Grading Permit for SMSC Village East Subdivision . )5, I), '3 I CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Approval of Grading Permit for Shakopee Mdewakanton Sioux Community East Village DATE: October 5, 2004 INTRODUCTION: Shakopee Mdewakanton Sioux Community applied for a grading permit on August 10, 2004 to excavate for stormwater storage/infiltration pond on the 40 acre site in the City of Shakopee. This agenda item is to discuss their grading permit application and what conditions should be placed on their grading permit. BACKGROUND: A grading permit has been applied for by the Shakopee Mdewakanton Sioux Community (SMSC) on the 80 acres of land that is in fee status adjacent to 80 acres in trust, which is adjacent to McKenna Road in the City of Shakopee. The (SMSC) is proposing to develop the 80 acres in trust for residential housing, move the existing pond. and drainage facilities in these 80 acres to the 80 acres that is held in fee. Thus, a grading permit is required under Chapter 11, of the City Code. A 'grading permit with drainage calculations and proposed plans have been sent to staff to review. The City's Development Review Committee did meet on August 11 th and August 25th and have determined that there are several issues associated with this permit that need to be addressed for possible approval. Attached to this memorandum is an August 30, 2004 letter to Kreg Schmidt, who is with Bolton & Menk, Inc., who is a consultant engineer doing the work for the SMSC. On September 15,2004, a response from the SMSC had been received on the August 30, 2004 review letter. Also attached to this memorandum is a September 7, 2004 review letter from WSB & Associates, Inc. on the storm drainage review of the proposed development and grading permit and a September 2ih response letter from the SMSC. , After review of the grading permit and associated proposal, the major issues with the SMSC proposal are as follows: 1. Accesses to McKenna Road as proposed by the East Village Subdivision 2. Compliance to the 1999 Stormwater Management Plan 3. Impact to the downstream channels, such as the Blue Lake and Prior Lake Outlet Channels. 4. Impact to future CSAH 21 alignment. 5. Maintenance responsibilities of proposed ponds. Issue No.1. Accesses to McKenna Road - This is not associated with the grading permit approval, however, would require approval from the City as part of a right-of-way access permit. McKenna Road is designated as State Aid route in the City of Shakopee and in the City of Prior Lake and adequate access spacing should comply with the City's adopted Transportation Plan. Staff has met with the applicant and their engineer and additional information has been provided on the future grade of McKenna Road. The access spacing proposed nearly meets the City's guidelines and will be for a five lot frontage road. Staff believes this access spacing would be acceptable after review of the future design of McKenna Road. Issue No.2. Compliance to the 1999 Stormwater Mana2ement Plan - The proposed development is proposing to discharge approximately 130 cubic feet per second (cfs) in the 100-year, 24 hour storm event which would drain into the Prior Lake Outlet Channel and also come into Dean Lake. The City of Shakopee's Stormwater Managt;:ment Plan proposed a .1 cfs per acre peak discharge for this 500 acre area located upstream of the major pond. In order to meet the City's .Stormwater Management Plan, this discharge rate should be reduced to approximately 50 cfs. Staff with WSB & Associates, Inc. and the Prior Lake-Spring Lake Watershed District has reviewed the calculations. The peak flow rate is higher than planned for future improvements to the Blue Lake Channel and Prior Lake Outlet Channel. These flows could be accommodated in the upgrading of the channel and cost ofthis flow should be allocated to the City of Prior Lake and the SMSC. If the SMSC provides significant rate reduction in other areas of the Blue Lake Channel, west of McKenna Road, this additional flow could be incorporated into the channel design and meet the City's overall Storm Water Management Plan. A condition has been written to address this flow into the city's overall Storm Water Management Plan. Issue No.3. Impact to Downstream Channels. such as the Blue Lake and Prior Lake Outlet Channnels - The City of Shakopee in conjunction with the City of Prior Lake and the Prior Lake-Spring Lake Watershed District, have been working towards a new Joint Powers Agreement for the upgrading of the Prior Lake Channel and the City of Prior Lake and in the City of Shakopee to serve all three entities. The current Prior Lake Channel is not adequate or stal:>le enough to serve the Cities and the Watershed District's needs on a long-term basis. The PLSL WD has completed an EA W on improvements to the Prior Lake Channel and is programming the funds for future improvements to the channel from Prior Lake to Blue Lake. SMSC has significant land holdings both in trust and in fee that are tributary to the Blue Lake and Prior Lake Outlet Channels. There is no agreement with the SMSC for any cost sharing or contributions for the upgrading of these channels due to development of their land. In other areas upstream, such as Greenfield and Park Meadows, City staff has required developers to pond the toO-year storage of 7.2-inch runoff event, which is a 10...day snow melt and infiltrate