Shakopee Board of Adjustments and Appeals April 4, 2024 FROM: Kyle Sobota, Senior Planner TO: Board of Adjustment and Appeals Subject: PUBLIC HEARING - Conditional Use Permit for a Vehicle Repair Facility at 8245 Crossings Blvd Policy/Action Requested: Adopt Resolution PC2024-003, a resolution approving a conditional use permit for a vehicle service and repair facility. Recommendation: Adopt the resolution, as presented. Discussion: Site Information: Site Address: 8245 Crossings Boulevard Property Owner: Shakopee Crossings LTD Partnership Lot Area: 2.30 acres (1.07 acres proposed in Final Plat) Current Zoning: B-1, Highway Business 2040 Comp. Plan: Mixed Use Commercial Center Kelly Schwieterman of CE SO, Inc., representing Valvoline Instant Oil Change, has applied for a conditional use permit for a vehicle service and repair facility at 8245 Crossings Boulevard, to construct a Valvoline Instant Oil Change in the Southbridge Fields development. In 2023 the subject property and the two adjacent parcels to the south were rezoned by the City Council to B-1, Highway Business. At the time of the rezoning, it was anticipated that this site would be used for a vehicle repair facility. The property owner has applied for a final plat that is scheduled for review on April 16th by the City Council to subdivide the property into a 1.07 -acre lot and a 1.23 -acre lot (see attached proposed final plat). Final plats are only reviewed by the City Council. Page 4 of 27 The proposed operation has three service bays that are accessed by vehicles from the existing private drive in the development. Valvoline Instant Oil Change allows for customers to remain in their vehicles while service work is performed. The applicant is providing a trail connection from the site to the trail along County Road 18, which is required by City Code. As proposed, the proposed building design / materials and general site plan meet the requirements of City Code. The applicant has proposed an adequate amount of landscaping on the site. Staff is recommending approval of the request, subject to conditions in the draft resolution. Staff is proposing a condition limit the hours of operation to be from 8:00 a.m. to 7:00 p.m., to limit noise impacts on the adjacent residential properties. Shakopee Public Utilities has commented on items regarding the electrical service and maintenance of cover over the existing watermain, which are noted in the attached draft resolution. The site is zoned B-1 Highway Business Zone. CESO on behalf of Valvoline LLC respectfully submits the attached Conditional Use permit package for the City's approval. There are over 1,800 Valvoline Instant Oil Change locations nationwide. Valvoline provides quick oil changes as well as other minor automotive preventative maintenance. Services are offered via drive - through, and customers remain in their vehicles from start to finish. Per City Standards, we provide the following responses: The lot is zoned B-1 Highway Business Zone and neighbors a Kwik Trip Gas Station and car wash to the southeast and proposed and existing commercial to the northwest. Valvoline fits in with the uses and zoning of the surrounding area. Residential homes are located to the rear of the site, but with the distance, heavy landscaping, plus Valvoline's hours and operational practices we feel there shouldn't be any harm to the residents. Valvoline is a low -traffic generator and therefore will not impede the existing or future operations of the area. Per the site plan submitted, adequate utilities, access roads, drainage and other necessary facilities will be developed. The lot is zoned B-1 Highway Business Zone and neighbors a Kwik Trip Gas Station and car wash to the southeast and proposed and existing commercial to the northwest. The property is located south of County Road 18 (Southbridge Parkway) and east of County Road 21. The Engineering department has completed its review and offers the following comments at this time for the applicant and for the planning department: 1. Connection to sanitary sewer must meet all requirements for the proposed use. This may require updates to the existing sanitary sewer floor drain to include an oil separator and/or other appurtenances. 2. Easements must be provided as approved by the City Engineer. They include, but are not limited to the following: a. Five feet of drainage and utility easement along the west property line. b. Drainage and utility easement encompassing all 100 -year high water levels. 3. Submit a detailed geotechnical report outlining any groundwater or bedrock encountered. The geotechnical report should provide infiltration rates at all proposed infiltration areas. 4. Prior to any land disturbing activity, the applicant will obtain a grading permit and/or a building permit. Along with the permit(s), the applicant must submit a detailed impervious surface drawing. 