IS. ft . ).. .
CITY OF SHAKOPEE
Memorandum
CASE NO.: 04-102
TO: Mayor and City Council
Mark McNeill, City Administrator
FROM: R. Michael Leek, Community Development Director
SUBJECT: Waiver of Subdivision Criteria: 8380 Eagle Creek Blvd., Mark and Michelle
Minea
MEETING DATE: November 3,2004
INTRODUCTION:
The Mineas have submitted a request for approval of a waiver of subdivision criteria for
property. to allow them to relocate the property line between the 2 parcels that they own. The
parcel on which their house is located is about .97 acres, while the northerly parcel is about
3.93 acres. (See their attached letter and location map). The property is zoned Rural
Residential (RR) Zone, and the requested lot line relocation would not result in lots meeting
the current ordinance standards for size and density, hence the request to waive those
requirement found in Chapter 11, Zoning.
ALTERNATIVES:
1) Approve the requested waiver of subdivision criteria that would allow the relocation of the
lot line between the Minea's parcels to create a 1.97 acre +/- and 2.93 acre +/- parcels.
2) Do not approve the waiver of subdivision criteria.
3) Table the matter for additional information.
ACTION REQUESTED:
Offer and pass a motion consistent with the Council's determination.

- Dear Sir,
We currently own two parcels of land in Shakopee. We live
on the .97 acre lot (Property 1D R 2791305(0) that is farthest
south of Eagle Creek Blvd. The second parcel (Property 1D
R 279130490) is 3.93 acres located just north of the house
extending to Eagle Creek Blvd. with open field area near the Blvd,
and a heavily wooded area closer to our home.
- We are requesting that the lot line between the two parcels
be moved to the north 1 acre or as little as ~ acre. We are
planning on selling the larger parcel, but our garden, part of our
yard (to the tree line), and part of our driveway are currently on
that parcel. Our family would love to keep that part of our yard
and the privacy provided by the woods, and we would like to avoid
losing legal access to the private road, Tuckaway Trail, by losing
the lower part of our driveway.
We are regretfully need to sell part of the land to be able
to afford to continue living here in the home and city that we
love. Thank you for your consideration.
