Appeal of Board of Adjustment and Appeals Denial of Sign Variance for Rainbow Foods IS, /3, i CITY OF SHAKOPEE Memorandum CASE NO.: 04-099 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner I RE: Appeal of Board of Adjustment and Appeal Denial of Sign Variance for Rainbow Foods DATE: October 19,2004 INTRODUCTION Rainbow Foods has filed an appeal of the Board of Adjustment and Appeals denial of a sign variance. The variance request from Rainbow Foods was to allow 430 square feet of wall signage on the west elevation of their building, 200 square feet maximum allowed, and 200 square feet of signage on the south elevation of their building, where 100 square feet is the maximum allowed. The Board of Adjustment and Appeals held a public hearing on the variance request at its October 7, 2004, meeting, and by a 4-0 vote, they denied the request. The Board determined that the request did not meet all of the criteria required for granting the variance. ,At that meeting, the applicant presented drawings that reduced the variance request to allowing 230 square feet on the west wall ofthe building for Rainbow Foods. They also revised the amount of signage on the south side of the building to 90 square feet, which complies with the City Code requirements. Several Board members acknowledged/appreciated the good faith effort to reduce the scope of the variance request, but felt that the applicant still did not comply with the criteria necessary for approving a variance. A copy of the staff report to the Board of Adjustment, which includes a draft recommendation of denial as well as address the initial request and the history of past variance requests in this area, is attached for the Council's reference. At the October 7, 2004 Board meeting, a property owner located north of this site (Gene DuPont, 1284 Swift Circle) expressed a concern with the amount oflight that will be generated from this site, particularly from the parking lot lights and from the lit signs, and how they would affect his use and enjoyment of his property. Mr. DuPont also submitted a letter, a copy of which is attached for the Council's review. ALTERNATIVES 1. Uphold the determination of the Board of Adjustment and Appeals, and direct staff to prepare a resolution for the Council's consent agenda that is consistent with that decision. 2. Uphold the appeal of the applicant, thereby granting the requested variance, and direct staff to prepare a resolution for the Council's consent agenda that is consistent with that decision. 3. Table the appeal for additional information. IllI Architecture City code currently allows 200 sf of signage per tenant on the west (front) elevation IIlI Interior Design and 100 sf on the south elevation. We are requesting approval for 230 sf on the west elevation. We are also proposing a 90 sf sign on the south elevation and a 55 II Planning sf sign for a 2nd tenant on the west elevation, both of which meet city code. D Construction Management Rainbow Foods is very pleased to be able to offer their services to this community. II The addition of this store enhances Shakopee's retail offerings and benefits the local consumer by offering another choice regarding quality, value and selection. ~ Being new to the area, it is important to let people know that we are here and where we are located. And because the store is set back a great distance from Marschall Road (the main commercial thoroughfare), it is very important that Rainbow be adequately signed. The strict enforcement of the ordinance prOVisions would cause undue hardship because we would have less visibility than our competition. Most retailers in this area, including Cub Foods, have been granted variances for sign age that is larger than what we are proposing. Rainbow Foods has significantly reduced the size of the signage at this location from their corporate standards in order to better comply with the city code. In addition, the words "Foods", "open 24 hours" and "Deli" which are typically included on all front facades, have in this case been eliminated. The variance, if granted will not alter the essential character of the locality. Other retailers in this area such as Target, Kohls and Cub Foods have signage that exceeds the 200 sf permitted by code. Attachments: Exhibit A: ZoningILocation Map Exhibit B: Site Plan Exhibit C: Applicant's Narrative INTRODUCTION: Rainbow Foods has requested a variance to allow 430 square feet of wall signage on the west elevation of their building, and 200 square feet on the south elevation, where 200 and 100 square feet, respectively, are allowed. The store is located at 1698 Vierling Drive (Exhibit A). CONSIDERATIONS: Rainbow Foods is presently remodeling the building that previously housed Kmart, although they Will not be utilizing the entire building. There are plans for an independent liquor store in a space centrally located in the building, with no proposed tenant(s) identified for the northernmost space. Wall signs for business complexes located in the B-1 Zone are regulated as follows: a. Shall be allowed two (2) square feet per linear foot of building wall on which the sign is mounted up to a maximum of 200 square feet per tenant, whichever is less, on the front of the building. b. Shall be allowed one (1) square foot per linear foot of building