1. Roll Call Present: Commissioners Ranua, Reding, Robbins, Sandhu(Vice Chair), and
Weiler
Absent: Commissioners Forsythe, Sepulveda
Sta? Present: Kerski
2. Approval of Agenda Motion by Robbins, seconded by Ranua to approve the agenda as
proposed. Approved unanimously.
3. Recognition by Planning Commission of interested Citizens - None
4. Consent Agenda
4.a March 2025 minutes Motion by Robbins and seconded by Reding to approve the
minutes as submitted. Approved unanimously.
5. General Business
5.a PUBLIC HEARING: Annexation, Zoning and MUSA Amendment of Multiple
Properties Located within Jackson Township
Public hearing had been continued from the previous meeting and is still open. Sta?
presented the case to annex three single family homes, adjacent vacant property and
several parcels bordering Hwy169.
Paul Melchor, representing the Melchor family trust spoke about the annexation and
impact on their parent’s property. They want to make sure that taxes are kept the same as
the Township since they are receiving no city services and that when the sewer is pushed
southerly and that it is bored under their property. The family has put a lot of e?ort into
creating a tree area that has diverse species of trees and is a perfect example of a
Minnesota woodlands.
Patrick Breeggemann and family. Concerns about timelines. What will happen to the area
based on the 2040 Comprehensive Plan. Concerns about the holding pond and the road to
have a new storm sewer pipe. The city will rebuild the road, and the storm sewer pipe will
go into the culvert on CH69. The Comp Plan shows the three homes to be park/open space
and the piece to the south is higher density residential and lower portion is commercial and
business.
Frank Weber spoke about his family property. Concerned about taxes and storm sewer
pipe for the overflow. Sta? noted that the taxes would be held at the current township rate.
The state doesn’t want islands left. Ranua asked about the appraisals being completed for
the blu? and the three houses. Sta? noted that the city would acquire the blu?. There is
the potential for the city to o?er a life estate. That will be done as part of the appraisal
process. There would be assistance provided per state law. Sta? expect appraisals will be
do back about in several months and shared with the property owners.
Brian Breeggemann was there for his parents. Can they sell to anyone, but the future is a
park. They can sell to whomever by there are benefits that the city can provide once
appraisals are completed.
Robbins made a motion to close the public hearing and Sandhu seconded. Approved
unanimously.
Robbins stated we are in a process right now, getting appraisals. The answers were not bad
for the property owners. Taxes will be held; people can stay in their properties through a life
estate.
Ranua wanted to add on the CIP recommendation for the sewer to be underground and
that the Council has the ability to abate the city’s portion. They would still pay the
township’s portion. Sandhu asked if the Commission could recommend that the sewer be
bored and that city’s taxes be abated.
Ranua made a motion to recommend approval to the city council with the
recommendation of forest preservation for CIP that it be bored or lift station and that taxes
be abated for the residential property. Robbins seconded. Passed unanimously.
Reding made a motion to recommend approval of the MUSA changes, seconded by
Robbins. Passed unanimously.
Sandhu made a motion to recommend approval of zoning to AG zone, seconded by
Robbins. Passed unanimously.
5.b PUBLIC HEARING – Preliminary Plat of Richland Court
Motion to open the hearing by Robbins and seconded by Reding. Approved unanimously.
Sta? presented the proposed preliminary plat request from Stonebrooke Engineering on
behalf of Matt Logeais, property owner, which includes 8 single family residential lots on
4.38 acres o? Townline Ave (CH79. Sta? showed the proposed preliminary plat, grading,
utility, stormwater, access plans. Sta? stated that this property has been zoned R-1B since
2006 which requires a density of three to six units/acre and there was a prior subdivision
approved for six lots, but that it was never recorded. This new subdivision proposal
reduces the lot count from 10 to 8 and increases the amount of ponding and space and
provides for stormwater overflow through the rear of one of the new home sites.
Brian Mont on Hillwood Drive, not against the property owner, needs to fit, even with 8
homes it doesn’t fit. Concerned we are creating an island. The surrounding houses are
large lot homes. This parcel is surrounded on three sides by large lot homes. 8 houses on
4+ acres. Not sure when it went to R1B since it looks like it was denied and approved later.
The Hillwood neighbors objected to the rezoning. Surprised that it happened 20 years ago
and not surprised. Maybe we missed it. Was rezoned in 2006 to R1B. Sta? noted that it
has been R1B since 2006. The neighbors objected to it, yet city council approved. The
residents noted that they were not notified about that council meeting. Sta? noted that
when items are on the city council, neighbors are not notified. Public hearings are held at
the Planning Commission.
Sta? noted that the 2030 and 2040 Comp Plans noted that it was R1B. This has been going
on for 20 years. The resident still believes it doesn’t fit. Sta? noted that under R1B they
could build almost 18 houses under the zoning, and they are asking for 8 houses. The
resident was concerned about the holding ponds and storm water issues. Sandhu noted
that this was addressed at the last meeting. Resident asked how would the city ensure it
works. Engineering will ensure it is built properly. Ranua asked about how we are sure this
works and assumed all the engineering is checked. Sta? noted that changes were made to
the current plan to ensure storm water was resolved. Ranua said there are a ton of
resources available to ensure that the storm water works. Weiler noted the storm water
was addressed. The developer and the city will make sure it works.
Mark Bodwin, not too much to add. Property owners surrounding this property never had
the chance to dispute the R1B. Zoning is incorrect compared to the surrounding homes.
Too many homes.
Motion to close made by Robbins and seconded by Reding. Passed unanimously.
There is a lot of history with this parcel, and it was rezoned by the city council almost 20
years ago and that zoning right stays with the parcel. There may be issues with the Met
Council regarding density but there are easements over the land. Robbins said he
appreciates people attending. Advisory to the city council. Governed by zoning. Since we
were all here since the last time, the developer has lessened the number of homes.
Sandhu suggested that there be a tree line bu?er along the edge where there is a house
adjacent to provide better bu?er. Ranua asked about the notice. Can we improve the
process so that people know better about the entire process. Don’t want to lead people
on. Sta? provided that the notice requirements have changed, now requiring a large sign
and added a larger bu?er for mailing. Ranua asked about access to older meetings which
are now no longer available. The software that the city used for agendas was terminated so
the city had to move to a di?erent product and the past records are now on an internal
server on Laserfiche. With the new city clerk coming, we can see what can be done.
Sandhu noted that the developer is trying to meet the needs and reduced the density.
Robbins made a motion to recommend to the city council approval for approval of the
preliminary plat of Richland Court. Seconded by Reading. Approved unanimously.
Motion made to adjourn to Thursday May 8, 2025, at 7PM by Robbins and seconded by
Weiler. Unanimously approved. Adjourned at 8:20PM
