No. 6139 ~I OJ CITY OF SHAKOPEE Memorandum CASE NO.: 04-097 TO: Mayor and City Council Mark McNeill, City Adminsitrator FROM: Julie Klima, Planner II SUBJECT: Vacation of Easement MEETING DATE: November 3, 2004 REVIEW PERIOD: September 21,2004 - January 19,2005 INTRODUCTION Associated Capital Corp. has submitted an application for vacation of easement located north of County Road 78, east of Barrington Drive, and west of CSAH 17. On October 5\ the Council approved Resolution No. 6139, a resolution setting the public hearing date for November 3rd. DISCUSSION The Planning Commission has reviewed this request and has recommended approval of the vacation. Attached for your information is a copy of the Planning Commission report from the October 21,2004 meeting. ALTERNATIVES 1. Approve Resolution No. 6139, a resolution of the City of Shakopee approving the vacation of easement within Valley Creek Crossing. 2. Deny the proposed vacation. 3. Continue the public hearing. 4. Close the public hearing and table the request to allow staff or the applicant time to provide additional information. ACTION REQUESTED Offer a motion to approve Resolution No. 6139, and move its adoption. -~ ulie Kli~a ' Planner II g:\cc\2004\11-03\vacacc04097.doc RESOLUTION NO. 6139 A RESOLUTION OF THE CITY OF SHAKOPEE VACATING EASEMENT WITHIN V ALLEY CREEK CROSSING WHEREAS, it has been made to appear to the Shakopee City Council that easement within the plat of V alley Creek Crossing located north of County Road 78, east of Barrington Drive, and west of CSAH 17 serves no public use or interest; and WHEREAS, the easement to be vacated is legally described as: That part of Outlot D, Beckrich Park Estates, Scott County, Minnesota, described as follows: Beginning at the northeast corner of said outlot; thence South 00 degrees 11 minutes 23 seconds West, assumed bearing, along the east line ofsaid outlot 419.97 feet; thence North 36 degrees 21 minutes 23 seconds West 161.67; thence North 34 degrees 22 minutes 55 seconds West 87.77 feet; thence North 26 degrees 05 minutes 19 seconds West 120.78 feet; thence North 05 degrees 41 minutes 33 seconds West 107.67 feet to the north line of said outlot; thence easterly along the north line of said outlot to the point of beginning; and WHEREAS, a public hearing to consider the action to vacate was held in the Council Chambers of the City Hall in the City of Shakopee at 7 :00 P.M. on the 3rd day of November, 2004; and WHEREAS, two weeks published notice was given in the SHAKOPEE VALLEY NEWS and posted notice was given by posting such notice on the bulletin board on the main floor ofthe Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall; and WHEREAS, all persons desiring to be heard on the matter were given an opportunity to be heard at the public hearing in the Council Chambers in the City of Shakopee. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: That it finds and determines that the vacation hereinafter described is in the public interest; That the easement described above serves no further public purpose; That the easement described above is hereby vacated,. After the adoption of the Resolution, the City Clerk shall file certified copies hereof with the County Auditor and County Recorder of Scott County. Plan: Single Family Residential Acreage: 1.28 Acre MUSA: The site is within the MUSA boundary. INTRODUCTION The City Council has received a request from Associated Capital Corporation to consider the vacation of easements located north ofCR 78, east of Barrington Drive, and west ofCSAH 17 (see Exhibit A). CONSIDERATIONS The City Council will hold a public hearing on Wednesday, November 3,2004 to consider this vacation request. A recommendation from the Planning Commission is required for the vacation process. The applicant is requesting the vacation so that the final plat of Valley Creek Crossings can be recorded. The subject property was fonnerly part of the open space within Beckrich Park Estates development. Prior to the platting of Valley Creek Crossings, the city approved the reguiding and, rezoning of the property to allow for single family residential development and the extension of MUSA. A condition of approval of the final plat for Valley Creek Crossings was that the easement over the subject area was to be vacated prior to recording ofthe final plat. City, County and other outside agencies were given the opportunity to review and provide comments regarding this application. Staffhas received no adverse comments. ALTERNATIVES 1. Recommend to the City Council the approval of the vacation. 2. Recommend to the City Council the approval of the vacation subject to conditions. 3. Recommend to the City Council denial of the request. 4. Table the decision to allow staff or the applicant time to provide additional information. STAFF RECOMMENDATION Staff recommends Alternative No.1, recommend to the City Council approval ofthe vacation.
