SUBJECT: 2005 Fee Schedule

INTRODUCTION
The City Council is asked to consider adopting the attached
ordinance setting fees for licenses, permits, services, and
documents for 2005.
BACKGROUND
Prior to the end of each year, the City Council adopts a fee
schedule by ordinance for the ensuing year. The fee ordinance
includes the fees for all licenses and permits issued within the
City of Shakopee. Department heads have been asked to re-examine
their fees and make appropriate recommendations for adjustments to
the City Council.
In the proposed ordinance, the stricken language is deleted
and the underlined language is inserted.
City Clerk - recommends increasing the license fee for
pawnshops from $1,500 to $2,500, as recommended by the Police
Department, page 3. Fees are deleted for massage centers and
massage therapists, as the city has discontinued licensing these.
An application/investigation fee has been added for a wine
license, page 2.
Building Department - recommends increasing the building
permit fees as outlined on pages 4 and 5 (See memo from Mark
Noble, Planner I, dated December 7, 2004, Exhibit "B".) i
refunding 100% of the certificate of occupancy escrow when a final
certificate of occupancy is issued, page 6; refunding up to 80% of
the permit fee when permits are abandoned or unused (consistent
with current practice), page 6; clarifying that detached accessory
buildings in excess of 120 square feet need a building permit,
page 7 i plan review fees will be "up to' I 65% of the building
permit fee, page 6.
The SAC charge is being increased from $l,350/unit to
$l,450/unit, page 8. The Metropolitan Council dictates this.

Fire Prevention - there are no changes recommended for 2005.
Finance Department - recommends increasing the monthly sewer
service charge by fifty cents (0.50) for both metered and
unmetered residential water accounts, page 10; and, increasing the
storm water drainage utility fee from $24.056 per REF to $25.05
REF (residential equivalent factor), page 17. See memo from Gregg
Voxland, Finance Director, dated November 10, 2004, Exhibit "A".
It is also recommended to increase the charge for assessment
searches and partial releases of a Developer's Agreement from $20
to $25, page 9.
Police Department - recommends increasing the license fee for
pawn shops from $350 in 2002 to $1,000 in 2003, $1,500 in 2004 and
$2,500 in 2005, as recommended in 2002 by Sgt. Forberg, after
researching fees charged by other cities, page 3. The hourly rate
for contracted police services is being increased to $52, page 10.
It is also recommended that the dog licenses be increased from $10
for the life of the dog to $20 for a two-year license; and, to
increase the duplicate license fee from $2 to $5, page 10. The
increased fee will help defray the cost of $10,800 the City pays
for animal control services. (An amendment to the city code to
change the license duration to two years will come to City Council
at a later date.)
Public Works - there are no changes recommended for 2005.
Planning Department - recommends adding two new fees, a
concept review by Planning Commission for $200 and a pre-
application meeting fee of $200 for each meeting after the first,
page 12. The title review fee is being increased by $150 to more
accurately reflect the actual cost billed to the city by the City
Attorney's office, page 12. See memo from Mark Noble, Planner I,
dated December 7, 2004, Exhibit "B". Also, an application for
variances for single family residential is being increased to $150
and the application for temporary seasonal sales is being
increased to $50, page 11. A fee for the Five Year CIP is being
deleted since those requesting copies are satisfied with the
summary and pay the $0.20/copy, page 11. The recording fee is
being reduced to $19.50 to be consistent with the fee charged by
the county, this is a pass through, page 13.
Engineering Department - in addition to some language
clarifications on page 15, the Engineering Department recommends
adjusting the following fees:
a. trunk storm water fee increase to $.093, page 15
b. trunk storm water storage and treatment charges increased
as outlined on page 16
c. trunk sanitary sewer fee is increased to $1,780/net acre,
page 14

d. excavation permit fees to work in right-of-way are
increased, page 17
e. the fee for topographic maps is increased, page 17

recommends increasing the park dedication fees as outlined on page

the fees for programs and facilities as outlined in the memo from
Mr. Themig dated December 7, 2004, Exhibit ......D" . (These pages
19-23 will be added to the fee schedule/Ordinance No. 715, but are
not copied with it at this time, to save on paper.)

