TO: Mayor & City Council .. . \) ,11& iJ';: Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Establishment of a Lateral Sewer Connection Charge Ordinance No. 775 DATE: January 2, 2006 INTRODUCTION: In conjunction with the CSAH 83 sanitary sewer extension, from Church Addition to River Valley Estates,. a lateral sewer connection charge needs to be established. Attached is Ordinance No. 775, an ordinance establishing a lateral sewer connection charge for the City of Shakopee. BACKGROUND: With the CSAH 83 sanitary sewer extension feasibility report, it was proposed to have a lateral sanitary sewer connection charge versus a lateral sewer assessment on properties adjacent to CSAH 83 so as not to place an assessment on properties that are not contemplating development at this time. City Council recently adopted a new assessment policy, in which either an assessment or lateral sewer connection charge could be established or a lateral sewer benefit associated with trunk: sewer line extensions. Attached to this memo is Ordinance No. 775, an ordinance that has been prepared by Jim Thomson, City Attorney, in order to establish a lateral sewer connection charge for the City of Shakopee. ALTERNATIVES: 1. Adopt Ordinance No. 775 . 2. Do not adopt Ordinance No. 775. 3. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No.1, so a lateral sewer connection charge can be established. I Shakopee, MN 55379 I I I I I Total 68.26 I 136 1$164,959.84 ORDINANCE NO. 775, FOURTH SERIES AN ORDINANCE AMENDING FEES BY ADDINGA LATERAL SANITARY SEWER CONNNECTION CHARGE FOR THE CSAH 83 SANITARY SEWER PROJECT Whereas, by Ordinance No. 772, the City Council adopted a Fee Schedule forthe fiscal year 2007; and Whereas, Minnesota Statutes, Chapter 444 and Section 3.02 of the City Code authorize the City Council to fix rates and charges for sanitary sewer services, including but not limited to establishing sanitary sewer availability and connection charges; and Whereas, the city council has detennined that a lateral sanitary sewer connection charge should be established for the CSAH 83 sanitary sewer project from the south plat line of Church Addition to the north plat line of River Valley Estates so that properties that can be served by public sanitary sewer as a resutt of the construction of that project pay for the their fair share of the costs of the project; Whereas, the Public Works Director has calculated the amount of the charge that should be established, and the City Council has concluded that the proposed charge is just and equitable. THE CITY COUNCIL OF lHE CITY OF SHAKOPEE, MINNESOTA ORDAINS: Section 1. The 2007 Fee Schedule, adopted by Ordinance 772 is amended by adding the following charge under "Engineering" on page 21 of the Fee Schedule: L. Lateral Sanitary Sewer Connection Charae for CSAH 83 Sanitary Sewer Proiect from the south plat line of Church Addition to the north plat line of River Vallev Estates $ 1.212.94 per SAC unit as calculated usino the most recent version ofthe Metropolitan Council SAC Procedures Manual The charae is to be collected when a property within the proiect area connects to the CSAH 83 sanitary sewer line or when a final plat is recorded for a development within the proiect area. whichever occurs first. Section 2. The current paragraph "L" entitled "Other Fees" is re-Iettered as paragraph "M." Section 3. This ordinance becomes effective from and after its passage and publication.