on-site to minimize the impact to downstream channels, such as the Blue Lake or Prior Lake Channels until these systems are upgraded. Staff has incorporated a condition for the SMSC to meet the Storm Water Management Plan, or obtain approval from the PLSL WD on this flow being acceptable or reduce flows in other areas of the Blue Lake Channel. Issue No.4. Impact of Future of CSAH 21 Alignment - Scott County is currently performing an Environmental Impact Statement on CSAH 21, from CSAH 42 to CSAH 18, and one of their alternatives would conflict with the location of the pond as shown in their grading permit application. Attached is a letter from Greg Ilkka, of Scott County, stating the pond would probably be in the future CSAH 21 alignment. Staff believes the issue of the proposed pond and CSAH 21 is a right-of-way acquisition issue between the County and the SMSC. The City should not have any additional costs for relocating the pond, as this pond does not serve any land in Shakopee other than the SMSC land. The city attorney agrees with the staffs conclusions on this issue. Issue No.5. Maintenance Responsibility of Proposed Ponds - It is anticipated that the SMSC would want to maintain these ponds on their land and not grant an easement to the City of Shakopee for pond maintenance. The question for Council, is this an acceptable policy and arrangement. Staff believes that the SMSC, who has their own Public Works Department, can adequately maintain these ponds and does not see the need for requiring easements on ponds in this area. However, it should be acknowledged by the SMSC that they will want to maintain the ponds inthis area. The main issues with the grading permit is the drainage calculations needed to comply with the 1999 Stormwater Management Plan or other provisions made to accommodate this flow into the Prior Lake outlet channel or other reductions in flow in the Blue Lake watershed. Another issue is the possible conflict with Scott County on the CSAH 21 alignment and possible relocation of the pond in the future. There are increased flows due to increased development in the watershed to downstream channels, such as the Prior Lake and Blue Lake Channels. There is no agreement with SMSC on negating those impacts to the downstream channels. The impact to the future CSAH 21 is an issue that Scott County would have in the future upon the construction of CSAH 21, and staff is identifying this issue for Council information and awareness. Staff has prepared a grading permit approval with conditions, which is attached to this memorandum. Council may wish to discuss the various issues and provide direction to staff for more information or provide additional conditions to the permit. ALTERNATIVES: 1. Approve a motion approving a grading permit for the SMSC, with conditions as outlined by staff. 2. Approve a motion approving a grading permit for the SMSC, with conditions as outlined by staff and as modified by the City Council. 3. Do not approve this grading permit at this time. 4. Table for additional information. RECOMMENDATION: The recommendation would be either to approve a permit with conditions, or table for additional information, or additional meetings with City staff/City representatives with the SMSC prior to issuing the permit. The storm water pond is necessary to accommodate the proposed East Village Subdivision and other adjacent subdivisions. As of September 30, 2004, the applicant has addressed several issues outlined in a letter from the City dated August 30, 2004. There still remain issues to be resolved, but the City, the Shakopee Mdewakanton Sioux Community, the Prior Lake - Spring LakeW atershed District and the County is working towards resolving them. On October 5,2004, the City Council may choose to approve this grading permit application. If this permit is approved, I suggest the following supplemental conditions be attached to the permit: . The applicant shall agree to hold the City of Shakopee harmless for any claims arising out of the City issuing the grading permit without approval of a preliminary plat or a final plat. . The applicant shall obtain all necessary Prior Lake - Spring Lake Watershed District permits and/or approvals. . The applicant shall meet the City's storm water management plan rate restriction of 0.1 cfs .peiacre or obtain approval from the Prior Lake - Spring Lake Watershed District for flow rates above the City's requirements or provide the City with information identifying areas where flow reduction in Mdewakanton Sioux Community property within the Blue Lake Watershed can be accomplished to meet the intent of the City's overall storm water management plan. . All work done within the City of Shakopee right-of-way shall require a right-of-way permit. Please contact the City engineering department for details. . The applicant shall provide a copy of the site's NPDES permit. . The applicant shall provide a copy of the Environmental Protection Agency's approval/registration of the proposed storm water infiltration system. . The applicant shall provide a wetland delineation report, a wetland replacement plan (if applicable) and a certificate of no loss/exemption. . The applicant shall submit a subsurface soil exploration report in order to verify' the hydraulic conductivity assumed in the infiltration system design. The applicant shall contact the City of Shakopee engineering department twenty-four (24) hours in advance of all proposed land disturbing activity. . All erosion control items shall be furnished and installed by the applicant and accepted by the City of Shakopee prior to construction. The applicant shall contact the City of Shakopee engineering department to arrange an inspection. . All erosion control measures shall be routinely inspected by the applicant and replaced as necessary or as directed by the City of Shakopee. . McKenna Road shall be kept free of any offsite sediments tracking. The installation of a rock construction entrance shall be required. . The applicant shall maintain dust control operations onsite for the haul roads throughout the grading permit process until final completion. . The applicant shall place six (6) inches of topsoil over all land disturbed. Exposed soil shall be seeded and mulched in accordance with NPDES Phase II requirements. . Grading and Erosion.Control PIan, East Village Subdivision; received at WSB 08/13/04~ . Drainage Calculations for East Village Subdivision; dated 08/06/04. Please find the following comments related to this development: , 1. Block 8 and drainage area of Street E appear to discharge into Outlot C without erosion control atthe Outfall. Consideration should be given to connecting this storm sewer system to the storm sewer in Street D. This will eliminate a point discharge into the ravine and reduce future maintenance due to erosion. 2. The proposed development appears to discharge approximately 130 cfs in the laO-year, 24- hour storm event into the trunk conveyancewaylocatedin the central portion of the project. The water then drains east into the Prior Lake-SpringLakeoutlefchannel and into Dean Lake. This rate appears inconsistent with the City of. Shakopee storrllwater management plan which requires 0.1 cfs/ acre peak discharge for the approximately 500 acre area .. located upstream of Pond 1. This discharge rate should be reduced to approximately 50 cfs. o. 3. The emergency overflow (EOF) for Pond 2 appears to be below the peak elevation of the '~ pond as identified in hydrologic calculations for the 100-year event. 4. Incorporate additional dead pool storage volume in Pond A3P. 5. Infiltration area located in Outlot A north of Street B should be designed to treat stormwater before being infiltrated. Please incorporate manholes located at the connections of the 24- inch pe1;"forated pipe in the infiltration area to provide access for maintenance. 6. Pretreatment required for discharge on western portion of Street A located in Block 1 before discharge into the conveyanceway. 7. To ensure a more efficient review of storm sewer system, please incorporate total catchment areas, intensity calculations, total "c" value, and design flow rates on rational stormwater system design'spread sheet. Also, include depth to cover elevation for each structure. 11. Identify discharge capacity of storm system from node PI 0 to AI. 12. Verify maxi,mum street grade requirements at intersection of McKenna and Street A. 13. Verify depth of cover for CB 22-24 and CB 32-38. 14. Review storm sewer system design at STM 56. The discharge velocities delivered to the structure exceed ave~ocity of22 fps. Consider incorPorating drop structure on structure 57!QAecrease velocities before discharging water into structure 56. 15. Please provide stage /discharge calculations for stream crossingat Street A. Attached are revised plan sheets, plan sheets this letter refers to, existing and proposed pond area exhibits, fee land estimated quantities, snowmelt hydraulic analysis, and a geotechnical evaluation report. The comments and responses are as follows: Community Development / Plannin!! Department Comments Comment: A portion of Street A is on "fee" land within the City of Shakopee, but is not proposed as part of a subdivision of the "fee" land. Also, no future access to Street A is being provided to the City of Shaknpee. The applicant shall work with City staff to resolve these issues. Response: Proposed Street A win be a private road constructed in accordance with City , standards. It will be maintainer; in perpetuity by the SMSC Public Works Dept. En2ineerin2 Department Comments Comment: The applicant shall show the proposed CSAH 21 alignment on the plan sheets and coordinate impacts on the Shakopee Public Utility Commission's future substation location with the Commission. Response: The application is for a grading permit, not approval of a plat or any form of subdivision or lot split. The parcel will remain undivided as a result of the grading. The contemplated future substation site is remote to the proposed grading operation. There is no direct or indirect legal or tec1micalnexus between the potential substation and the proposed grading. Comment: The applicant shall work with the Shakopee Public Utility Commission to determine the need for future water service from the Commission, if any. Response: Not Applicable Comment: Since the City has designated McKenna Road as a State Aid route, its future design will be to State Aid standards. Therefore, the applicant shall provide adequate access spacing to comply with the City's adopted Transportation plan. ClUTently, the proposed frontage road access points onto McKenna Road do not meet the City's spacing requirements. It should also be noted future street widths and vertical profiles of McKenna Road will need to be accommodated. Natural Resources