Recommendation: Adopt the Resolution, as presented. Discussion: Site Information: Applicant: Lena Strauss, Dewberry Engineers, Inc as agent for Space Exploration Technology, Inc. Property Owner: Compass Datacenters MSP I, LLC Property Address: 4450 Dean Lakes Boulevard Lot Area: 11.59 acres Current Zoning: Business Park (BP) with PUD Overlay 2040 Comp. Plan: Mixed Use Center Lena Strauss, representing Space Exploration Technology, Inc., has applied for a PUD Amendment to the Dean Lakes PUD to allow the construction of an approximate 95' x 193' fenced area, within the existing perimeter fencing, where 40 ground based satellite antennas would be installed. The proposed satellites will support Starlink, a constellation of low earth - orbit satellites facilitating broadband internet service for underserved communities and remote areas where access to high-speed internet may be limited or non-existent. The PUD allows for commercial and business park uses; however, changes to uses require a PUD Amendment. This request is considered a minor amendment by City Code, as it involves less than 10 percent of the PUD area (approximately 266 acres). Minor PUD Amendments are Page 2 of 18 only reviewed by the Planning Commission, unless the Commission's decision is appealed to the City Council. Staff spoke with representatives of the property owner in January 2024 and informed them that a PUD Amendment and permits (building, grading, and electrical) would be required for the proposed satellites. In March 2024, a fence permit was applied for but not issued due to the requirement for a PUD Amendment. It was observed shortly thereafter that grading, electrical, and fencing work had commenced on the property without the proper permits. A Stop Work Order was then issued. The proposed satellites would be located northwest of the existing building in an area surrounded by a proposed 6' black, vinyl coated chain link fence that is being leased by the applicant. Each satellite is enclosed in a white fiberglass housing called a radome which is approximately 8' tall and approximately 7' wide. The radomes are installed on a pre-fab concrete base and positioned for exclusively skyward transmission. In addition to the 40 satellites, 4 transformers would be installed within the fenced area. A driveway and parking pad is also proposed on the south side of the fenced area off the existing interior access drive. No additional lighting is proposed. The applicant is proposing to plant a total of 48 coniferous trees of 4 different approved varieties around the west, north and east sides of the proposed fenced area to serve as screening. The trees shall comply with City Code Section 151.111 and 151.112. The Engineering, Planning, and Fire Department have reviewed the request and are recommending approval provided the applicant complies with the Engineering Memo dated June 25, 2024 and obtains all of the necessary building, electrical, stormwater, and grading permits. The following is a description of the proposed activity/activities: • Installation of an outdoor fenced compound, dimensions of 95.2 ft by 193.6 ft within a secured - access data center site. The compound will be gravel filled and will contain 40 proposed ground - based satellite antennas. It will be accessed by a 15 ft wide gravel access drive. Power and fiber connection will be pulled from the existing data center on site. An H -frame will be located inside the compound housing the manual transfer switch. • The completed facility will support Starlink, a constellation of low Earth -orbit satellites facilitating broadband internet service for underserved communities and remote areas including agricultural lands, utility sites, and public lands and outdoor recreation spaces where access to high-speed internet may be limited or non-existent, and will require the install of new electrical service; site preparation, earthwork, and landscaping/ hardscaping for approved surface improvements and stormwater management; and installation of required signage, the H- frame, and the perimeter fence. • The individual factory -mounted antennas to be located within the fenced area will be delivered and installed on a pre-fab concrete pad and positioned for exclusively -skyward transmission within an enclosed white fiberglass housing called a radome. Although the completed facility will be inaccessible to the public and surrounded on all sides by the secured data center property, signs notifying passersby of the presence of radio frequency will be installed on each side of the perimeter fence in accordance with national guidelines. The site is located east of CSAH 83 (Canterbury Road South), north of Eagle Creek Boulevard, and south of Deans Lakes Boulevard. This review should be considered preliminary, as more comments will follow with additional submittals. However, the Engineering Department offers the following comments at this time to the applicant and to the planning department: 1. Plan review comments have been prepared and a copy of those comments are attached to this memo. Revise plans to address the provided comments and provide a comment response memo. 2. A drainage and utility easement must be provided that encompasses the 100 -year HWL of proposed BMPs. 3. Obtain final approval of the site's storm water management plan. 4. Prior to any land disturbing activity, a grading or building permit must be obtained. A submittal must include detailed construction plans. 