AN ORDINANCE SETTING FEES FOR
CITY LICENSES, PERMITS, SERVICES AND DOCUMENT
WHEREAS, by Ordinance No. 692, the City Council established a fee schedule effective
January l, 2003; and
WHEREAS, amendments to the fee schedule were subsequently made with the adoption
of Ordinance No. 699; and
WHEREAS, the City Council has determined that adjustments to those fees are
reasonable and appropriate.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Shako pee,
Minnesota, that the Fee Schedule dated January 1, 200S, a copy of which is on file in the office
of the City Clerk, is hereby approved and adopted in its entirety.
BE IT FURTHER ORDAINED, that the Fee Schedule shall become effective on January
1, 200S, unless indicated otherwise therein, and Ordinance Numbers 692 and 699 and all other
. ordinances and resolutions inconsistent herewith shall be repealed effective January 1,2005.
Adopted in Regular Session of the City Council of the City of Shakopee, Minnesota,. held

Engineering
A. Private Developments
The development fees for private developments apply in situations where private developers choose to construct the
'i
public improvements, rather than having them constructed by the City. The fees that the City charges in those
situations are intended to reimburse the City for all of the direct and indirect costs incurred by Engineering and Public
Works Departments to process the development application, to process and administer the project, to review and
approve the plans for the project, and to inspect the construction of the project. The percentage used for various items
are based on the historical costs incurred by the City.
Streets and Utilities
The Development Fees for private developments include a lump sum of 8.5% of the estimated construction costs for
the following: public sanitary sewer, public storm sewer, public street construction, sidewalks, boulevard trees and
other appurtenances. The lump sum des not include costs associated with soils and material testinQ. These testing
costs are paid by the City and reimbured 100% by the developer. The 8.5% lump sum is based on the following
breakdown:
Administrative Fee 1.50%
Plan Review Fee 2.50%
Inspection Fee 4.50%
Total 8.50%
Watermain
The Development Fees shall also include a lumpsum of 4.0% of the estimated construction costs for public water,
based on the following breakdown:

limits minus the portion of the development used for public right-of-way, lakes, wetland areas, stormwater ponding
easements, and parks.
C. Trunk Storm Water Storage and Treatment Charges
A fee will be charged to all new developments that utilize regional ponding systems, per the City's Trunk Storm Water
Charge Policy. This fee shall be as follows:
Developments having a net density of 3 or less lots/acres ~ Ulli.Lper developable sq. ft.

Sewer Charge Policy. The term "net acre" means the acreage equal to 85% of the gross acreage of the development.
E. City Projects and Miscellaneous Engineering Work
The actual hourly rates of the employees will be used plus a multiplier of 2.5 for benefits, overhead, etc.
A 1 % project administration fee will be charged to all projects.
Other Costs incurred will be added in using the actual costs (ie. Consultant fees, testing laboratories, etc.)
F. Grading Permits
Grading Permit Fee - Estimated Costs up to $200,000
For grading projects where the estimated grading cost is up to $200,000, the grading permit fee shall be a lump sum of

