b. PUBLIC HEARING — Preliminary Plat of Countryside 3rd Addition
Motion by Sepulvado to open the hearing and seconded by Reding. Passed.
Staff presented the case. Donnay Homes and Link submitted preliminary plat for 5.44
acres in the area that is by 17th Avenue and Marystown Road. Annexed by the city and
granted MUSA by the MET Council. It is zoned Urban Residential (R -1B). The preliminary
plat is for 17 single family lots on the extension of Lusitano Street. Lusitano would end
in a temporary cul-de-sac. The development exceeds the Met Council's required 3 DUA.
Homes will be generally similar to those constructed to the north. The development to
the east is existing rural residential homes located within Jackson Township. Staff
shared stormwater and landscaping plans. Staff recommends the PC support the
approval at city council.
Paul Donnay spoke with engineer John Bender asked if there questions. Started work in
this area in the 1990s. Chair asked price range, seemed larger. Donnay said similar that
he had built in the area. Choice lots. 4 -bedroom homes. These are custom homes and
he is the developer. Price range mid -500K to 600K depending on finishes. These are
custom homes. Commissioner Sepulvado asked about size 130 x 65 feet, about a third
of an acre. Some on the east side are larger lots. Sepulvado asked about side yards. 7.5
feet side yards so total of 15 feet. Sepulvado asked about stormwater. Basin will
discharge into trunk storm sewer line that drains into the city's larger basin that works
its way to Hwy 169. The Commissioner asked if this was single family or multifamily. He
asked about the bedroom sizes. The last subdivision had no two bedrooms. The price of
the lot and building requires at least three bedrooms and up. Two stories are four
bedrooms with 3.5 baths plus a finished basement.

Commissioner Schleck asked if they were building models. Donnay said he has built
thousands of homes. He will build one model home for sure. They have the ability to
make lots of changes in plans since these are all custom homes. He has many floor plans
you can choose from. Commissioner Sundhu asked about disruption to the existing
neighborhood. The city has rules about hours of construction to not disturb neighbors
at night or in the morning. They will also have a site protection plan and will work with
the city to ensure that there is no tracking into the street. Will have an erosion control
plan in place. Commissioner Sepulvado asked when it was starting. After road
restrictions are off and they get their grading permit. Anticipating summer of this year.
Motion to close the public hearing by Sepulvado and seconded by Schleck. Unanimously
approved.
Motion by Reding for a positive recommendation to city council approving preliminary
plat. Seconded by Schleck. Approved unanimously.
7. Other business. Chair asked Commissioner Sundhu to introduced himself. Moved here in
January 2020 from Pakistan. Received citizenship last year. Was involved in politics there so
wanted to be involved here.
8. Motion to adjourn to April 4, 2024 by Reding moved and seconded by Sepulvado. Unanimously
approved. Adjourned at 7:35 PM.

Rod Just of KRB Development, representing the Bharatall family, has applied for a vacation
of a public drainage and utility easement on Lot 7, Block 1, Meadowbrook Run. The subject
property is adjacent to the Whispering Waters development that is currently being developed
by KRB Development.
The applicant is proposing to vacate a 20' drainage and utility easement that covers an
existing drainage swale that is undersized for certain rain and snowmelt events and needs to
be widened for the 2nd phase of the Whispering Waters development. The applicant
proposes to construct a wider swale and dedicate a larger easement south of the current
easement that will accommodate larger storm events.
City Engineering staff anticipated this vacation request and staff recommends that the City

Council approve the request, on the condition that a new easement is provided. The applicant
has already provided a draft easement document for the new easement for the City's review.

Dear Shakopee Planning Commissioners,
I am writing on behalf of Bharatlall & Ramona Motillal who live at 2133 Pike Lake Road. I
represent KRB Development VIII who is the developer of the Whispering Waters neighborhood
which is south of Eagle Creek Blvd, east of Pike Lake Road and adjacent to the Motillal family
property. Through a Hydrology study that we were required to do as part of our development
requirements, it was determined that the 20' drainage swale that was platted in 1992 on the
Motillal property was not large enough to handle the amount of water that is present with certain
spring melt and rain events. The study recommends that the drainage easement be 35' wide,
15' wider than the existing easement. The Motallil family was agreeable to granting an additional
15' for the drainage easement but requested that the easement be relocated 45' further to the
south away from their home. We had the Hydrology report reviewed and it was determined that
moving the drainage swale further from their residence had no negative impact on the previous
findings. The Motallils are requesting since they are granting a wider easement in a different
location on their property that they would like the city to Vacate the current easement which will
no longer be needed or utilized. We appreciate your consideration.

SUBJECT: Vacation of Public Drainage and Utility Easement
PROJECT NO.: VACA-000195-2024
DATE: March 26, 2024
The application indicates a request to vacate a drainage and utility easement. The reason for this
request is that a larger drainage and utility easement is needed to accommodate the Whispering
Waters development located east of the subject property. The property owner has agreed to
granting the additional easement with the request that the easement is relocated further south
from their residence. Per the hydrology study that was prepared for the Whispering Waters
development, it was determined that relocating the drainage and utility easement to the south
has no negative impacts.
The Engineering Department has completed its review of the vacation request and offers the
following comments at this time for the applicant and for the planning department:
1. Conduct a title search to confirm other interest from utility holders in any
existing/underlying easements on the property.
2. Vacation of easements shall be contingent on new drainage and utility easements
being dedicated and recorded with the County.
Recommendation
Should the City recommend approval of this request, the Engineering Department suggests the
items listed above be attached as conditions of the approval.

RESOLUTION R2024 -
A RESOLUTION APPROVING THE VACATION OF A CERTAIN DRAINAGE
AND UTILITY EASEMENT IN THE MEADOWBROOK RUN PLAT
WHEREAS, Rodney Just, applicant, and Bharatall and Ramona Motilall, property
owners, has made application proposing to vacate a certain easement within the
Meadowbrook Run plat; and
WHEREAS, it has been presented to the Shakopee City Council that the public
drainage and utility easement as described below on Lot 7, Block 1, Meadowbrook Run, is
no longer of public use or interest; and
WHEREAS, the Shakopee Planning Commission considered the request at its
meeting of April 4, 2024, and recommended approval to the City Council; and
WHEREAS, a public hearing to consider the action to vacate the alley was held
in the Council Chambers of the City Hall in the City of Shakopee at 7:00 P.M. on the
16th day of April, 2024; and
WHEREAS, the proposed vacation is described as:
The 20.00 -foot drainage and utility easement within Lot 7, Block 1, as depicted and
dedicated per record plat of Meadowbrook Run, according to the recorded plat thereof, Scott
County, Minnesota described as the North 20.00 feet of the south 200.00 feet of said Lot 7,
Block 1, except the West 10.00 feet thereof and the Easterly 35.00 feet thereof; and
WHEREAS, ten days published notice was provided by publication of the notice
in the SHAKOPEE VALLEY NEWS and posted notice was provided by posting such
notice on the bulletin board in the Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, that it finds and determines that the vacation of
the alley as identified above is in the public interest, provided the following conditions are
met:
1. A title search shall be conducted to confirm other interest from utility
holders in any existing/underlying easements on the property.

2. This vacation of easement is contingent on a new drainage and utility
easement being dedicated and recorded at Scott County Land Records.
After the adoption of the Resolution, the City Clerk shall file certified copies hereof with
the County Auditor and County Recorder of Scott County.
Adopted in Regular session of the City Council of the City of Shakopee, Minnesota,
held the 16th day of April, 2024.