5. Prior to approval of a grading permit and/or a building permit, the applicant will obtain approval of a storm water management plan (SWMP). The SWMP will adequately address requirements set forth in the City of Shakopee's Comprehensive Water Resources Management Plan (CWRMP). Obtain a NPDES construction site permit prior to any land disturbing activity. A copy of the permit coverage card and letter must be provided to the city. A certified SWPPP inspector must conduct the required SWPPP inspections and provide documentation to the city. 8. Submit a recorded copy of a Utility Facilities Easement Agreement for the proposed development. A template can be obtained from the Engineering Department. 9. Submit a Construction Management Plan. A template can be provided by the engineering division. 10. Approval of the conditional use permit request does not constitute approval of the submitted plans. H:\Development\Valvoline (Southbridge)\_Project Management\Letters an gesk at w\CUP (Valvoline) 03 27 24.docx RESOLUTION PC2024-003 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW VEHICLE SERVICE AND REPAIR AT 8245 CROSSINGS BOULEVARD WHEREAS, Kelly Schwieterman, applicant, and Shakopee Crossings LTD Partnership, property owner, have made application for a Conditional Use Permit (CUP) to allow for a vehicle service and repair facility on property located at 8245 Crossings Blvd; and WHEREAS, the property upon which the request is being made is legally described as: Lot 2, Block 1, Southbridge Fields Third Addition, Scott County, MN; and WHEREAS, all required public notices regarding the public hearing for the application were duly sent and posted and all persons appearing at the hearing have been given an opportunity to be heard thereon; and WHEREAS, the Board of Adjustment and Appeals of the City of Shakopee did review this application on April 4, 2024, and adopted the following findings: Criteria #1 The City has not received any evidence that the proposed use will be injurious to the use and enjoyment of other property in the immediate vicinity, nor would it substantially diminish or impair property values in the area, provided the use complies with the conditions of the resolution. Finding #1 The applicant is proposing to build a facility that complies with the appearance standards for commercial buildings and will meet the landscaping requirements of City Code. Neighborhood meetings were held when this property was rezoned and for this conditional use permit request. None of the surrounding property owners attended either neighborhood meeting to express concerns regarding this development. Criteria #2 The conditional use permit should not impede future development and improvement in the area, provided the use complies with the conditions of the resolution. The Board finds that adequate utilities, access, drainage and other necessary facilities have been or will be provided for the site, as conditioned in the resolution. This site is served by both city sewer and water and other private utilities. Access to the site is from an existing private drive that can support the anticipated number of vehicle trips. The applicant will be required to provide adequate facilities for stormwater. The use of the subject property is consistent with the purposes of the Light Highway Business (B-1) Zone. Vehicle service and repair is a listed conditional use in the B-1, Highway Business Zone. The use is not in conflict with the Comprehensive Plan (Mixed Use Commercial Center). Vehicle service and repair is an allowed use by the comprehensive plan in the Mixed Use Commercial Center designation. NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment and Appeals of the City of Shakopee, Minnesota that the requested CUP is hereby approved, subject to the following conditions: 1. The applicant must comply with the Engineering Department Memo dated March 27, 2024 2. The applicant must receive a Hazardous Waste Generator License from Scott County Environmental Services prior to operation of the business, contact Joan Anderson at Scott County Environmental Services for details. 3. All service or repair work on vehicles must take place inside the building. 4. Trash handling must either take place inside the building, or be contained in a trash enclosure that meets City Code requirements, including a roof. 5. Unlicensed or inoperable vehicles must not be stored on the site. 6. The operation must not have a public address system or exterior speakers. 7. Automotive bodywork or painting is not permitted by this conditional use permit. 8. A stormwater management plan must be submitted and approved with the grading and/or building permit. If there is greater than one acre of disturbance, an NPDES Construction Stormwater Permit must be obtained. 9. 7.5' of cover must be maintained over the 16" diameter watermain along County Road 18 10. Underground electric service must be extended to the north lot line of this site. The Shakopee Public Utilities electric system is required to be looped to provide looping ability to the adjacent parcels. The point of connection to SPU's existing underground service shall be at the transformer serving Kwik Trip. The Valvoline building is required to take service from their own transformer.
