A, CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Assessment Hearing for 2003 Street Reconstruction, Project No. 2003-3 DATE: November 3, 2004 INTRODUCTION: Attached is Resolution No. 6138, a resolution which adopts the assessment for the above referenced project. BACKGROUND: This project has essentially been completed and all project costs identified. The final project cost IS $3,424,149.00, which consists of construction costs and engineering/administration costs. A breakdown ofthe project costs are as follows: Description Amount City Costs $1,853,463.92 Assessments $1,494,356.15 SPUC $ 76,328.93 TOTAL PROJECT COSTS $3,424,149.00 The City costs are to be paid for the following funding sources and amounts: Fundin2 Sources Totals Sanitary Sewer Fund $ 58,440.82 Storm Sewer Fund $ 477,860.41 Tax Levy $ 493,668.43 State Aid $ 823,494.26 TOTAL $1,853,463.92 . The Sanitary Sewer Fund paid for sewer replacement on 4th Avenue, west of CSAH 17 and for replacing the private sewer line on 4th Avenue by the KC Hall. .,', . The Storm Sewer Fund paid for the non-assessed storm sewer improvements on 4th A venue and for the storm sewer system and pond from Sarazin Street to the Mill Pond as a trunk system improvement. . Tax levy paid for the non-assessed amount of the street reconstruction on 4th A venue and Cavanaugh Drive. . State Aid funding paid for the widening of 4th Avenue, additional right-of- way, concrete sidewalk and bituminous trails on 4th Avenue and Sarazin Street and railroad crossing improvements on Sarazin Street. Street reconstruction assessments on 4th A venue and Cavanaugh Drive feasibility report is to assess 25% of the street, storm sewer and street lighting. The curb and gutter was assessed at 100%, since it was not installed previously. Sidewalk and bituminous trail was not assessed, as per previous Council action on 4th Avenue and Sarazin Street. New sanitary sewer, watermain and services was assessed 100% to benefiting property owners. Reconstruction of existing watermain and sanitary sewer main were not assessed but paid by SPUC and the City. Assessments for street, storm sewer, street lighting and watermain improvements was based on a front footage method, while new sanitary sewer was based on an area method. Assessment notices were set out at least fourteen days prior to the hearing. An error has been found in the calculations, which will lower the assessments slightly. The assessment roll attached for Council approval reflects the correction in the calculations. Attached to this memo is a final cost estimate, funding summary and assessment roll showing the new assessments as compared to the mailed notice amount. Issues in the assessments that staff knows about prior to the hearing will be the watermain assessment to properties that have watermain already. Two properties that have water and are receiving a watermain assessment are the outlots owned by Pinewood Estates Homeowner's Association ($51,538.18) and the Shakopee Ballroom parcel ($27,709.71). The issue with these parcels is whether a looping agreement exists or is valid for the watermain work done on 4th Avenue or Spruce Street in Pinewood Estates. Staff has sent a letter to SPUC's staff asking that the utility reimburse the City if these assessments are not held up if appealed. Staff will be attending the November 1, 2004 SPUC meeting to address this issue and will bring any results .from that meeting to the November 3, 2004 public hearing. If no looping agreement exists or is valid, then the likelihood ofthe assessments being upheld in court is very low. Attorneys for SPUC are reviewing the looping agreements and will have an opinion at the SPUC meeting. If the opinion is such that the looping agreements do not exist or are not valid, staff may suggest that the watermain assessments be removed from the properties. The city attorney would have an opinion on this situation at the public hearing. The City did enter into assessment agreements with Northland Forest Products and Kelly Fuels, which did put maximums on the assessments and deferments on a portion of the assessments. The assessments above the maximum for Kelley Fuels on Sarazin Street were redistributed to other properties such as SPUC and United Properties. The assessment roll for the project is attached for Council approval. A presentation of the final project costs and assessments will be made at the Council meeting. AL TERNATIVES: 1. Adopt Resolution No. 6138. 2. Deny Resolution No. 6138. 3. Table Resolution No. 6138 for specific reasons. RECOMMENDATION: Staff recommends Alternative No.1. Sarazin Street, from 4th Avenue to County Road 101 . Cavanaugh Drive, from Sarazin Street to Union Pacific Railroad Crossing NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount ofthe assessments levied against it. 2. Such assessments shall be payable in equal annual installments extending over a period often years,.the first installment to be payable on or before the first Monday in January, 2005, and shall bear interest at the rate of 5.00 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 2005 and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year. One of these parcels is the Pinewood Estates Homeowner's Association, in which they have a large assessment for watermain for their properties. The City of Shakopee did assess $51,038.18 of watermain assessments to Pinewood Estates Homeowner's Association, as discussed with SPUC's staff previously, in order to complete the looping requirements in this area. It is not certain whether or not a looping agreement has been recorded for the Pinewood Estates development. Before the November 3, 2003 public hearing, the City of Shakopee needs to know if SPUC will support any loss of assessment for the watermain improvements along 4th Avenue and Spruce Street, if there is loss of assessments due to lack of benefit for the improvement, such as watermain installed to Pinewood Estates. It is my understanding that this issue and others will be discussed at the November 1, 2004 SPUC's meeting and I would like to be in attendance for discussion on that item. Also, the City would be concerned about the potential loss of watermain assessment to the Shakopee Ballroom parcel if the looping agreement on this parcel is not