INTRODUCTION
Link Construction Company has submitted applications for concurrent review of the Preliminary
Plat and Final Plat for Park Place. The subject site is located north of Vierling Drive, East of
Adams Street and west of Cider Circle.
CONSIDERATIONS
The applicant is proposing to create 5 single family residential lots on this property. Other City
Departments and outside agencies were provided the opportunity to provide comments regarding
this application. The comments received have been incorporated into the recommende~
conditions of approval.
PLANNING COMMISSION RECOMMENDATION
On September 23, 2004, the Planning Commission reviewed the Preliminary Plat of Park Place,
and by a unanimous vote, recommended approval of the request to the City Council. The staff
report to the Planning Commission is attached for the Council's information.
ALTERNATIVES
1. Approve Resolution No. 6122, approving the Preliminary and Final Plat of Park Place,
subject to the conditions set forth in the resolution.
2. Approve Resolution No. 6122, subject to revised conditions.
3. Deny the Preliminary and Final Plat of Park Place, and direct staff to prepare a resolution
consistent with the direction of the Council.
4. Table the requesting to allow staff and/or the applicant time to provide additional
information.
STAFF RECOMMENDATION
Staff recommends Alternative No.1, approve Resolution No. 6122, approving the Preliminary
and Final Plat of Park Place, subject to the conditions set forth in the resolution.

RESOLUTION NO. 6122
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
PRELIMINARY AND FINAL PLAT OF PARK PLACE
WHEREAS, Link Construction Company, applicant and property owner, have made
application for Preliminary and Final Plat of Park Place; and
WHEREAS, the subject property is legally described as attached on Exhibit A; and
WHEREAS, the Planning Commission recommended approval of the proposed
Preliminary Plat of Park Place with conditions; and
WHEREAS, on October 5, 2004, the City Council reviewed the proposed.final plat, and
found it to be consistent with the preliminary plat.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee,
Minnesota that the Preliminary and Pinal Plat of Park Place is hereby approved subject to the
following conditions;
1. The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval oftitIe by the City Attorney.
B. Execution of a Developers Agreement with provisions for Plan A and Plan B
improvements, as well as payment of engineering review fees, and any other
fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements ofthe
Design Criteria and Standard Specifications of the City of Shakopee.
5. The developer shall be responsible for payment of Trunk Storm Water
Charges, Trunk Sanitary Sewer Charges, Trunk Storm Water Storage
and Treatment Charges, security for the public improvements,
engineering review fees, and other fees as required by the City's most
recent adopted Fee Schedule.
6. No public improvements shall be constructed until the City Engineer
and the Shakopee Public Utility Commission approve the Final
Construction Plans and Specifications.
7. The applicant shall be required to sign a waiver of assessment appeal
for the Vierling Drive improvements.
8. The applicant shall obtain an NPDES permit prior to any land
disturbing activity. A copy of this permit shall be forwarded to the
City.
9. Park dedication requirements shall be met through a cash contribution
in an amount accordance with adopted fee schedule in place at the time
of final plat approval. The required park dedication fees shall be paid
at the time of the recording of the final plat.
C. Easements shall be shown on the Final Plat as approved by the City Engineer.
D. Simultaneous to the recording of the plat, a deed restriction shall be recorded
on Lots 3 and 4, Block 1. The deed restriction shall appear as the following:
This conveyance is made conditioned upon and subject to the following
restriction. The Grantee, heirs, successors and assigns, are restricted from
erecting any fence or other structure within the utility and drainage easements
dedicated by plat over the above-described property, except with the prior
written consent of the City of Shakopee. This restriction shall run in favor of
and be enforceable by the City of Shakopee.
E. The survey data (length and bearings) shall be shown for each lot.
F. Temporary street signs shall be provided until such time that permanent street
signs are installed.
II. Following approval and recording of the final plat, the following conditions shall
apply;
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. The developer and/or their assigns shall be responsible for any required or desired
noise or dust mitigation measures.
C. Shall provide electronic (Auto CAD) files ofthe Final Plat to the Engineering
Department.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the Preliminary and
Final Plat of Park Place does not constitute a representation or guarantee by the City of Shakopee
as to the amount, sufficiency or level of water service that will be available to lots within the plat
as they are developed.

