A, CITY OF SHAKO PEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Assessment Hearing for Weinandt Acres 1st Addition Street Reconstruction, Project No. 2004-1 DATE: October 19,2004 INTRODUCTION: Attached is Resolution No. 6130, a resolution which adopts the assessment for the above referenced project. BACKGROUND: This project has essentially been completed and all project costs identified. The final project cost IS $310,624.00, which consists of construction costs and engineering/administration costs. A breakdown of the project costs are as follows: Description Amount City Costs (Tax Levy) $232,968.00 Assessments $ 77,656.00 TOTAL PROJECT COSTS $310,624.00 City policy is to assess 25% of the project costs are proposed to be assessed on a per lot basis. One parcel is large enough for future subdivision and will be assessed two lots. The remainder of the costs will be paid by the City. The assessment rate per unit is $4,568.00. The assessment roll for this project is attached for Council approval and is based on the feasibility report. A presentation ofthe final project costs and assessments will be made at the Council meeting. AL TERNATIVES: Adopt Resolution No. 6130. Deny Resolution No. 6130. Table Resolution No. 6130 for specific reasons. RECOMMENDATION: Staff recommends Alternative No.1. ACTION REQUESTED: Offer Resolution No. 6130, A Resolution Adopting Assessments for Weinandt Acres 1st Addition Street Reconstruction, Project No. 2004-1 and move it adoption. ~W~ Jeff Weyandt Assistant City Engineer BUpmp ENGR/2004PROJECTIWEINANDTIWORDIMEM6130 RESOLUTION NO. 6130 A Resolution Adopting Assessments For The Weinandt Acres 1 st Addition Street Reconstruction Project No. 2004-1 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shako pee met and heard and passed upon all objections to the proposed assessments of: 29th A venue, Maxine Circle and Marcia Lane from 29th A venue to the Plat Line for street reconstruction and any appurtenant work. NOW, THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2. Such assessments shall be payable in equal annual installments extending over a period often years, the first installment to be payable on or before the first Monday in January, 2005, and shall bear interest at the rate of 5.00 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 2005 and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current. tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year.
