SUBJECT: Text Amendment Regarding Submittal Requirements for Plat Applications

INTRODUCTION:
Section 12.21 and 12.22 ofthe City Code currently addresses the submittal requirements for
preliminary and final plat applications. The draft ordinance accompanying this staff report proposes to
provide a more flexible approach to materials required for submittal with plat applications.
ALTERNATIVES:
1. Approve Ordinance No. 710, approving the text amendment as presented.
2. Approve Ordinance No. 710, approving the text amendment with revisions.
3. Do not approve the proposed amendment.
4. Table the matter for additional information.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission reviewed the proposed amendment at its July 8,2004, meeting. The
Commission has recommended approval of the proposed amendment as presented. A copy of the staff
report from the July 8 Commission meeting is attached for the Council's reference.
ACTION REQUESTED:
Offer and pass a motion to approve Ordinance No. 710, amending City Code Sections 12.21 and
12.22, as presented. ~ .._

ORDINANCE NO. 710, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CHAPTER 12.21 AND 12.22 SUBMITTAL REQUIREMENTS
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1 - That City Code Chapter 12, Subdivision Regulations, Section 12.21 and 12.22 is
hereby amended by adding the language which is underlined and deleting the language which is
struckthrough.
SEC. 12.21 SUBMITTAL REQUIREMENTS FOR PRELIMINARY PLATS.
Subd. 2. Drawings Required. In submitting a preliminary plat for consideration, the
Developer shall submit the following drawings which are described in detail below.;, the
number of copies necessary for submittal is to be determined by the Zoning Administrator
and/or the City Engineer:
A. Twenty (20) copies of a drawing of the preliminary plat.
B. Twenty (20) copies of an existing conditions map;
C. Twenty (20) copies of a grading and erosion control plan;
D. Twenty (20) copies of a street and utilities plan;
E. Twenty (20) copies of a stormwater management plan.
Subd. 3. All Drawings. Each drawing submitted by the developer must be on paper which
does not exceed thirty-six (36) inches by twenty-two (22) inches by thirty four (34) inches,
unless otherwise approved in advance by the City Engineer. In addition the developer shall
provide one (1) paper copy of each drawing on paper which is eleven (11) inches by
seventeen (17) inches.
SEC. 12.22 SUBMITTAL REQUIREMENTS FOR FINAL PLATS.
Subd. 2. Drawings Required. In submitting a final plat for consideration, the developer
shall submit the following drawings which are described in detail below.;, the number of
copies necessary for submittal is to be determined by the Zoning Administrator:
A. T'o'lcnty (20) copies of a drawing ofthe final plat;
B. Twenty (20) copies of a drawing of the area plat;
C. Twenty (20) paper copies and one (1) autocad copy of construction plans for all
public improvements.
Subd. 3. All Drawings. Each drawing submitted by the Developer must be on paper which
is a minimum eleven (11) inches by seventeen (17) inches or a maximum ofthirty-six (36)
inches bv twenty-two (22) inches by thirty four (34) inches, unless otherwise approved in
advance by the City Engineer.

Section 2 - - Effective Date. This ordinance becomes effective from and after its passage
and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota, held
the day of , 2004.

INTRODUCTION:
The City of Shakopee is proposing an amendment to Chapter 12 regarding the number of
drawings required to be submitted at the time of preliminary and final plat application.
DISCUSSION:
Sections 12.21 and 12.22 of the City Code address the submittal requirements for preliminary
and final plat applications. Currently, these sections of the Code require that 20 copies of all
drawings be provided at the time of submittal. Staff has found this requirement difficult to
implement due to varying conditions in developments and review by other departments and
outside agencies. In response, staffhas prepared a draft text amendment in an attempt to provide
the flexibility needed without the potential of being in violation ofthe City Code. Language that
is underlined is proposed for addition. Language that is struckthrough is proposed for deletion.

City Code states that the City Council may grant an amendment when it finds that one or more of
the following criteria exist. Staffhas prepared draft findings for the Board's consideration:
Criteria #1 That the original subdivision regulations ordinance is in error;
Finding #1 The original subdivision regulations ordinance is not in error; however, the
amendment as proposed allows for flexibility when reviewing individual plat
applications.
Criteria #2 That significant changes in community goals and policies have taken place;
Finding #2 Significant changes in community goals and policies have not taken place.
Criteria #3 That significant changes in City-wide or neighborhood development patterns
have occurred; or
Finding #3 Significant changes in development patterns have occurred in that current and
future development is and will occur in areas of the city that pose additional
natural resource impacts. The change, as proposed, will allow staff the flexibility
to require the necessary amount of information to be submitted at the time of
application.
Criteria #4 That the Comprehensive Plan requires a different provision.
Finding #4 The proposed amendment does not conflict with the policies outlined in the
Comprehensive Plan.
ALTERNATIVES:
1. Recommend to the City Council approval of the proposed text amendment as presented.
2. Recommend to the City Council approval of the proposed text amendment with revisions.
3. Do not recommend to the City Council approval ofthe proposed text amendment.
4. Continue the public hearing for additional information.
5. Close the public hearing, but table the matter for additional information.
STAFF RECOMMENDATION:
Staff recommends alternative no. 1 or 2.
ACTION REQUESTED:
Recommend to the City Council approval ofthe proposed text amendment as presented, or with
reVISIons.
