SUBJECT: Set Public Hearing for Vacation of Easements Located North of
County Road 78, east of Barrington Drive, and west of CSAH 17
MEETING DATE: October 5, 2004
INTRODUCTION
Associated Capital Corp. has submitted an application for vacation of easements located
north of County Road 78, east of Barrington Drive and west of CSAH 17 (Exhibit A). The
attached Resolution No. 6121 sets a public hearing date to consider the vacation of the
easements.
DISCUSSION
The attached resolution sets a public hearing for Wednesday, November 3, 2004. On that
date, comments from staff members and utilities, as well as a recommendation from the
Planning Commission, will be presented to the City Council for consideration. The
Planning Commission will consider the request at its October 21, 2004 meeting.
ACTION REQUESTED
Approve Resolution No. 6121, a resolution setting the public hearing date to consider the
vacation of easements for property north of County Road 78, east of Barrington Drive and
west ofCSAH 17.

RESOLUTION NO. 6121
A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE
VACATION OF EASEMENTS FOR PROPERTY NORTH OF COUNTY ROAD 78,
EAST OF BARRINGTON DRIVE AND WEST OF CSAH 17
WHEREAS, it has been made to appear to the Shakopee City Council that
easements located north of County Road 78, east of Barrington Drive and west of CSAH 17
serves no public use or interest; and
WHEREAS, a public hearing must be held before an action to vacate can be taken
and two weeks published and posted notice thereof must be given;
WHEREAS, two weeks published notice will be given in the SHAKOPEE
V ALLEY NEWS and posted notice will be given by posting such notice on the bulletin
board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post
Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the
Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council
Chambers on the 3rd day of November, 2004, at 7:00 P.M. or thereafter, on the matter of
vacating easements located north of County Road 78, east of Barrington Drive and west of
CSAH 17.
Adopted in session of the City Council of the City of Shako pee,