wall on which the sign is mounted up to a maximum of 100 square feet per tenant, whichever is less, on a side of the building other than the front. Rainbow is proposing a rainbow fresh store sign on the west elevation that would be 400 square feet in area (Exhibits B & C). They are also proposing a 10 square foot pharmacy sign and a 20 square foot Guaranty Bank sign. On the south side of the building (facing Hwy. 169), they are proposing a 200 square foot rainbow fresh store sign, where 100 square feet is the maximum allowed. Additionally, there are plans to install a 55 square foot sign for the proposed liquor store, which is an independent business that will have its own entrance and store space. That sign appears to comply with the City Code requirements. Staffwill work with the future tenant that will occupy the northernmost space of this building to ensure compliance with the sign regulations for that space. Previously, Kmart received a sign variance through an appeal to the City COlUlcil to allow a single 366 square foot sign on the west elevation of this building, with conditions that no other signage was allowed on the west elevation and that no signage was allowed on the south elevation. Kmart was the only tenant of this building at that time. Kohl's and Target, located directly south of the proposed Rainbow Foods site, received variances through appeals to the City Council that essentially transferred allowed square footage from one wall of the building to another wall. These three examples are somewhat dissimilar to Rainbow Food's request, which is asking for additional area on two walls of their building. FINDINGS: Section 11.89, Subd. 2, of the City Code contains provisions for the granting of variances only if all of the followlng circumstances are found to exist. Staff has provided draft fmdings for purposes of discussion by the :Bol:l!'~' The Board may use or modify these draft findings as it sees fit, as well as propose other findings. Criterion I: - The strict enforcement of the ordinance provisions would cause undue hardship because of circumstances unique to the individual property under consideration. Undue hardship means the following: I.A. The property in question cannot be put to a reasonable use if used under conditions allowed bY'theofficial controls; Finding 1.A. The property can be put to reasonable use as a commercial development and comply with the signage regulations as stated in the City Code. I.B. The plight of the landowner is due to circumstances unique to the property; 'Finding J.B. The plight of the landowner/tenant is not due to circumstances unique to the property. The circumstances are based on the applicant's desire for additional signage beyond what is allowed by City Code. LC. The circumstances were not created by the landowner; FindingJ.C The circumstances were created by the proposed tenant as a result of their desire for additionalsignag~ 1.D. The variance, if granted, will not alter the essential character of the locality; and Finding J.D. The variance would not alter the essential character of the locality. t.E. The problems extend beyond economic considerations. Economic considerations do not constitute an undue hardship if reasonable use for the property exists under the terms of the ordinance. Finding I.E. The problems do extend beyond economic considerations. Criterion 2: It has been demonstrated that a variance as requested will be in keeping with the spirit and intent of this Chapter. , Finding 2. The proposed variance would not be in keeping with the spirit and intent of Chapter 11 (Zoning) in that it would allow additional signage beyond what is allowed by City Code. Criterion 3: The request is not for a use variance. Finding 3. The request is not a use variance. Criterion 4: Conditions to be imposed by the Board of Adjustment and Appeals will insure compliance to protect the adjacent properties. Finding 4. (Dependent on the Board's action on the request.) Table the decision for additional information. Mark, This is a list of our concerns that you requested I send you when we had our telephone conversation last week in regards to the Rainbow store on Vierling Drive. The Planning Commission is having a public hearing on September 23, regarding a variance on signage. . We are concerned about the size of signs because of lighting issues we already deal with. . What are codes for if variances are continually granted? Codes were originally written for a reason. What is the reason? Why are they being changed constantly? . We are concerned about what may' go in the other end (north end) and what type of signage will they request? Will a sign be mounted facing north towards the residential area? This is a unique situation because you have to consider there is a residential area right across the street. On the other side of Marschall (where Cub is located), the residential area is behind the store and they have installed a 6 foot privacy fence between the store and the residential area. Plus they landscaped it with large trees. . Is it necessary.to light the entire parking lot 24 hours a day? Why can't they use a lower wattage bulb or install some type of shield arQund the lights on the perimeter of their lot so that it does not light up the residential area across the street.
