Board of Adjustment and Appeals Meeting
October 3, 2024

appropriate Public Hearings None

5. Consent Business - (All items listed in this section are anticipated to be routine. After a
discussion by the Chair there will be an opportunity for members of the BOAA to remove any items
from the consent agenda for individual discussion. Those items removed will be considered
following the Public hearing portion of the agenda. Items remaining on the Consent Agenda will not
be discussed and will be approved in one motion.)

Public Hearing: Variance to Allow Gravel Parking Lot at Valleyfair
Motion to open public hearing by Reding seconded by Forsythe, motion approved
unanimously.
Sta? presented the case. Valleyfair is looking to create a gravel parking lot between its
current entrance and the existing form facilities. They plan on using the gravel that was purchased
during the recent floods that acted as an entrance walkway and to relocate that material to the area
and mix it with some soil and grass seed to create a firm area. Sta? is recommending that this not
be approved since it does not meet city code.
The applicant was represented by Tom Suel, Director of Maintenance and Construction for
Valleyfair. Mr. Suel said that he wanted to grade the lot and use it occasionally for parking and to
make it into a laydown lot for future expansion. Thery need space to lay things out. They want to
grade it flat and install rock and then grass it out. Chair Sepulveda asked why then did they submit
a request for use as a parking lot. He said that it would be used occasionally for parking like their fall
event Valley Scare. It is not a good parking lot he stated because of where it is situated you have to
cross the main entrance tra?ic. Not a good place for parking lot. They want to create a
multipurpose facility. Chair said clearly there was a misunderstanding. Chair asked if there was
some confusion. Sta? said that it being used as an overflow parking lot. Either you have to meet
the city code or not use it. Mr. Suel said that it was currently gravel with grass. Commissioner
Forsythe said that you would need to decide what you are using it for. Mr. Suel said that it might be
used again for parking during their fall event. Commissioner Forsythe said it would not be used for
dorms. Commissioner Wilder said maybe the narrative needs to be rewritten. Chair Sepulveda
said maybe you need to go back to the city and figure out what you want. Lucas Jones, PE, project
manager from MSA professional Services, 60 Plato Blvd, #420, St. Paul. MN, stated they had started
with a grading permit. There may have been some miscommunication with what they were
planning. The intent is to have the large quantity of gravel to level out the city. The intent is to mix
that material with topsoil and see it and create a future laydown for future rides. Commissioner
Forsythe said the issue is that the lot may still be used for parking, even for four days per year. That
material spread over that lot would be about two inches. Intent is that a grading permit would be
needed at a minimum to use the gravel at the location. Chair said there is confusion on the use.
Could they get an interim use permit for temporary parking? They are limited by code to the number
of years. Sta? noted that it is a horrible parking lot location based on their own testimony.
Motion to close public hearing by Commissioner Weiler and seconded by Commissioner Sandu.
Forsythe moved to approve the Resolution and seconded by Commissioner Weiler. Passed
unanimously.
Approve Resolution NO. PC2024-011, a resolution denying a variance
request to City Code Sections 151.140 (Parking) & 151.142 (Design
Standards) to create a gravel parking lot for dorms at Valleyfair, 1 Valley
Fair Drive South, where bituminous asphalt and/or concrete are listed
required materials of the City Code.

seconded by Reding, Unanimous. Meeting ended at 7:03PM
