INTRODUCTION
McGough Construction has submitted applications for concurrent review of the Preliminary Plat and Final
Plat for Valley Park 16th Addition. The subject site is located south of Valley Industrial Boulevard South,
west of Valley Park Drive, and east of Canterbury Road (Exhibit A).
CONSIDERATIONS
The applicant is proposing to construct a new industrial building on this property. Presently, this property
is owned by two different entities. The purpose of this plat is to split a portion of the property from the
adjacent parcels and combine into one new buildable lot.
Other City Departments were provided the opportunity to provide comments regarding this application.
The comments are listed below:
. Shakopee Pubic Utilities (SPU) has provided a memorandum, requesting that Lot 1, Block 1,
Valley Park 16th Addition should have a perimeter utilities and drainage easement.
. Shakopee Engineering has provided a memorandum, recommending approval contingent on their
conditions being addressed prior to recording of the Final Plat.
PLANNING COMMISSION RECOMMENDATION
On July 22,2004, the Planning Commission reviewed the Preliminary Plat of Valley Park 16th Addition, and
by a 6-0 vote, recommended approval of the request to the City Council. The staff report to the Planning
Commission is attached for the Council's information.
AL TERNATIVES
1. Approve Resolution No. 6093, approving the Preliminary and Final Plat of Valley Park 16th
Addition, subject to the conditions set forth in the resolution.
2. Approve Resolution No. 6093, subject to revised conditions.
3. Deny the Preliminary and Final Plat of Valley Park 16th Addition, and direct staff to prepare a
resolution consistent with the direction ofthe Council.
4. Table the requesting to allow staff and/or the applicant time to provide additional information.
STAFF RECOMMENDATION
Staff recommends Alternative No.1, approve Resolution No. 6093, approving the Preliminary and Final
Plat of Valley Park 16th Addition, subject to the conditions set forth in the resolution.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
PRELIMINARY AND FINAL PLAT OF V ALLEY PARK 16TH ADDITION IN THE 1-2 (HEAVY
INDUSTRY) ZONE
WHEREAS, McGough Construction; applicant, and GES Properties, property owners, and MBF
Inc. (Fremont Industries), property owners, have made application for Preliminary and Final Plat of Valley
Park 16th Addition; and
, WHEREAS, the subject property is legally described as:
Lot 1, Block 1, and Out/ot A; Valley Park Second Addition, Scott County, Minnesota (Torrens Certificate
Number 27696); and

WHEREAS, the Planning Commission recommended approval of the proposed Preliminary Plat of
Valley Park 16th Addition with conditions; and
WHEREAS, on August 4, 2004, the City Council reviewed the proposed final plat, and found it to
be consistent with the preliminary plat.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee,
Minnesota that the Preliminary and Final Plat of Valley Park 16th Addition is hereby approved subject to
the following conditions;
The following procedural actions must be completed prior to the recording of the final plat:
1. Payment of Trunk Sanitary Sewer, Trunk Storm Water and Trunk Storm Water Storage and
Treatment Charges shall be made, as required by the most current City of Shakopee Fee
Schedule.
2. The applicant shall provide City staff with electronic AutoCAD files of the Final Plat to be
recorded.
3. Easements shall be shown on the Final Plat as approved by the City Engineer. They shall
include, but not be limited to, the following:
A. Provide a total of fifteen (15) feet of drainage and utility easement along the East
property line of Lot 1, Block 1.
4. Street lighting to be installed in accordance with the requirements of the Shakopee Public
Utilities Commission.
5. Electrical system to be installed in accordance with the requirements of the ShakopeePublic
Utilities Commission.
6. Water system to be installed in accordance with the requirements of the Shakopee Public
Utilities Commission.
7. Adequate storm water storage and treatment shall be required as directed by the City of
Shakopee's engineering department.
8. No site improvements shall be allowed within the City right-of-way or approved drainage
and utility easements.
9. The site will require a NPDES permit prior to any land disturbing activity. The City of
Shakopee's engineering department shall receive a copy of this permit.
10. All work within the right-of-way shall require a permit prior to construction. Please contact
the City of Shako pee's engineering department for details.
11. Provide electronic (Auto CAD) files ofthe Final Plat to the engineering dep~rtment.
B. Following approval and recording of the final plat, the following conditions shall apply:
1. Building construction, sewer, water service, fire protection and access will be reviewed for
code compliance at the time of building permit application(s).
2. After the final plat is recorded, submit two (2) copies of the final plat (11" x 17"), and an
electronic copy, to the Community Development Department.
The final plat copies shall be labeled 'Final' and include the Council hearing approval date.
Submit paper copies to: Community Development Department, 129 South Holmes Street,
Shakopee, MN 55379.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the Preliminary and Final Plat
of Valley Park 16th Addition does not constitute a representation or guarantee by the City of Shakopee as
to the amount, sufficiency or level of water service that will be available to lots within the plat as they are
developed.

INTRODUCTION
McGough Construction has submitted applications for concurrent Preliminary Plat and Final Plat for
Valley Park 16th Addition. The subject site is located south of Valley Industrial Boulevard South, west of
Valley Park Drive, and east of Canterbury Road (Exhibit A). The applicant is proposing to construct an
industrial use building on this property. Currently, the property is owned by two different entities. A
Conditional Use Permit was approved earlier this year for exterior storage as part of this proposed
development, with one of the conditions requiring that this property be re-platted to ensure that the
building would be on one lot. Prior to construction of this building, plat approval is required, as is the
proposed vacation of easements.
CONSIDERATIONS
Initially, staff discussed pursuing the Minor Subdivision and/or the Registered Land Survey (RLS) process
for this proposed project. Unfortunately, neither of these processes were acceptable options, and the
applicant proceeded with the submittal of this Preliminary and Final Plat application. Under the subdivision
ordinance, only the preliminary plat application is reviewed by the Planning Commission.
Other City Departments were provided the opportunity to provide comments regarding this application.

Municipal water service is available subject to our standard terms and conditions. These
include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk
Water Charge, and paying the Water Connection Charge.
Underground electric service is available subject to our standard tenns and conditions.
These include, but are not limited to: entering into an Underground Distribution
Agreement, granting any necessary easements, and paying the associated fees.
Street Lighting installation is available subject to our standard tenus and conditions.
These are contained in the current City of Shakopee Street Lighting Policy. Applicant