valid. The City would like assurances that SPUC would reimburse the City if this assessment is not held up if appealed by the property owners. Specific objections pertain to the assessed costs for the water ~in and water connection charges to the Pinewood Estates development~ A pre-existing water main within the development derived little or no benefit from the 4th Ave project. Background: The Pinewood Estates Homeowners Association, a multi-tenant development created by Barrington Corp., was started in the. summer of1996 and completed sometime in the fall of 1998. Development plans approved by the CityofShakopee Planning Department laid out a 6" water main. The water main connected at Shenandoah Drive runs down Pinewood Drive and crossing through the development to Sirazin Ave. This same water main also circles Spruce and Ash Street reconnecting to itself at the intersection of Pinewood and Ash. Currently: In February 2004 board members of Pine wood Estatesinformally heard of a town meeting regarding the road improvements for 4th Ave. The meeting notice was not formally addressed or delivered to the Pinewood Estates Association. A board member who did attend the February 10, 2004 meeting submitted a written report to the board. This report specifically sited question to the assessment for sewer and water, because of a "looping agreement" dated at the time of development ofthe Pinewood estates. It is our understanding the City of Shako pee and/or the Shakopee Public Utilities Commission has a copy of this looping agreement. Board members of Pine wood Estates have requested a copy of this "looping agreement" from the Scott Count Clerk of Courts, but apparently no record of this agreement exists. Objection of Proposed Assessment 2003 Street Reconstruction Project No. 2003-3 Conclusion: It is the consensus of the Pinewood Estates Homeowners Association that without said "looping agreement," the Pinewood Estates Homeowners Assoc. never agreed to additional water main construction. It is also agreed it should not be our responsibility to pay for construction of the new water main rumring adjacent to Outlot A & B and the connecting line rumring perpendicular to 4th Ave to our existing water main. Although, Association members agree with the assessments for the cost of improvements for curb, gutter and approximately 25% of the cost of the roadway running adjacent to Outlots A & B. BACKGROUND: The assessment roll for the above referenced project is revised and attached as an error in the storm sewer calculations on Sarazin Street (Segment 3) was discovered. Assessments have been recalculated for parcels owned by United Properties, Shakopee Public Utilities and Tim Dressen. The assessments are being lowered by $27,631.47 and the Storm Drainage Fund contribution is increased by that amount. Also included in this memo are memos from Lou VanHout and Joe Adams of SPUC in regard to the 4th Avenue project and watermain assessments. At the November 1, 2004 SPUC meeting, it was decided by the Commission to wait and see what parcels may . appeal their assessments and to continue the current practice or policy with the City until an examination can be done. The City of Shakopee has assessed watermain improvements as part of this project. The properties being Pinewood Estates and Shakopee Ballroom have water service and were to have a looping agreement to pay for additional watermain along 4th Avenue. To date, no recorded looping agreements have been found. The City Attorney has reviewed memos and is recommending the Council conduct the hearing and then continue the hearing until November 16th, giving staff time to evaluate any written objections. At this point, staff would recommend conducting the public hearing and either continue the public hearing or close the public hearing and the adoption of the assessment roll until November 16, 2004. Also, staff would ask for Council direction on how to proceed with the assessments to Pinewood Estates and Shakopee Ballroom after hearing the City Attorney's opinion. ALTERNATIVES: 1. Adopt Resolution No. 6318 with revised assessment roll. 2. Conduct the public hearing and continue hearing until November 16, 2004. 3. Conduct the public hearing and closed the public hearing and table action on Resolution No. 6138 until November 16, 2004. MEMORANDUM TO: Bruce Loney FROM: Jim Thomson, City Attorney DATE: November 2, 2004 RE: 2003 Street Reconstruction Assessments I reviewed the staff memoranda that were provided to SPUC for its meeting last night concerning the water main portion of the special assessments for the 2003 Street Reconstruction project. As I understand it, the issue is whether the City or SPUC would be responsible for a portion of the costs associated with the construction of the water mains if some of the assessments for that portion of the project are not upheld. My suggestion is that the City Council conduct the public hearing tomorrow night as scheduled on the special assessments. If property owners file written objections challenging the water main assessments, the public hearing can be continued until the next regularly scheduled council meeting. That will give City staff and our office time to evaluate the likelihood of success of any assessment appeals and to advise the City Council accordingly. If we conclude that a special assessment appeal is likely to be successful, we would recommend (as we have done in other similar cases) that the assessment be reduced to an amount that can be sustained. A two-week delay would also give SPUC more time to evaluate the situation. At some point, the issue of who would pay for any portion of the water main costs that cannot be assessed will need to be addressed. That issue should not, however, affect the decision on whether those assessments should be levied. I do not recommend that the Commission take action on alternative #1 as Joe recommends. However, I am including his memo and the one from the City Engineer, despi~e my opposition to the staff recommendation, because it is now after 12 Noon on 10/29 and time is too short to permit further work.on the matter before sending out the Commission agenda. My further understanding is that City staff has asked the matter to be brought before the ,Commission under the short timeline