Michael Leek, Community Development Director SUBJECT: Text Amendment Regarding Temporary Signage MEETING DATE: December 21, 2004 INTRODUCTION: At its August 10,2004 workshop meeting, the City Council provided staff with direction regarding amendments to the city's sign regulations regarding temporary signage and real estate directional signage. Theattached draft ordinance incorporates those recommended changes, and was reviewed by the Planning Commission on September 9th and December 9' 2004. ALTERNATIVES: 1. Offer and pass a motion approving Ordinance No. 718 as presented. 2. Offer and pass a motion approving Ordinance No. 718 with revisions. 3. Provide other direction to staff. 4. Table the matter for additional information. PLANNING COMMISSION RECOMMENDATION: The Planning Commission recommended alternative 1, approval as presented. Michael Leek Community Development Director G:\CC\2004\12-21 \T A-signs _ ord718.doc 1 ORDINANCE NO. 718, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CHAPTER 11.70, SIGNS THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - That City Code Chapter 11.70, Signs, is hereby amended by adding the language, which is underlined, and deleting the language that is. struck through. SEC. 11.70 SIGNS.. Subd. 2. Prohibited Signs. K. illuminated signs, which exhibit any of the following; 1. external illuminations that blinks. flashes. rotates. or is determined to interfere with safe traffic operations; 3. Signs containing neon. Subd. 4. Shms not re2ulated. Signs which are located on the interior of a structure. signs specifically desi~ed to be viewed from within the lot or parcel of land on which they are located and not from a street. national flags, flags of political subdivisions, and holiday decorations are not regulated by this section. (Re-number accordingly) Subd. 4. Location of Si2n. B. (Re-letter accordingly) Subd. 5. Temporary Si2ns. A. Grand Openin~s. No more than two (2) temporary banners may be displayed for the grand opening or grand re-opening of a business. Banners displayed in connection with a grand opening of a business shall comply with the following: 1. Shall not exceed thirty-two (32) square feet in area: 2. Shall be displayed for no more than thirty (30) days: 3. Shall only be displayed upon the issuance ofa temporary sign permit. B. Special Events. In addition to banners for the grand opening of a business, u? to two (2) banners may be displayed in connection with special events in compliance with the following: 1. Grand opening/re-opening banners may be affixed to a building or displayed elsewhere on the property in compliance with all applicable lot or setback requirements. 4. Shall only be displayed upon the issuance of a temporary sign permit. C. Proiect Sie:ns. One (1) temporary unilluminated identification sign identifying the name ofthe project, architect, engineer, contractor and/or financing agency may be installed at a construction site in any zone for the period of construction only. Such sign(s) shall not exceed thirty-two (32) square feet in area and shall be removed within seven (7) days following the issuance of a certificate of occupancy. A temporary sign permit is not required. All proiect signs shall complete with all applicable lot and setback requirements. D. Real Estate Open House and Directional Sie:nae:e. Real estate open house and directional signage is allowed without the issuance of a temporary sign permit. and in compliance with the following; 1. Signs shall not exceed four (4) square feet in area per side; 2. Signs shall not exceed three (3) feet in height; 3. At intersections. one open house sign or proiect directional sign shall be permitted per approach to the intersection. and each sign at an intersection shall be located outside the thirty (30) foot sight triangle for the intersection. 4. All real estate open house and directional signs shall be located no less than five (5) feet from the edge of a street; 5. Signs may be displayed from six (6) p.m. Friday until eight (8) a.m. the following Monday morning. (Re-number accordingly.) Section 2 - - Effective Date. This ordinance becomes effective from and after its passage and publication. Adopted in session of the City Council of the City of Shakopee, Minnesota, held the day of , 2004.
