On August 17, 2004 the Council will hold a public hearing on the requested annexation. A copy of the petition is attached for the Commission's information. The Commission is asked to provide a recommendation to the City Council on whether the City should proceed with annexation ofthe subject property. DISCUSSION: The City's adopted Land Use Plan identifies this area for single-family density development. This designation was based on direction received from Council in the course of previous discussions between the Township and the City. With the assistance of Northwest Associated Consultants (NAC), the City is in the process of updating its Comprehensive and Land Use Plans. The draft land use plan prepared by NAC has shown this area as guided for single family density development. Should the Council ultimately decide that the subject properties should be annexed into the City, that action does not constitute a guarantee of any particular land use guiding or zoning. Both guiding and zoning will need to be determined after separate public processes once the property is within the City's jurisdiction. The subject property is proposed to be part of an overall project area that encompasses property to the east that has been recently annexed into the City. The Engineering Department has provided comment that has been attached as Exhibit C. Extension of water service and looping of water service are issues that need to be specifically addressed with the Shakopee Public Utilities Commission. ALTERNATIVES: 1. Recommend to the City Council that the proposed annexation proceed. 2. Recommend to the City Council that the proposed annexation not proceed at this time. 3. Continuetheitem for additional infonnation. ACTION REQUESTED: Offer a motion recommending to the City Council that the proposed annexation proceed, and move its adoption (Alternative No.1). g:\boaa-pc\2004\08-05\annexpowers.doc ~tHIBIT A Scott County Page 1 of 1 tro IiI:: .;)ild! i1riV'It"t ' ~ WIN 'I63 . E)(fII BITG City of Shakopee Memorandum SHAKOPEE TO: Julie Klima, Planner II FROM: Joe Swentek, Project Engineer SUBJECT: Annexation - 9.5 Acres in Jackson Township, Scott County (located South of Highway 169, East of County Road 15) PID NO.: \69-130061 (Jackson Township Pill) , CASE NO.: 04061 DATE: July 27,2004 The application indicates a request to annex property from Jackson Township. This property is located South of Highway 169 and East of County Road 15 (Marystown Road). After reviewing the above referenced application, I have the following comments for the applicant and the planning department: Street Ali2nment/ Access Currently 17th Avenue, which will provide access to the parcels, is not extended West of County Road 79. City and County staff will require further review of its potential alignment and access points. Since this property may be adjacent to future 17th Avenue, the property owner should be required to sign a waiver of assessment appeal for the 17th A venue improvements. Utilities Currently, no sanitary sewer or storm sewer has been extended to the property. Further review will be required concerning future sanitary sewer trunk facilities and storm sewer trunk facilities. The City of Shakopee shall establish storm water criteria relating to drainage, retention/detention and discharge rates prior to development. Agreements for future trunk fees that apply will also be required prior to development.