SUBJ: 2005 Sewer and Storm Utility Budgets and Rates

Proposed for inclusion in the 2005 Fee Schedule are rate
changes for the Sewer Fund and the Storm Fund. The city's
operational budget for the two funds is similar to 2004 with
increasing costs to maintain the storm drainage system. The
capital expenditures for the funds were reviewed with the
Capital Improvement Plan.
Sewer
It is recommended to maintain the flow charge for sewer.
The 2004 flow charge is $1.60 per thousand gallons and it is
recommended to maintain that rate. Forecasting is difficult
due to Rahr adding back to the system and the effects of
infiltration, inflow and growth. Recently Rahr has
increased water use and is again using the city system more.
Metropolitan Council is raising the treatment charge from
$1,340 per million gallons to $1,460 per million gallons for
an increase of 10.0%. The difference in their rate and our
rate is to provide funding for the collection system and
because the flow the city bills out is always smaller than
the flow that Metropolitan Council bills the city due to
inflow/infiltration and unknown/unauthorized use of the
sanitary sewer system.
It is proposed that the base fee of $6.00 per month would
increase to $6.50. The 2001 rate was $6.50. There are
increasing costs for depreciation and cash outlay for sewer
line replacement.
Storm
The increasing size of the system leads to increasing
depreciation and the need to have cash available for
replacement. A two percent increase in the rate is
recommended at this time.
Alternatives
1. Maintain rates the same as 2004.
2. Adopt different rates.
3. Adopt rates proposed above.
Recommendation
Recommend is Alternative 3.
Action requested
Move to accept the Sewer and Storm Funds budget and direct
staff to include in the 2005 Fee Schedule the rates of:
A rate of $6.50 for the Sewer base rate and a sewer
flow fee of $1.60 per 1,000 gallons of water use/flow.
For the Storm Fund set a rate of $25.05 per residential
equivalent factor per acre per quarter.

Met Council to use New Methodology for Setting 2005
Wastewater Rates
The Metropolitan Council's Environmental Services Division (MCES) has completed its annual
budget meetings with customer communities and is preparing a final recommendation to the
Council to move ahead with plans for a firm flow cost allocation system in 2005. This new system
will set cities' 2005 charges based on their measured wastewater flow from July 1, 2003 to June
30,2004 - an amount which will be known later this summer and allow the Council to avoid using
flow estimates when setting their budget.
As a result of this change, MCES did not present a proposed rate for municipalities at their annual
budget meetings, as they have in past years. Instead, MCES staff suggested that cities use an
estimated rate of $145 to $147 per 100,000 gallons for initial budget estimates, which is up from
(/ $134 per 100,000 gallons in 2004. However, cities preparing estimates should be aware that this
t1) )Q\ higher rate will be applied to a lower than normal wastewater flow. The time period that will be
0) 0 used to determine 2005 charges has been abnormally dry, resulting in less inflow and infiltration
\ into the system and therefore a reduction in the flow that MCES can bill cities for.
Cities trying to prepare early budgetary estimates can contact MCES finance manager Jason
Willett at (651) 602 - 1196 for help in estimating city-specific charges for 2005. The Council plans
on finalizing the flow data necessary for calculating the municipal wastewater rate by late August
or early September, at which time they will be able to notify each city of their total charges for
2005. Cities will then be billed an equal amount each quarter of the year.
MCES's proposed budget for 2005, which is entirely fee supported, totals $183 million, or a 7.7
percent increase over their 2004 budget. Although they are budgeting for 17 fewer full time
employees (FTEs), the Council is anticipating a I percent increase in wages and a 23 percent
increase in health care costs. Another major factor contributing to the budget growth is rising debt
service costs resulting from the need to expand the system to accommodate growth, while at the
same time rehabilitating older portions of the system.

INTRODUCTION:
This memo. is to highlight the major changes proposed for these two areas.
INSPECTIONS:
The fees are changed to reflect the 2003 League of Minnesota Cities fee schedule. I
attended some of the meetings that resulted in this proposal, and believe that it was, at
least in part, an attempt to answer concerns expressed in the past by builders in the Twin
Cities area. Council will note that there are slight increases in the fees. Staffwill be
instituting a new tracking system for time and costs related to building permits in order to
better monitor the relationship between these fees and the costs of accepting, reviewing,
and administering building permits.
PLANNING:
As the Council may know, planning fees have remained amazingly stable over the last
eight years. A result is that expenditures to administer land use applications far exceed
revenues. I am proposing two new fees to help address this situation. The first is a
concept plan review fee for preliminary plats. Concept review by the Planning
Commission is not mandatory, but has occurred in the past without any payment of
review fees. This fee addresses that situation.
The second places a fee on pre-application meetings after the first meeting. Staff time is
spent in numerous meetings, and this will help to compensate for the time expended.