Comments Comment: The proposed forty (40) acre site is primarily open farmland. However, there appears to be some woodland areas that may be impacted by the proposed grading. The City's woodland management ordinance, Section 11.60, Subdivision 9 of the Shakopee City Code, states, "Any applicant who desires to remove any tree on any parcel of land containing a woodland must submit a woodland management plan to the City and must demonstrate there are no feasible or prudent alternatives to removing any tree." In order to comply with the ordinance, youlTIustsJ.lblTIit a woodland management plan to the City and demonstrate there are no feasible or prudent alternatives to removing any tree. In addition to the woodlands, this portion of the City is a specific concern and should be a discussion item with the Environmental Advisory Committee as it relates to the blue- Lake watershed area and the Prior Lake - Spring Lake outlet channel. City staff will bring the grading permit application, woodland management plan and impacts to the Blue Lake watershedIPrior Lake outlet channel to the Environmental Advisory Committee and to the City Council for their comments, recommendations and approval. The proposed improvements decrease the 1 GO-year discharge to 128.8cfs. 3. The emergency overflow for Pond 2 has been increased 0.2'. 4. The required NURP dead pool volume for the contributing area is approximately 0.23 AF; the proposed pond A3P provides approximately 0.38 AF. 5. This portion of the storm sewer is located on trust land and not applicable to the grading pennit. The system will be constructed in accordance with the Environmental Protection Agency Permit. 6. The pOl1ion of Str-eet A not being treated amounts to about 300 linear-feet of street and 2.5 lots, which amounts to approximately 0.6 acres of impervious area. Due to elevation limitations it is not possible to convey the runoff from this area to Pond A2P. However, the mentioned pond is proposed to treat an additional 7.9 acres of undisturbed farmland from the 11011h, which is currently discharged untreated into the channel. Public Works Director / City Engineer City of Shakopee 129 Holmes Street South Shakopee, MN 55379 Subj: EAST VILLAGE PLAT - SMSC GRADING PERMIT APPLICATION Dear Mr. Loney: The Scott County Highway Department has reviewed the grading plan for the stormwater ponding for the subject plat and offers the following comments. In February 2004, the Highway Department presented a preferred alignment for evaluation in the "build" scenario for the CSAH 21 EIS to the County Board of Commissioners. The preferred alignment completely avoids the YMCA Camp property and runs entirely on the 80 acre parcel west of the YMCA Camp, owned in fee by the SMSC. A review of the preferred alignment in relation to the proposed stormwater ponds on this. parcel clearly indicates that the eastern portion ofthepond is proposed in the same location as the proposedCSAH21. While this does not necessarily preclude the future construction of CSAH 21 through this area, it would add unnecessary and avoidable cost to construction of the highway. We anticipate we would be required to re-configure the proposed ponding in order to perpetuate it's discharge rate and volume characteristics. This may include the necessity to acquire additional right-of-way and construction of additional storm sewer at consider<:lble cost. Due to the County's cost participation policy, the city would share 50% of these potential costs. Given this, it would seem prudent for all parties to review this proposed ponding before it is constructed in order to minimize potential future costs. It would be more cost effective to all parties to re-design the proposed stormwater ponds now, in order to accommodate all parties interests, versus reconfiguring these ponds at a later date. Jordan,1fJN 55352 RE: East Village Plat-SMSC Grading Permit Application Dear Mr. llkka: This letter is in regard to your letter dated September 29, 2004, in response to the Shakopee Mdewakanton Sioux Community (SMSC) grading permit application and possible conflict with future proposed CSAH 21. The City appreciates. your response and will incorporate this in the memorandum going to City Council for consideration on the SMSC grading permit on October 5, 2004. In regard to potential future City costs on the relocation and reconfiguration of proposed ponding, in order to facilitate future CSAH 21,the City would have a different viewpoint. In regard to the County's Cost Participation Policy, the County isrequired to obtain 100% of the right-of-way for CSAH 21 and the City and.County ~ould participate in additional storm sewer. The relocation of the pond, as necessary, would be something that the City would view as part of right-of-way acquisition. Also, it should be noted that the proposed pond by theSMSC serves property in the. City of Prior Lake and owned by the SMSC. Almost no area of the CitY of Shakopee would be drained into this pond, except possibly CSAH 21. The purpose of this response letter is to inform you of the issues that the City of Shakopee may have with your letter. However, we do agree that it would be prudent for all parties to design the appropriate improvements in this-area, which would save costs in the long run for all parties. However, I do believe there is a disagreement between the SMSC and the County on the location of CSAH 21 in this area.