because an answer is needed prior to the City Council action on November 2. I do not want to minimize the difficulties the City has in . . setting up assessments, nor the uncertainties of the legal process on assessment appeals. And. I would not even object to the consideration of the issues that lie behind :the present question being brought. However, the attorney's advice as of very recent vintage (an hour ago) is to recommend against having an in-depth discussion of the specific issues at this time. And the general discussion of easements, appeals, who defends an appeal, who bears the risk the risk of a successful. appeal, and how does SPUC get to know of those risks before approving a project --- all that is a co-ordination matter which has been worked .out by previous Commission's and Council's - and this is not the time to overturn that general working arrangement without a thorough understanding of it. Despite the fact that some have always had a difficult time comprehending an arrangement whereby the City absorbs the losses of any successful assessment appeal - even those for water improvements - but that has been the practice and has been consistently adhered to by previous Council's and Commission's. Should that practice be re-examined? I am not opposed to that, but I am opposed to a blanket change made on short notice with rushed information. Are there specific details in the present case that would lead to a departure from the general practice? Perhaps. But the time to consider those was when the project was being approved. Could the Commission agree to absorb the "watermain portion:" of any successful appeal on this project? That could be considered after the assessment and appeals have proceeded to conclusion, or have been settled out of court. Conclusion: It is my belief that: 1. the general change to the policy should not be made on short notice with partial information. 2. There may be reasons to consider a departure from the regular policy because of special circumstances in certain cases, but 3. we are precluded from discussing the specifics of the present matter because of attorney advice on the likelihood for appeal. 4. The legal advice (as I understand it as of an hour ago) is, that the City's assessment should go forward on Tuesday evening not changed by any Commission action on Monday evening. Thi.s is in conflict with the 200 paragraph of the letter from the City Engineer and it should have been resolved before the matter was brought to the Commission except for the time left today. Recommendation: 1. That a general decision to change the policy not be made without thorough examination of the co-ordination system on public improvement projects. 2. That any specific commitments in the present case wait until we can find a way to appraise the Commission of the specifics. SUBJECT: 4th A VENUE PROJECT - 2003 STREET RECONSTRUCTION WATER MAIN AGREEMENTS & ASSESSMENTS DATE: October 29, 2004 INTRODUCTION The attached memorandum from Public Works Director Bruce Loney requests assurances from the Utilities Commission that the City would be reimbursed by the Utilities Commission for the water main assessment to two properties in the project, the Pinewood Estates PUD and the Shakopee Ballroom, if the property owners successfully appeal their assessments. DISCUSSION Whenever special assessments are levied, any property owner may challenge the validity of the assessments on procedural grounds or on the issue of whether the "benefit" to the property (the increase in market value caused by the proj ect) is equal to or greater than the amount of the assessments. If the amount ofthe assessments exceeds the benefit, the assessments must be reduced to the amount of the benefit. The City Engineer is asking the Commission to verify that, if any of the special assessments for the 4th A venue water main are successfully challenged, the Commission will be responsible for any water main costs that are not reimbursed by special assessments. ALTERNATIVES 1. Assure the Public Works Director that the Commission will reimburse the city for water main assessments on the 4th Avenue proj ect if property owners successfully challenge the amount of benefit created by the project. 2. Do not assure the Public Works Director that the Commission will reimburse the city for water main assessments on the 4th Avenue project to the extent if property owners successfully challenge the amount of benefit created by the project. RECOMMENDATIONS Staff recommends alternative 1. The water main is owned and operated by the Commission, and the Commission should be responsible for the costs of the main, to the extent that the project costs exceed the benefit to the assessed properties. CITY OF SHAKOPEE Memorandum TO: Joe Adams, Engineering Coordinator FROM: Bruce Loney, Public Works Director SUBJECT: 2003 Street Reconstruction Assessments DATE: October 24,2004 With the 2003 Street Reconstruction Project, there are some parcels that have assessments that may appeal their assessment. One of these parcels is the Pinewood Estates Homeowner's Association, in which they have a large assessment for watermain . for their properties. The City of Shakopee did assess $51,038.18 of watermain assessments to Pinewood Estates Homeowner's Association, as discussed with SPUC's staff previously, in order to complete the loopin~ requirements in this area. It is not certain whether or not a looping agreement has been recorded for the Pinewood Estates development. Before the November 3, 2003 public hearing, the City of Shakopee needs to know if SPUC will support any loss of assessment for the watermain improvements along 4th Avenue and Spruce Street, iffuere is loss of ~sessments due to lack of benefit for the improvement, such as watermain installed to Pinewood Estates. It is my understanding that this issue and others will be discussed at the November 1, 2004 SPUC's meeting and I would like to be in attendance for discussion on that item. Also, the City would be concerned about the potential loss of watermain assessment to the Shakopee Ballroom parcel if the looping agreement on this parcel is not valid. The City would like assurances that SPUC would reimburse the City if this assessment is not held up if appealed by the property owners.
