The applicant proposes customer / employee parking east of the building, toward Stagecoach Road and vehicles waiting for service will be parked southwest of the building behind a fence / gate. As proposed, the applicant's request appears to be consistent with 8 zoning requirements for a vehicle repair operation. A draft condition is included in the resolution that requires vehicles that are unlicensed and inoperable to only be stored within a building. Another draft condition limits the outdoor parking area southwest of the building to nine vehicles and is only to be used for vehicles associated with customers of the vehicle repair business. The Fire Department provided a comment regarding painting requirements, updating fire extinguishers within the building, storage of flammable materials, and exit signage. Review CI JP (Auto Repair) 12 29 25.docx 14 RESOLUTION PC2026-002 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW VEHICLE REPAIR IN THE HEAVY INDUSTRY (I-2) ZONE AT 7480 COUNTY HIGHWAY 101 EAST WHEREAS, Jim Marsh, applicant, and Stagecoach LLC, property owner, have made application for a Conditional Use Permit (CUP) to allow for vehicle repair on property located at 7480 County Highway 101 East; and WHEREAS, the property which the request is being made is legally described as: Lot 1, Block 3, Cretex Industrial Park 1st Addition, Scott County, MN; and WHEREAS, all required public notices regarding the public hearing for the application were duly sent and posted and all persons appearing at the hearing have been given an opportunity to be heard thereon; and WHEREAS, the Board of Adjustment and Appeals of the City of Shakopee did review this application on January 8, 2026, and adopted the following findings: Criteria #1 Finding #1 Criteria #2 Finding #2 Criteria #3 Finding #3 Criteria #4 Finding #4 The City has not received any evidence that the proposed use will be injurious to the use and enjoyment of other property in the immediate vicinity, nor would it substantially diminish or impair property values in the area, provided the use complies with the conditions of the resolution. The conditional use permit should not impede future development and improvement in the area, provided the use complies with the conditions of the resolution. Conditions are put in place to require that the use follow City Code and not have impacts on surrounding properties. The Board finds that adequate utilities, access, drainage and other necessary facilities have been or will be provided for the site, as conditioned in the resolution. This site is served by both city sewer and water and other private utilities. Access to the site is from an existing driveway that can support the anticipated number of vehicle trips. The use of the subject property is consistent with the purposes of the Heavy Industry (I-2) Zone. Vehicle repair is a listed conditional use in the Heavy Industry (I-2) Zone. 15 Criteria #5 Finding #5 The use is not in conflict with the Comprehensive Plan (Industrial). Vehicle repair is an allowed use by the comprehensive plan in the Industrial Land Use designation. The applicant must comply with the Engineering Dept. Memo dated December 29, 2025. 2. All repair work and detailing must take place inside the building. Vehicle repair is only permitted in the eastern building on this site. 3. Trash handling must either take place inside the existing building, or be contained in a trash enclosure that meets City Code requirements, including a roof. 4. Unlicensed and/or inoperable vehicles must not be stored outside of buildings on the site. 5. The applicant must receive a Change of Occupancy Permit from the Building Department prior to operation of the business. 6. The applicant must receive a Hazardous Waste Generator License from Scott County Environmental Services prior to operation, if a License is required. 7. Vehicle sales is not permitted in I-2, Heavy Industry zone and is therefore not approved by this conditional use permit. 8. No more than nine customer vehicles waiting for service or pickup that are associated with this business are permitted to be parked in the area southwest of the building in the area noted on the site plan. 9. Outside storage of vehicles and equipment not associated with the vehicle repair operation, such as boats, trailers, semi trucks and trailers, campers, etc. is not approved. 10. Spray finishing shall be completed in methods compliant with the Minnesota State Fire Code. Any used rags that contain petroleum -based products must be stored in metal cans with self -closing lids. The applicant recently constructed a multi -tenant building on this site and received a conditional use permit for vehicle repair within the building, but did not have the other tenant spaces of the building leased at that time. The applicant has since leased all but one space of the building to users that have / require exterior storage. The applicant has provided a site plan with storage areas for the tenants as noted above. This application request covers multiple tenant's use of the site. If the conditional use permit is approved and one tenant violates conditions of approval and the permit is revoked by the Board of Adjustment and Appeals, all of the tenants listed above would lose their approval for exterior storage. Staff clearly explained this to the applicant prior to the application being submitted, as the applicant did not wish to file separate applications for different tenants, or have tenants submit their own applications. The applicant installed a berm and landscaping on the south side of the site when the 1555 building was constructed and there are existing trees screening this area from adjacent residential properties and an existing privacy fence on the east side of the site. The Engineering Department has provided comments regarding this application and is specifically requiring that the applicant provide a drainage and utility easement that was to be dedicated by the Maras Street First Addition plat that was approved by the City Council in 2024, but has not been recorded. A condition has been added to the resolution to require that either the necessary easements must be provided or the plat must be recorded by March 1, 2026. The applicant is proposing to store vehicles and equipment affiliated with different tenants of the buildings on the site. The conditional use permit should not impede future development and improvement in the area, provided the use complies with the conditions of the resolution. Conditions are put in place to require that the use follow City Code and not have impacts on surrounding properties. The Board finds that adequate utilities, access, drainage and other necessary facilities have been or will be provided for the site, as conditioned in the resolution. This site is served by both city sewer and water and other private utilities. Access to the site is from an existing driveway that can support the anticipated number of vehicle trips. The use of the subject property is consistent with the purposes of the Light Industry (I-1) Zone. Exterior Storage is a listed conditional use in the Light Industry (I-1) Zone. 31 Criteria #5 Finding #5 The use is not in conflict with the Comprehensive Plan (Mixed Use Employment Center). Exterior Storage is an allowed use by the comprehensive plan in the Mixed -Use Employment Center designation. NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment and Appeals of the City of Shakopee, Minnesota that the requested CUP is hereby approved, subject to the following conditions: 1. Tenants of the buildings are allowed exterior storage of their equipment as noted in the narrative within their allowed spaces noted on the submitted and attached site plan. Storage of materials or equipment outside of the specified areas is not permitted. 2. The applicant must comply with the Engineering Dept. Memo dated December 30, 2025. 3. Trash handling must either take place inside the existing buildings, or be contained in a trash enclosure that meets City Code requirements, including a roof. 4. Unlicensed or inoperable vehicles must not be stored on the site. 5. All vehicles parked or stored on the site must be affiliated with tenants of the 1555 Maras Street building and tenant space E-5 of the 1465 Maras Street building. Parking of semi- trailers and semi -trucks is only permitted in the outdoor spaces allotted to Suites 1, 2, and 6, as they are businesses that perform work on commercial vehicles. 6. Service on vehicles and equipment or dismantling or salvaging of parts of portable toilets is not permitted outside of buildings. 7. All tenants of the buildings for this application must receive Certificates of Occupancy from the Building Department. 8. The applicant must either provide the necessary drainage and utility easements or record the Maras Street First Addition plat by March 1, 2026. 9. This resolution approves exterior storage for multiple tenants on this site. If the Board revokes this conditional use permit, the approval of exterior storage for all tenants relating to this request will be vacated.
