SUBJECT: Request of RH. Renner & Sons, Inc.

INTRODUCTION:
By letter dated July 12, 2004, E.H. Renner & Sons, Inc., the contractor for Shakopee
Public Utilities Well No. 15 has requested that City Code Sec. 10.60, Noise Elimination
and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended
for certain work hours.
BACKGROUND:
The above named section of the City Code restricts the hours of operation from 7 :00
A.M. to 10:00 J>.M. on weekdays, and from 9:00 AM. to 9:00 P.M. on weekends and
holidays.
E.H. Renner & Sons, Inc. is requesting a suspension on the hours as follows:
Wednesday, July 21st 7:00 A.M. to 12:00 AM.
Thursday, July 22nd 12:00 A.M. to 7:00 AM.
E.H. Renner & Sons is requesting these hours due to a 24 hour test pump of the well as
directed by Shakopee Public Utilities.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and
direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period
of time as determined appropriate by the City Council, and direct staff to publish
notice of the suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

RE: V ARlANCE REQUEST
For 24 hour test pumping
Dear .Mr. Loney.
E.H. RENNER & SONS, lNe. has completed the development of well #15 and has begun the
test pumping {8-hr step test) of the well todetennine the capacity and specific yield.
We have been directed perform a 24 hour {around the clock) test pump of the well. We would
like to stan this test as soon as we can get City Council approval. Weare requesting a variance
or council approval for the working hours to perfonn this one time around the clock testing.
If the City Council meets ,on Tuesday the 20th. we would start the test at 7:00am on Wednesday
the 21 $I and complete the test at 7:00am Thursday the 22nd.
The noise of the test pump engine (Detroit V871) has two oversized mufflers that should keep
the noise to a minimum. The 24-hour pump test will only tank one day tom complete. We are
requ.esting that this be placed on City Council agenda for approval this coming Tuesday evening.
