No. 6141 9aC , CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Assessment Hearing for 2003 Vierling Drive Improvements, Project No. 2002-4 DATE: November 3,2004 INTRODUCTION: Attached is Resolution No. 6141, a resolution which adopts the assessment for the above referenced project. BACKGROUND: On October 15, 2002, City Council adopted Resolution No. 5796, a resolution ordering the improvement of Vierling Drive, from County Road 15 to Orchard Park West. On February 4, 2003, the City Council reviewed alternatives of roadway alignment and selected an alignment which would allow a fire station to be built in Lion's Park. The City also later sold approximately 2 acres, north of Vierling Drive to Pat Link Construction. Plans were approved by the Council on July 15, 2003 by adopting Resolution No. 5911. A contract was awarded to S.M. Hengtes & Sons, Inc. on August 19,2003 and the work done in 2003 and 2004. This project has essentially been completed and all project costs identified. The final project cost IS $835,550.15, which consists of construction costs and engineering/administration costs. A breakdown ofthe project costs are as follows; Description Amount City Costs (State Aid) . $101,975.77 City Costs (Storm Sewer Fund) $167,263.06 Assessments $545,717.30 SPUC $ 20,594.02 TOTAL PROJECT COSTS $835,550.15 The local street equivalent was assessed to benefiting properties, as per the feasibility report. The City costs are for the widening of the road to a collector street, bituminous trail and the box culvert. SPUC's participation is for the trunk oversizing of the ';:A: , The City also is receiving an assessment of $105,265.00 for future Lion's Park fire station. Other properties assessed included the area purchased by Pat Link Construction from the City, north of Vierling Drive and an undeveloped 24 acre parcel south of Vierling Drive. Property was assessed based on benefiting property front footage that would benefit from the improvements. Attached to this memo is a funding summary of the project, assessment roll and assessment map showing the benefiting areas. Also attached is a letter from Cal Haaskens, Sharon Haaskens, Christy Haaskens Schuler and Chad Haaskens objecting to the assessment to their parcel. A presentation of the project costs and assessments will be made at the public hearing. AL TERNA TIVES: 1. Adopt Resolution No. 6141. 2. Deny Resolution No. 6141. 3. ACTION REQUESTED: Offer Resolution No. 6141, A Resolution Adopting Assessments for 2003 Vierling Drive Improvements, Vierling Drive, from County Road 15 to Orchard Park West Plat Line, Project No. 2002-4 and move it adoption. aney Public Works Dire BUpmp ENGRl2002PROJECTNIERLNGDRlWORDlMEM6141 RESOLUTION NO. 6141 A Resolution Adopting Assessments For 2003 Vierling Drive Improvements, Vierling Drive, From County Road 15 To Orchard Park West Plat Line Project No. 2002-4 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shako pee met and heard and passed upon all objections to the proposed assessments of: Vierling Drive, from County Road 15 to Orchard Park West Plat Line for reconstruction and any appurtenant work. NOW, THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute. the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2. Such assessments shall be payable in equal annual installments extending over a period often years, the fIrst installment to be payable on or before the first Monday in January, 2005, and shall bear interest at the rate of 5.25 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 2005 and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her offIce and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installment~ and interest On assessments on each parcel of land which are to become due in the following year.