INTRODUCTION
City ordinance requires Council to set the park dedication fees each year. Attached are
the proposed 2005 Park Dedication fees being recommended by the Parks and
Recreation Advisory Board. Council is asked to review and approve or modify and
approve the proposed fees.
BACKGROUND AND DISCUSSION
Park Dedication Fees
The city's park dedication fee is based on recent land transactions for undeveloped
property that is either in the urban service area, or urban services are imminent. The
average land value used to calculate the 2004 park dedication fee was $90,365.
Attachment A outlines several recent sales of undeveloped land that are, or under the
City's adopted comprehensive plan, may be served by municipal sanitary. sewer and
water service. Using residential sales and excluding those with commercial, the average
land value is $115,810.

The park dedication fee is calculated using a formula that was developed with the 1998
Comprehensive Park Plan (Attachment B). In order to demonstrate the relationship
between park dedication fees and costs for providing the city's park system, the analysis
calculated full development costs based on average land values for acquisition and
actual construction costs, and assigned those costs 85% to residential, and 15% to
commercial.
Since the park dedication fee calculation was based on average land values and costs to
develop the parks, the current formula is still applicable even though land values have
increased. Therefore, there would be an increase in the park dedication fee. However,
we will want to have the formula reviewed as part of the upcoming park comprehensive
plan update.
The Parks and Recreation.Advisory Board had considerable discussion about the
proposed fee increase. They came to consensus that the fee is objective and is based
values that developers are paying for land. Therefore, they recommended the proposed
fee 6-0.
I've included a comparison of 2004 Park Dedication fees for several growing
communities. In addition, I had a chance to speak with Todd Hoffman, Parks and
Recreation Director for the City of Chanhassen, and he indicated that their 2005 Park
Dedication fees would be $4,000 for single-family, and $10,000 for
com mercial/industrial.
Finally, City Council should be aware that we are processing a park dedication text
amendment that the Parks and Recreation Advisory Board recommended earlier this
year, which eliminates the inequity for the city when a developer proposes to provide a
combination of land and cash. This text amendment will provide the developer credit for
the land they are dedicating, and the remaining percentage of their cash contribution will
be based on the. Park Dedication fee. The text amendment will be coming to you in
January for your consideration.
REQUESTED ACTION
The recommended Park Dedication fees are included in the 2005 Fee Schedule, which
City Council is reviewing tonight.

Eden Prarie Proposed fees for 2005 are $3,400/unit for residential, $8,OOO/acre for commercial/industrial.
Developers are told that trails are part of the transportation system, and are responsible for trailsl sidealks unless they are within a park.
Minnetonka Fees may be reduced or waived if the subdivision contributes to the City's affordable housing goals or other public purpose.
Shakopee Credit can be applied, per Council determination, for private open space used for park or rec use.
Credit may also be given for combination of cash and land. Wetland and ponding areas are not considered part of the dedication.

Attached are the proposed fees for Parks and Recreation services being recommended
by the Parks and Recreation Advisory Board. Council is asked to review and approve or
modify and approve the proposed fees.

Fees and Charges
The following summarizes proposed changes in fees and charges that were reviewed
recommended by the Parks and Recreation Advisory Board. The amounts do not reflect
growth in participation and attendance, as well as new programs. The detailed rate
structure proposal follows.

Recreation Proaram Fees
Recreation program participants are charged fees to cover costs associated with the program. These fees
are designed to cover the direct cost of the program, including part-time salaries and supplies, plus a
portion of administrative overhead, proposed to be an additional 20% of the program fee.
These fees vary depending on the program, supplies costs, ect. The following are examples of