DISCUSSION
Link Construction Company has submitted an application for preliminary plat approval
of property located as shown on Exhibit A. The plat, as currently proposed, contemplates
the construction of 5 single family lots (Exhibit B).
The area proposed for development was once part of Lions Park but was sold at the time
that Vierling Drive was extended. The preliminary plat, as proposed, does not include
any requests for variances.
EAC and PRAB
The Environmental Advisory Committee and the Park and Recreation Advisory Board
have reviewed this project. Their respective comments and recommendations have been
attached for your reference. The PRAB has recommended that a cash contribution be
made to satisfy the park dedication requirements.
Engineering
The Engineering Department has reviewed the applications and provided comment.
These comments have been attached for the Commission's review. The conditions have
been included in the list of recommended conditions of approval.
Finance Devartment
The Finance Department has commented that pending and levied assessments exist on the
property. Staff is recommending a condition that required the levied assessments to be
paid prior to the recording of the final plat.
Minnegasco
Minnegasco has provided comments which are attached for the Commission's review and
reference. Staffhas included inthe recommended conditions of approval that the
applicant comply with the requirements ofMinnegasco.
STAFF RECOMMENDATION
Staff recommends that the Planning Commission recommend to the City Council the
approval ofthe Preliminary Plat of Park Place subject to the following conditions:

INTRODUCTION
I am writing to forward recommendations regarding the Park Place Preliminary and Final
Plat application.
BACKGROUND AND DISCUSSION
The Environmental Advisory Committee reviewed the proposed development at their
August 11 meeting, and the Parks and Recreation Advisory Board reviewed the
proposed development at their August 23 meeting.
Environmental Advisory Committee Recommendation
Since the site has not substantial natural resources, the Environmental Advisory
Committee recommended approval with no specific conditions. They did question the
outlot shown on the site. As I understand in talking to the applicant, that outlot is
proposed to be a ponding area.

Parks and Recreation Advisory Board Recommendation
The Parks and Recreation Advisory Board also recommended approval of the
application, with the park dedication requirements being met through cash contribution.
Cash dedication based on the adopted 2004 Fee Schedule would be:
5 single-family units X $3,615/unit = $18,075

Link Construction Co. Inc. has submitted application for preliminary and final plat
approval for the Park Place development. Park Place is a two acre parcel located west
of Marystown Road and north of Vierling Drive. This parcel was once part of Lions Park,
but sold to a developer when Vierling Drive was extended.-.
(The parcel was sold primarily because it would have remained a remnant parcel
segregated from the remainder of the park by the drainage ditch. Portions of the
proceedS of the sale were used to pay the assessments on the park property for Vierling
Drive, and the remaining $41,000 for future Lions Park improvements.)
The applicant is proposing five single family homes on the parcel. There would also be a
retention pond constructed on Outlot A There are no significant natural resources on the
parcel.
REQUESTED ACTION
The Committee is asked to review the proposed application and provide any
recommendations for consideration by the Planning Commission and City Council.

Criteria
Park Dedication Criteria for Residential
The City's park dedication requirements set a standard in residential plats of a minimum
of one acre of parkland per 75 people. Thus, one acre of land shall be conveyed to the
City as an outlot warranty for every 75 people the platted land could house.
The City's park dedication ordinance also allows the City to accept cash in lieu of land,
or a combination of land and cash. Cash dedication based on the adopted 2004 Fee
Schedule would be:
5 single-family units X $3,615/unit = $18,075
Considerations
In this case the development is adjacent to Lions Park and is a small development. Cash
contribution should be required.

General Comments
1. This development is adjacent to Vierling Drive and should be required to sign a waiver of
assessment appeal for the Vierling Drive improvements.
2. Execution of a Developer's Agreement, which shall include provisions for security for
public improvements within the Final Plat and the engineering review fees.
3. Payment of Trunk Sanitary Sewer Charges shall be made, as required by the most current
City of Shakopee Fee Schedule.
4. Payment of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment
Charges shall be made, as required by the most current City of Shakopee Fee Schedule.
5. No public improvements shall be constructed until the City Engineer and the Shakopee
Public Utility Commission (SPUC) approve the Final Construction Plans and
Specifications.
6. Provide electronic (Auto CAD) files of the Final Plat to the engineering department.
7. The applicant shall obtain a NPDES permit prior to any land disturbing activity.

Dear Ms. Klima:
With reference to the preliminary plat of F'ark Place, CenterPoint Energy Minnegasco
currently has an easement for an 8-inch high-pressure transmission pipeline operating.
at a pressure of 650 pounds per square inch crossing this property.
During construction last year the grade was changed over the transmission pipeline.
The developer must arrange for the transmission pipeline to be sUNeyed to determine
the exact depth and the exact location of the transmission pipeline. This information
must be included on the grading plan and submitted for approval by CenterPoint
Energy. Ideally, there must be four to five feet of fill, three feet minimum, over the
pipeline for approval of this plat. I have attached a copy of CenterPoint Energy
Guidelines for Encroachment for reference.
The developer must have a representative of CenterPoint Energy present when
exposing the transmission line. Call Gary Allison, master technician, at 612.861.8688
to arrange for field representative to monitor the work.
