CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Receive the Feasibility Report for the East Shakopee Industrial Sewer Extension Project and call for a Public Hearing DATE: November 18, 2012 ACTION SOUGHT: Adopt Resolution No. 7264, a resolution receiving a report and calling for a public hearing on the East Shakopee Industrial Sewer Extension Project, Project No. 2013 -4. INTRODUCTION: Attached is Resolution No. 7264, a resolution receiving a report and calling for a hearing on the East Shakopee Industrial Sewer Extension Project, Project No. 2013 -4. BACKGROUND: On October 16, 2012, Council adopted Resolution No. 7242 which ordered the preparation of a Preliminary Engineering Report for the area known as "East Shakopee Industrial Area ". The purpose of the report is to evaluate the existing infrastructure (streets, utilities, drainage) and make recommendations for any improvements that are needed. The report also addresses the estimated costs for the improvements and the proposed assessments that result from the project being constructed. The attached resolution sets a date for the public hearing for this project for January 22, 2013. The approval of Resolution No. 7264 does not order the project, nor does it commit the Council to constructing any improvements. The intent of this resolution is to accept the report and set a public hearing date. The public hearing will allow the property owners adjacent to the project area and the general public the opportunity to address the City Council on this project. Staff will make a full presentation at the January 22, 2013 public hearing on the report to the public and the City Council. Staff will make a brief presentation on the issues with the project and in the report at the December 18, 2012 meeting. Issues with this project and included in the report are as follows: 1. Two Alternatives analyzed a. Low Pressure System b. Gravity System — Lift Station — Force Main c. Staff is recommending low pressure system due to lower assessments and less maintenance to the City. 2. Use of Metropolitan Council Environmental Services (MCES) Sewer Availability Charges (SAC) a. City approved a SAC Credit Policy and identified this area as one for city assistance b. Staff would recommend giving SAC credits and waiving the City's SAC fee in exchange for a waiver of assessment appeal c. The estimated SAC units for existing properties are twenty units. These are six undeveloped parcels with an estimated potential SAC determination of twelve units. 3. Trunk Sanitary Sewer Charge a. This area was identified to have a major truck line extended to south of TH 169. b. Further review of this line with the Southbridge Development indicated this line could not be extended to TH 169 but through Southbridge utilizing the Prior Lake Interceptor. Since no trunk line is needed to serve "East Shakopee Industrial Area ", staff would recommend trunk charge not be charged for this area. 4. Sewer & Water Service to Union Pacific Yard Building a. Union Pacific yard building is in need of sewer and they have indicated a desire for water. All other developed parcels have city water. ALTERNATIVES: 1. Adopt Resolution No. 7264. This action will receive the report and set the date for the public hearing for January 22, 2013. 2. Deny Resolution No. 7264. This action will halt the project until such time that City Council reconsiders the resolution. 3. Move to receive the report but do not set a date for the public hearing at this time. This action will place the project on hold until such time as the City Council sets a date for the public hearing. 4. Table Resolution No. 7264 to allow time for staff to prepare additional information and /or revise the report as directed by the City Council. BUDGET IMPACT: If the project is approved, it will be funded by special assessments. The City would contribute in providing SAC Credits, waiving City SAC fee and waiving Trunk Sanitary Sewer charges. RECOMMENDATION: Offer Resolution No. 7264. A Resolution Receiving a Report and Calling a Hearing for the East Shakopee Industrial Sewer Extension Project, Project No. 2013 -4 and move its adoption. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The Council will consider East Shakopee Industrial Sewer Extension Project and all appurtenant work in accordance with the report and the assessment of abutting and benefited property for all or a portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvement for the East Shakopee Industrial Sewer Extension of $605,404.80. 2. A public hearing shall be held on such proposed improvements on the 22nd day of January, 2013, at 7:00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street, Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and improvement as required by law. 3. The work of this project is hereby designated as part of the 2013 -4 Public Improvement Project. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption of this resolution. More detailed information is contained in the body of the report. On October 16, 2012, the City Council adopted Resolution No. 7242, which ordered the preparation of a preliminary engineering report to analyze the construction of sanitary sewer to serve properties abutting CSAH 101 and Stagecoach Road from 70 Street to TH 169. The report identifies two options for providing service to the properties in this area. The first option will be for a low pressure system and the second will be for a gravity system with a lift station. Owners of 10 of the 16 affected properties have expressed interest in obtaining information on the costs to provide sewer service to their parcels. The total estimated project cost for the proposed improvements described as the Low Pressure System is $605,404.80. The total estimated project cost for the Gravity System is $1,217,967.19. INTRODUCTION On October 16, 2012, the City Council adopted Resolution No. 7242, which ordered the preparation of a preliminary engineering report to analyze the construction of sanitary sewer to serve properties along CSAH 101 and Stagecoach Road from 70 Street to TH 169. This project is included in the City's 2012 Capital Improvement Program. 2. SCOPE This report will determine the feasibility and cost effectiveness of constructing/extending sanitary sewer from 70 Street to TH 169 in order to provide service to properties along CSAH 101 and Stagecoach Road. The report will provide a description of the proposed improvements, an itemized cost estimate, a cost apportionment and a preliminary assessment roll. 3. BACKGROUND In 2003, a feasibility report for the East Shakopee Industrial Sewer Extension was proposed but did not move forward due to cost and the number of properties not interested in the project. Since that time, the City's EDAC has identified this area for economic development if sanitary sewer was extended. Also, the City has adopted a Sewer Availability Charge (SAC) credit policy for commercial and industrial properties. Also, there is now more interest from some properties due to the conditions of their Individual Sewage Treatment Systems (ISTS) and the possibility of SAC credits being available. For these reasons, a number of land owners in the area have requested the city to once again investigate the feasibility of extending sanitary sewer service to the area. 4. EXISTING CONDITIONS The properties within the project area are identified on Drawing 1 in the appendix. Two of the properties currently have sewer and water service and will not be assessed for the proposed improvements. One property is land locked, does not have water service and is not proposed to receive a sewer service or an assessment. These lots do have water available to connect to and are proposed to be assessed for the proposed sewer improvements. The railroad property has a building on it and water available. There is no record that the building is hooked up to water. It is proposed to assess this property for the proposed sewer improvements. The remaining 9 properties all have buildings and are connected to municipal water. All of the property in the project area is vacant or has commercial or industrial use. 5. PROPOSED IMPROVEMENTS The two options are as follows: 5.1 Sanitary Sewer (Low Pressure System) The proposed low pressure system improvements are identified in Drawing Nos. 2 — 5 in the Appendix. A 12" gravity sanitary sewer line would be extended easterly from the existing 24" sanitary sewer located in 70 Street for a distance of approximately 1750'. The 6" low pressure sewer system would connect to the gravity system at this point and be extended easterly along Stagecoach Road to the south side of TH 169. 2" services from the low pressure main would be stubbed to the right of way line to serve the abutting properties. For non - serviced properties abutting the gravity line, 6" services would be stubbed to the right of way line. With this option the property owners abutting the low pressure line would be responsible for installing their own low pressure sewage pumps and connecting to the city provided service stubs. Sewage pumps can range in price from $5,000 to $40,000 depending upon how much water is used, if the owner wants a backup pump and if the existing tank can be used as a wet well or if a new tank will need to be installed. Properties abutting the gravity portion of the sanitary sewer would have the option to use a pump or gravity system depending upon the elevation of the current or future building. The total estimated project cost for the low pressure sanitary sewer improvements is $605,404.80. Preliminary Engineering Report East Industrial Sewer Improvements City of Shakopee, MN City Project No: 2013 -4 Page 2 5.2 Sanitary Sewer (Gravity System) The proposed gravity system improvements are identified in Drawing Nos. 6 — 9 in the Appendix. This option would require the construction of an 8' diameter sanitary lift station and three gravity lines in order to serve the tributary area. A 12" gravity sanitary sewer line would be extended easterly from the existing 24" sanitary sewer located in 70 Street for a distance of approximately 1750' and would provide the discharge point for the proposed 6" forcemain of approximately 3200 feet from the proposed lift station (this portion of proposed gravity sewer is the same as is proposed in the low pressure option). The proposed lift station would be constructed on the south side of Stagecoach Road as shown on Drawing 9. Two gravity sewer lines would be constructed to discharge into this lift station. A 12" gravity sanitary sewer line would be constructed to the west for a distance of approximately 2800' and a second line would be constructed to the south approximately 1700'. 