposing a redevelopment of the existing site located at 2601 4th Ave E in Shakopee, MN The proposed redevelopment site is approximately 65.65 acres and will remain under the current Light Industrial (I-1) zoning district.
