Criteria
MEETING DATE: December 7, 2004
INTRODUCTION:
The City of Shakopee Parks and Recreation Department has submitted an application requesting
approval of a waiver of subdivision criteria for the Quarry Lake Reuse Project (Exhibit A).
The Parks and Recreation Dept. has submitted a request for waiver of the lot frontage criteria to
allow the creation of a lot without frontage on a public street. This property would be utilized
for future park purposes (see attached letter and plans from Mark Themig, dated December 1,
2004). This property presently consists of one parcel that is owned by Aggregate Industries, and
is located north ofHwy. 169 and south of 70th Street. Ifthe Waiver request and Minor
Subdivision request are approved, this property would be split into two (2) parcels, with the park
located on a 111.425 acre parcel and Aggregate Industries retaining a 14.573 acre parcel.
DISCUSSION:
The Parks and Recreation Dept. would prefer that they own the property on which their facilities
are located. For that reason, the Parks and Recreation Dept. seeks to create a lot for the above-
identified project. The subject property is zoned 1-2, Heavy Industrial Zone, which has a
requirement that lots shall have 100 feet of frontage on a public street. This property presently
does not comply with the lot frontage requirement, nor will the proposed lot split comply with
this requirement. As a result, the Parks and Recreation Dept. is requesting that the Council
waive the lot frontage requirement for the proposed lots. If approved, Parks and Recreation
would then proceed with the submittal of a minor subdivision application.
ALTERNATIVES:
1. Offer and approve a motion approving the Parks and Recreation Department's request for
waiver of subdivision criteria regarding the City's lot frontage requirement.
2. Offer and approve a motion denying the Parks and Recreation Department's request for
waiver of subdivision criteria regarding the City's lot frontage requirement.
3. Provide staff with other direction.
4. Table the matter and request additional information.
STAFF RECOMMENDATION:
Staff recommends Alternative No.1, approve a motion approving the Parks and Recreation
Department's request for waiver of subdivision criteria regarding the City's lot frontage
requirement for the proposed Quarry Lake Reuse Project.
REQUESTED ACTION:
Offer and approve a motion waiving the subdivision criteria related to lot frontage for property
north ofHwy. 169 and south of 70th Avenue, that would allow the creation of new lots for the
Quarry Lake Reuse Project by means of the minor subdivision process.

INTRODUCTION
I am writing to request a waiver of minor subdivision criteria for the Quarry lake Reuse
Project.
BACKGROUND AND DISCUSSION
As you are aware, the city is in negotiations to acquire a significant portion of the
property currently owned by Aggregate Industries for reuse as a park, recreation, and
natural resource amenity. The acquisition would result in the need to subdivide the
property into two parcels (see attachment). Parcel A (14.573 acres) would be retained
by Aggregate Industries, while Parcel B (111.425 acres) would be sold in fee title to the
city.
I am requesting waiver of the road frontage requirements for this parcel as the property
will not have public road frontage for the foreseeable future. Current access to the
property will be via an access easement that Aggregate Industries is granting to the city
as part of the purchase agreement. This access easement is not shown on the attached
survey, but would be located along the north side of Parcel A. At some point in the
future, we hope to acquire an additional public access from the northwest or west side of
the parcel.
If approved, this request would allow the city to proceed with an administrative minor
subdivision, and meet the deadline that Aggregate Industries has set for closing on the
sale, December 31, 2004.