6" services would be stubbed to the right of way line to provide service for the abutting non - serviced properties. The lift station would initially be constructed as a 200 gpm station, which based upon preliminary calculations, is adequate to serve the existing uses within the service area. If expansion and/or subdivision would occur in the future service area, the lift station could be upgraded to a pumping rate of 350 gpm which is projected to be sufficient for the ultimate flows for this area. With this option, properties abutting the sanitary sewer should be able to be served without the need for individual pumps. The total estimated project cost for the gravity sanitary sewer improvements is $1,217,967.19. 5.3 Watermain A water service has been requested by the Union Pacific Railroad and is proposed to be installed with either sanitary sewer option. The cost for the water service, including the street restoration, is estimated to be $20,592.00 and would be entirely assessed to the Union Pacific Railroad. Union Pacific will need to sign up for water service with Shakopee Public Utilities and pay any Lateral Watermain and Trunk Watermain charges as determined by SPU. SPECIAL ASSESSMENTS 6.1 Sanitary Sewer (Low Pressure System) The costs associated with the sanitary sewer improvements will be assessed to the benefiting properties on a per acre basis. The assessment rate is estimated to be $ 4,241.83 per acre. The costs associated with the casing pipe installed under the railroad tracks and the cost to extend a water service to the railroad property would be assessed directly to the Union Pacific Railroad. 6.2 Sanitary Sewer (Gravity System) The costs associated with the sanitary sewer improvements will be assessed to the benefiting properties on a per acre basis. The assessment rate is estimated to be $ 8,948.36 per acre. The costs associated with the casing pipe installed under the railroad tracks and the cost to extend a water service to the railroad property would be assessed directly to the Union Pacific Railroad. A preliminary assessment roll is included in the Appendix. Actual assessments will be based on the final project costs, final project area and apportionments. 7. ESTIMATED COSTS An itemized cost estimate is included in the Appendix. The following costs were prepared using construction costs from past projects and are subject to change, depending on timing of the project, final design, bids received, and actual work performed. It will be necessary to acquire permanent easement for the lift station and also temporary construction easements for the construction of the sewers and services. The costs for easements are not included in the project costs. A summary of the estimated construction costs plus a 5 - 10% contingency, engineering and administration costs for the project are as follows: Low Pressure System Gravity System Sanitary Sewer Improvements $ 605,404.80 $ 1,217,967.19 TOTAL PROJECT COST $ 605,404.80 $ 1,217,967.19 Project costs will increase if the required easements are not given to the city. FUNDING SOURCES A summary of the estimated funding apportionment for the recommended improvements is as follows: Low Pressure System Gravity System Assessments $ 605,404.80 $ 1,217,967.19 TOTAL PROJECT COST $ 605,404.80 $ 1,217,967.19 SAC CREDITS In order to lessen the financial impact to the property owners and as an incentive to connect to the city sewer system, this service area is included in the Sewer Availability Charge (SAC) Credit Policy as a potential for city assistance. Staff would recommend providing MCES SAC credits and waiving of City SAC fee to those parcels who sign a waiver of assessment appeal. For the ten properties with existing buildings, that twenty SAC units could be applied. For the six undeveloped parcels, a total of twelve SAC units could be applied. TRUCK SANITARY SEWER CHARGE The current trunk sanitary sewer charge policy does indicated this area to receive a trunk charge. It also had shown a 24" trunk line through this area. This 24" line has been eliminated with the trunk line through the Southbridge area. The proposed sewer extension is not a trunk and connects to a line going to the Blue Lake Treatment Plant. It is being recommended in the report to NOT charge trunk sewer in the area due to the elimination of the trunk sewer. 9. CONCLUSION From an engineering standpoint the proposed improvements are feasible, cost effective and necessary in order to provide municipal sewer service to the proposed service area. The low pressure system has much lower estimated assessments and will have a much lower long term maintenance cost to the city due to the fact that the city will not be maintaining a large lift station. SEWER AVAILABILITY CHARGE (SAC) CREDIT POLICY General Purpose and Objective for Creating this Policy. To help sustain the local economy and to maintain and strengthen the tax base, the City often considers ways to stimulate economic development. The City is committed to promoting quality development, redevelopment and reuse of properties. In certain situations, up front utility costs may prevent business start-ups, renovations or expansions. In any of these situations, they City may consider assessing, granting or borrowing the funds necessary for sewer and water availability charges. This will be determined on a case by case basis for each fee and/or a combination of all of these fees. At any