DISCUSSION:
At the May 4,2004 Council meeting, adjacent property owners expressed their concerns about
Shenandoah Apartments, primarily focusing on the height of the berm that is located along Eagle
Creek Boulevard. They also commented that it appears that the berm at the east end of the property
does not properly screen the apartment building.
On Tuesday, May 25th, in response to the staff request, Heritage Development (the developers/property
owners of Shenandoah Apartments) provided staff with copies of documentation regarding the
elevations, which were completed in January. This information was shared with the Council on June
1,2004. In summary, the elevations showed that in some locations, the elevations achieved or
exceeded what was represented in the drawings that were a part of the preliminary plat review; in other
locations (particularly on the west end of the project) the final elevations were somewhat short; while
in some locations the final grades were consistent with the preliminary plat plans.
Subsequently, staff have met with representatives from Heritage Development to address
improvements proposed for the berm located along Eagle Creek Boulevard. The developer has
recently submitted a plan that identifies their proposal to install a fence on the top of the berm. This
fence, as shown on the attached site plan and photograph, would be four (4) feet tall, would start at the
east end ofthe berm and extend approximately 200 feet to the west in overlapping 32 foot sections,
and would be constructed from wood.
Concerning other site issues, staff have received complaints regarding an outlot located at the
southwest corner of Alysheba Road and Affirmed Drive. This is an outlot of the Condominiums of
Shenandoah Second Addition, and there is an agreement between Heritage Development and the
Homeowner's Association that upon completion of the installation of 11 trees (excluding the two
Cedar trees) and the installation of topsoil and seeding the site with high quality park seed, the
Homeowner's Association would take over the maintenance of this parcel. Upon a recent inspection,
staff noted that the site does not seem to have sufficient top soil and that there appear to be more weeds
than established turf on the site. Additionally, the recently planted trees do not appear to be getting
adequate water and do not look like they will survive for an extended time.
There are a number of public improvements that have not been completed, including the installation of
a trail on the west side of Alysheba Road, and a trail on the east side of Alysheba Road and south side

of Jeffery Allen Road, as shown on the attached site plan. This work will entail at least some removal
of existing sod and regrading of the site as well as the installation of the bituminous trail. The
developer has recently removed excess dirt located in the northwest corner of the Shenandoah
Apartments/southwest corner Condominiums of Shenandoah Place Second Addition, except that final
site grading has not yet been approved by City Engineering.
Lastly, although the developer has recently installed sod between the curb and trail along Eagle Creek
Blvd., and a couple rows behind the trail, the area north ofthis sodded area and the area on the berm
does not appear to have established turf, as required by City Code. In fact, there are numerous areas
where dirt and/or rock are exposed, and weeds are predominant.
ACTION REQUESTED:
Council is asked to review the attached information and provide Planning staff with direction
regarding corrections or improvements to the berming and other site issues.