5. Private infrastructure must not encroach on the perimeter drainage and utility easements. 6. The proposed access road and parking area shall be paved with asphalt or concrete. 7. Obtain a NPDES construction site permit prior to any land disturbing activity. A copy of the permit must be provided to the city. The owner must enter into a Utility Facilities Easement Agreement with the city. The document must be recorded with Scott County. 9. The contractor must submit a Supplemental Conditions of the Grading Permit to the city prior to any grading activities. 10. The contractor must submit a Construction Management Plan to the city prior to any construction activities. 11. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5 and Section 11.2 (A -L). The record plans need to be certified and submitted to the engineering department. Provide a letter from the engineer of record certifying all improvements were constructed per approved plans and under the direct supervision of the engineer of record. The developer/engineer of record must provide a full-time onsite inspector during all utility installation. 12. Approval of the PUD Amendment does not constitute approval of the submitted plans. Recommendation The Engineering Department recommends approval of the application subject to the conditions above being addressed/completed by the applicant. H:\Development\Compass Datacenters (4450 Dean Lakes Boulevard)\Project Management \Letters and Memos\Staff Review\PUD Amendment (Compass Datacenters) 06 25 24.docx 2 oft Page 15 of 18 RESOLUTION PC2024-008 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT #24, DEAN LAKES WHEREAS, Lena Strauss, Dewberry Engineers, Inc., as agent for Space Exploration Technology, Inc., applicant on property owned by Compass Datacenters MSPI, LLC, has applied to amend the Planned Unit Development Overlay District #24 of Dean Lakes; and WHEREAS, the property is legally described as: Lot 2, Block 1, Dean Lakes 9th Addition, Scott County, MN; and WHEREAS, the Shakopee City Council approved the Dean Lakes PUD Overlay District on December 9, 2003; and WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on July 11, 2024, at which time all persons present were given an opportunity to be heard; and WHEREAS, the proposed amendment is considered a minor amendment by City Code because the proposal impacts less than ten percent of the Planned Unit Development area; and WHEREAS, the Planning Commission approves the amendment to Planned Unit Development Overlay District #24; and NOW, THEREFORE BE IT ORDAINED, that the Planning Commission of the City of Shakopee hereby adopts the following findings of facts relative to the above -named request: Criteria #1: Is the proposed development amendment consistent in all respects with the comprehensive plan? Finding #1: The proposed development complies with the current guiding for the site. The proposed amendment specifically relates to installation of ground -based satellites on an existing lot. Criteria #2: Is the proposed development, including deviations from design standards compatible with surrounding land uses? 1 Page 16 of 18 Finding #2: The proposed satellite installation is a complementary use to the existing datacenter; will be screened with coniferous trees; and shall not have adverse impacts including but not limited to odor, noise, additional lighting, or traffic. Criteria #3: Does the proposed development provide adequate open space, circulation, pedestrian orientation, parking, recreation, screening, and landscaping? Finding #3: The applicant is proposing a driveway and small parking area off an existing internal access drive and will provide screening consistent with City Code requirements. Criteria #4. If the primary function of the PUD is to encourage development which will preserve and enhance worthwhile natural terrain characteristics, it should not force intense development to utilize all portions of a given site in order to arrive at the maximum density allowed. Finding #4: The proposed satellite installation is proposed on a level area of the existing lot which does not require significant modifications to existing terrain or tree removal. Criteria #5: Does the PUD provide an overall compatibility of land uses and overall appearance and compatibility of individual buildings to other site elements or to surrounding development. The architectural style of buildings shall not solely be a basis for denial or approval of a plan. Finding #5: The existing structure on the property provides screening for most of the residential properties to the south and east. The applicant will provide screening per City Code requirements. Criteria #6. Whether the proposed PUD plan would offer a greater general public benefit than would be realized under the underlying zoning district and/or general zoning provisions. Finding #6: The satellite installation does not reduce the required open space or trail connections required in this development. BE IT FURTHER RESOLVED, that the property listed above in the Dean Lakes 9th Addition plat is hereby approved for an amendment to PUD Overlay District #24 in the Zoning Ordinance subject to the following conditions: 1. Applicant shall obtain all necessary permits including, but not limited to grading, stormwater, building, and electrical. 2. Shall comply with Engineering Memo dated June 25, 2024. 3. Shall comply with all applicable City Code Sections including, but not limited to 151.105- 151.125.