time, the City may discontinue the option to provide any assistance for these fees. II. Background. A. Metropolitan Council Sewer Availability Charge When there is new construction or a change in use of a property that requires additional sanitary sewer capacity, a fee is charged by the Metropolitan Council - Environmental Services. The fee is based on a determination of the number of sewer availability charge (SAC) units. One SAC unit equals 274 gallons of daily wastewater flow (based on the Metropolitan Council's calculation of what a single family dwelling produces in one day). The fee for each Metropolitan Council SAC unit is as charged by the Metropolitan Council. If the property has a change in use, the SAC fee is reduced by any previous SAC payments. In September, 2008, the City received 1,494 SAC credits from Rahr Malting coming from the regional system. As a result, the City has a limited `bank' of Metropolitan Council SAC credits that can be applied city -wide. A credit is equivalent to the fee for one SAC unit. The total number of City credits is automatically reduced when new SAC units are required for new construction or additional SAC units are required for a change in use of a property. B. City Sewer Availability Charges In 1994, the City adopted access fees for the sanitary sewer system (SAC). Those fees are used for construction of other MCES interceptors and long -term maintenance of the City sanitary sewer system. For any construction project or change in use, the City SAC is the same as the number of units determined by the Metropolitan Council. However, city fees will be imposed only for the units resulting from an expansion or a change of use that requires additional charges. The total number of units for a project may be reduced in instances where the use was established prior to adoption of the City fees. III. Potential Situations for City Assistance The following list provides examples of potential projects that may benefit from City assistance: CR69 Sewer Extension of sewer to existing businesses East Shakopee Industrial Reuse or expansion of existing spaces that result in increased jobs SEWER AVAILABILITY CHARGE (SAC) CREDIT POLICY Page 2 III. Potential Situations for City Assistance Industrial Development Development of industrial properties, job creation Commercial Development Development of underutilized commercial properties, job creation In making a decision or considering a request under this assistance policy, the Council may wish to consider the number of available City -owned Metropolitan Council SAC Credits, the City's future need for credits, and the benefits to the economic base of the community. Request specific to construction of single family homes are not eligible under this program. IV. Basic Requirements In addition to the requirements of the application/approval process described below, the following basic tenets shall apply: Assessment or Loan Agreements: • Agreements may be developed to bear interest as determined • Period of agreements shall not exceed five (5) years or as approved by Council • The owner of record must execute an agreement and waiver wherein the amount of the assessment or loan (per agreement) shall be recorded and assessable to the property in the event of default according to the terms of the agreement Any applicant who has not been in good standing with the City, in regards to licenses, fees or other specific charges will not be considered for this program. V. Financing Upon application, the City may consider an interest bearing loan or assessment that allows financing of sewer access charges. The loan or assessment must be approved by City Council. In general, payments shall be placed in a pre - determined fund. Use of funds will be subject to Council approval. Nothing herein shall imply or suggest that the City is under any obligation to provide incentives to any applicant. VI. Criteria for Evaluating Requests The following may be utilized in evaluating request for use of SAC Credits: • Does the request provide for a redevelopment project? • Does the request provide the community with o Increased employment of job retainage? o Additional spin -off development? o Potential for increased property tax capacity? o Has the project met the requirements of the comprehensive plan, building code, zoning? o Are there any other identified sources of other public assistance? SEWER AVAILABILITY CHARGE (SAC) CREDIT POLICY Page 3 VII. Application/Approval Process The City may charge a fee for requests under this policy, and these fees will be adopted annually during the fee schedule review. The City reserves the right to determine and limit the amount of SAC credits that are applied for by any one applicant. This is to allow for the maximum utilization and benefit of the credits. The following information must be submitted for application for request of SAC Credits: • Business Name • Address • Legal Description • Name of Authorized Representative or Contact • Name of Property Owner (if different from Business Owner) • Description of Business • Description of Improvements and Any Anticipated "Change of Use" that the project will result in • Narrative Explaining the Request When the complete packet of information is received, staff will review the application and contact the applicant for any additional information needed to process the application.
